Abstract

ABSTRAKPengawasan partisipatif merupakan salah satu komponen penting untukmenjamin integritas dan transparansi proses pemilihan di Indonesia yangmemerlukan kolaborasi antara Bawaslu dan KPU. Penelitian ini bertujuan untukmenganalisis kolaborasi antara Bawaslu dengan KPU dalam mewujudkan perananpengawasan partisipatif dan tantangan yang dihadapi oleh kedua lembaga iniselama proses pemilu. Dengan metode yuridis normatif, penelitian ini menganalisisperaturan serta literatur hukum yang menunjukan bahwa kolaborasi antara Bawasludan KPU tidak secara tegas diatur di dalam Undang-Undang Nomor 7 Tahun 2017akan tetap tugas, kewenangan dan kewajiban dari kedua lembaga ini mencerminkanadanya kerjasama antara Bawaslu dan KPU yang secara implisit dalammeningkatkan pengawasan partisipatif. Namun, terdapat tantangan yang dihadapiberupa rendahnya kesadaran masyarakat, keterbatasan kapasitas sumber dayamanusia oleh Bawaslu dan KPU hingga kerumitan antar-lembaga yang menjadihambatan dalam pengawasan pemilu. Berdasarkan hasil penelitian ini menunjukanperlunya peningkatan terhadap regulasi yang tegas, pengaturan mekanismekoordinasi yang jelas, peningkatan kapasitas sumber daya manusia oleh Bawasludan KPU dan literasi politik kepada masyarakat guna mengoptimalkan pengawasandan meningkatkan partisipasi masyarakat. Dengan kolaborasi antara Bawaslu danKPU diharapkan dapat mewujudkan pemilu yang demokratis.Kata Kunci: Kolaborasi Bawaslu dan KPU, Pengawasan Partisipatif, Pemilu

Abstract

ABSTRAKAda beberapa kejadian yang dapat menimbulkan konflik selama prosesPemilihan Kepala Daerah (PILKADA). Perselisihan dapat dibagi menjadi dua jenis,yaitu yang melibatkan sesame peserta dan yang melibatkan peserta denganpenyelenggara. Berdasarkan data dari Bawaslu Provinsi Sumatera Utara, terdapatsengketa Di Bawaslu Kabupaten Labuhanbatu Utara akibat keputusan KPU yangdianggap merugikan langsung hak peserta pemilih. Maka terhadap peristiwatersebut penulis melakukan penelitian mengenai bagaimana peran Bawaslu dalamupaya penyelesaian sengketa serta bagaimana mekanisme penyelesaiannya. Studilapangan dengan pendekatan kualitatif merupakan metodologi penelitian yangdigunakan. Dalam penyelesaian konflik, baik upaya preventif maupun represifdigunakan. Sementara itu, dalam penerapan sistem penyelesaian sengketa, yangdigunakan adalah Peraturan Bawaslu Nomor 2 Tahun 2020 Tentang Tata CaraPenyelesaian Sengketa Pemilihan Gubernur dan Wakil Gubernur, Bupati dan WakilBupati, serta Wali Kota dan Wakil Wali Kota.Kata Kunci: Peran Bawaslu, Penyelesaian Sengketa, Pilkada

Abstract

The rapid development of information technology in recent decades has had a significant impact on various sectors, including the legal sector. One of the main impacts is the implementation of the e-Court system, which is a digitization of court procedures starting from case registration, fee payment, to trial that can be done online. This innovation is designed to overcome various challenges faced by the conventional justice system, such as convoluted bureaucracy, length of case resolution, and limited access for the general public. E-Court plays a role in improving the efficiency, transparency, and accessibility of legal processes. However, in addition to the various benefits it offers, the implementation of e-Court also brings new challenges, especially for advocates who need to adapt to the development of this technology. this study aims to analyze the impact of technology on legal practice, with a particular focus on the roles and challenges faced by advocates in the context of e-Court. Through a qualitative approach supported by literature studies and in-depth interviews with advocates, this article explores how technology is influencing the role of advocates in the modern legal process. The results show that although technology has accelerated case resolution, advocates are faced with a number of obstacles, such as limitations in digital literacy, difficulties in adopting new technologies, and concerns related to data security and client privacy. In addition, the limited infrastructure in some areas, especially in remote areas, is a challenge in the optimal implementation of e-Court. Furthermore, the study also revealed that e-Court can reduce direct interaction between advocates and courts, potentially affecting the quality of legal defense and representation. Therefore, strategic steps are needed so that advocates can quickly adapt to technological developments, including through training, skill improvement, and adequate infrastructure development. This article emphasizes the importance of clear and inclusive regulations in facing the challenges of digitalization in the legal sector, in order to create a more responsive, efficient, and fair judicial system in the digital era.

Abstract

This research aims to analyze the participation of North Sumatra students ahead of the 2024 Regional Head Election (Pilkada) in the context of the digital era. Students, as a young generation who are technologically literate, have an important role in shaping the future of regional politics. In the digital era, access to information and involvement in the political process is increasingly open through social media and digital technology. Student political participation is strongly influenced by several factors, such as accessibility of information, political education, social environment, and perceptions of candidates. Digital technology and social media provide space for students to access information, discuss and be actively involved in political campaigns, which in turn increases their political awareness. However, various challenges still exist, including low digital literacy, political apathy and information overload. This research concludes that social media and digital technology have a big role in shaping student political participation in the 2024 Pilkada, but their effectiveness is very dependent on digital literacy and adequate access to technology. Efforts to increase student participation in the digital era can be done through political education and interactive campaigns, which are expected to strengthen youth participation in the democratic process in North Sumatra.

Abstract

The political journey in Indonesia post-reform has often experienced fluctuations, with stagnation in political participation reflected in the decline in both the quality and quantity of voter participation, especially in general elections. Several regions still face high levels of abstention (golput), driven by dissatisfaction with the performance of political parties and figures, as well as the threat of negative practices such as vote-buying that influence voter decisions. To address these issues, efforts are needed to enhance public participation and enforce sanctions against money politics. The success of the elections also depends on the role of the media as a tool for monitoring and disseminating information that shapes public opinion, while educating the public about their rights and responsibilities as voters. This study aims to describe and analyze the role of the media in reporting on Bawaslu in accordance With Law No. 40 Of 1999 On The Press during the 2024 Simultaneous Elections, as well as the role of Bawaslu and the media in preventing the spread of hoaxes that undermine the integrity of the elections. Using a qualitative research method with a normative approach and Focus Group Discussions (FGD) with media and journalists, this study is expected to provide recommendations for improving the quality of news reporting and voter education to ensure democratic, fair, and transparent elections.

Abstract

This research examines the strengthening of the position of the Honorary Council of Election Organisers (DKPP) in the Indonesian constitutional system, focusing on the enforcement of the code of ethics after the 2024 elections. Through normative research methods and literature studies, the research found that DKPP has worked quite effectively so far and needs to be developed and maintained. DKPP has proven to be an independent institution with final and binding decisions, having an equal position with the KPU and Bawaslu in the system of checks and balances. The study reveals the urgency of transforming DKPP into an Election Court, which requires the 5th amendment of the 1945 Constitution to include DKPP in the judicial power according to article 24. Despite facing institutional, regulatory and operational challenges, the study concludes that strengthening DKPP requires a comprehensive approach and multi-stakeholder support to realise more effective and sustainable code of ethics enforcement in the Indonesian constitutional system.Keywords: DKPP, Election Code of Ethics,Constitutional System, Election Court, Election Organiser, 1945 Constitutional Amendmentio.

Abstract

Resolving customary land disputes through mediation is a relevant approach in the context of Indonesian people who have a diversity of customs and cultures. This article aims to analyze the mediation mechanism as an alternative to resolving customary land disputes within the framework of Indonesian positivist law. This study uses normative juridical methods and empirical approaches with literature and literature studies. The results of the analysis show that mediation as part of the alternative dispute resolution (ADR) system has been regulated in various laws and regulations in Indonesia, including Supreme Court Regulation No. 1 of 2016 concerning Mediation procedures in Court. In the context of customary land, mediation allows the integration of customary law values with positive law, resulting in a more accommodating and fair solution for the parties to the dispute. However, the implementation of mediation at the practical level often faces obstacles, such as differences in the interpretation of customary law and lack of understanding of mediation by the parties. Therefore, it is necessary to strengthen the capacity of mediators, clearer recognition of customary law and the national legal system, as well as harmonization between customary law and positive law to increase the effectiveness of resolving customary land disputes through mediation.

Abstract

This study analyzes juridically the appointment of Acting Regional Heads in regional head elections (Pilkada) held simultaneously in 2024 and its implications for the principles of democracy in Indonesia. In the context of simultaneous regional elections, the vacancy of the position of regional head caused by the term of office that ends before the implementation of the elections is filled by the Acting Regional Head based on the provisions of Article 201 paragraph (9), (10), and (11) of Law Number 10 of 2016 governing Regional Head Elections. Acting Heads are appointed from among officials with Middle high-leadership positions in the Governor, and Primary high-leadership in the Regent or Mayor. This research uses a normative juridical method with a doctrinal approach, namely analyzing relevant legislation, jurisprudence, and the views of legal experts. The analysis shows that the appointment of Acting Regional Head is a strategic policy needed to maintain the continuity of regional government. However, the appointment mechanism that is fully determined by the central government without community involvement has various implications for democratic principles, such as reduced public participation, reduced accountability of the process of filling positions, and the absence of direct accountability to the people. The implications of the results of the analysis and studies in this research can be input and consideration for policy makers to improve the legal framework governing the appointment of Acting heads, so as to strengthen democratic principles and maintain political and government stability at the provincial, district or city level.

Abstract

This study aims to analyze the legal implications for micro, small, and medium enterprises (MSMEs) that do not register their trademarks, as well as the legal steps that can be taken in the event of trademark infringement by another party. The method used is normative legal research, which focuses on a study of the legal norms governing trademark registration through the Directorate General of Intellectual Property (DJKI). This study was conducted by examining laws and regulations, court decisions, and academic literature to identify challenges and opportunities in the trademark registration process for MSMEs. The results showed that failure to register a trademark can lead to various legal, economic, and strategic risks, such as potential trademark infringement, loss of control over the market, and a weak legal position in dispute resolution. International legal frameworks, such as the Paris Convention and the TRIPS Agreement, emphasize that trademark registration is a key requirement for strong legal protection. In Indonesia, various protection mechanisms are available for MSMEs that experience trademark infringement, including civil lawsuits, criminal sanctions, and administrative complaints. Therefore, MSME actors are advised to immediately register their brands, obtain legal assistance, and encourage the simplification of law enforcement procedures to ensure the continuous protection of trademarks and increase competitiveness in the market.

Abstract

Regional Head Election (Pilkada) is a people's democratic party in electing regional heads and their deputies who come from proposals from certain political parties, combinations of political parties or independently and who have met the requirements. The general election process for regional heads is regulated in a new law, namely Law Number 10 of 2016 concerning the Election of Regional Heads, Bawaslu Regulation Number 8 of 2020 concerning Handling Violations in the Election of Governors and Deputy Governors, Regent and Deputy Regent, and Mayor and Deputy Mayor. and Joint Regulation No. 5 of 2020 concerning Integrated Law Enforcement Centers in the Election of Governors and Deputy Governors, Regent and Deputy Regent, and Mayor and Deputy Mayor. Regency/City Bawaslu has the authority to receive and follow up on reports relating to alleged violations of the implementation of laws and regulations governing elections, whether violations of the code of ethics, administration or criminal acts. The research results show that 1) handling violations of the code of ethics carried out by the election organizer, namely the KPU. 2) handling election administration violations related to accepting registration for individual candidates in the 2024 Pilkada. 3) handling election criminal violations based on reports related to criminal acts of forging signatures as a requirement for candidate administration and determining candidate pairs in the 2024 Regent and Deputy Regent elections.
