Abstract

Tulisan ini bertujuan untuk mengkaji dan meneliti terkait bagaiamana penegakan hukum terhadap para pembuat konten dalam penggunaan lagu di media sosial. Metode penelitian hukum yuridis normatif dengan pendekatan analisis dengan menggunakan ketentuan perundang-undangan yang relevan dengan permasalahan yang dibahas. Hasil studi menunjukkan bahwa salah satu fenomena yang cukup sering ditemukan di internet khususnya di berbagai platform media sosial adalah pelanggaran hak cipta  yang dilakukan oleh para pembuat konten dalam penggadaan ulang dan mempublikasikan karya cipta lagu milik Pencipta lagu atau musisi, tanpa menyadari pentingnya aturan hak ekonomi dan hak moral terkait hak cipta lagu. Akibat maraknya pelanggaran yang terjadi mengenai hak cipta khususnya mengenai lagu, tidak sedikit peran dari para musisi ataupun pencipta lagu yang menginginkan pembaharuan terkait peraturan hak cipta khususnya dalam penggunaan karya lagu di media sosial.  Adapun dalam penelitian  ini akan membahas tentang apa bentuk pelanggaran hak cipta yang dilakukan oleh para pembuat konten dalam penggunaan lagu di media sosial dan bagaimana bentuk penegakan hukum bagi para pembuat konten dalam penggunaan lagu media sosial. Bahwa  berdasarkan hasil analisis, dapat ditarik kesimpulan menjadi penting untuk dibuat dalam peraturan pemerintah yang secara spesifik mengenai ketentuan hak cipta dalam penggunaan lagu di media sosial yang kaitannya dengan hak ekonomi dan hak moral.

Abstract

The protection of trade secrets plays a vital role in safeguarding a nation’s competitive edge, particularly amid globalization and economic integration. Indonesia has enacted a legal basis through Law No. 30 of 2000; however, its practical enforcement still encounters obstacles related to legal certainty, law enforcement, and procedural consistency. This research examines the protection of trade secrets in Indonesia by comparing it with Taiwan and the United States, while also exploring the possible adoption of best practices to enhance national competitiveness. The study employs a normative juridical method combined with a comparative approach and regulatory analysis, relying on literature reviews of legislation, international instruments, and relevant scholarly works. The findings suggest that incorporating best practices—such as preliminary injunctions, whistleblower immunity, stricter sanctions, and improved inter-agency collaboration—could significantly strengthen trade secret protection in Indonesia. Recommendations are directed toward the Directorate General of Intellectual Property (DGIP), the Ministry of Trade, and the Supreme Court to develop technical guidelines, establish a dedicated task force, and provide information security training for businesses, thereby aligning Indonesia’s trade secret protection framework with global standards.

Abstract

The development of financial technology has led to the emergence of ICS as a solution to the limited access to formal credit still experienced by underbanked communities and MSME players in Indonesia. This study aims to analyze the role of ICS in increasing financial inclusion and to examine the implementation of POJK 29/2024 in supporting the optimization of ICS for MSMEs. The research method employed is normative legal research, utilizing a legislative and conceptual approach. The results demonstrate that ICS plays a crucial role in expanding credit access by leveraging AI and ML-based alternative data, thereby reaching underbanked communities and MSMEs that lack a formal credit history. In addition, POJK 29/2024 provides legal certainty and a more comprehensive governance framework for the implementation of alternative credit, particularly in relation to licensing, supervision, and consumer protection. Banks are expected to optimized the use of ICS in the credit assessment process to improve access to financing for MSMEs while continuing to apply the principle of prudence.

Abstract

Kasepuhan Karang is one of the Sundanese indigenous communities located in the Lebak Regency, Banten Province, Indonesia. This community is part of a network of kasepuhan around the Gunung Halimun Salak National Park (TNGHS). Their lives are closely related to environmental sustainability, especially in the management of customary forests. The social and cultural systems of the Kasepuhan Karang community reflect harmony between humans and nature. These values are reflected in customary traditions such as ngaseuk (planting), customary spatial planning that divides the area into restricted forests, production forests, and agricultural land, as well as tatali paranti (customary rules) that serve as guidelines for maintaining ecosystem sustainability. This study focuses on the importance of the Kasepuhan Karang Customary Forest in the context of environmental conservation and climate change mitigation. In addition, this study will identify the main challenges faced in preserving customary forests, including policy aspects, cross-sectoral understanding, and external pressures that threaten their sustainability. By prioritizing the perspective of indigenous peoples as the primary managers of the forest, this study aims to provide an overview of how synergy between local traditions and modern policies can be realized to support sustainable development.

Abstract

Criminal liability is based on the perpetrator's awareness and ability. However, Indonesian criminal law still experiences a normative gap because it does not regulate the blood alcohol concentration (BAC) limit as an objective parameter for assessing the ability to be responsible. As a result, judges' assessments are subjective and lead to disparities in decisions. This normative-comparative research aims to analyze the gap in the BAC norm in Indonesia by comparing it to the German criminal law system. The method used is normative legal research with a legislative, conceptual, and comparative approach, using literature study data. The results show that Germany sets a BAC limit of 0.3–1.09‰ for relative impairment and ≥1.1‰ for complete loss of ability, while Indonesia does not have a similar standard. The novelty of this research lies in the formulation of a concept for determining a measurable and applicable alcohol level limit in Indonesia, namely the proposed addition of Article 38A to the National Criminal Code with a BAC limit of 0.03%–0.1%. This determination is recommended to realize legal certainty, proportionality, and substantive justice in the Indonesian criminal law system.

Abstract

Intellectual Property Rights, particularly trademarks, play a vital role in strengthening business identity and competitiveness within the increasingly competitive culinary sector. However, many MSMEs have limited knowledge of the urgency of trademark protection and its registration procedures, making them vulnerable to business imitation risks. This community engagement program was conducted to support the culinary MSME “Nasi Bebek Albisri” in understanding the strategic benefits of trademark registration while providing direct assistance throughout the application process. The method used included counseling sessions consisting of material presentation, interactive discussions, and hands-on guidance during the preparation and submission of trademark documents to the Directorate General of Intellectual Property (DJKI). The results indicate a significant improvement in the MSME’s understanding of trademark functions, legal protection benefits, and administrative procedures involved in registration. Furthermore, the program successfully accompanied the MSME in completing its official trademark filing, thereby enhancing its business competitiveness and ensuring legal protection for its brand identity.

Abstract

There are often cases where irresponsible individuals create social media accounts using other people's personal identities as if the account is the original account of the person whose identity is being used, hereinafter referred to as fake social media accounts. Such actions can be threatened with Article 35 jo. Article 51 paragraph (1) of Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE Law). The type of research used by the author in this study is prescriptive normative law research with a statute approach and a case approach. In Verdict Number 1739/Pid.Sus/2020/PN Jkt.Brt, the defendant was declared guilty of committing a crime under Article 28 paragraph (1) jo. Article 45A paragraph (1) ITE Law. Not only fulfilling the elements in Article 28 paragraph (1) of the ITE Law, but the defendant also fulfilled the elements in Article 35 of the ITE Law. However, the defendant was not found guilty of a criminal offense under Article 35 of the ITE Law, even though Article 35 of the ITE Law was one of the prosecutor's indictments. Based on this research, the defendant was not found guilty of a criminal offense under Article 35 of the ITE Law because  the form of the indictment in Verdict Number 1739/Pid.Sus/2020/PN Jkt.Brt is less precise. The form of indictment used by the public prosecutor is an Alternative Indictment where ideally the public prosecutor ought to use Cumulative Indictment on a concursus realis crime that the defendant committed.
