Abstract

This study specifically focusing on uncertainty and inconsistencies that faced on blood transfusion services caused by the existence of Blood Donor Unit and Blood Transfusion Unit led by existing norms on the statutory laws. The Act on Health, the Blood Service Government Regulation, and the Minister of Health Regulation No. 83/2014 assign blood services to the Blood Transfusion Unit. However, the existence of the Red Cross Law along with the Red Cross Government Regulation normalizes the task of providing blood services to the Blood Donor Unit, without confirming legal certainty for the Blood Transfusion Unit. This has triggered the issue of legal inconsistency towards those who carry out blood services, so a solution is needed through this study. This study is based on normative juridical legal research supported by a statutory approach as well as a legal conceptual approach. The results of this study are there are two options that can be formulated in the future, namely by basing the principle of legal preference lex posteriori derogate legi priori or based on the technique of formulating statutory norms according to the principle of clarity of formulation, certainty of the formulation of explanations, transitional provisions, closing provisions and phrases that selected in determining the executor of blood service duties.

Abstract

The agreement is made to undertake a treatment for an illness, which resulted in the conclusion of a therapeutic contract under Laws as regulated under Article 1233 of the Civil Code of Indonesia (Kitab Undang-Undang Hukum Perdata). Every legal relationship will result in rights and obligations. Medical malpractice is usually caused by an unfulfillment of a patient’s basic rights because of the lack of communication or information, which are the basic rights of a patient. The dispute settlement through court system is unsatisfactory for either patient or doctor. Therefore, a dispute settlement that is considered ideal is through non-litigation process, which is mediation, to achieve win-win solution. Procedures for mediators to mediate such malpractice dispute are in accordance to seven principles, which are also regarded as the seven bbaasic philosophies of mediation for medical dispute, which are known as the principle of Iknemook. The contents of the Iknemook principle for mediator in medical malpractice dispute settlement through mediation are the problems in this research. This research aims to assess and study the seven principles of Iknemook for mediator in medical malpractice dispute settlement through mediation. This research is categorised as a library research with a specification of descriptive research, which is presented to explain Iknemook principles for mediator in medical malpractice dispute settlement through mediation. This research finds that the principles comprised of the principles of good faith of both parties, trust, neutrality, exclusivity of a mediator (med-power), open-mind, autonomy, and confidentiality.

Abstract

The development of digital economy has led people to adapt to the use of services in information-technology-based loan or peer-to-peer lending. In early 2019, the V-loan case attracted attention of many people. The case has made debtors depressed, removed from their own houses, etc. Some debtors even were fired from works. In a case, the loan provider misused debtors’ personal data in debtors’ cell phones. The loan provider created WhatsApp groups containing all debtors’ contacts, including the debtors. Then, they uploaded pornographic content. Their objective was to defame debtors. Parties involved in loan agreement should adhere rules and arrange for reasonable loan. To discuss this matter, it is necessary to review agreement based on the Law on Electronic Information and Transaction and the Regulation of Financial Services Authority number 77 of 2016. The study focused on legal protection of parties involving in P2P lending activities. The credit agreement of peer-to-peer lending is considered valid if it is based on Article 47 of the Government Regulation number 82 of 2016. Standard contract must be based on Article 20 of the Regulation of Financial Services Authority number 77 of 2016. Electronic signature is also required based on Article 41 of the Regulation. In addition, the application of information technology and electronic transactions must be carried out based on the principles of legal certainty, benefits, good faith, and the freedom of choice of technology based on Article 3 of Law Number 19 of 2016. Principles and objectives are fundamental elements of legal certainty. Therefore, organizer and the government must protect user of peer-to-peer lending.Perlindungan Hukum Para Pihak dalam Perjanjian Kredit Online (P2P Lending) Studi Kasus PT Vcard Technology Indonesia AbstrakPerkembangan ekonomi digital menuntun masyarakat terhadap adaptasi penggunaan layanan dalam kegiatan pinjam meminjam uang berbasis teknologi informasi atau P2P lending. Kasus yang menyorot perhatian di awal tahun 2019 ialah kasus Vloan. Kasus ini membuat debiturnya tertekan, diusir dari rumah, bahkan sampai kehilangan pekerjaan dengan menyalahgunakan data pribadi yang ada pada ponsel debitur dengan cara membuat grup whatsapp berisi seluruh kontak pada ponsel debitur termasuk debitur itu sendiri kemudian melakukan penagihan yang tidak beretika dengan menyebarkan konten pornografi dan pencemaran nama baik. Para pihak seharusnya mengikuti aturan yang berlaku dan penyelenggara menghindari praktik penagihan yang tidak wajar. Untuk membahas hal tersebut perlu ditinjau perjanjian yang mengacu pada UU ITE dan POJK 77/2016 dan perlindungan hukum para pihak terhadap kegiatan P2P lending. Keabsahan perjanjian kredit P2P lending dinyatakan sah apabila memenuhi ketentuan yang diatur di dalam Pasal 47 PP 82/2016, kontrak baku yang disediakan oleh penyelenggara paling sedikit memuat ketentuan yang diatur di dalam Pasal 20 POJK 77/2016, dan tanda tangan elektronik juga wajib dipergunakan sesuai dengan ketentuan Pasal 41 POJK 77/2016. Selain itu, pemanfaatan teknologi informasi dan transaksi elektronik wajib dilaksanakan berdasarkan asas kepastian hukum, manfaat, itikad baik, dan asas kebebasan memilih teknologi/netral teknologi yang diatur di dalam Pasal 3 UU 19/2016, sebab asas dan tujuan merupakan kunci dari perbuatan hukum yang andal, khususnya dalam kegiatan P2P lending yang beroperasi menggunakan teknologi informasi dan komunikasi dan Perlindungan hukum pengguna tidak akan dapat dilindungi ketika tidak didukung oleh peran para pihak seperti penyelenggara, pengguna, dan pemerintah.Kata Kunci: Fintech, P2P Lending, Perlindungan Hukum https://doi.org/10.22304/pjih.v6n3.a5

Abstract

Legal politics examines changes within present law due to consistent demands and needs of people. Legal politics continue to develop the rule of law, from the Ius Constitutum, which is based on the previous legal framework, to the formulation of the law in the future, the Ius Constituendum. The Indonesian 2019 draft of Criminal Code formulates customary sanctions as the fulfillment of customary obligations in several articles. These articles provide a new paradigm of criminal law policy to formulate criminal law reform in the future for customary sanctions in cases of customary crimes. The study used normative juridical or library research on normative legal substances. It aims to reveal the truth based on scientific logic from the normative side by examining library materials or secondary data consisting of primary and secondary legal materials. The results show that the fulfillment of customary obligations can be expected to become criteria or signs/guidelines for judges to determine “law that lives in society” or “The Living Law” as a source of law (material legality) in the future. It is a form of new paradigm in the renewal of customary criminal law. Thus, customary (criminal) law can become (1) a positive source of law, in the sense that customary criminal law (sanctions) can be the legal basis to examine cases at the Court; and (2) negative sources of law, in the sense that the provisions of customary criminal law (sanctions) can be justified reasons, reasons for mitigating punishment or providing more severe punishment.Paradigma Baru Kebijakan Hukum Pidana dalam Formulasi Sanksi dalam Kasus Delik AdatAbstrakPolitik hukum mengkaji berbagai perubahan pada hukum di tengah masyarakat yang didasari tuntutan dan kebutuhan masyarakat yang senantiasa berkembang. Politik hukum berusaha meneruskan arah perkembangan tertib hukum, dari Ius Constitutum yang bertumpu pada kerangka landasan hukum yang terdahulu menuju pada penyusunan hukum di masa datang atau Ius Constituendum. Rancangan Undang-Undang Kitab Undang-Undang Hukum Pidana Tahun 2019 merumuskan ketentuan sanksi adat sebagai pemenuhan kewajiban adat dalam beberapa pasal. Pasal-pasal tersebut memberikan paradigma baru kebijakan hukum pidana dalam perumusan sanksi adat untuk kasus tindak pidana adat sebagai pembaharuan hukum pidana di masa yang akan datang. Kajian ini menerapkan metode yuridis normatif atau penelitian kepustakaan yang berkaitan dengan substansi hukum yang bersifat normatif. Metode ini dipilih untuk menemukan kebenaran berdasarkan logika keilmuan dari sisi normatif, dengan meneliti bahan pustaka atau data sekunder yang terdiri atas bahan hukum primer dan bahan hukum sekunder. Hasil penelitian ini bahwa perumusan Pasal 2 ayat (2) RUU KUHP tahun 2019 mengenai pemenuhan kewajiban adat dapat diharapkan menjadi kriteria atau rambu-rambu/pedoman bagi Hakim dalam menetapkan “hukum yang hidup dalam masyarakat” atau “the living law” sebagai sumber hukum (legalitas materiil) di masa yang akan datang sebagai bentuk paradigma baru dalam pembaharuan hukum pidana adat. Dengan demikian, hukum (pidana) adat dapat menjadi: (1) Sumber hukum yang positif, dalam arti hukum pidana adat (sanksi adat) dapat menjadi dasar hukum pemeriksaan perkara di Pengadilan Negeri; dan (2) Sumber hukum yang negatif, dalam arti ketentuan-ketentuan hukum pidana adat (sanksi adat) dapat menjadi alasan pembenar, alasan meringankan pidana atau memperberat pidana.Kata Kunci: hukum pidana, sanksi adat, tindak pidana adat.DOI: https://doi.org/10.22304/pjih.v8n2.a6

Abstract

In cases of terrorism involving minors, it must be understood that they are victims. Terrorism eradication regulations, which do not provide the possibility for diversion for children as manus ministra, need to consider the condition of the minors' psychological growth, which, of course, still has the potential to be of good value if properly nurtured. This study aims to determine the arrangement of the straf minima of minors as manus ministra in the crime of terrorism. The research method used is juridical normative or literature research related to normative legal substances, to find the truth based on scientific logic from a normative perspective by examining library materials or secondary data consisting of primary legal materials and secondary legal materials. The results of this study show that there are differences in the imposition of criminal sanctions for criminal acts of terrorism committed by a minor, namely Articles 19 and 24 of the Law on the Eradication of Criminal Acts of Terrorism. The Law on Combating Criminal Acts of Terrorism does not apply to minors who are involved in terrorism. This means that the general straf minima contained in the Criminal Code are used, namely for imprisonment to be imposed for at least 1 day. Article 19 and Article 24 of the Law on Combating Criminal Acts of Terrorism also abolish the provisions of the death penalty and life imprisonment for a person who is not yet 18 years old.

Abstract

Tugas psikolog forensik pada proses peradilan pidana adalah membantu pada saat pemeriksaan di kepolisian, di kejaksaan, di pengadilan maupun ketika terpidana berada di lembaga pemasyarakatan. Gerak psikolog dalam peradilan terbatas dibanding dengan ahli hukum. Psikolog dapat masuk dalam peradilan sebagai ahli sebagaimana disebutkan dalam ketentuan Pasal 120 ayat (1) dan Pasal 133 ayat (1) Undang-Undang Republik Indonesia Nomor 8 Tahun 1981 tentang KUHAP. Berdasarkan hal tersebut diperlukan promosi kepada bidang hukum akan pentingnya psikolog dalam permasalahan hukum sehingga dalam kasus-kasus pidana, ahli hukum mengundang psikolog. Tanpa undangan aparat hukum, psikolog akan tetap berada di luar sistem dan kebanyakan menjadi ilmuwan dan bukan sebagai praktisi psikolog forensik. Inti kompetensi psikolog adalah asesmen, intervensi, dan prevensi. Hal yang membedakan psikolog forensik dengan psikolog lainnya adalah konteks tempat ia bekerja. Psikolog forensik menerapkan kompetensi asesmen, intervensi, dan prevensinya dalam konteks permasalahan hukum. Seorang psikolog forensik dibutuhkan untuk melakukan pemeriksaan bagi pelaku kejahatan untuk dianggap mampu mengambil tanggung jawab atas tindakannya. Ketentuan dalam Pasal 44 ayat (1) Kitab Undang-Undang Hukum Pidana menyatakan bahwa menyatakan bahwa seseorang tidak dapat dipidana karena perbuatannya dan tidak dapat dipertanggungjawabkan kepada orang itu berdasar adanya gangguan kejiwaan seorang pelaku. Dengan adanya psikolog forensik, seseorang yang diduga melakukan suatu tindak pidana benar-benar dapat ditelaah terlebih dahulu, apakah benar-benar bersalah atau tidak, dan melalui psikologi forensik dapat ditentukan hukuman apa yang paling sesuai terhadap pelaku tindak pidana tersebut. Abstract

Transportation is one of the derivative needs in society due to economic, social activities, and so on. In general, there are two transportations, namely based on conventional and online, but the problem is that discrimination often occurs against providers of online-based transportation services, especially in transporting passengers. Thus, the purpose of this study is to find out the legal protection for online transportation service providers in transporting passengers and to find out the legal consequence of discriminating against online transportation service providers in carrying passengers. The method used in this study is normative legal research method. Meanwhile, the legislative and conceptual approach is the approach used in this study. The results of this study showed that the legal protection of online transportation service providers in Indonesia is regulated in legislation including the 1945 Constitution of the Republic of Indonesia which in principle every legal subject must be treated equally before the law, and Law Number 39 Year 1999 which protects that every person is entitled to a job, and legal protection is also contained in Law No. 8 of 1999 which in principle regulates the rights and obligations of business actors. The legal consequence of discrimination is that it can result in criminal and civil law in the form of compensation for imprisonment or fines.

Abstract

State-owned Enterprise PT.PLN (persero) App Bali made a tender on travo 150/20 jobs. The tender was won by PT. Global Twin Star, in it’s work there are disputes in the contract agreement. So from this dispute the author takes the formulation of the problem as follows. How to resolve disputes between the two sides. The second is how the implementation of the settlement results through negotiations. The purpose of the writer is to know and analyze how the results of the settlement through negotiations and also find out whether this implementation is very relevant for both parties each achieved. Agreement made and agreed by PT. PLN (Persero) with PT. Twin Star applies as a law for both parties or called the principle pacta sunt servanda. Settlement through Alternative Dispute Resolution is based on the spirit of win-win solution. Therefore, taking into account future interests, then from the parties to the dispute there must be a desire to maintain their good relationship. Implementation obtained is a continuous relationship of work between the two sides. Where the PT. Global twin star gets additional work from PLN to maintain existing transformer and owned PT.PLN. PLN's transformer is well maintained until the work is done. In a business dispute the parties prefer to avoid to resolve their dispute through the courts. setlement of specific defaults disputes and business disputes in general to be resolved through atlernative negotiated settlement disputes. This is because the company's good name is maintained, cost and time are also more efficient if through this path. The result of dispute resolution through alternative dispute resolution, able to merely render the objectives of the law itself, namely justice, certainty and benefit.Keywords: Dispute Settlement, Wanprestasi, Negotiation.

Abstract

The negative impact of the development of the tourism industry, information technology and communication and transportation in addition to problems of poverty, unemployment, dropping out of school, and limited employment is still an unresolved problem, thus further encouraging the Commercial Sex Exploitation of Children. Through strengthening Desa Adat and regulating child protection in awig-awig or pararem regarding strengthening the position of children in Bali by incorporating the concept of local wisdom will certainly be able to reduce the number of sexual violence and child exploitation in Bali, so that synergy in solving positive legal cases will be easier effective, because if a case occurs, it will be resolved first within the scope of the village through prevailing customary law before continuing into the realm of positive law. Arranging and determining Awig-awig who adopt local wisdom concepts and values including Tri Hita Karana, Tri Kaya Parisudha, and Tat Twam Asi are able to reflect religious, ritual and upakara elements in preventing sexual violence and exploitation of children.

Abstract

Sosialisasi protokol kesehatan semakin digencarkan oleh pemerintah, hal ini dilakukan untuk menekan angka pasien COVID-19. Dengan dilakukannya pembentukan Tim SATGAS COVID-19 di setiap Desa untuk membantu pemerintah dalam memberikan edukasi kepada masyarakat. Di Desa Penatahan Tim SATGAS COVID-19 berfokus kepada para lansia dalam memberikan edukasi mengenai protokol kesehatan, al ini dilakukan karena para lansia memiliki keterbatasan dalam mengakses media sosial. Sehingga agar mendapatkan informasi dan pemahama yang pasti mengenai hal tersebut, perlu adanya edukasi secara langsung kepada lansia. Dengan menerapkan strategi pendekatan persuasif fan edukatif agar tercapainya hubungan timbal balik yang seimbang dari proses sosialisasi kprotokol kesehatan. Metode pelaksanaan yang diguakan adalah dengan wawancara dan melakukan observasi langsung kelapanga unutk memperoleh data yang valid.
