Abstract

Village administrative services constitute an integral part of public service delivery, serving to fulfill the administrative rights of citizens. However, their implementation continues to face various challenges, including a lack of transparency in service procedures, delays in administrative processing, inconsistencies in service requirements, and the limited understanding of applicable legal provisions among village officials. These issues may create legal uncertainty, thereby reducing the effectiveness of protecting citizens' rights. This study aims to examine the role of legal certainty as an instrument for safeguarding citizens' rights in the provision of village administrative services while also analyzing the factors influencing its implementation. The study employs a normative legal research method using both the statutory approach and the conceptual approach. The data consist of primary, secondary, and tertiary legal materials, which are analyzed qualitatively through library research. The findings indicate that legal certainty in village administrative services is reflected in the implementation of clear service standards, well-defined procedures, compliance with prevailing laws and regulations, and the application of the principles of good governance. The implementation of legal certainty not only guarantees the fulfillment of citizens' administrative rights but also promotes transparency, accountability, and greater public trust in village government. Therefore, continuous efforts are required to enhance the competence of village officials, improve standard operating procedures, and strengthen supervisory mechanisms to ensure that village administrative services provide optimal legal protection for every citizen.

Abstract

Artikel ini menganalisis transformasi living law dalam sistem hukum nasional Indonesia melalui perspektif sosiologi hukum. Living law menunjukkan bahwa hukum tidak hanya bersumber dari negara, tetapi juga tumbuh melalui nilai, kebiasaan, dan praktik sosial yang memperoleh legitimasi dari masyarakat. Penelitian ini menggunakan metode kepustakaan dengan pendekatan sosiologi hukum melalui analisis terhadap literatur dan peraturan perundang-undangan yang relevan. Hasil kajian menunjukkan bahwa living law, terutama yang termanifestasi dalam hukum adat, tetap memiliki legitimasi sosial dan berfungsi dalam mengatur kehidupan masyarakat. Meskipun telah memperoleh pengakuan dalam sistem hukum nasional, keberlakuannya masih berada dalam batas dan mekanisme yang ditentukan negara. Formalisasi tersebut menghasilkan transformasi yang bersifat ambivalen karena pada satu sisi memperkuat kedudukan yuridis living law, tetapi pada sisi lain berpotensi membatasi otonomi dan karakter dinamisnya. Oleh karena itu, integrasi living law perlu mempertemukan legitimasi sosial dan legitimasi yuridis secara proporsional tanpa menghilangkan karakter hukum yang hidup dalam masyarakat.

Abstract

Abstract Digital transformation has changed the way migrant workers access information, communicate, store documents, conduct transactions, and adapt to workplace demands. Intensive smartphone use, however, does not automatically translate into productive, critical, and safe digital practices. This international community service program aimed to strengthen the digital technical skills and digital literacy of Indonesian Migrant Workers in Kuala Lumpur, Malaysia. The program was conducted on 13–18 April 2026 by the Master of Law Postgraduate Program of Universitas Islam Kalimantan Muhammad Arsyad Al Banjari Banjarmasin, involving lecturers, practitioners, and several Indonesian workers in Malaysia. A participatory approach was employed through needs identification, short lectures, demonstrations, hands-on practice, case discussions, and participant reflection. The learning materials covered digital document management, workplace communication, information searching and verification, account security, personal data protection, online scam awareness, and the use of digital services to support work and daily life. Evaluation was descriptive, based on participation, completion of practical tasks, question-and-answer sessions, and reflective feedback, without inventing unavailable pre-test or post-test scores. The activity indicated that participants were able to recognize safer digital practices, organize work-related documents more systematically, verify information sources more carefully, and apply basic measures for protecting accounts and personal data. The program suggests that digital literacy for migrant workers should be understood not merely as the ability to operate devices, but as a combination of work competence, self-protection, and continuous capacity development. Keywords: Indonesian migrant workers; digital technical skills; digital literacy; digital safety; Malaysia Abstrak Transformasi digital telah mengubah cara pekerja migran mengakses informasi, berkomunikasi, menyimpan dokumen, melakukan transaksi, dan menyesuaikan diri dengan tuntutan kerja. Namun, penggunaan telepon pintar yang intensif tidak selalu diikuti kemampuan memanfaatkan teknologi secara produktif, kritis, dan aman. Kegiatan Pengabdian kepada Masyarakat (PKM) internasional ini bertujuan memperkuat keterampilan teknis digital dan literasi digital Pekerja Migran Indonesia (PMI) di Kuala Lumpur, Malaysia. Kegiatan dilaksanakan pada 13–18 April 2026 oleh Program Pascasarjana Magister Hukum Universitas Islam Kalimantan Muhammad Arsyad Al Banjari Banjarmasin dengan melibatkan tim dosen dan praktisi serta beberapa PMI yang bekerja di Malaysia. Metode pelaksanaan menggunakan pendekatan partisipatif melalui identifikasi kebutuhan, penyampaian materi, demonstrasi, praktik langsung, diskusi kasus, dan refleksi. Materi difokuskan pada pengelolaan dokumen digital, komunikasi kerja berbasis digital, pencarian dan verifikasi informasi, keamanan akun, perlindungan data pribadi, kewaspadaan terhadap penipuan daring, serta pemanfaatan layanan digital untuk kebutuhan kerja dan kehidupan sehari-hari. Evaluasi dilakukan secara deskriptif melalui observasi partisipasi, penyelesaian tugas praktik, tanya jawab, dan refleksi peserta tanpa menggunakan klaim angka pre-test atau post-test yang tidak tersedia. Hasil kegiatan menunjukkan bahwa peserta mampu mengidentifikasi praktik digital yang lebih aman, menata dokumen kerja secara lebih sistematis, memahami pentingnya verifikasi sumber informasi, serta menerapkan langkah dasar perlindungan akun dan data. Program ini menegaskan bahwa literasi digital bagi PMI perlu ditempatkan sebagai keterampilan kerja, keterampilan perlindungan diri, dan sarana peningkatan kapasitas yang berkelanjutan.

Abstract

The Election Supervisory Agency of the Republic of Indonesia (Bawaslu) has utilized advancements in information technology through the launch of the Election Violation Handling Information System (Sigap Lapor) as a public service innovation aimed at improving public access to electoral justice. This application is expected to facilitate the reporting of alleged election violations in a faster, more effective, and transparent manner. However, the implementation of Sigap Lapor at the regency and municipal Bawaslu levels has raised several constitutional law issues, particularly regarding the fulfillment of citizens’ constitutional rights to fair and equal public services. This study aims to analyze the public service law dimensions of Sigap Lapor and examine the relationship between the principles of technological accessibility and legal certainty in election violation handling mechanisms. The research employs a normative juridical method using statutory and conceptual approaches. The findings indicate that the use of Sigap Lapor still leaves a legal vacuum, especially concerning the certainty of reporting deadlines when system failures occur on the central server. Furthermore, fully digital reporting requirements have the potential to discriminate against communities with limited access to technology and inadequate digital literacy. Therefore, synchronization and revision of Bawaslu regulations are necessary through the development of new electronic operational standards that include system failure mitigation mechanisms to ensure the protection of constitutional rights and legal certainty for election violation reporters.
