Abstract

This study aims to analyze the role of the murabahah contract as a Sharia-compliant financing solution free from riba (usury) in meeting both consumptive and productive needs of the community. Murabahah, a sale contract with an agreed profit margin between Islamic banks and customers, has become one of the dominant instruments in the Islamic finance industry. This research adopts a qualitative descriptive approach through literature study. Data sources include books, scholarly journals, fatwas from the National Sharia Council of Indonesia (DSN-MUI), and reports from Islamic finance practitioners. The findings indicate that the murabahah contract is highly flexible in financing various needs, ranging from household consumer goods purchases to working capital financing for MSMEs. Furthermore, murabahah offers profit margin certainty and is free from riba, aligning with Sharia principles. Nevertheless, challenges remain in its implementation, such as the potential for practical deviations and the low public literacy regarding Sharia contracts. Therefore, strict supervision and continuous education are needed to ensure that murabahah truly serves as a fair and sustainable solution within the Islamic financial system.

Abstract

The implementation of the Salam contract in agricultural financing by Islamic banks in Indonesia serves as an alternative financing method aligned with Sharia principles. The Salam contract is a type of sale in which payment is made in advance, while the goods are delivered at a later date. This model is highly relevant in the agricultural context, as farmers require working capital before the harvest period. This study focuses on how Islamic financial institutions apply the Salam contract to support the agricultural sector, starting from the identification of farmers' needs, determination of price and product specifications, payment mechanisms, to the distribution of agricultural products. The challenges faced by Islamic banks in implementing the Salam contract include commodity price fluctuations, crop failure risks, uncertainty in harvest time, and limited risk management capacity. Furthermore, this study evaluates the extent to which the Salam contract instrument can address farmers' needs for fast, easy, and interest-free (riba-free) financing, as well as its contribution to enhancing national agricultural productivity.

Abstract

The implementation of the Musyarakah contract in business capital financing within Islamic banking in Indonesia plays a crucial role in supporting economic growth based on sharia principles. Through a qualitative approach and case studies on several leading Islamic banks, the research shows that Musyarakah is an effective profit-sharing financing instrument, capable of increasing business capital while strengthening the partnership between banks and customers. However, there are several challenges that need to be addressed, such as the complex management of business risks, the need for transparency in profit distribution, and ensuring that financing practices comply strictly with sharia regulations. To optimize the implementation of the Musyarakah contract, Islamic banks need to enhance their risk management capabilities and provide more intensive education to customers so they better understand the profit-sharing mechanism. Additionally, consistency in applying sharia principles is a crucial factor to ensure the sustainability and trustworthiness of Musyarakah-based financing. These findings contribute significantly to the development of more effective and sustainable sharia financing in Indonesia’s banking sector.

Abstract

This study aims to conduct a comparative analysis of the implementation of the wadiah contract in savings products at several Islamic banks in Indonesia and examine its impact on customer loyalty. Wadiah is a safekeeping (deposit) contract without compensation, commonly applied in Islamic banking savings products. This research uses a descriptive qualitative approach with case studies at three prominent Islamic banks: Bank Syariah Indonesia (BSI), Bank Muamalat, and Bank Mega Syariah. Data were collected through in-depth interviews with management and customers, as well as product documentation. The results show that the application of the wadiah contract varies in terms of transparency, hibah (bonus) incentives, and treatment of customer funds. These differences significantly affect customers' perceptions of fairness, comfort, and trust, ultimately influencing varying levels of customer loyalty. This study recommends standardizing the implementation of the wadiah contract to avoid sharia ambiguity and maintain public trust in Islamic banks.

Abstract

Mudharabah is one of the fundamental forms of business partnership contracts in Islamic economic jurisprudence, established between the capital provider (shahibul maal) and the entrepreneur or business manager (mudharib). In the context of modern Islamic banking, the mudharabah contract serves as a crucial instrument for both collecting and distributing customers' funds, while also representing the values of justice, transparency, and partnership in economic activity. The implementation of mudharabah in contemporary Islamic financial institutions often faces various challenges that warrant critical examination from the normative perspective of Islamic law. This study aims to thoroughly examine how the mudharabah contract is applied in modern Islamic banking practices and to evaluate its compliance with the principles of fiqh muamalah as established by both classical and contemporary Islamic scholars. The approach used in this study is descriptive-analytical, by exploring primary sources of Islamic law (the Qur’an and Hadith), secondary sources (including ijma’, qiyas, and fatwas issued by the National Sharia Council—DSN-MUI), as well as operational practices adopted by Islamic banking institutions in Indonesia and several other Muslim-majority countries. In practice, the mudharabah contract has undergone significant modifications to align with the demands of the modern and complex banking sistem.

Abstract

This study aims to analyze the practice of online buying and selling without ownership of goods (drop shipping) from the perspective of Islamic law. The main focus of this research is to assess the validity of contracts and ownership status in transactions conducted by business actors who do not directly own, control, or store the goods being sold. The research method used is qualitative with a normative-juridical approach, by reviewing secondary data in the form of classical and contemporary fiqh literature, fatwas of Islamic scholars, as well as regulations governing electronic commerce (e-commerce). The analytical technique used is descriptive-analytical, examining the compatibility of drop shipping practices with the principles of Islamic commercial law (muamalah). The results of the study indicate that drop shipping is permissible in Islam under certain key conditions, including transparency in the contract, absence of deceit or uncertainty (gharar), and the obligation of the seller to disclose that the product is shipped directly by a third party. If these conditions are met, the practice can be categorized as a valid wakalah bil ujrah or salam contract under Islamic law. Conversely, if there is any ambiguity or manipulation of information, the transaction may be considered impermissible (haram) or invalid.
