Abstract

This study analyses the practice of online lending within Muslim households from the perspective of muamalah fiqh, the liability of husbands and wives for debt under Islamic family law, and its implications for family resilience within the maqashid al-sharia. The proliferation of online lending, with outstanding balances approaching Rp95 trillion by the end of 2025, has triggered domestic conflicts and even divorce. This normative-empirical qualitative study combines an analysis of fiqh texts, DSN-MUI fatwas, the Compilation of Islamic Law, and interviews with couples using online loans, scholars, religious counsellors, and academics in the city of Padangsidimpuan. The research findings reveal three key points. Firstly, conventional online lending is not Sharia-compliant as it involves riba through interest and cumulative penalties, gharar due to unclear information, and problematic multiple contracts that contravene DSN-MUI Fatwa No. 117/2018. Secondly, debt liability is personal if the spouse is not involved (Article 93(1) of the Islamic Family Law), becomes a joint liability if for the family’s benefit (Article 93(2) of the Islamic Family Law), and cannot be imposed on a spouse who is unaware of the unilateral debt. Thirdly, online lending threatens family resilience in multiple dimensions: eroding assets, endangering lives through psychological pressure, impairing mental well-being, damaging the family through divorce, and eroding religious values. The vulnerability of women, who account for 62.14% of online lending victims, underscores the urgency of protecting vulnerable groups. This study recommends strengthening Islamic financial literacy, regulating spousal consent, and developing Sharia-compliant fintech based on qardh al-hasan.

Abstract

Isu intoleransi dalam berbangsa dan bernegara menjadi kajian serius dewasa ini. Pola fikir sebagian masyarakat telah terpapar faham radikalisme yang mereka peroleh dari oknum dan media tertentu. Oleh karena itu, pemerintah di setiap jenjang mencoba melakukan berbagai upaya dalam mensosialisasikan   faham moderat dalam berbangsa, bernegara dan juga dalam beragama. Tentu dengan upaya ini dapat memberikan pengaruh positif dan membuat pemahaman masyarakat tercerahkan terkait kehidupan berbangsa, bernegara dan beragama dalam bingkai kemajemukan. Pengabdian ini dilakukan untuk memberikan penguatan moderasi beragama bagi santri Pondok Pesantren Darussalam Parmeraan. Metode yang digunakan dalam pengabdian ini adalah dengan melakukan pre-tes terlebih dahulu, dilanjutkan kegiatan presentasi, diskusi dan mengkomparasikan pemahaman sejumlah tokoh dalam memahami teks agama dan pengamalannya yang disesuaikan dengan realita dan fakta sosial. Selanjutnya dilakukan tanya jawab dan ditutup dengan kegiatan post-test serta menyimpulkan. Adapun hasil pengabdian menunjukkan bahwa santri Pondok Pesantren Darussalam Parmeraan dapat memilah pemahaman para tokoh dalam memahami teks agama. Selain itu santri juga telah mampu mencontohkan faham moderat dalam berbangsa, bernegara dan beragama. Sebagai kesimpulan bahwa kegiatan pelatihan secara umum telah dapat memberikan penguatan faham moderasi beragama bagi santri Pondok Pesantren Darussalam Parmeraan. Abstract

The phenomenon of unregistered marriages in Mandailing Natal Regency remains a serious issue that weakens legal protection for women and children and increases the risk of exploitation of these vulnerable groups. This study aims to analyze the implementation of the maslahah principle in marriage registration policies and evaluate their effectiveness in preventing the exploitation of women and children. This research employs a qualitative method with a descriptive-analytical approach to explain the application of the maslahah principle in marriage registration and its relevance in exploitation prevention. The study location was selected purposively due to the high incidence of unregistered marriages and child marriage in Mandailing Natal Regency, as well as the strong influence of local cultural practices. A normative-empirical approach was applied by integrating the analysis of maslahah principles in Islamic law with the social realities within the community. Primary data were obtained through in-depth interviews with religious leaders, community leaders, and affected residents using purposive sampling, while secondary data were collected from literature and official documents. Data were gathered through interviews and observation, then analyzed qualitatively through data reduction, data display, and conclusion drawing, supported by source triangulation to ensure data validity. The results show that low legal awareness, perceptions that marriage registration is merely administrative, limited access to services, economic constraints, and widespread child marriage are key factors contributing to the high rate of unregistered marriages. The novelty of this research lies in the comprehensive integration of the maslahah principle with local empirical findings, producing a maslahat-based policy recommendation through legal education, expanded service access, and digital innovation as preventive measures to protect women and children.   Fenomena pernikahan tidak tercatat di Kabupaten Mandailing Natal masih menjadi persoalan serius yang melemahkan perlindungan hukum bagi perempuan dan anak serta meningkatkan risiko eksploitasi terhadap kelompok rentan tersebut. Penelitian ini bertujuan untuk menganalisis implementasi prinsip maslahat dalam kebijakan pencatatan pernikahan serta mengevaluasi efektivitasnya dalam mencegah eksploitasi terhadap perempuan dan anak. Penelitian ini menggunakan metode kualitatif dengan sifat deskriptif-analitis untuk menggambarkan penerapan prinsip maslahat dalam pencatatan pernikahan dan relevansinya dalam pencegahan eksploitasi. Lokasi penelitian dipilih secara purposive karena tingginya kasus pernikahan tidak tercatat dan perkawinan anak di Kabupaten Mandailing Natal serta kuatnya pengaruh budaya lokal. Pendekatan normatif-empiris digunakan dengan mengintegrasikan analisis prinsip maslahat dalam hukum Islam dan realitas sosial masyarakat. Data primer dikumpulkan melalui wawancara mendalam dengan tokoh agama, tokoh masyarakat, dan warga terdampak menggunakan teknik purposive sampling, sementara data sekunder diperoleh dari literatur dan dokumen resmi. Pengumpulan data dilakukan melalui wawancara dan observasi, kemudian dianalisis secara kualitatif melalui reduksi data, penyajian data, dan penarikan kesimpulan, serta dilengkapi triangulasi sumber untuk menjamin keabsahan data. Hasil penelitian menunjukkan bahwa rendahnya kesadaran hukum, anggapan bahwa pencatatan hanya formalitas administratif, terbatasnya akses layanan, faktor ekonomi, dan maraknya perkawinan anak menjadi penyebab utama tingginya pernikahan tidak tercatat. Kebaruan penelitian ini terletak pada integrasi komprehensif antara prinsip maslahat dan temuan empiris lokal, menghasilkan rekomendasi kebijakan pencatatan pernikahan berbasis maslahat melalui edukasi hukum, perluasan akses layanan, dan inovasi digital sebagai langkah preventif melindungi perempuan dan anak.

Abstract

This study critically examines the normative framework of Article 97 of the Indonesian Compilation of Islamic Law (KHI), which regulates an equal (50:50) division of marital property upon divorce, through a socio-legal perspective focusing on cases involving unemployed husbands in Mandailing Natal Regency. While existing scholarship has primarily emphasized doctrinal interpretation and procedural aspects of joint property classification, limited attention has been given to how formal legal norms operate within contexts of structural economic inequality and differentiated spousal contributions. Furthermore, empirical assessments of proportional justice in the application of Article 97 remain underdeveloped. To address this gap, this research adopts a mixed normative-empirical approach by integrating doctrinal legal analysis with field data from Mandailing Natal Regency. The empirical material consists of thirteen divorce cases and in-depth interviews with twelve key informants. The data are analyzed through a socio-legal interpretive framework that juxtaposes normative legal provisions with lived socio-economic realities. The study is theoretically grounded in maqāṣid al-Usrah as an extension of maqāṣid al-shariah, which is operationalized as an evaluative framework for assessing substantive fairness in Islamic family law. The findings indicate that, within the observed cases, the strict application of Article 97 tends to produce outcomes that insufficiently reflect the differentiated financial and non-financial contributions of spouses, particularly in situations where wives bear dual domestic and economic responsibilities. This study contributes theoretically by advancing maqāṣid al-Usrah as an operational analytical tool in socio-legal inquiry, and empirically by providing context-specific evidence from Mandailing Natal that evaluates the adequacy of the equal-sharing principle under conditions of economic asymmetry. The findings suggest that proportional justice offers a more context-sensitive interpretive approach for marital property division while remaining aligned with the normative objectives of maṣlaḥah and al-‘adālah. The study concludes that a context-sensitive interpretive refinement of Article 97 may be warranted, particularly by considering verifiable spousal contributions as a basis for more substantively equitable outcomes in post-divorce property distribution.
