Abstract

Islamic law experienced dullness and decline after the period of taklid. However, that period disappeared after Muslims sought a solution so as not to be left behind from the West which was increasingly advanced while Islam was the opposite. The revolution of Islamic thought was present during the progress of Islam after blind taklid, spearheaded by Islamic thinkers of his time, such as Abdul, Sheikh Muhammad as- Sirhindi, Sayyid Ahmad Syahid, Muhammad Abdul Wahab and so on, which made Islamic law and Islamic thought advance again. This research aims to analyze the development of Islamic law after the taqlid period. This research uses a qualitative method with a literature study approach as a data search process. Primary and secondary data are obtained from books, electronic journal manuscripts that have been published in journals that have national and international reputations related to the development of Islamic law during the taqlid period. After the data has been obtained, data analysis is carried out to find answers to the problems raised and after that the real conclusion is drawn. The results showed that Islamic law experienced a period of development, one of which is called the Awakening period which began in the second part of the 19th century until now, with the central figures being Jalaluddin Al-Afghani (1839-1897) and Muhammad Abduh (1849-1905). Their thoughts were heavily influenced by those of Ibn Taymiyyah (1263-1328). The first characteristic is the call to establish Pan Islamism and make comprehensive changes to the Islamic world, especially in the field of utilizing reason over the Qur'an and Sunnah and at the same time releasing ties from the shackles of the madhhab. Mazhab is something common, but excessive bigotry against the mazhab is something that perishes and destroys. Second, the approach to Islamic law through Mazhab Comparison, both the Shafi'i, Maliki, Hanafi and Hambali madhabs plus the Shi'a Mazhab. Comparisons are even made with Western legal systems and other laws. Third, it is characterized by considerable attention from the European and Western world in general to study Islamic law so that they make Islamic law an official subject in the Faculty of Law. Fourth, from the development of Islamic law is the tendency in Muslim countries to return to Islamic Law as seen in the Middle East and in Southeast Asia. Even if the country is not an Islamic state, the law applied in it is Islamic law.

Abstract

This research focuses on the inheritance rights of children from unregistered marriages in the Compilation of Islamic Law. Although marriages are supposed to be registered, situations where they are not recorded can have an impact on the inheritance rights of children. This research uses a qualitative research method with a normative juridical approach that is carried out based on legislation, which in this case includes the Civil Code, Law No. 1 of 1974. Data is obtained from sources of Law, Civil Code and journals. Data analysis is carried out to filter the data obtained and collected according to its type and finally draw conclusions from the findings obtained. The results show that children from irri marriages previously only received inheritance from the mother and the mother's family. However, the decision of the Constitutional Court allows extra-marital children to inherit from their biological father if legally proven. The Compilation of Islamic Law states that children from irri marriages only have a nasab relationship with the mother and her family, not with the father. Parents can apply for itsbat nikah to confirm the legal relationship, providing inheritance protection. However, if itsbat nikah is rejected, the child is not entitled to receive inheritance from the father. In conclusion, children from irri marriages have inheritance rights depending on the legal recognition of the relationship with their parents.

Abstract

Gender construction in Islamic societies was influenced by religious interpretations and local culture, which can affect social roles and expectations for individuals based on gender. This research aims to analyze the interaction between Islamic religious education and gender construction in Islamic society context. This research uses a qualitative method with a literature study approach or literature analysis to collect and criticize literature related to religious education, gender, and Islam. After the data is collected, it is analyzed to produce concrete conclusions. The research findings indicate that religious education has a significant role in maintaining and changing gender construction in Islamic society. The interpretation of religion and its emphasis in the religious education curriculum can influence how gender roles are defined and implemented daily. In addition, cultural factors and social context also play a role in shaping gender construction in Islamic societies. Local traditions, social norms, and historical factors can reinforce or change perceptions of gender roles in society. The research also highlights the importance of religious education in reflecting on Islamic teachings to promote gender equality and overcome patriarchal views. This research was expected to provide further insights into how Islamic religious education can influence the construction of gender in Islamic societie

Abstract

Unclear marital status remains a crucial issue in Pasirlangu Village, leading to family instability and hindered access to civil rights. This community service aims to solve this problem through the implementation of mass isbat nikah. The methods used include data collection of residents with nikah sirri status, socialization of the importance of isbat nikah, and cooperation with relevant agencies for the implementation of mass isbat nikah. The results showed that the implementation of mass isbat nikah succeeded in providing legal certainty to the marital status of Pasirlangu Village residents who previously had the status of nikah sirri to become legal in religion and the State. In addition, the number of couples who have been isbatized is at least 35 couples who have been successfully isbatized in this service activity. And this program also succeeded in increasing public awareness of the importance of marriage legality as the foundation of a sakinah family and the achievement of legal certainty for all Indonesian people.

Abstract

Polygamy is a marital practice in which a man simultaneously has more than one wife. In contemporary society, this practice often poses various legal and social challenges. This study aims to analyze the role of family law in regulating polygamy, protecting individual rights, and maintaining a balance between religious freedom and women's rights. Family law plays a central role in ensuring that polygamy is conducted with the principles of justice, equality, and protection of the wives' rights. This research uses a qualitative method with a literature study approach. In contrast, this research's primary and secondary sources are journals published with national and international reputation indexes, as well as books, laws, and so on that support this research. Data analysis uses description analysis, data following the actual, and then the data is compiled, processed, and analyzed to provide an overview of the existing problems. The results show that polygamy remains a controversial issue in contemporary society. Family law is essential in regulating and dealing with this practice, significantly impacting individuals, families, and communities. This research provides a further understanding of the complexity of the role of family law in the context of polygamy. It can serve as a basis for further discussion on regulating and protecting individual rights in a changing society.

Abstract

Keluarga adalah unit terkecil dalam masyarakat yang memiliki peran penting dalam pembentukan struktur sosial. Pemerintah sebagai regulator masyarakat berperan dalam mengatur kebijakan yang berkaitan dengan keluarga. Salah satu kebijakan yang memiliki pengaruh signifikan terhadap keluarga adalah kebijakan keluarga berencana. Kebijakan ini bertujuan untuk mengendalikan pertumbuhan populasi dan meningkatkan kualitas hidup keluarga. Dalam perspektif hukum, kebijakan keluarga berencana memiliki dampak yang kompleks dan perlu dianalisis secara mendalam. Tujuan dari penelitian ini adalah untuk menganalisis pengaruh kebijakan keluarga berencana terhadap keluarga dalam perspektif hukum. Metode yang digunakan adalah studi kepustakaan dengan mengumpulkan data dari berbagai sumber seperti peraturan perundang-undangan, literatur ilmiah, dan kebijakan pemerintah terkait. Analisis dilakukan dengan mempertimbangkan aspek-aspek hukum yang terkait dengan kebijakan keluarga berencana, termasuk peraturan, hak asasi manusia, dan perlindungan keluarga. Hasil analisis menunjukkan bahwa kebijakan keluarga berencana memiliki dampak yang signifikan terhadap keluarga dalam perspektif hukum. Di satu sisi, kebijakan ini memberikan manfaat seperti akses terhadap informasi dan layanan kesehatan reproduksi yang lebih baik, pengendalian jumlah anak, dan peningkatan kesejahteraan keluarga. Di sisi lain, terdapat beberapa isu hukum yang muncul, seperti pelanggaran hak asasi manusia, diskriminasi gender, dan intervensi pemerintah yang berlebihan dalam kehidupan pribadi keluarga. Peraturan kebijakan keluarga berencana perlu dianalisis dengan cermat untuk memastikan bahwa kebijakan tersebut sejalan dengan prinsip-prinsip hukum dan hak asasi manusia. Diperlukan keseimbangan antara kepentingan negara dalam mengatur populasi dan hak-hak keluarga untuk membuat keputusan mengenai tubuh mereka sendiri. Kebijakan yang menghormati hak asasi manusia, kesetaraan gender, dan menjaga privasi keluarga akan memberikan dampak positif dalam jangka panjang.

Abstract

Gender roles in society have undergone significant changes in recent decades. Social transformation, economic progress, and the increasingly championed gender equality have influenced the dynamics of family law. This research aims to analyze gender roles and the redefinition of family law: towards a modern family with justice. This research uses a qualitative approach with the method of literature study and lawyer analysis. Literature study, collecting data from various written sources, such as books, scientific journals, news articles, and official documents. And discourse analysis, analyzing legal texts, regulations, and mass media. Data analysis uses thematic analysis to identify themes in the data. As well as using interpretative analysis to understand the meaning of the data and produce new findings. The results showed that gender roles are still very strong in Indonesian families, with an unfair division of labor between men and women. This causes women to experience a double burden and injustice in the family. Family law in Indonesia also still contains many elements of discrimination against women, such as in terms of marriage, divorce, and inheritance. Causing women not to get their full rights in the family. To realize a modern family with justice, a redefinition of gender roles and family law is needed. Redefinition of gender roles needs to be done by changing the mindset and behavior of the community about the roles of men and women in the family. Redefinition of family law needs to be done by changing laws and regulations that discriminate against women.

Abstract

ABSTRAKTradisi Merarik di Desa Merembu, Lombok Barat, menjadi sorotan menarik dalam kajian antropologi hukum. Praktik perkawinan di bawah umur yang marak dalam tradisi ini menghadirkan tantangan dalam konteks hukum positif Indonesia. Penelitian ini secara mendalam mengurai mekanisme penyelesaian perkawinan Merarik, dengan fokus pada implikasi hukum yang timbul. Metode penelitian menggunakan metode hukum empiris dan pendekatan kualitatif dengan data primer dari lokasi penelitian dan data sekunder dari sumber terpercaya. Teknik pengumpulan data meliputi observasi, wawancara, dan studi dokumen. Hasil Penelitian ini mengungkapkan bahwa Tradisi Merarik di Desa Merembu, Lombok Barat, meski sarat dengan nilai budaya, namun berpotensi menimbulkan permasalahan hukum akibat ketidaksesuaiannya dengan ketentuan perkawinan dalam hukum positif Indonesia. Penelitian ini menyoroti pentingnya mencari titik temu antara hukum dan budaya untuk melindungi hak-hak individu dan memastikan kepastian hukum dalam konteks perkawinan adat. Temuan ini mengindikasikan adanya pertentangan antara nilai-nilai budaya lokal dengan ketentuan hukum nasional. Oleh karena itu, diperlukan upaya untuk mencari solusi yang dapat mengakomodasi kedua aspek tersebut, sehingga perlindungan hukum bagi individu, khususnya perempuan dan anak, dapat terjamin tanpa mengabaikan nilai-nilai kearifan lokal. The Merarik tradition in Merembu Village, West Lombok, is an interesting highlight in the study of legal anthropology. The rampant practice of underage marriage in this tradition presents challenges in the context of Indonesian positive law. This research deeply analyzes the mechanism for resolving Merarik marriages, with a focus on the legal implications that arise. The research method uses empirical legal methods and a qualitative approach with primary data from the research location and secondary data from trusted sources. Data collection techniques include observation, interviews, and document studies. The results of this study reveal that the Merarik Tradition in Merembu Village, West Lombok, although full of cultural values, has the potential to cause legal problems due to its incompatibility with the provisions of marriage in Indonesian positive law. The research highlights the importance of finding common ground between law and culture to protect individual rights and ensure legal certainty in the context of customary marriage. The findings indicate a conflict between local cultural values and national legal provisions. Therefore, efforts are needed to find solutions that can accommodate both aspects, so that legal protection for individuals, especially women and children, can be guaranteed without ignoring local wisdom values.

Abstract

The role of gender in society has undergone significant changes in recent decades. Social transformation, economic advancements, and the increasing advocacy for gender equality have influenced the dynamics of family law. This research aims to analyze the impact of changing gender roles on family law dynamics in the context of the modern era. In this case study, the researcher will examine how changes in gender roles affect child custody, roles in marriage and divorce, and other legal implications using a qualitative approach by collecting data from various sources, such as literature reviews, documentation, and analysis of related legal cases. Data analysis will be conducted using a comparative descriptive approach to identify changes occurring in family law and its relation to changing gender roles. The results of this study indicate that changes in gender roles within family law have significant impacts in the modern era. These changes include the expected roles of husbands and wives in marriage, child custody after divorce, as well as legal protection against gender discrimination and access to fair legal services. Although challenges still exist, it is important for society and the legal system to support these changes and address existing barriers. Thus, marital and divorce relationships can become more balanced, fair, and consider the best interests of the couples and children involved.
