Abstract

This study analyzes criminal law enforcement in handling cigarette traders without excise stamps, a crucial issue in protecting state revenue and promoting economic justice. Selling cigarettes without excise stamps violates Law Number 39 of 2007 on Excise, which prescribes imprisonment and/or fines for offenders. Such practices harm the state fiscally, distort fair competition, and lower public compliance with the law. The research applies a normative legal method focusing on positive legal norms (law in the book), using statute, conceptual, and case approaches. Data were collected through library research and analyzed qualitatively by interpreting relevant laws, legal theories, and case studies. Findings show that criminal sanctions, as stipulated in Article 54 of Law Number 39 of 2007, are essential in curbing the illegal cigarette trade. Law enforcement agencies namely the Directorate General of Customs and Excise, the Police, and the Prosecutor’s Office play a vital role in supervision, investigation, and prosecution. However, effectiveness remains limited due to resource constraints, weak inter-agency coordination, low legal awareness, and economic motives among small traders. Improving enforcement requires stronger institutional cooperation, digital surveillance, continuous legal education, and economic empowerment for traders to transition to legal products. Consistent and fair enforcement is expected to enhance deterrence, increase compliance, and support state fiscal protection.

Abstract

This study explores the application of kasepekang, the most severe customary sanction in Balinese traditional law, and its implications for land rights over pedruwen desa, particularly Pekarangan Desa (PKD) and Ayahan Desa (ADS). The sanction of kasepekang is imposed on individuals or families who commit serious violations of awig-awig or pararem desa, leading to the loss of their status as members of the customary village (krama desa). This loss of status results in the forfeiture of rights to PKD and ADS lands, which are often inherited and cultivated for generations. Such practices raise complex issues when examined under Indonesia’s national agrarian law, as the Basic Agrarian Law No. 5 of 1960 and Government Regulation No. 24 of 1997 explicitly safeguard long-term land tenure and constitutional rights guaranteed under Article 28H of the 1945 Constitution. The objective of this research is to analyze the concept of kasepekang in Balinese customary law, evaluate its compatibility with national agrarian principles, and formulate a harmonization framework that allows the enforcement of customary sanctions without violating constitutional protections. Employing a normative legal method with statutory, conceptual, and comparative approaches, this study applies Philipus M. Hadjon’s Theory of Legal Protection, Gustav Radbruch’s Theory of Legal Certainty, and John Rawls’ Theory of Justice. The findings confirm that while kasepekang is legitimate within customary law as an instrument of social and religious order, it cannot be extended to revoke PKD and ADS land rights. The novelty of this study emphasizes restricting kasepekang to socio-religious domains, supported by clear mechanisms for mediation and rehabilitation, thereby ensuring legal certainty while preserving the integrity of customary law within the national legal system.

Abstract

Necrophilia, the act of engaging in sexual activities with corpses, remains an unregulated legal and ethical issue in Indonesia. The absence of specific legal provisions creates challenges in law enforcement and societal protection. This study analyzes the legal gaps in handling necrophilia cases and proposes reforms to ensure proper criminalization and deterrence. Using a normative legal research method, this study relies on library resources, including books, journals, and legal documents. Case studies help examine the legal and social implications of necrophilia. The findings reveal that necrophilia is not explicitly regulated under the Indonesia’s Criminal Code, leading to inconsistent legal responses and unclear punitive measures. While such acts violate societal norms and laws, their legal categorization remains ambiguous. A comparative analysis of international legal frameworks highlights the need for Indonesia to strengthen its laws. Countries like the UK and the U.S. classify necrophilia as a sexual crime, ensuring stricter penalties. The absence of similar provisions in Indonesia underscores a critical gap in the country’s criminal law, requiring urgent reform. Addressing this gap will reinforce legal protections and uphold societal values regarding the dignity of the deceased. It is recommended that Indonesia incorporate specific laws against necrophilia, drawing from international best practices, to ensure comprehensive legal enforcement and deterrence.

Abstract

This study examines the legal analysis of imposing criminal sanctions on online gambling perpetrators from the perspective of the Electronic Information and Transactions Law (UU ITE). The development of information technology has shifted the modus operandi of gambling from conventional to digital, creating complex legal challenges in criminal law enforcement in Indonesia. The purpose of this study is to analyze the criminal law provisions for online gambling crimes under the ITE Law and to assess the effectiveness of imposing criminal sanctions on online gambling perpetrators. The method used is normative legal research with a statutory approach and a conceptual approach, by adopting primary legal materials in the form of the Criminal Code, Law No. 1 of 2024 concerning the Second Amendment to the ITE Law, as well as secondary legal materials in the form of literature, journals, and related research results. The results of the study indicate that the regulation of online gambling crimes is covered in Article 27, paragraph (2), and Article 45, paragraph (2) of the ITE Law with a maximum prison sentence of 6 years or a maximum fine of IDR 1 billion. However, the effectiveness of law enforcement still faces obstacles in the aspects of evidence, cross-country jurisdiction, and limited resources of law enforcement officers. This study concludes that it is necessary to strengthen regulations, increase the capacity of law enforcement, and coordinate between institutions to increase the effectiveness of imposing criminal sanctions on online gambling perpetrators in Indonesia.

Abstract

Freedom of the press in Indonesia is constitutionally guaranteed under Article 28F of the 1945 Constitution as a vital pillar of democracy and freedom of expression. However, this freedom is often misused by individuals posing as journalists to commit extortion, thereby undermining the integrity of the press. This study aims to analyze the form of criminal liability imposed on individuals who abuse the journalist profession to conduct extortion accompanied by threats, as regulated in Article 368 of the Indonesian Criminal Code. Using a normative legal research method with a literature-based approach, this study examines legal doctrines, scholarly works, and relevant legislation, including the Press Law and the Criminal Code. The findings indicate that the principle of lex specialis derogat legi generali cannot be applied to such cases because extortion is a general crime, not a press dispute. Therefore, criminal liability falls entirely under the jurisdiction of general criminal law, not the Press Law. The study concludes that the misuse of journalistic attributes as tools for extortion eliminates press privilege and must be prosecuted as an ordinary criminal offense to safeguard press integrity and uphold legal certainty.

Abstract

This study examines the legal status of recordings obtained without consent as evidence in adultery cases, particularly in relation to the tension between legal certainty and the right to privacy. The main problem lies in the absence of clear legal standards governing the admissibility of such evidence, which creates uncertainty in judicial practice. This research aims to analyze the validity of unauthorized recordings as evidence and to assess their implications for privacy protection within the Indonesian legal framework. The study employs a normative juridical method using statutory and conceptual approaches, focusing on relevant regulations such as the Criminal Procedure Code, the Electronic Information and Transactions Law, and the Personal Data Protection Law, as well as constitutional court decisions. The findings indicate that although such recordings may be considered as supporting evidence under certain conditions, their use raises serious concerns regarding violations of privacy rights. The lack of consistent legal interpretation further complicates their admissibility in court. Therefore, clearer legal guidelines are necessary to balance evidentiary needs with the protection of fundamental rights.

Abstract

This study examines the criminogenic factors that influence theft offenses leading to murder and analyzes the criminal liability of the offender based on Decision of the Denpasar District Court Number 619/Pid.B/2025/PN Dps. The research focuses on the escalation of theft into violent crime resulting in loss of life, which reflects the complex interaction between individual and environmental factors in criminal behavior. This research aims to identify the criminogenic factors underlying the crime and to evaluate their relation to criminal responsibility under Indonesian criminal law. The study employs normative legal research using statutory, case, conceptual, and analytical approaches. Legal materials were collected through library research and analyzed descriptively and qualitatively. The findings show that economic pressure, unstable psychological conditions, and situational circumstances significantly contributed to the offender’s actions. Although the offender initially intended to commit theft, the situation developed into fatal violence during the commission of the crime. Nevertheless, the offender remains criminally liable because the element of fault is fulfilled under criminal law. Criminogenic factors may be considered by judges in sentencing, but they do not eliminate criminal responsibility.

Abstract

This study examines legal pluralism in the regulation of customary criminal law through a comparative analysis of Indonesia and South Africa. Using a normative legal method with conceptual, comparative, and statutory approaches, it explores how both countries integrate customary criminal law into their national criminal justice systems. The findings show that both jurisdictions reflect a post-colonial commitment to legal pluralism by incorporating restorative justice grounded in indigenous legal traditions. Indonesia recognizes customary criminal law through Articles 2 and 66 of the New Criminal Code, while South Africa does so through Section 211 of the Constitution and the Traditional Courts Act. Although both systems seek to promote restorative justice and reduce recidivism, they differ in their institutional design and implementation. Indonesia adopts a hierarchical model in which customary sanctions supplement state law, whereas South Africa grants greater autonomy to customary courts. The study recommends implementing comprehensive Government Regulations and harmonizing Regional Regulations in Indonesia to strengthen legal certainty. It also recommends revising South Africa's Traditional Courts framework to improve judicial oversight, gender representation, and evidentiary standards while ensuring compliance with constitutional human rights protections.
