Abstract

Globalization and the Fourth Industrial Revolution have driven significant changes across various sectors, including technology, economics, and law. The rapid advancement of technology and internet access in Indonesia has led to a surge in the use of fintech services, particularly crowdfunding. Crowdfunding, rooted in microfinance and crowdsourcing, has become a popular method for raising funds via the Internet. Despite its innovative nature, crowdfunding practices in Indonesia face several challenges, particularly regarding regulation and legal protection. Current crowdfunding regulations in Indonesia still refer to Law No. 9 of 1961 on the Collection of Money or Goods, which does not accommodate electronic systems. This has resulted in the potential misuse of donation funds not being adequately addressed. This study employs normative legal research methods with a statute approach and a conceptual approach. The study examines the regulation of donation-based crowdfunding in Indonesia and compares it with Denmark, which has more detailed regulations through the Danish Fundraising Act. Denmark has implemented stringent oversight mechanisms to ensure transparency and accountability in fundraising activities, which can serve as a valuable reference for Indonesia in drafting similar regulations. Legal protection for donation-based crowdfunding practices is crucial to ensure public trust and the sustainability of these activities

Abstract

This study analyzes the legal protection and responsibilities for interns in Indonesia, particularly regarding stipends and working hours based on Indonesian labor laws. The legal uncertainty surrounding the protection of interns opens the potential for exploitation, an issue that has not been widely discussed in previous studies, especially in comparison with the legal system in Australia. Employing a normative juridical study method and a comparative analysis with the Australian legal system, this study reveals a significant gap between existing regulations and practices in the fields. This comparative approach provides a new perspective in building a more progressive legal framework to protect interns in Indonesia. The study findings highlight a substantial disparity between existing regulations and practical implementation regarding the protection of interns. Ambiguities in the regulations create loopholes for unfair practices, such as excessive working hours and inadequate wages for interns. Therefore, this study urges comprehensive legal reforms to promote fairer labor practices, improve welfare, and ensure justice for all interns. Key issues discussed include the lack of clear guidelines, inconsistent implementation regarding stipend calculations, and the flexibility of working hours, which opens up opportunities for intern exploitation. The study concludes that legal updates, especially in labor laws, are necessary, including specific provisions on work hour limits and minimum stipend standards to ensure adequate protection for interns and promote fair and decent work practices. Penelitian ini menganalisis perlindungan hukum dan tanggung jawab bagi pekerja magang di Indonesia, khususnya terkait uang saku dan jam kerja berdasarkan undang-undang ketenagakerjaan Indonesia. Ketidakpastian hukum mengenai perlindungan pekerja magang, membuka potensi eksploitasi yang belum banyak dibahas dalam penelitian sebelumnya, khususnya dalam perbandingan dengan sistem hukum di Australia. Menggunakan metode penelitian hukum yuridis normatif dan perbandingan dengan sistem hukum Australia, penelitian ini mengungkap adanya celah signifikan antara regulasi yang ada dengan praktik di lapangan. Pendekatan perbandingan ini memberikan perspektif baru dalam membangun kerangka hukum yang lebih progresif untuk melindungi pekerja magang di Indonesia. Hasil penelitian mengungkapkan adanya kesenjangan signifikan antara regulasi yang ada dengan praktik di lapangan. Ketidakjelasan dalam peraturan menciptakan celah bagi praktik-praktik yang tidak adil, seperti jam kerja yang berlebihan dan upah yang tidak layak bagi pekerja magang. Penelitian ini mendesak adanya reformasi hukum yang komprehensif untuk mendorong praktik ketenagakerjaan yang lebih adil, meningkatkan kesejahteraan, serta mewujudkan keadilan bagi seluruh pekerja magang. Isu utama yang dibahas termasuk peraturan mengenai tidak adanya pedoman yang jelas serta penerapan yang tidak konsisten mengenai perhitungan uang saku, dan fleksibilitas jam kerja yang sering kali tidak jelas menyebabkan terbukanya peluang eksploitasi bagi tenaga kerja magang. Penelitian ini menyimpulkan bahwa diperlukan adanya pembaharuan hukum terlebih pada undang-undang ketenagakerjaan yang mencakup ketentuan spesifik tentang batasan jam kerja dan standar minimal uang saku guna memastikan perlindungan yang memadai bagi pekerja magang dan mendorong penerapan praktik kerja yang adil dan layak.

Abstract

Underdeveloped regions have high potential for Solar Power Plants (PLTS), as data from the Institute for Essential Services Reform (IESR) indicates. The main challenges in developing PLTS in these areas are related to financing and the supply of solar panel materials. Therefore, the implementation of Presidential Regulation No. 105 of 2021 concerning the National Strategy for Accelerating the Development of Underdeveloped Regions for 2020-2024 (Perpres 105/2021) is necessary, mainly through the establishment of silica industry manufacturing companies to support PLTS and financing schemes such as Public-Private Partnerships (PPP) in PLTS development. The research problem focuses on how regulatory implementation in PLTS development can advance underdeveloped regions and how formulating the PPP financing scheme can support PLTS infrastructure development in these areas. This study aims to examine regulations in PLTS development that contribute to the progress of the remote regions and analyse the formulation of PPP financing schemes to accelerate PLTS infrastructure in underdeveloped areas. This study employs normative legal research using statutory, conceptual, and comparative approaches. The findings indicate that establishing silica industry manufacturing companies to support PLTS is essential, with various stakeholders’ support, as Perpres 105/2021 stipulated. Additionally, a specific PPP regulation is required to govern PPP schemes in underdeveloped regions.

Abstract

The high number of players in a game can be leveraged by certain individuals to make a profit. In games, there are digital items that can be bought and sold. For example, in the game Mobile Legends, there is something called diamonds. Besides being able to be purchased through Mobile Legends, diamonds are also widely sold in stores opened on Instagram. As its function, Instagram is a social media platform. Unlike Tokopedia or Shopee, which are E-Commerce platforms, Instagram does not have any responsibility for buying and selling activities that occur on its platform. This makes purchases through stores on Instagram more vulnerable to crimes such as fraud. Therefore, the existence of the Consumer Protection Law and ITE Law serves as protection for consumers who wish to engage in buying and selling transactions on social media platforms. This research used a normative juridical research method, wherein law served as the primary guide to examine theories and cases related to this study. The author used two approaches in conducting this research: the statutory approach and the case approach. The results of this study aimed to reveal that legal protection for consumers is regulated by consumer protection laws, thereby necessitating businesses to provide it to consumers.

Abstract

Public transportation, particularly buses, plays a vital role in community mobilization due to their flexibility and accessibility. While public transportation offers many benefits, its operation isn't always flawless, as evidenced by the continued occurrence of public transportation accidents, especially involving buses. This research aims to investigate the legal protection available to consumers who experience bus accidents and determine the responsibility of bus business operators towards accident victims in Guci, Tegal. The research employs a normative legal method (normative juridical) supplemented with interviews. The approach utilizes both a statutory approach and a case approach. The form of legal protection in the event of a bus accident has been regulated in the UUPK and UULLAJ. In this case, the PO Mitra Duta Sejati has not fulfilled its full responsibility because there is still one of the victims whose rights have not been fulfilled, namely the right to receive road maintenance when injured as a result of the accident and compensation to the families of the victims who died, this is contrary to paragraph 235 (1) and (2) UULLAJ. Therefore, the victim's family has the right to receive compensation from the PO Mitra Duta Sejati. The amount of compensation can be obtained from a court decision or amicably by way of agreement between both parties, this provision is based on article 236 paragraphs (1) and (2) UULLAJ. With this research, it is hoped that if passengers experience a bus accident, they will be able to know the form of legal protection and the form of responsibility of business actors.

Abstract

According to the Indonesian Constitution, general elections (Pemilu) must be held in order to transfer power from one administration to another. The public's perceptions are distorted as a result of the propagation of hoaxes during elections. In addition to undermining a nation's political stability, hoaxes can harm the standing of the candidates and political parties involved. They can also compromise the integrity of the democratic process. According to Presidential Regulation of the Republic of Indonesia Number 22 of 2023 concerning the Ministry of Communication and Information, the Ministry of Communication and Information is the body in Indonesia that oversees the regulation of information and communication on social media and online media. In this study, we will look at Article 3 of the Presidential Regulation of the Republic of Indonesia Number 22 of 2023, which relates to the Ministry of Communication and Information. According to this regulation, Kominfo is tasked with taking proactive measures to stop the propagation of false information ahead of the 2024 election. Normative approaches are used in this kind of research. The study's findings demonstrate that, in order to comply with Article 3 of the Presidential Regulation of the Republic of Indonesia Number 22 of 2023 concerning the Ministry of Communication and Information, the Ministry will likely employ three main strategies to address hoaxes that circulate during the 2024 election. These strategies include: (1) implementing digital literacy at all societal levels through the National Digital Literacy Movement (GNLD); (2) moderating, curating, and removing content that contains hoaxes; and (3) establishing an Election Monitoring Desk in coordination with the Republic of Indonesia Police and the Election Supervisory Body to conduct law enforcement against those who fabricate and disse.

Abstract

This study discusses the legal protection of consumers who are victims of phishing schemes in vehicle buying and selling transactions on the OLX digital platform. In the digital era, phishing is one form of cybercrime that is rampant and threatens consumer rights, both as sellers and buyers. Phishing schemes that occur on OLX are generally carried out by impersonating sellers or buyers in order to steal sensitive information and harm other parties financially. This study aims to examine the impact of phishing schemes on consumer rights and analyze the form of legal responsibility of OLX as a platform organizer if consumers experience losses. The method used in this study is normative juridical, with a relevant legal approach such as the Consumer Protection Law, the ITE Law, and the Personal Data Protection Law. The results of the study show that weak identity verification and the lack of monitoring mechanisms from the platform open up loopholes for cybercrime, and put consumers in a vulnerable position. Therefore, there needs to be regulatory updates and strengthening of the legal responsibility of digital platforms to ensure consumer protection in electronic transactions.

Abstract

Amid the wave of digitalization, the judicial system is required to adapt and innovate to provide faster, easier, and more efficient access to justice for the public. One rapidly evolving innovation is the implementation of Online Mediation (Online Dispute Resolution/ODR). According to Article 1 of the Supreme Court Regulation (PERMA) No. 1 of 2016, mediation is defined as a dispute resolution process conducted through negotiations between the disputing parties, assisted by a mediator to reach a mutual agreement. In the context of divorce cases, mediation is considered crucial as it may help reduce the high rate of divorce. The issuance of Supreme Court Regulation No. 3 of 2022 concerning Electronic Mediation further solidifies the status of online mediation as an official part of the dispute resolution mechanism within the court system. This research adopts a normative juridical approach and employs qualitative analysis through a case study of Divorce Petition No. 440/Pdt.G/2024/PA.Pct, relying primarily on secondary data sources.

Abstract

The rapid rise of online gambling in Indonesia stems from economic hardship, limited legal awareness, and the exploitation of digital technologies for illegal activities. This study aims to examine the accountability of the Ministry of Communication and Digital Affairs (Komdigi) in combating online gambling through a normative juridical approach. The central issue addressed is how Komdigi’s legal authority and strategic role are implemented in managing a secure digital space. The research applies a normative legal method by analysing relevant legislation and administrative practices. Findings indicate that Komdigi has exercised its mandate through AI-based detection systems, public reporting platforms, and inter-agency collaboration with the Financial Services Authority (OJK), the Financial Transaction Reports and Analysis Center (PPATK), and the National Police to block access and take enforcement actions. This research is novel in its mapping of cross-sectoral synergy, reflecting the state's collective effort to combat digital crime. The results show that blocking alone is insufficient, as gambling websites are highly adaptive. It recommends enhancing digital literacy, reinforcing social values, and regularly assessing blocking mechanisms for long-term prevention.

Abstract

This research aims to maximize the role of digital forensics in the discovery of electronic evidence and to understand the forms of accountability for online gambling offenders in Demak Regency. The method used in this research is normative juridical and descriptive-analytical. The findings from this research include the following: First, online gambling is a criminal act committed using electronic devices, thus requiring electronic data for its investigation. In this context, the role of digital forensics is essential to find and collect evidence to uncover online gambling cases in Demak Regency. The use of digital forensics in discovering electronic evidence in online gambling cases in Demak Regency can be conducted using the Integrated Digital Forensics Investigation Framework (IDFIF). This method consists of four stages: preparation, crime scene investigation, laboratory examination, and reporting. Second, the form of accountability for online gambling offenders is outlined in Article 27 paragraph (2) of Law No. 19/2016 on Amendments to Law No. 11/2008 on Electronic Information and Transactions. This article stipulates that any person who intentionally and without authority distributes or transmits electronic documents containing gambling content. The criminal penalties for violations of Article 27 paragraph (2) are specified in Article 45 paragraph (2) of Law No. 19/2016, which is a maximum imprisonment of 6 years and/or a maximum fine of Rp. 1,000,000,000.00.
