Abstract

Regional Head elections in Indonesia are a real manifestation of direct democracy, where the people have a right to choose their regional leaders. The regional heads election is meant to be a very important thing in the discussion in society, where the regional heads election in Indonesia which is held every 5 (five) years is a momentum in determining who becomes the leader of the region. Often there are problems in regional head elections such as SARA issues, money politics to the issue of campaigns carried out outside the predetermined schedule. This makes the state through the law form an institution in terms of supervising regional head elections and elections. To overcome this, the existence of the general election Supervisory Agency (Bawaslu) as an independent supervisory institution is very crucial. In supervising the implementation of elections, ensuring that the democratic process rus fairly, honestly, and transparently. This journal will discuss the role of Bawaslu as a law enforcer in maintaining regional election democracy in Indonesia, focusing on the authority, challenges, and efforts made to increase the effectiveness of supervision.

Abstract

Pemilihan Umum (Pemilu) merupakan mekanisme fundamental dalam sistem demokrasi yang memberikan kesempatan kepada rakyat untuk memilih perwakilan mereka dalam pemerintahan. Tindak pidana pemilu merupakan pelanggaran hukum yang terjadi selama pelaksanaan pemilihan umum, yang dapat mencakup berbagai perbuatan melawan hukum yang mengancam integritas dan keadilan pemilu. Mekanisme penanganan laporan tindak pidana pemilihan pada tahapan pencalonan merupakan prosedur yang dirancang untuk memastikan integritas dan keadilan dalam proses Pemilihan Umum. Mekanisme ini bertujuan untuk memastikan bahwa setiap dugaan tindak pidana pemilu pada tahapan pencalonan ditangani secara profesional, transparan, dan sesuai dengan ketentuan hukum yang berlaku, guna menjaga integritas proses pemilu. Penelitian ini bersifat yuridis normatif yang menganalisis asas hukum. Sumber data yang digunakan adalah data sekunder melalui penelusuran pustaka, dengan merujuk pada beberapa bahan hukum seperti Kitab Undang-Undang Hukum Pidana, UU Nomor 7 Tahun 2017 Tentang Pemilihan Umum, dan PKPU terkait Pemilu.

Abstract

Pengawas pemilu adalah lembagayang bertanggung jawab untuk mengawasi, mempelajari, memeriksa, dan menilai proses penyelenggaraan pemilihan umum sesuai dengan peraturan undang-undang. Untuk menjamin pemilihan umum yang adil, demokratis, umum, transparan, jujur, dan adil sesuai dengan peraturan perundang-undangan yang berlaku. Bawaslu pada masing-masing tingkatan sudah mempunyai tanggung jawab penting. Tugas Bawaslu adalah mencegah pelanggaran selama pemilihan umum. Dalam hal politik uang selama penyelenggaraan pemilihan kepala daerah serentak, divisi pencegahan dan partisipasi masyarakat dibawa oleh Bawaslu. Namun, fakta yang berkembang di masyarakat adalah bahwa politik uang terus terjadi selama pemilihan kepala daerah . Penelitian ini bertujuan untuk mengindentifikasikan efektivitas fungsi badan pengawas pemilihan umum dalam proses pemilihan di Provinsi Sumatera Utara serta untuk menentukan peran mereka dalam pencegahan dan penindakan politik uang uang yang berkaitan dengan pemilihan di Provinsi Sumatera Utara. Penelitian ini adalah penelitian hukum empiris yang bertujuan untuk menggambarkan atau mempelajari masalah hukum yang dihasilkan dari wawancara dan analisis literatur dari bahan hukum primer, sekunder, dan tersier. Hasilnya menunjukkan bahwa fungsi Bawaslu dalam pemilu dilaksanakan sesuai dengan Undang-undang Nomor 15/2011 Tentang Penyelenggaraan Pemilihan Umum, Bawaslu juga harus meningkatkan kinerjanya sebagai lembaga pengawasan pemilu dengan meningkatkan sumber daya manusia, faktor anggaran, dan faktor rekrutmen. Selain itu, mereka juga harus meningkatkan kinerjanya sebagai lembaga pengawasan pemilihan umum.

Abstract

Corporate Social Responsibility (CSR) in Indonesia began to develop in the 2000s, along with increasing global awareness of social and environmental issues. The culmination of this development occurred in Indonesia in 2007 with the passing of Law Number 40 on Limited Liability Companies, which requires companies, especially in the natural resource sector, to carry out social and environmental responsibilities. Since then, various regulations and policies have been issued to strengthen CSR obligations, including Law Number 25 of 2007 on Capital Investment and Law Number 32 of 2009 on Environmental Protection and Management. Nonetheless, the implementation of CSR in Indonesia still faces challenges, including violations committed by several companies in Indonesia. This research aims to explore the legal responsibilities of companies in implementing CSR in Indonesia as well as sanctions that can be imposed if companies do not fulfill their obligations. The research method used is normative with qualitative analysis that refers to various laws and regulations and related literature. This research emphasizes the importance of the company's role in sustainable economic development and is oriented towards the welfare of society.

Abstract

Public information disclosure has become a pressing legal issue due to its significance in ensuring transparency and its role as a pillar of a healthy democracy. It serves as a crucial tool for guaranteeing the public’s right to know what the government is doing, has done, and plans to do. Law No. 14/2008 on Public Information Disclosure aligns with fundamental principles in Indonesian Constitutional Law, including the right to communicate and access information as stated in Article 28F of the 1945 Constitution. This research aims to address two key questions: 1) What is the role of Law No. 14/2008 within the Indonesian constitutional system? and 2) How is the law implemented in resolving public information disputes, particularly in ensuring the equal distribution of Information Commission institutions across districts and cities in North Sumatra? The research uses a normative juridical approach and a qualitative method, focusing on a deep understanding of the issue rather than generalization. Ultimately, the study seeks to propose the establishment of District/City Information Commissions throughout North Sumatra, which would assist local communities in resolving public information disputes more efficiently, reducing the need to travel to the North Sumatra Information Commission in Medan and thereby saving time and costs for all parties involved.

Abstract

This research uses normative legal research methods to analyze the installation of campaign props in prohibited areas and law enforcement. Installing campaign props (APK) is a form of strategy used by candidates and political parties in conveying their vision, mission and work programs to the public during the campaign period. APKs include banners, billboards, posters and various other media placed in public spaces. However, installing APKs often causes various problems, especially when carried out in prohibited areas, such as places of worship, public facilities and government facilities. Regulations governing the installation of APKs are contained in various laws and regulations, such as the Election Law and KPU Regulations. Violations of this rule can disrupt the aesthetics of the city, damage public order, and have the potential to cause conflict between supporters. Law enforcement against violations of installing APKs in prohibited areas is a challenge for election supervisors and related agencies. There are several factors that influence the effectiveness of law enforcement, including the lack of awareness of election participants regarding regulations, limited supervisory resources, and weak coordination between institutions. Law enforcement efforts include preventive measures through socialization of regulations and repressive measures in the form of issuing or removing APKs that violate the rules.

Abstract

Indonesia is a country that adheres to a democratic system, which means that the supreme power is in the hands of the people and the people have the right to determine who becomes their leader or representative, through an election, hereinafter referred to as (Election). As stated in Article 1 paragraph (2) of the Constitution of the Republic of Indonesia that "Sovereignty is in the hands of the People and is exercised according to the Constitution". Thus elections are an important instrument in a democracy that adheres to a representative system. In this research the author uses a type of normative juridical research that is qualitative in nature, namely research that aims to examine legal principles, legal systematics, and legal synchronization. In this study the authors focus on discussing the juridical review of the role of Bawaslu Medan city in preventing and supervising the practice of money politics in the 2024 elections in Medan City. To examine this research, the authors make a formulation of the problem, namely, how is the regulation of Bawaslu's role in preventing and supervising the practice of political money in the 2024 elections in Medan city, how is the role of Bawaslu in preventing and supervising the practice of political money in the 2024 elections in Medan city, and what are the obstacles Bawaslu in preventing and supervising the practice of political money in the 2024 elections in Medan city. In organizing elections, it is carried out by the Election Organizing Commission (KPU), and supervised by the Election Supervisory Body (Bawaslu) which is adhoc. The institution carries out its duties, powers and obligations according to Law No. 7 of 2017 concerning General Elections and based on the 1945 Constitution of the Republic of Indonesia. Every election implementation often occurs various violations, criminal acts, and also election disputes, one of which is money politics. Money politics or known as money politics is an election crime regulated in article 280 paragraph (1) of Law No. 7 of 2017 concerning elections. The efforts of Bawaslu Medan City in preventing and supervising the practice of money politics in the 2024 elections in Medan city, conducting socialization to the community, students, and also election participants, and supervising reports of alleged money politics that occurred in the Medan city area. However, Bawaslu Medan City also experienced several obstacles in carrying out its role caused by economic factors, factors of habit, tradition, and opportunity, as well as factors of lack of public understanding of politics.

Abstract

This study aims to analyze the legal position of the Special Envoy of the President in the field of fostering young people and art workers based on the perspective of Indonesian constitutional law. The existence of the position of Special Envoy of the President in the Indonesian constitutional structure, especially in the context of empowering the younger generation and strengthening the creative industry, raises juridical questions regarding its legal basis, authority, and accountability. Using a normative juridical legal research method with a statutory approach, this research examines Presidential Decree Number 76/M of 2024 which regulates the appointment of special envoys of the President in the 2024-2029 period, as well as the relevance of these regulations within the framework of Indonesian constitutional law. The results show that although the special envoy of the President has a strategic role in supporting the development of young talents and the creative industry sector, the position lacks a clear and specific legal basis, which can lead to problems in terms of accountability and transparency. Therefore, this study recommends the need for the drafting of firmer regulations regarding the position, duties, and authority of special envoys, as well as strengthening supervision and coordination mechanisms with relevant ministries or institutions. This is expected to increase the effectiveness and contribution of special envoys to the progress of the Indonesian nation, especially in the development of the creative economy.

Abstract

This research examines the legal consequences of unilaterally closing public road access based on case study Number 92/Pdt.G/2021/PN. Sim. This closure gave rise to legal and social disputes in society. With a normative juridical approach, this research analyzes legal bases such as the UUPA, Civil Code, and Road Law. The research results show that the act of closing road access without a valid legal basis violates the principle of the social function of land rights (Article 6 UUPA) and can be categorized as an unlawful act (Article 1365 of the Civil Code). The main obstacles in resolving disputes are the defendant's non-compliance with legal decisions and weak enforcement of regulations. Therefore, it is necessary to strengthen regulations regarding road access, increase the government's role in mediating land disputes, as well as legal education for the community to prevent similar conflicts in the future.

Abstract

The election supervisory agency (Bawaslu) has a crucial role in maintaining the integrity of elections in Indonesia, especially in preventing the practice of money politicts that can damage the democratic process. Money politics is a form of violation that often occurs in elections, wich can affect voters choices and create injustice. In order to prevents this practice, Bawaslu implements various prevention straregies, including socialization to the community, supervision of prospective election participants, and law enforcement against specified violation. This study aims to evaluate the effectiveness of Bawaslu efforts in preventing money politics and identifying the challenges faced. The result of the study show that although Bawaslu has carried out various initiatives, such as educational campaigns and increased public participation in supervision, challenges such as lack of public awarenes and limited recources are still significant obtacles. Therefore, it is necessary to strengthen the capacity of Bawaslu and collaborate with other institutions to create a cleaner and more transparent electon environment. Thus, effort to prevent money politics by Bawaslu are expected to produce a more democratic and fair one for all Indonesian people.
