Abstract

Election violations in the form of casting more than one vote constitute a serious offense that undermines democratic integrity and the principle of one person, one vote, one value. This crime becomes more severe when it is intentionally committed by individuals who possess access and authority within the voting process. This study aims to analyze the factors causing election crimes involving multiple voting during the voting process and to examine their law enforcement based on Decision Number 99/Pid.Sus/2024/PN.Sdn. The research employs normative juridical and empirical approaches, with data collected through literature review and field research and analyzed qualitatively. The findings indicate that internal factors include the perpetrator’s intent, abuse of authority as a member of the Polling Station Working Committee (KPPS), low legal awareness and electoral ethics, and personal interests. External factors consist of weak supervision during voting, suboptimal polling station management, and a permissive culture toward election violations. Law enforcement against this crime was conducted through the Integrated Law Enforcement Center (Gakkumdu), involving the Election Supervisory Body, the Police, and the Prosecutor’s Office, resulting in a court verdict imposing a sentence of three months’ imprisonment and a fine of IDR 5,000,000 with one month subsidiary imprisonment. This decision provides legal certainty and reinforces the integrity of election administration.     Pelanggaran Pemilu berupa pemberian suara lebih dari satu kali merupakan perbuatan yang mencederai integritas demokrasi dan prinsip one person, one vote, one value. Tindak pidana ini menjadi semakin serius apabila dilakukan dengan sengaja oleh pihak yang memiliki akses dan kewenangan dalam proses pemungutan suara. Penelitian ini bertujuan untuk menganalisis faktor penyebab terjadinya tindak pidana Pemilu berupa pemberian suara lebih dari satu kali pada waktu pemungutan suara serta penegakan hukumnya berdasarkan Putusan Nomor 99/Pid.Sus/2024/PN.Sdn. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dan empiris, dengan pengumpulan data melalui studi pustaka dan studi lapangan, yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa faktor internal meliputi unsur kesengajaan pelaku, penyalahgunaan kewenangan sebagai anggota KPPS, rendahnya kesadaran hukum dan etika kepemiluan, serta adanya kepentingan pribadi. Faktor eksternal meliputi lemahnya pengawasan saat pemungutan suara, tata kelola TPS yang belum optimal, serta budaya permisif terhadap pelanggaran Pemilu. Penegakan hukum terhadap tindak pidana tersebut telah dilaksanakan melalui mekanisme Sentra Penegakan Hukum Terpadu (Gakkumdu) yang melibatkan Bawaslu, Kepolisian, dan Kejaksaan, dan berujung pada pemidanaan oleh pengadilan berupa pidana penjara 3 (tiga) bulan dan denda Rp5.000.000,00 subsidair 1 (satu) bulan kurungan, sehingga memberikan kepastian hukum dan memperkuat integritas penyelenggaraan Pemilu.

Abstract

The criminal act of using explosives without authorization in fishing activities constitutes a form of crime that not only violates criminal law but also causes serious damage to marine ecosystems. This study aims to analyze the criminal liability of perpetrators in cases involving the use of explosives for fishing, as reflected in Court Decision No. 1220/Pid.Sus/2024/PN Tjk. The research method employed is normative juridical with a case study approach, examining relevant legislation and analyzing the judge's considerations in the ruling. The findings indicate that the defendant was legally and convincingly proven to have violated Article 1(1) of Emergency Law No. 12 of 1951 and Article 84(1) of Law No. 45 of 2009 concerning Fisheries. The judge imposed imprisonment and fines as a form of criminal liability for the act committed. This study emphasizes the importance of strict law enforcement against the use of explosives in fishing to protect the sustainability of marine resources and maintain public order. The research combines a normative juridical approach with an empirical approach. Data were collected through literature review, observation, interviews, and documentation.

Abstract

Illegal mining is a criminal act in the mining sector that causes state losses and has an impact on environmental damage and social life of the community. In law enforcement, judges have an important role in making decisions by considering the legal aspects and socio-economic conditions of the perpetrators. This study aims to determine the factors causing the crime of illegal mining in Pesawaran Regency and the judge's considerations in deciding the case based on Decision Number: 237/Pid.Sus/2025/PN TJK. The research method used is normative and empirical juridical with data obtained through literature studies and interviews. The results of the study indicate that the factors causing illegal mining include economic factors, low legal awareness, complicated licensing processes, weak supervision, and high market demand for illegal mining products. The judge's considerations are based on trial facts, fulfillment of the elements of the crime, evidence, as well as the defendant's socio-economic conditions and the environmental impacts caused. Thus, the judge's considerations not only focus on legal certainty but also pay attention to aspects of justice and legal benefits.

Abstract

This article examines the constitutional position of mutual insurance as a manifestation of economic democracy within Indonesia's national insurance system. Following the Constitutional Court Decision Number 32/PUU-XVIII/2020, which declared Article 6 paragraph (1) of Law Number 40 of 2014 on Insurance conditionally unconstitutional, scholarly discussions have primarily focused on institutional and regulatory aspects of mutual insurance, while its constitutional significance as an embodiment of economic democracy and its implications for Indonesia's economic constitutionalism remain insufficiently explored. Employing normative legal research through statutory, conceptual, and historical approaches, this study uses Hans Kelsen's Pure Theory of Law to examine the normative consistency between constitutional principles and insurance legislation. In contrast, Gustav Radbruch's theory of legal certainty serves as the analytical framework for assessing the legal consequences of the existing regulatory vacuum. The analysis demonstrates that mutual insurance reflects the constitutional principles of collective ownership, participation, and kinship embodied in Article 33 paragraph (1) of the 1945 Constitution. Furthermore, the Constitutional Court Decision Number 32/PUU-XVIII/2020 establishes a constitutional obligation for the legislature to provide a statutory framework that recognizes the distinctive institutional character of mutual insurance, thereby transforming legal recognition from a regulatory policy into a constitutional mandate. Accordingly, this article contributes to the development of Indonesia's economic constitutionalism by reconceptualizing mutual insurance as a constitutionally protected economic institution whose sustainability depends upon legal certainty through comprehensive legislative reform.
