Abstract

This study aims to determine the legal protection for consumers of Indihome internet services who feel they have been harmed by the services provided by Indihome, then further discuss the liability of PT. Telekomunikasi Indonesia as a provider of Internet services to consumers who have sued the problem. This study uses a normative juridical method with a law approach, a case approach and a conceptual approach, with primary and secondary legal sources. The results of the study show that legal protection for consumers also includes consumer rights as regulated in Article 4 of Law Number 8 of 1999 and Article 45 of Law Number 8 of 1999. There are obstacles to damage or losses experienced by consumers related to the quality of services provided is the responsibility of PT. Telecommunications Indonesia as a business actor. In addition to demanding rights, consumers must also pay attention to their obligations such as reading or following information instructions and procedures for the use or utilization of goods and/or services, for the sake of security and safety which aims to prevent consumers from things that will harm consumers later. The form of responsibility of PT. Telekomunikasi Indonesia that is given to IndiHome consumers, namely providing compensation according to company regulations, providing compensation, resolving disputes regarding the implementation and/or interpretation of subscription contracts, are jointly resolved by PT. Telekomunikasi Indonesia and customers by deliberation

Abstract

Abstract Most of the residents of Baros village work in the agricultural and plantation sectors with most of the residents having education up to junior high and high school levels. Thus, they do not understand the law and technology that is currently developing due to their low educational background. Therefore, Baros Village needs socialization about the online legal assistance of nonlitigation in order towards a modern and justice village. The method used is in the form of socialization accompanied by counseling to the community, namely by providing explanations and discussions with the aim of activities that Baros villagers understand the importance of online legal assistance through non-litigation using current technology such as computers, laptops and hand phones. The results of the activities in the socialization turned out to be many Baros villagers who did not understand the existence of online legal assistance to resolve their cases outside the court such as negotiation, mediation, conciliation, and consultation. The village office must provide an internet network, computer or laptop for its citizens to learn technology in order to become a modern village. Abstrak Sebagian besar penduduk desa Baros bekerja di sektor pertanian dan perkebunan dengan sebagian besar warganya mempunyai pendidikan sampai tingkat SMP dan SMA. Sehingga mereka kurang memahami hukum dan teknologi yang berkembang saat ini dikarenakan latar belakang pendidikan yang masih rendah. Oleh karenanya, Desa Baros perlu adanya sosialisasi tentang pentingnya memahami teknologi dan hukum untuk dapat menyelesaikan sengketanya secara online dan melalui alternative penyelesaian sengketa diluar pengadilan atau non litigasi. Metode yang digunakan berupa sosialisasi disertai penyuluhan kepada masyarakat yaitu dengan memberikan penjelasan dan diskusi dengan tujuan kegiatan agar warga desa Baros memahami pentingnya bantuan hukum online melalui non litigasi dengan menggunakan teknologi saat ini seperti computer, laptop dan Hand phone. Hasil kegiatan dalam sosialisasi ternyata banyak warga desa Baros yang tidak memahami adanya bantuan hukum online untuk menyelesaikan perkaranya melalui diluar pengadilan seperti negosiasi, mediasi, konsiliasi, konseltasi. Kantor desa harus menyediakan jaringan internet, computer atau laptop untuk warganya belajar teknologi agar menjadi desa yang modern.

Abstract

Indikasi Geografis merupakan bagian dari Hak Kekayaan Intelektual dan juga merupakan hal penting yang dapat menaikkan reputasi terhadap suatu wilayah. Masyarakat Adat sendiri merupakan masyarakat yang hidup secara teratur yang menempati suatu wilayah yang memiliki tradisi serta keunikan tersendiri yang berbeda antara satu wilayah dengan wilayah lainnya. Indikasi Geografis dan Masyrakat Adat sendiri sangat berkaitan erat satu sama lain, dimana terdapat suatu persamaan diantara kedua hal tersebut yaitu sama-sama berkaitan dengan karakteristik dalam suatu wilayah. Tujuan dari penelitian ini yaitu untuk mengetahui hambatan apa saja yang dialami oleh Masyarakat Adat Baduy dalam mendaftarkan produk khasnya menjadi produk berindikasi geografis, serta upaya atau solusi apa yang dapat dilakukan untuk meminimalisir hambatan tersebut. Terkait dengan penelitian ini, metode yang digunakan yaitu metode Yuridis Normatif dengan menggunakan pendekatan perundang-undangan (statute approach) dan dalam proses pengumpulan data diperoleh melalui studi kepustakaan serta metode analisis data menggunakan metode deskriptif analitis. Hasilnya menunjukan bahwa Masyarakat Adat sendiri belum menjadikan perlindungan hukum terhadap produk yang dihasilkannya menjadi suatu kebutuhan maupun urgensi yang harus segera mendapatkan perlindungan.

Abstract

This research discusses the issue of Non-performing loan settlement for residential property developers amid the Covid-19 pandemic. The legal research used is a normative juridical method with a statutory approach. This research was conducted by making an inventory of primary and secondary materials to assess published legal issues. This research examines that the settlement of property developers' bad credit can be done by means of credit rescue and credit settlement. Credit rescue is carried out by providing easy conditions for debtors so that they are expected to complete their credit, which can be done by restructuring credit both inside and outside the court. Meanwhile, credit settlement is carried out by executing the collateral object made by the creditor, such as taking collateral, cessie, subrogation, execution of mortgage rights, lawsuit for default and bankruptcy. In the event of bad credit, creditors will generally choose the bankruptcy route to resolve bad credit by the developer. The bankruptcy of property developers will certainly be very detrimental to property consumers because the position of property consumers is only as concurrent creditors, which means that consumers will get the final payment after preferred creditors and separatists.

Abstract

Perkembangan teknologi yang semakin maju menimbulkan perubahan terhadap pola hidup masyarakat dalam banyak aspek, Salah satunya adalah munculnya aplikasi jual beli berbasis online atau e-commerce. Dengan adanya kemudahan tersebut ternyata terdapat permasalahan baru yang muncul, yaitu penyalahgunaan akun. Permasalahan yang akan dibahas dalam penelitian ini adalah mengenai faktor-faktor penyebab terjadinya penyalahgunaan akun dan perlindungan hokum konsumen pengguna e-commerce terhadap kasus penyalahgunaan akun dalam konstruksi Hukum Informasi dan Transaksi Elektronik (ITE). Penelitian ini menggunakan metode penelitian Yuridis-Normative. Hasil Penelitian menunjukan bahwa faktor-faktor penyebab terjadinya penyalahgunaan akun dibagi menjadi 2 (dua), yakni factor internal dan factor internal. Konsumen pengguna e-commerce berhak mendapatkan perlindungan hokum menurut Undang Undang Informasi dan Transaksi Elektronik dan Undang-Undang Perlindungan Data Pribadi. Bekaitan dengan hal tersebut, peneliti berpendapat bahwa diperlukan peran aktif dari konsumen, perusahaan penyedia platform aplikasi e-commerce, serta aparat penegak hokum untuk mencegah dan mengurangi angka jumlah korban penyalahgunaan akun di Indonesia.

Abstract

Kasus kepailitan yang diputus oleh pengadilan Niaga menyatakan perusahaan pengembangan properti pailit karena tidak mampu melunasi hutangnya hal tersebut berpotensi merugikan konsumen yang tengah terlibat dalam transaksi jual beli maka dari itu Perlindungan Konsumen sangatlah penting salah satunya upaya menjamin kepastian hukum untuk memberi perlindungan bagi konsumen. Bertujuan untuk memperingatkan konsumen agar lebih berhati-hati dalam memutuskan untuk membeli properti. Metode yang digunakan dalam penulisan ini yaitu yuridis normatif yang memfokuskan pada penerapan kaidah-kaidah atau norma dalam hukum positif. Kepailitan dijelaskan dalam undang-undang Nomor 37 tahun 2004 tentang kepailitan dan penundaan kewajiban Pembayaran utang. Dalam melindungi konsumen sesuai pasal 19 ayat 1 undang-undang Perlindungan Konsumen pelaku usaha bertanggung jawab memberikan ganti rugi atas kerusakan pencemaran atau kerugian konsumen yang terjadi pada konsumen. Dalam kasus ini perlu pembaharuan undang-undang tentang perlindungan konsumen serta konsumen yang ingin melakukan perjanjian agar lebih teliti.

Abstract

In the law embodied in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations, there isn't a requirement stipulating that a debtor must be declared unable (insolvent) to pay their debts through an insolvency test as a condition to determine their bankruptcy status or not. Instead, the debtor's bankruptcy status is established by proving that the debtor has a minimum of 2 (two) creditors, has failed to pay at least 1 (one) due and collectible debt. The absence of insolvency testing as a bankruptcy criterion in Indonesia could lead to companies that are actually capable of fulfilling their obligations being considered bankrupt because they meet the bankruptcy requirements in Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations regulates the requirements for bankruptcy. This has the potential for significant impact, even reducing the confidence of foreign investors to invest in Indonesia. This research employs a normative legal approach. The data source utilized in this study comprises secondary data obtained through the analysis of existing literature or documents. The results of insolvency testing, determining whether a company is categorized as insolvent or not, provide an opportunity for solvent debtors to prove that they have sufficient assets to settle debts to multiple creditors. This gives debtors the chance to rebuild their businesses. Therefore, the implementation of insolvency test in a company plays a role in saving solvent debtors from bankruptcy petitions filed by creditors.

Abstract

In the second quarter of 2020, Commercial Courts in Indonesia handled 132 bankruptcy cases. In the first semester of 2020, the number of bankruptcy cases handled by the Commercial Court in Indonesia increased to 233 cases, including 43 cases handled by the Central Jakarta Commercial Court. The aim of bankruptcy is basically to provide a solution to the parties if the Debtor stops paying/is unable to pay his debts. Bankruptcy prevents/avoids unfair actions that can harm all parties, namely: avoiding execution by creditors and preventing fraud by the debtor himself. Bankruptcy is a legal institution that has an important function, namely as the realization of two important articles in the Civil Code regarding the debtor's responsibility for the obligations carried out, namely Articles 1131 and 1132. This research aims to determine the validity of the bankruptcy petition submitted by workers to the compliance company. his rights. This research uses normative juridical legal research methods. In this research, what is emphasized is the aspect of law application which is carried out integrally with morality. The research results show that a worker's bankruptcy petition is a petition submitted by workers or labor unions to the commercial court to declare the company where they work bankrupt. A worker's bankruptcy application can be filed if the company does not pay wages, allowances and other rights that should be paid to workers.

Abstract

Peer to peer lending or online loans are online money lending services commonly known as financial technology, which currently generally take the form of applications. Online loans really help people who need fast and easy funds for both consumptive and productive purposes. This service is increasingly mushrooming in Indonesia due to interest from the community itself, resulting in the emergence of illegal online loan apllications which have a detrimental impact on consumers. The normative juridical method used in this research is conducting a literature study on secondary data. The research results show legal protection and the level of effectiveness of supervision for consumers who are harmed by illegal online loan applications.
