Abstract

Civil law governs the rights and obligations of citizens, encompassing both material and procedural regulations. To improve access to justice, the Supreme Court introduced an online trial system (e-court) in 2018, which was implemented nationwide in 2020. Online trials provide several advantages, including ease of access, cost and time efficiency, and enhanced data security. Despite these benefits, several challenges persist. In Indonesia's eastern regions, internet connectivity remains a significant barrier. Additionally, the implementation of online trials can be less than ideal, with frequent audio disruptions hindering the extraction of case facts. Other obstacles include limited technological proficiency among users, inadequate coordination between involved parties, and challenges ensuring the safety and honesty of witnesses and defendants. Public education is also necessary to maximize the potential of the e-court system. Awareness campaigns can help citizens understand how to utilize this technology effectively, such as registering cases online through the court's official website.

Abstract

This study examines the empowerment of village governments in realizing village autonomy as regulated in Law Number 6 of 2014 concerning Villages, with a case study focus on the Natumingka Village Government, Borbor District, Toba Regency. The law affirms villages as government entities that have the authority to regulate and manage community interests based on ancestral rights and local autonomy, which aims to strengthen democratic, participatory, and independent village governance. This study also examines changes and improvements to regulations that occurred with the enactment of Law Number 3 of 2024 Jo, which emphasizes the strategic role of villages in national development and optimizes the authority and support for the empowerment of village government officials and their communities.

Abstract

The transfer of land rights is an important aspect of the sale and purchase transaction to ensure legal certainty for the buyer. However, there are often delays due to the seller's negligence that causes losses. This study aims to analyze the seller's legal responsibility to the buyer in the case of delay in the transfer of rights based on Government Regulation No. 24 of 1997, as well as to examine the judge's considerations in Decision Number 711/Pdt.G/2023/PN Jkt.Utr. The research method used is normative juridical with a case study approach. The results show that sellers remain legally liable for delays despite administrative constraints, and courts provide legal protection to good-faith buyers. This decision affirms the principles of legal certainty, justice, and protection for the aggrieved party.

Abstract

Pengawasan partisipatif merupakan salah satu komponen penting untuk menjamin integritas dan transparansi proses pemilihan di Indonesia yang memerlukan kolaborasi antara Bawaslu dan KPU. Penelitian ini bertujuan untuk menganalisis kolaborasi antara Bawaslu dengan KPU dalam mewujudkan peranan pengawasan partisipatif dan tantangan yang dihadapi oleh kedua lembaga ini selama proses pemilu. Dengan metode yuridis normatif, penelitian ini menganalisis peraturan serta literatur hukum yang menunjukan bahwa kolaborasi antara Bawaslu dan KPU tidak secara tegas diatur di dalam Undang-Undang Nomor 7 Tahun 2017 akan tetap tugas, kewenangan dan kewajiban dari kedua lembaga ini mencerminkan adanya kerjasama antara Bawaslu dan KPU yang secara implisit dalam meningkatkan pengawasan partisipatif. Namun, terdapat tantangan yang dihadapi berupa rendahnya kesadaran masyarakat, keterbatasan kapasitas sumber daya manusia oleh Bawaslu dan KPU hingga kerumitan antar-lembaga yang menjadi hambatan dalam pengawasan pemilu. Berdasarkan hasil penelitian ini menunjukan perlunya peningkatan terhadap regulasi yang tegas, pengaturan mekanisme koordinasi yang jelas, peningkatan kapasitas sumber daya manusia oleh Bawaslu dan KPU dan literasi politik kepada masyarakat guna mengoptimalkan pengawasan dan meningkatkan partisipasi masyarakat. Dengan kolaborasi antara Bawaslu dan KPU diharapkan dapat mewujudkan pemilu yang demokratis. Kata Kunci: Kolaborasi Bawaslu dan KPU, Pengawasan Partisipatif, Pemilu

Abstract

Ada beberapa kejadian yang dapat menimbulkan konflik selama proses Pemilihan Kepala Daerah (PILKADA). Perselisihan dapat dibagi menjadi dua jenis, yaitu yang melibatkan sesame peserta dan yang melibatkan peserta dengan penyelenggara. Berdasarkan data dari Bawaslu Provinsi Sumatera Utara, terdapat sengketa Di Bawaslu Kabupaten Labuhanbatu Utara akibat keputusan KPU yang dianggap merugikan langsung hak peserta pemilih. Maka terhadap peristiwa tersebut penulis melakukan penelitian mengenai bagaimana peran Bawaslu dalam upaya penyelesaian sengketa serta bagaimana mekanisme penyelesaiannya. Studi lapangan dengan pendekatan kualitatif merupakan metodologi penelitian yang digunakan. Dalam penyelesaian konflik, baik upaya preventif maupun represif digunakan. Sementara itu, dalam penerapan sistem penyelesaian sengketa, yang digunakan adalah Peraturan Bawaslu Nomor 2 Tahun 2020 Tentang Tata Cara Penyelesaian Sengketa Pemilihan Gubernur dan Wakil Gubernur, Bupati dan Wakil Bupati, serta Wali Kota dan Wakil Wali Kota. Abstract

Law No.8 Standard clauses, as part of standard contracts often used in business transactions, have significant implications for both parties, namely businesses and consumers.This study aims to analyze how standard clauses in the law affect consumer protection and business liability.Through a qualitative analysis method, it is found that standard clauses often benefit businesses but can harm consumers if not properly regulated.Therefore, effective law enforcement and consumer education are needed to address this imbalance and ensure fairness in transactions.

Abstract

This study discusses the efforts of the Public Prosecutor to provide evidence in a case of theft with violence committed by a minor at the Medan District Attorney's Office based on Decision Number 49/Pid.Sus-Anak/2025/PN.Mdn. The method used is normative juridical with a library approach through primary and secondary legal materials analyzed qualitatively. The results of the study indicate that the main causes of this crime include economic factors, low education, unemployment, victim negligence, bad company, and a consumptive lifestyle. The Public Prosecutor faced obstacles in the form of difficulty in presenting witnesses, low public legal awareness, and the child's uncooperative attitude. In providing evidence, statements from witnesses, the defendant, and valid evidence were submitted in accordance with Article 184 of the Criminal Procedure Code. The judge assessed that all elements of Article 365 paragraph (2) of the Criminal Code in conjunction with Law No. 11 of 2012 had been fulfilled, so the defendant was found guilty and sentenced to 1 year and 6 months. This research emphasizes the importance of the quality of evidence in order to achieve legal certainty, justice, and benefits, especially in cases of children who commit crimes.

Abstract

Abstrak Tulisan ini menganalisis kewenangan pengadilan dan status hukum perkawinan pasangan Islam yang berpindah agama setelah menikah dalam perspektif hukum Islam dan hukum positif Indonesia. Permasalahan muncul karena Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan sebagaimana telah diubah dengan Undang-Undang Nomor 16 Tahun 2019 tidak secara eksplisit mengatur akibat hukum dari perpindahan agama, sehingga menimbulkan vacuum legis dan perbedaan tafsir di kalangan hakim. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual melalui studi kepustakaan, dengan menelaah ketentuan dalam Undang-Undang Nomor 1 Tahun 1974 jo. Undang-Undang Nomor 16 Tahun 2019 Tentang Perkawinan, Undang-Undang Nomor 3 Tahun 2006 Tentang Peradilan Agama, Instruksi Presiden Nomor 1 Tahun 1991 Tentang Kompilasi Hukum Islam (KHI), yurisprudensi Mahkamah Agung, serta literatur fikih klasik. Hasil penelitian menunjukkan bahwa kewenangan absolut tetap berada pada Pengadilan Agama apabila akad nikah dilangsungkan menurut hukum Islam, meskipun salah satu pihak berpindah agama. Status perkawinan tidak batal secara otomatis karena murtad, melainkan tetap sah hingga ada putusan pengadilan. Pandangan fikih klasik yang menempatkan murtad sebagai pembatal akad berbeda dengan hukum positif Indonesia yang menekankan prosedur formal demi kepastian hukum. Penelitian ini menyimpulkan perlunya penguatan regulasi melalui amandemen Undang-Undang Nomor 1 Tahun 1974 atau peningkatan kedudukan Kompilasi Hukum Islam (KHI) agar tidak hanya bergantung pada yurisprudensi. Kata Kunci: Perceraian, Perpindahan Agama, Hukum Islam, Pengadilan Agama, Yurisprudensi   Abstract This article examines the jurisdiction of the court and the legal status of marriages involving Muslim couples who convert to another religion after marriage, analyzed from the perspective of Islamic law and Indonesian positive law. The problem arises because Law Number 1 of 1974 concerning Marriage as amended by Law Number 16 of 2019 does not explicitly regulate the legal consequences of religious conversion, thereby creating a vacuum legis and divergent interpretations among judges. This study employs a normative juridical method with a statutory and conceptual approach through literature review. The sources analyzed include Law Number 1 of 1974 jo. Law Number 16 of 2019 concerning Marriage, Law Number 3 of 2006 concerning the Religious Courts, Presidential Instruction Number 1 of 1991 concerning the Compilation of Islamic Law (KHI), Supreme Court decisions, and classical Islamic jurisprudence. The findings indicate that absolute jurisdiction remains with the Religious Courts as long as the marriage was conducted under Islamic law, even if one spouse later converts. The marriage does not automatically dissolve due to apostasy but remains valid until a court decision is issued. The contrast between classical fiqh and Indonesian positive law highlights the need to strengthen regulations to ensure legal certainty, justice, and the protection of religious freedom. Abstract

In the Indonesian criminal justice system, there are several stages in the mechanism for handling a criminal case. The first stage is the examination, also known as the investigation and inquiry conducted by the police, which is then transferred to the prosecutor's office for further investigation and finally to the process of transfer to the court and finally to trial. The purpose of this study is to determine the procedure for transferring criminal cases from investigators to public prosecutors in stage II according to the Criminal Procedure Code and the procedure for handing over and investigating suspects by investigators to prosecutors in a brief examination procedure. The method used is a qualitative method. The results of this study are about how the case examination procedure according to the Criminal Procedure Code and how the procedure for transferring cases in a brief examination procedure. First, the Case Examination Procedure according to the Criminal Procedure Code in Chapter XVI differentiates the case examination procedure in district court trials. Basically, the starting point for this difference in examination procedures is reviewed from the type of crime being tried on one side and from the ease or difficulty of proving the case in question on the other side, the Procedure for Transferring Cases in a Brief Examination Procedure. Regarding the brief examination procedure, in the Criminal Procedure Code (Law No. 8 of 1981), it is regulated in Articles 203 and 204. From the results of the study, it can be concluded that the procedure for brief case examination is generally guided by the ordinary examination procedure. The Criminal Procedure Code does not provide limitations on which cases are included in the ordinary examination. In the examination of cases in the brief examination procedure, the public prosecutor does not make an indictment but the public prosecutor immediately after the defendant in court answers the questions then informs the defendant verbally from his notes about the crime charged to him by explaining the time, place and circumstances when the crime was committed.

Abstract

Community Organizations are community associations that form organizations with an orderly nature and structure, usually starting from the highest/central level to the lowest level/leadership at the regional level or even community associations. Considering that social organizations provide freedom of association, assembly and expression of opinion as a form of guarantee of human rights. Therefore, the reasons used are based on statutory regulations as explained in Article 60 paragraph (1) and paragraph (2) Government Regulations in Lieu of Law of the Republic of Indonesia Number 2 of 2017 concerning Amendments to Law Number 17 of 2013 concerning Organizations Even though Community Organizations can be dissolved, the dissolution procedure must be carried out democratically. The government must not monopolize the authority to disband a mass organization by negating the role of other state institutions, so that the government will tend to behave authoritarian. The consequence of an authoritarian government is that the laws that are born will be repressive in nature, prioritizing the interests of the rulers over the people. This research is included in Normative Juridical research, namely research that examines legal norms that originate from legal rules, namely laws. The conclusion obtained in this research is that the system for dissolving mass organizations in Indonesia still does not have clear indicators and mechanisms that are in accordance with the existence of the rule of law. The dissolution of mass organizations is based on the mass organization not carrying out its obligations and prohibitions. So the reasons for disbanding mass organizations can be classified into threats to democracy, national ideology, constitution, state sovereignty and national security. The mechanism for dissolving social organizations is divided into two categories based on their registration, where the dissolution of social organizations that are not legal entities is carried out by the government, namely the Minister of Home Affairs. Meanwhile, for social organizations with legal entities, their dissolution is handed over to the Minister of Law and Human Rights.
