Abstract

Abstract. The implementation of diversion in Deli Serdang Regency based on Law No. 11 of 2012 concerning the Child Criminal Justice System and Deli Serdang District Decree No. 2283 of 2016 concerning the Implementation Team of the Diversity and Restorative Justice Forum in Handling Children in Conflict with the Law in Deli Serdang Regency is an effort made to achieve the diversion goal optimally in the form of avoiding detention, avoiding labeling as a criminal, proposing interventions needed by victims or the perpetrators without going through a formal process and avoiding children from following the criminal justice process in order to avoid the negative influence and implications of the process. Abstract

Point of this study is as follows: (a) What are the legal rules for the protection of children as victims of trafficking in persons, (b) What are the factors causing the crime of trafficking in women and children in North Sumatra, (c) What are the policies carried out by the women's empowerment office? and children in North Sumatra in preventing and overcoming traffickers against children. The type of research in this writing is normative legal research. Normative or doctrinal legal research, namely legal research that uses secondary data source research. The results of the research and discussion in this study are: The Legal Rules for the Protection of Children as Victims of Trafficking in Persons are as follows: (a) Law Number 23 of 2002 concerning Child Protection; (b) Law of the Republic of Indonesia Number 21 of 2007 concerning Eradication of the Crime of Trafficking in Persons; (c) Law No. 35 of 2014 concerning Amendments to Law No. 23 of 2002 concerning Child Protection; (d) North Sumatra Province Regional Regulation Number 3 of 2014 concerning the Implementation of Child Protection. Factors Causing the Crime of Trafficking in Women and Children in North Sumatra: Several factors that cause child trafficking include the following: (a) Poverty; (b) Low Education Level; (c) Victims of Parental Divorce; (d) Early Sexual Experience; (e) Job Seekers. Policies in overcoming criminal acts of protecting people are carried out in three ways, namely: (a) Primary Prevention, (b) Secondary Prevention, (c) Tertiary Prevention.

Abstract

This paper aims to examine the rule of law regarding law violations by motorcycle gangs, to examine the role of the Brimob Police Corps and the obstacles faced in overcoming law violations by motorcycle gangs. The problem is focused on how the law rules regarding law violations by motorcycle gangs, what is the role of the Brimob Police Corps and the obstacles faced in overcoming law violations by motorcycle gangs. To approach this problem, Soerjono Soekanto's role theory is used. The data were collected through interview guidelines and analyzed qualitatively. This study concludes that the criminal act of violating the law by motorcycle gangs is contrary to Article 170 regarding crimes against public order, Article 351, Article 352, Article 368 regarding persecution and Article 510 and Article 511 regarding violations of public order in the Criminal Code, contrary to Article 106 and Article 115 in the Law of the Republic of Indonesia Number 22 of 2009 concerning Road Traffic and Transportation. The role of the Brimob Police Corps in overcoming violations of the law by motorcycle gangs can be seen by using Soerjono Soekanto's theory based on aspects of role as a norm, role as an individual/norm, and role in the social structure of society. The constraint factors faced by Brimob are that the perpetrators of violations are minors, the lack of parental supervision of their children and the actions of motorcycle gangs usually involve a large number of people.

Abstract

The spread of narcotics which has spread to various levels of society and remote villages has reached children whose thinking abilities are still low. In the decision of the panel of judges not to apply diversion which refers to Article 12, Article 52 paragraph (5) of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This study aims to determine the legal protection of children as narcotics abusers. The research method used is a normative juridical research with analytical descriptive character. The approach method used in this research is the case approach to the statutory approach which is carried out by examining the provisions of the applicable legislation. The analysis was carried out qualitatively. The results of the study indicate that the legal protection carried out against children as narcotics abusers in Indonesia based on Law No. 11 of 2012 concerning the Juvenile Criminal Justice System has been regulated starting from the process of investigation, arrest, detention, prosecution, examination in court and correctional. The Medan District Court has tried to carry out the legal protection process for children as narcotics abusers by referring to Law No. 11 of 2012 concerning the Juvenile Criminal Justice System. Juvenile Judges seek to realize the legal protection process by fulfilling children's rights during the examination process, as well as seeking settlement of cases through diversion. However, the efforts of juvenile judges in the legal protection process for children are still not maximized.

Abstract

This paper aims to examine and analyze the rule of law, law enforcement and criminal policy against criminal acts without the right to control sharp weapons. To approach this problem, the theory of the legal system is used. The data were collected through interview guidelines and analyzed qualitatively. This study concludes that the rule of law regarding law enforcement against criminal acts without the right to control sharp weapons in demonstrations is regulated in Emergency Law Number 12 of 1951 in Article 2 paragraph (1), Law no. 9 of 1998 concerning Freedom to Express Opinions in Public in Article 16, Perkapolri No. 7 of 2012 concerning Procedures for the Implementation of Services, Security, and Handling of Public Opinion Cases in Article 8 letter j. Law enforcement against criminal acts without the right to control sharp weapons in demonstrations against the Criminal Code Bill at the Medan District Court is carried out through investigations, prosecutions and judges' decisions. The criminal law policy against people who carry sharp weapons in Medan City consists of a penal policy carried out by legally processing the perpetrators, followed by examining the defendants at trial. Non-penal policies as a preventive measure for criminal acts without the right to control sharp weapons are counseling, raids and community participation.

Abstract

Perdagangan narkotika dewasa ini sangat mengkhwatirkan. Anak-anak yang notabene generasi penerus sebagai penentu kemajuan bangsa, terlibat dalam tindak pidana narkotika. Anak tidak hanya selaku penyalahguna, namun juga sebagai kurir dalam perdagangan narkotika. Hal ini tentu sangat memprihatikan, sehingga seluruh pemangku kepentingan (stake holder) harus berperan dalam melakukan pencegahan tindak pidana narkotika pada anak. Tindak Pidana narkotika mendapat ancaman pidana penjara dan denda yang berat. Inilah yang harus disadari oleh masayarakat, khususnya di daerah mitra, yaitu kelurahan Bantan Timur. Selain menyadarkan ancaman pidana, pendidikan hukum juga memberi tips agar anak tidak terlibat dalam tindak pidana narkotika, baik itu sebagai penyalahguna maupun kurir. Tentunya efektifitas dari tips pencegahan tersebut akan sangat ditetukan oleh lingkungan anak itu sendiri.

Abstract

One of the narcotics criminal acts which is quite interesting to study is someone who knows that there is a narcotics crime as regulated in Article 131 of Law No. 35 of 2009 concerning Narcotics. Abstract

The application of punishment to minors as perpetrators of criminal acts of obscenity in the judge's decision does not provide a sense of justice for minors and their families as victims of obscenity. This study discusses the sentencing of minors as perpetrators of criminal acts of obscenity in cases of obscenity against child victims who are both underage in Decision Number 8/Pid.Sus.Anak/2016/PN.Trt and Decision Number 9/Pid .Sus.Anak/2016/PN.Trt dated September 6, 2016. It was concluded that the imposition of punishment on child perpetrators for the obscenity case in the Tarutung District Court Decision did not fulfill the sense of justice in a balanced manner according to the principle of proportional equality (distributive justice). Considerations for treatment and rehabilitation, as well as utility are not balanced, only for child actors. Child perpetrators are subject to maatregel, but child victims are not recovered from their trauma. Fines, compensation of any kind are not imposed on child perpetrators or their families for the costs of recovery, treatment, rehabilitation of child victims. Alternative legal sanctions for the parents of the perpetrator's child should be subject to civil liability for compensation. In order to have a deterrent effect and special prevention for parents, be careful, alert and control their children from criminal acts, continuous supervision, provide them with formal and non-formal education, and so on. The right to compensation should also be handed down by the court judge to the perpetrator even though it was not requested in the public prosecutor's indictment

Abstract

The legal arrangements regarding diversion for children who have committed criminal acts are contained in several laws and regulations, government regulations, regulations of the Supreme Court which have regulated the procedures for implementing diversion for children who have committed criminal acts. In Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which has explained about diversion, namely as in Article 1 point 7 states that diversion is the transfer of settlement of juvenile cases from the criminal justice process to processes outside of criminal justice The results of this research can be seen, the legal basis for diversion is regulated in Law Number 11 of 2012 concerning the Criminal Justice System for Children, Government Regulation Number 65 of 2015 concerning the Implementation of Diversion and Handling of Children who are not 12 (twelve) years old, and Regulations Supreme Court Number 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Criminal Justice System. And in these laws and regulations, the objectives of diversion are stated in article 6 of Law Number 11 of 2012, namely: achieving peace between victims and children, resolving cases of children outside the judicial process, preventing children from being deprived of liberty, encouraging the public to participate , and instill a sense of responsibility in children

Abstract

In Law No. 11 of 2012 concerning the Juvenile Criminal Justice System, it is regulated regarding the obligations of law enforcers to seek diversion (settlement through non-formal channels) before entering all stages of the legal process. For cases of criminal acts committed by children, Restorative Justice at least aims to repair or restore criminal acts committed by children with actions that are beneficial to children, victims and their environment that involve them directly (reintegration and rehabilitation) in solving problems. This research is a normative juridical research with analytical descriptive nature. The technique of collecting secondary data was obtained by means of a literature review (Library Research), while the primary data was obtained directly in the field using the interview method. Data analysis was carried out qualitatively.
