Abstract

The role of gender in society has undergone significant changes in recent decades. Social transformation, economic advancements, and the increasing advocacy for gender equality have influenced the dynamics of family law. This research aims to analyze the impact of changing gender roles on family law dynamics in the context of the modern era. In this case study, the researcher will examine how changes in gender roles affect child custody, roles in marriage and divorce, and other legal implications using a qualitative approach by collecting data from various sources, such as literature reviews, documentation, and analysis of related legal cases. Data analysis will be conducted using a comparative descriptive approach to identify changes occurring in family law and its relation to changing gender roles. The results of this study indicate that changes in gender roles within family law have significant impacts in the modern era. These changes include the expected roles of husbands and wives in marriage, child custody after divorce, as well as legal protection against gender discrimination and access to fair legal services. Although challenges still exist, it is important for society and the legal system to support these changes and address existing barriers. Thus, marital and divorce relationships can become more balanced, fair, and consider the best interests of the couples and children involved.

Abstract

This study aims to examine the phenomenon of voter abstention, known as voter abstention (Golongan Putih or Golput), from the perspectives of Islamic law and Indonesian electoral legislation. The research utilizes a qualitative approach, relying on literature reviews and primary governmental documents to analyze how these two legal frameworks address and regulate voter abstention. The study explores the intersection of Islamic jurisprudence, particularly the 2009 fatwa by the Indonesian Ulama Council (Majelis Ulama Indonesia or MUI) that declared Golput haram (forbidden), and Indonesia’s electoral law, specifically Law No. 7 of 2017, which encourages voter participation without penalizing abstention. The findings reveal that while Golput is not prohibited by electoral law, it is framed as a violation of religious duty within Islamic legal thought. Additionally, the study highlights Golput as a form of civil resistance and political expression in Indonesia's democratic system. The analysis of these dual legal systems provides insights into the complexities of voter behavior and presents recommendations for strengthening democratic engagement. The implications of this research suggest that integrating religious principles with legal norms could enhance voter turnout and foster more inclusive electoral participation in Indonesia.

Abstract

Local Elections (Pilkada) in Indonesia are pivotal in the democratic framework, requiring fair and transparent conduct at all levels of local government, including villages. Village Heads play a crucial role in upholding the integrity of the electoral process and ensuring its adherence to principles of healthy democracy. Village heads play a pivotal role in local governance in Indonesia, responsible for administering government affairs, development initiatives, and public services within their communities. However, the issue of village head neutrality becomes crucial in the context of regional elections. This study aims to examine the role of Village Heads in facilitating the smooth conduct of Pilkada, particularly in the context of implementing neutrality regulations. These regulations are stipulated in Law Number 23 of 2014 on Regional Government.The research methodology employed involves a literature review from various relevant sources, including legislative regulations, research reports, and relevant case studies. The analysis reveals that despite the existence of neutrality regulations, challenges persist in their practical implementation. Some Village Heads occasionally engage in non-neutral political activities, directly or indirectly influencing the overall electoral process. The impact of Village Heads' neutrality violations on the integrity of the democratic process at the village level includes election unfairness, loss of public trust in the local democratic system, and potential social polarization and conflicts. Efforts to enhance Village Heads' understanding and compliance with neutrality regulations, such as training, intensive socialization, and monitoring and addressing violations, need continuous improvement. This research aims to contribute to improving the local democratic system in Indonesia by strengthening the role of Village Heads as guardians of neutrality in the electoral process.

Abstract

Islamic law has a close relationship with the evolving social dynamics within Muslim societies. Social, cultural, and political changes demand flexibility in the application of Islamic law to remain relevant. This study employs a historical approach and descriptive analysis, focusing on two major phases in Islamic history: the Khulafaur Rasyidin phase and the Mulkan Jabariyyah phase. Data were collected through literature reviews of various primary and secondary sources. The findings indicate that Islamic law can adapt to social changes through the mechanisms of ijtihad and tajdid. However, its application must consider social, cultural, and historical contexts to avoid misinterpretation. Islamic law is not a static entity but a dynamic and responsive system that evolves with societal changes. With the right contextual approach, Islamic law can remain relevant in modern Muslim societies.

Abstract

During the time of Rasulullah SAW, Muslims did not need certain rules in understanding sharia law. After the spread of Futuhat Islamiyah, Arab Muslims interacted a lot with other nations who had different languages. On the other hand, the need for ijtihad is very urgent, because there are many new problems that have never occurred before and require clarity in fiqh law. So two large madrasahs emerged that reflected their ijtihad method - the Ahlir-ra'yi Madrasah used more qiyas (analogies) to generate heated debates, thus making the ulama feel the need to create written regulations that were recorded as common law in uniting these two madrasas. The hadith about being more careful in giving fatwas and qiyas gave rise to heated debate, making the ulama feel the need to make written rules which were recorded as joint laws in uniting the two madrasas. Imam Syafi'i was the first person to write a book about ushul fiqh-Imam Syafii was a great mufti of the Muslim community who was also the founder of the Syafi'i school, developing his school in Baghdad. Ushul fiqh is the postulates of fiqh which are global in nature - The object of the discussion is to study the postulates which are still of a general nature seen from their general legal provisions and the ultimate aim of studying them is to protect the Islamic religion from deviations and misuse of the postulates of the Shari'a, so that misleading carelessness does not occur.

Abstract

This law has a significant impact on various aspects of people's lives, including the economy, labor, and the environment. This study aims to analyze the Omnibus Law on Job Creation from an Islamic perspective with a focus on aspects of social justice, protection of workers' rights, and environmental impacts. However, the problems are (1) How is the Islamic perspective on social justice regulated in the Omnibus Law on Job Creation Law? (2) How is the protection of workers' rights in the Omnibus Law on Job Creation Law seen from an Islamic perspective? (3) How is the environmental impact of the implementation of the Omnibus Law on Job Creation Law from an Islamic perspective?. This research uses a normative juridical method with a qualitative approach as well as conceptual and statutory regulations (normative-juridical). By analyzing legal documents, and Islamic literature, related to the Omnibus Law on Job Creation Law. This approach will help in understanding aspects of social justice, protection of workers' rights, and environmental impacts associated with the law. The results show that, although the Omnibus Law on Job Creation is designed for the public good with the aim of promoting economic growth and job creation, there are discrepancies with the principles of Islamic Law, particularly in terms of social justice, welfare, and protection of workers' rights. Some of the rules in this law tend to favor employers, which can be detrimental to workers and society, and contradict the concept of justice in Islam. In addition, the negative impact on the environment that may arise from the implementation of this law is also not in line with Islamic principles that emphasize the importance of preserving nature and the balance of the ecosystem.

Abstract

The professionalism of a legal professional is not only due to being competent, intellectual and successful in his field as a law enforcement officer, but the behavioral aspect is also part of the assessment that must be had in implementing the Code of Ethics or Legal Professional Ethics to uphold law and justice. However, if we look at the existing reality, there are still many legal practitioners who do not comply with the Code of Ethics for the Legal Profession. The research method in this journal uses normative juridical, which uses library-based secondary data sources. The results of this research are that the Code of Ethics for the Legal Profession must be obeyed (forced) even if it is not officially used as a regulation. Because Legal Professional Ethics has an important role in law enforcement which is also a manifestation of efforts to realize better law.

Abstract

Adoption refers to the act of taking a child who is not your biological child and making him your own child. The process of adopting a child must be carried out through legal procedures. When adopting a child, it is necessary to pay attention to existing law, namely from an Islamic legal perspective and from a state legal perspective. In this research, the law and the process of adopting a child are discussed according to Islam and state law. This research uses a library study method where the researcher relies on sources of information from literature as the main source. This research focuses on analyzing existing data or texts, not field data or information obtained directly from experience or eyewitnesses. Researchers only interact with sources available in the library or existing secondary data. The results of this study reveal the Islamic view of someone adopting a child and what laws apply in the process of adopting a child.

Abstract

In the practice of contract law, the fulfillment of promises and compliance with agreements are fundamental aspects to ensure justice and legal certainty. The principle of pacta sunt servanda which emphasizes the obligation to honor agreements has relevance to Islamic rules which also require the fulfillment of promises. This research uses normative legal research methods with a comparative juridical approach. Primary data sources are obtained from laws, government regulations, court decisions, and other relevant legal documents. While secondary data is obtained from books, journals, scientific articles, and other literature that discusses the principle of pacta sunt servanda, Islamic rules on promises, and contract law. Data collection techniques use literature study and document analysis, while data analysis techniques use qualitative analysis using the inductive method, and comparative analysis to compare the principle of pacta sunt servanda with Islamic rules of promise. The findings show that pacta sunt servanda and Islamic rules of promise have similarities in emphasizing the importance of commitment to the contract. However, there are differences in the application of these two legal systems, especially regarding exceptions and certain conditions such as force majeure and the principle of benefit in Islam. The principle of pacta sunt servanda and the Islamic rule of promise can complement each other in the practice of contract law, especially in the context of countries that apply legal pluralism. The application of these two principles encourages trust and stability in business transactions. This research recommends strengthening the legal framework that accommodates elements of contract compliance while taking into account aspects of substantive justice and relevant special conditions.

Abstract

Penelitian ini bertujuan untuk mengkaji implementasi hukum waris dalam Islam melalui studi komparatif tentang praktik waris di beberapa negara Muslim. Penelitian ini menggunakan metode deskriptif komparatif dengan mengumpulkan data melalui studi pustaka dan analisis terhadap literatur yang relevan. Beberapa negara Muslim yang menjadi objek studi meliputi Arab Saudi, Mesir, Indonesia, dan Malaysia. Negara-negara ini dipilih karena mewakili berbagai tradisi hukum Islam yang berbeda dan memiliki perbedaan dalam praktek waris mereka. Hasil penelitian ini menunjukkan bahwa meskipun ada kesamaan dalam prinsip-prinsip hukum waris dalam Islam, implementasinya dapat berbeda di setiap negara. Arab Saudi, sebagai negara yang menerapkan Syariah secara ketat, mengikuti sistem waris yang ditentukan dalam Al-Qur'an dan hadis-hadis Nabi Muhammad. Mesir, di sisi lain, memiliki sistem waris yang dipengaruhi oleh hukum nasional mereka yang terkadang bertentangan dengan prinsip-prinsip Islam. Indonesia dan Malaysia, yang menerapkan sistem hukum campuran, memiliki aturan-aturan waris yang mencakup prinsip-prinsip Islam namun juga mempertimbangkan faktor-faktor budaya dan adat istiadat setempat. Diharapkan hasil penelitian ini dapat menjadi dasar untuk memperbaiki dan mengembangkan sistem hukum waris di negara-negara Muslim, sehingga dapat mencapai keadilan sesuai dengan prinsip-prinsip Islam.
