Abstract

The principle of rule of law is the main foundation of the state of law which requires that the process of forming laws be carried out in a constitutional, transparent, accountable, and participatory manner. However, in the practice of legislation in Indonesia, various laws often receive criticism due to weak procedural compliance, lack of meaningful public participation, and increasing formal testing in the Constitutional Court. This condition shows that there is a gap between the legal norms of the formation of laws and regulations and the actual practice of legislation. This study aims to analyze and evaluate the strengthening of the principle of rule of law in the legislative process in Indonesia by examining the relationship between the normative framework of law-making and the institutional practice of law-making. This study uses the doctrinal-socio-legal research method with a qualitative approach, which combines normative analysis of laws and regulations and the principles of the state of law with empirical analysis based on official documents of the legislation process, including academic manuscripts, minutes of DPR meetings, list of problem inventories, and statements of the DPR and the Government in the Constitutional Court's decision. The data is analyzed qualitatively through legal reasoning and content analysis. The results of the study show that although the regulatory framework for the formation of laws has accommodated the principle of rule of law, its implementation is still formalistic and does not fully guarantee meaningful public participation. This study concludes that strengthening the rule of law in the legislative process requires procedural reform and strengthening accountability mechanisms to ensure the quality of constitutional and democratic legislation.

Abstract

Of the many cases of dispensation from marriage, it is known that the bride-to-be is already pregnant, while the man as the groom-to-be is willing to marry for responsible reasons. Of course, this is considered morally right, but if viewed from a gender perspective, even if the marriage takes place, a series of accompanying problems will arise, including divorce, violence and gender injustice against women. From the data that the researchers found at the Religious Court class 1A in Ponorogo Regency, from 2021 to 2022 there were 345 cases of dispensation of marriage, of which more than 125 cases were filed because the prospective bride was pregnant. Furthermore, from the reports of the Women and Children Protection Unit (PPA) POLRES Ponorogo, it was also found that there were approximately 9 cases of violence against female partners who did dispensation of marriage. This is certainly interesting to study considering the cases that occurred showed that there was both physical and sexual violence that occurred in underage marriages. This study aims to examine women's rights by looking at the role of men and alternative solutions in preventing acts of violence against women in marriage dispensation couples with a gender perspective. Furthermore, the research was carried out by interviews and direct observation and also supported by existing secondary data. From this research, it can be concluded that the role of men must be taken into account by being responsible for marrying the woman they are pregnant with in preventing violence, while alternative solutions must continue to be actualized by maximizing the role of stakeholders in preventing violence against women.

Abstract

Stunting merupakan persoalan struktural dalam pembangunan manusia yang mencerminkan kegagalan pemenuhan hak dasar anak dan menuntut peran aktif pemerintahan desa sebagai garda terdepan kebijakan publik. Namun, peran strategis tersebut kerap belum didukung oleh pemahaman hukum perangkat desa yang memadai, sehingga pencegahan stunting cenderung dijalankan secara administratif dan jangka pendek. Permasalahan dalam Pengabdian kepada Masyarakat ini adalah bagaimana penguatan pemahaman hukum perangkat desa dapat berkontribusi secara efektif dalam pencegahan stunting di Desa Re’es. Kegiatan Pengabdian kepada Masyarakat ini bertujuan memperkuat pemahaman hukum perangkat desa guna meningkatkan peran dan tanggung jawab kelembagaan desa dalam pencegahan stunting. Metode yang digunakan adalah Participatory Action Research (PAR) melalui tahapan identifikasi awal, refleksi bersama, edukasi hukum dialogis, serta evaluasi partisipatif. Hasil kegiatan menunjukkan bahwa penguatan pemahaman hukum mendorong perubahan cara pandang perangkat desa, dari pendekatan teknis kesehatan menuju pemaknaan pencegahan stunting sebagai tanggung jawab hukum pemerintahan desa yang berkelanjutan.

Abstract

ABSTRAK Pengelolaan hutan berkelanjutan merupakan tantangan serius di Indonesia, khususnya di Kalimantan Barat, akibat deforestasi, alih fungsi lahan, dan lemahnya penegakan hukum lingkungan. Di tengah absennya peran hukum negara, Masyarakat Adat Dayak Kanayat’n di Kecamatan Sengah Temila menerapkan sistem kearifan lokal melalui ritual adat Balala’ sebagai bentuk konservasi hutan. Balala’ adalah tradisi tahunan yang memuat larangan terhadap segala bentuk intervensi terhadap alam, seperti menebang pohon, membunuh hewan, atau pergi ke hutan. Tradisi Balala’ merefleksikan pemahaman ekologis yang mendalam serta keterhubungan spiritual antara manusia dan lingkungan. Berdasarkan kondisi tersebut, rumusan masalah dalam penelitian ini ialah bagaimana implementasi nilai-nilai pengelolaan hutan berkelanjutan melalui ritual adat Balala’ Dayak Kanayat’n. Tujuan dari penelitian ini adalah untuk menganalisis dan mendeskripsikan praktik Balala’ dalam konteks konservasi hutan, serta meninjau relevansinya dengan teori Deep Ecology yang menekankan kesetaraan hak seluruh makhluk hidup dan ekosistem. Metode yang digunakan adalah penelitian hukum empiris dengan pendekatan yuridis sosiologis. Data diperoleh melalui observasi, wawancara dengan pemangku adat dan masyarakat, serta ketentuan hukum adat di Kecamatan Sengah Temila. Hasil penelitian menunjukkan bahwa ritual Balala’ merupakan bentuk nyata pengelolaan hutan berkelanjutan berbasis adat yang diwariskan lintas generasi dan dijalankan secara konsisten melalui mekanisme sosial dan spiritual yang kuat. Kata kunci: Balala’; Dayak Kanayat’n; Deep Ecology; Hukum Adat; Konservasi Hutan.   ABSTRACT Sustainable forest management is a serious challenge in Indonesia, specifically in West Kalimantan, due to deforestation, land use change, and weak enforcement of environmental law. In the absence of the rule of law, indigenous community of Dayak Kanayat'n in Sengah Temila District applied a local wisdom system through balala' traditional ritual as a form of forest conservation. Balala' is an annual tradition that prohibits all forms of intervention against nature, such as cutting down trees, killing animals, or entering forests. This tradition reflects deep ecology understanding and spiritual connection between humans and the environment. The problem formulation was how to implement sustainable forest management values through traditional ritual of balala' Dayak Kanayat'n. Therefore, this study aimed to analyze and describe the practice of balala' in the context of forest conservation, as well as to review the relevance to the theory of deep ecology, which showed the equal rights of all living things and ecosystems. An empirical legal study was conducted adopting a sociological juridical method. Data were collected through observation, interviews with traditional and community stakeholders, and local traditional law provisions. The results showed that balala' ritual was a tangible form of traditional-based sustainable forest management passed down through generations and consistently carried out by strong social and spiritual mechanisms. Abstract

Although integrated marriage validation (itsbat nikah) services are available to Indonesian migrant workers (PMI) in Sarawak, Malaysia, some participants still need information regarding court procedures, the function of marriage registration, family documents, and the protection of civil rights. This Community Service activity aims to strengthen PMI’s legal literacy through media-based legal education as a complement to the integrated marriage validation hearings at the Consulate General of the Republic of Indonesia (KJRI) in Kuching, with evaluation indicators including understanding of marriage validation procedures, perceptions of legal certainty, and the benefits of integrated services. The activity was conducted on December 4-8, 2025, by a collaborative Community Service (PKM) team from Panca Bhakti University in Pontianak, Tarumanagara University in Jakarta, and Sahid University in Jakarta, involving 102 Indonesian migrant worker couples. The activity employed an educational-participatory approach through observation, educational reporting, brief interviews, discussions, legal consultations, the distribution of brochures, and evaluation via questionnaires. The results of the activity showed that 77 applications for itsbat nikah (75.5%) were granted, 5 applications (4.9%) were rejected, and 20 applications (19.6%) were dismissed. As part of the PKM activities, a post-activity evaluation of 60 respondents showed that 87% fell into the “understand” and “fully understand” categories regarding the marriage validation procedure, 92% gave a positive assessment that marriage legalization provides legal certainty, and 93% assessed that the integrated service benefits families. The evaluation results indicate that media-based legal education can complement marriage registration services by providing more contextual and communicative information. This mentoring model can be developed as part of legal services for Indonesian migrant workers at Indonesian diplomatic missions abroad.Penguatan Literasi Hak Sipil Pekerja Migran Indonesia melalui Edukasi Hukum Berbasis Media pada Sidang Itsbat Nikah Terpadu di SarawakABSTRAKMeskipun layanan sidang itsbat nikah terpadu telah tersedia bagi Pekerja Migran Indonesia (PMI) di Sarawak, Malaysia, sebagian peserta masih memerlukan informasi mengenai prosedur persidangan, fungsi pencatatan perkawinan, dokumen keluarga, dan perlindungan hak sipil. Kegiatan Pengabdian kepada Masyarakat ini bertujuan memperkuat literasi hukum PMI melalui edukasi hukum berbasis media sebagai pendamping sidang itsbat nikah terpadu di Konsulat Jenderal Republik Indonesia (KJRI) Kuching, dengan indikator evaluasi meliputi pemahaman prosedur itsbat nikah, persepsi terhadap kepastian hukum, dan manfaat pelayanan terpadu. Kegiatan dilaksanakan pada 4-8 Desember 2025 oleh tim PKM kolaborasi dari Universitas Panca Bhakti Pontianak, Universitas Tarumanagara Jakarta, dan Universitas Sahid Jakarta dengan sasaran 102 pasangan PMI. Kegiatan menggunakan pendekatan edukatif-partisipatif melalui observasi, peliputan edukatif, wawancara singkat, diskusi, konsultasi hukum, pembagian brosur, dan evaluasi melalui angket. Hasil kegiatan menunjukkan bahwa 77 permohonan itsbat nikah (75,5%) dikabulkan, 5 permohonan (4,9%) ditolak, dan 20 permohonan (19,6%) dinyatakan gugur. Dalam rangkaian kegiatan PKM tersebut, evaluasi pascakegiatan terhadap 60 responden menunjukkan bahwa 87% berada pada kategori paham dan sangat paham terhadap prosedur itsbat nikah, 92% memberikan penilaian positif bahwa legalisasi perkawinan memberikan kepastian hukum, dan 93% menilai pelayanan terpadu memberikan manfaat bagi keluarga. Hasil evaluasi menunjukkan bahwa edukasi hukum berbasis media dapat melengkapi pelayanan itsbat nikah dengan penyampaian informasi yang lebih kontekstual dan komunikatif. Abstract

AbstrakKasus pencurian di Indonesia terus meningkat dan menjadi tantangan bagi sistem peradilan pidana yang sering kali tidak mempertimbangkan aspek keadilan restoratif. Dalam masyarakat adat Dayak Kanayat’n, penyelesaian kasus pencurian tidak hanya mengandalkan sistem hukum negara, tetapi juga melalui mekanisme mediasi adat yang berorientasi pada pemulihan sosial. Penelitian ini bertujuan untuk menganalisis peran mediasi adat Dayak Kanayat’n dalam penyelesaian kasus pencurian serta efektivitasnya sebagai alternatif penyelesaian sengketa di luar peradilan negara. Metode penelitian yang digunakan adalah penelitian hukum normatif-yuridis dengan pendekatan kualitatif. Data diperoleh melalui studi kepustakaan terhadap bahan hukum primer dan sekunder, termasuk Musyawarah Adat Dayak Kanayat’n Tahun 2010. Hasil penelitian menunjukkan bahwa pranata adat seperti Timanggong, Pasirah, dan Pangaraga berperan sebagai mediator yang tidak hanya memfasilitasi dialog antara pihak bersengketa, tetapi juga memiliki wewenang dalam menetapkan putusan berdasarkan hukum adat. Proses mediasi adat melibatkan tahapan pengaduan, pemanggilan, musyawarah mufakat, serta sumpah adat jika diperlukan. Sanksi adat yang diberikan bersifat simbolik dan bertujuan untuk mengembalikan keseimbangan sosial, berbeda dengan sistem peradilan pidana yang cenderung retributif. Kebaruan dari penelitian ini terletak pada analisis mendalam terhadap integrasi mediasi adat dalam konsep keadilan restoratif, yang dapat menjadi model penyelesaian sengketa berbasis kearifan lokal. Temuan ini diharapkan dapat menjadi rujukan bagi pembuat kebijakan dalam mengakui dan mengakomodasi hukum adat dalam sistem hukum nasional. AbstractTheft cases in Indonesia continue to rise, posing a challenge to the criminal justice system, which often does not take restorative justice aspects into account. In the Dayak Kanayat'n indigenous community, the resolution of theft cases does not rely solely on the state legal system but also on customary mediation mechanisms that are oriented toward social recovery. This study aims to analyze the role of Dayak Kanayat'n customary mediation in resolving theft cases and its effectiveness as an alternative dispute resolution method outside the state courts. The research method used is normative-juridical legal research with a qualitative approach. Data were obtained through a literature review of primary and secondary legal materials, including the 2010 Dayak Kanayat'n Customary Deliberation. The study's findings indicate that customary institutions such as Timanggong, Pasirah, and Pangaraga act as mediators who not only facilitate dialogue between disputing parties but also have the authority to render decisions based on customary law. The customary mediation process involves several stages, including complaints, summons, consensus deliberation, and, if necessary, a customary oath. The sanctions imposed under customary law are symbolic and aim to restore social balance, in contrast to the criminal justice system, which tends to be retributive. The novelty of this study lies in its in-depth analysis of the integration of customary mediation within the concept of restorative justice, offering a model for dispute resolution based on local wisdom. These findings are expected to serve as a reference for policymakers in recognizing and incorporating customary law into the national legal system.

Abstract

The limitations of conventional legal counselling, due to access, cost, and time constraints, create a need for more effective digital media to increase public legal awareness. The main issues examined are the need for local governments and the Regional Offices of the Ministry of Law to develop effective digital legal counseling media, and how the initial design of the SAHABAT application can be proposed as a website-based innovation to realize legal awareness. The purpose of this study is to describe institutional needs and design a preliminary model for the SAHABAT application. The method used is empirical legal research with a sociological jurisprudence approach, employing interviews and questionnaires with legal educators and village heads, and using descriptive-qualitative analysis. The results show that the SAHABAT application can provide interactive, participatory, and easily accessible legal education. The novelty of this research lies in the concrete design of the SAHABAT application as a digital legal counseling medium that reflects the theories of legal effectiveness, responsive law, and progressive law.

Abstract

This article explores the utilization of digital technology to enhance public legal awareness from a comparative global perspective. In the digital era, technology has become a significant tool for expanding access to legal information and empowering individuals to understand their legal rights and obligations. This study analyzes various global practices, including digital initiatives such as law-based mobile applications, e-learning platforms, social media-based legal awareness campaigns, and online legal aid systems. Furthermore, the article evaluates the necessary legal reforms to effectively support the use of digital technology in legal contexts, with a focus on Indonesia. By comparing approaches in countries such as the United States, the United Kingdom, and Scandinavian nations, this research provides recommendations to strengthen inclusive and equitable digital legal awareness strategies. The article underscores the importance of technological innovation in fostering a legally informed society and supporting legal transformation in the digital age.
