Abstract

Kasus kekerasan seksual sebagian besar korban pelecehan seksual berada di bawah usia 18 tahun Anak-anak yang mengalami pelecehan tidak selalu melaporkannya segera. Kekerasan seksual terhadap anak merupakan salah satu bentuk pelanggaran hak asasi manusia yang paling serius, dengan dampak jangka panjang pada korban, baik secara fisik, psikologis, maupun sosial. permasalahan kekerasan seksual pada anak terus meningkat, namun akses keadilan bagi korban masih terbatas, terutama pada anak terus meningkat, namun akses keadilan bagi korban masih terbatas, terutama bagi kelompok rentan yang tinggal di wilayah perkotaan padat penduduk seperti Kelurahan Manggarai, Tebet, Jakarta Selatan. Tingginya angka kekerasan seksual terhadap anak serta sulitnya akses keadilan mendorong urgensi pengembangan platform pelaporan yang dapat menjawab kebutuhan korban dan memberikan akses keadilan yang lebih baik. "LindungiKita" bagi korban kekerasan seksual pada anak di Kelurahan Manggarai merumuskan Permasalahan prioritas yang dihadapi mitra adalah Tidak ada wadah penerapan teknologi yang memudahkan pelaporan jika terjadi tindak pidana kekerasan seksual terhadap anak. Oleh karena itu, Wadah Penerapan teknologi yang memudahkan proses pelaporan bagi masyarakat yang mengalami atau menyaksikan kekerasan seksual terhadap anak. Platform LindungiKita menjadi aplikasi yang mudah dan detail guna memudahkan akses kapan saja dan dimana saja untuk melakukan pelaporan kasus kekerasan seksual. Kondisi di Kelurahan Manggarai pertama, Tingkat Kesadaran Masyarakat: Kesadaran masyarakat mengenai kekerasan seksual terhadap anak dan cara melaporkannya masih rendah. Platform digital seperti aplikasi dan website dapat digunakan untuk menyebarkan informasi dan meningkatkan pengetahuan masyarakat tentang hak-hak anak dan prosedur pelaporan. Kedua, Kendala dalam Pelaporan: Banyak korban dan keluarga merasa terhalang untuk melapor. Dengan teknologi, seperti aplikasi pelaporan anonim, korban dapat melaporkan kejadian tanpa takut akan stigma atau pembalasan.

Abstract

This research aims to explore and contribute to the understanding of the misuse of the veto power in resolutions for international conflict resolution. The focus is on describing the challenges arising from the use of the veto power in the UN Security Council, often prolonging conflicts without a definitive resolution. The research methodology employed is juridical normative with descriptive analysis, referring to provisions in the UN Charter and other reliable literature. The findings highlight that the abolition of the veto power in the UN Security Council could serve as a solution for more effective conflict resolution. Prolonged international conflicts result in significant losses, especially for civilians, while the UN, as the largest international organization, frequently fails to resolve these conflicts. The main issue lies in the rejection of resolutions by veto-wielding states, leading to the failure of these resolutions and the continuation of conflicts. Structural reforms within the UN are crucial to enhance its performance in conflict resolution to prevent further casualties. The unbridled use of the veto power, based on the geopolitical considerations of certain states, slows down the conflict resolution process. Additionally, the power disparity between veto-wielding states and other members contradicts the principle of sovereign equality enshrined in the UN Charter. Therefore, clear criteria must be established for the use of the veto power in peace resolutions to ensure that conflict resolution is not hindered by purely geopolitical interests.

Abstract

This article examines the application of restorative justice theory as an alternative approach to resolving human rights violations in two complex conflicts: the Rohingya crisis in Myanmar and the Syrian civil war. Both cases highlight the limitations of international legal frameworks and retributive justice in addressing large-scale violations, including genocide, forced displacement, and systemic discrimination. Restorative justice, emphasizing victim recovery, offender accountability, and community reconciliation, offers a more inclusive and sustainable solution to these crises. In Myanmar, the Rohingya community has faced decades of systemic persecution, culminating in military operations in 2017 that forced over 700,000 people to flee, primarily to Bangladesh. In Syria, the prolonged civil war since 2011 has caused widespread displacement and destruction, leaving over 8.6 million people internally displaced by 2022. Traditional mechanisms, such as International Court of Justice (ICJ) proceedings and United Nations interventions, have been hindered by political obstacles and enforcement challenges. This study explores the potential of restorative justice in both contexts, focusing on mechanisms such as inclusive dialogues, reparations, and reconciliation. Drawing on theoretical frameworks by Howard Zehr, Johan Galtung, and John Braithwaite, the article proposes practical applications for rebuilding trust and addressing the root causes of the conflicts. The findings suggest that restorative justice can not only address the immediate needs of victims but also foster long-term peace and stability by transforming social relationships and reducing the likelihood of recurrent violence. By shifting the focus from punitive measures to holistic recovery, this approach offers valuable insights into the resolution of modern humanitarian crises..

Abstract

The Islamic Boarding School Mahasantri Institute Dirosat Al-Amien Prenduan is part of the Indonesian state that instils multicultural values. Where the students come from various cultures, but they live in harmony with several types of educational programs that are implemented and implemented by the kyai and lecturers. It is very urgent in this research because all students live harmoniously without conflict because they accept all existing cultures with full support from educators. Meanwhile, the findings of this research are to understand the basic concepts of multicultural education, know about the implementation of multicultural education in Islamic boarding schools, and describe the supporting factors and obstacles to the implementation of multicultural education in these Islamic boarding schools. This research is qualitative research with the type of case study research; in collecting data, this research uses interviews, observation and documentation. Meanwhile, in analyzing this data, the researcher uses data reduction, presentation, and conclusion. So that this research gets a conclusion as follows: first, multicultural education is an effort created in society to respect each other between tribes and customs that each person has. Second, the implementation of this multicultural education is carried out in consulate parade activities, groups of students and recitation of Islamic religious books. In contrast, the supporters of this implementation include teaching and learning activities for 24 hours, and the obstacles are students' disobedience to regulations and lack of awareness of educational multicultural. values

Abstract

Refugees, especially refugee children, are a group of people who are particularly vulnerable to human rights violations. Children, who lack the problem-solving skills of adults, are often victims of violence and exploitation due to conflict, war and political issues. Especially refugee children will only become inhumane victims. This research aims to examine the importance of legal protection and fulfillment of human rights for refugee children so that their rights can be protected from various forms of crimes against humanity. This research uses the Normative Juridical research method by analyzing international regulations (protocols) applied by UNHCR in protecting refugee children. The results of this study indicate that legal protection and fulfillment of human rights for refugee children is a priority scale that will support their survival. So that the legal protection and fulfillment of human rights for refugee children is an effort to reduce the risk of refugees to crimes that make it easier for them to take part in it or even become victims of a crime. The recommendation of this research is the need for increased international cooperation to protect the rights of refugee children more effectively.

Abstract

The dynamic state of democracy and the challenges of election administration place the General Election Supervisory Agency (Bawaslu) as a key institution in safeguarding democratic integrity in Indonesia. This study employs a qualitative-descriptive approach using literature review and document analysis to examine Bawaslu's role in the context of international engagement, particularly through its involvement in the Global Network on Electoral Justice (GNEJ). The findings reveal that Bawaslu’s active participation in GNEJ especially its election as President of GNEJ for the 2022–2023 period, following its previous role as Regional Vice President for Asia has significantly strengthened Indonesia’s institutional diplomacy on a global scale. This leadership position has enabled Bawaslu to promote Indonesia’s electoral justice system and foster cross-national collaboration toward fair and inclusive electoral justice. The successful organization of the 5th Plenary Assembly of GNEJ stands as a strategic milestone reflecting Bawaslu’s commitment to regional and global democratic advancement. The study concludes that Bawaslu’s presidency in GNEJ not only enhances the institution’s international image but also creates avenues for inter-state cooperation in building more effective and just electoral oversight systems. Collaboration and the spirit of mutual support serve as essential foundations in addressing the complexities of electoral issues and in strengthening human resource capacities. Bawaslu RI demonstrates that a state institution can play a constructive diplomatic role in advancing shared democratic objectives at the global level.   Kondisi demokrasi yang dinamis dan tantangan dalam penyelenggaraan pemilu menempatkan Badan Pengawas Pemilu (Bawaslu) sebagai lembaga yang strategis dalam menjaga integritas demokrasi di Indonesia. Studi ini menggunakan pendekatan kualitatif-deskriptif dengan metode studi kepustakaan dan dokumentasi untuk menganalisis peran Bawaslu dalam konteks hubungan internasional, khususnya dalam jaringan Global Network on Electoral Justice (GNEJ). Temuan utama menunjukkan bahwa keikutsertaan aktif Bawaslu dalam GNEJ, terutama saat dipercaya menjadi Presiden GNEJ periode 2022–2023 setelah sebelumnya menjabat sebagai Wakil Presiden Regional Asia, memperkuat posisi diplomasi kelembagaan Indonesia di ranah global. Momentum tersebut dimanfaatkan Bawaslu untuk mempromosikan sistem peradilan pemilu Indonesia dan mendorong kolaborasi lintas negara dalam memperjuangkan keadilan pemilu yang inklusif dan adil. Penyelenggaraan 5th Plenary Assembly GNEJ menjadi salah satu capaian strategis yang menunjukkan komitmen Bawaslu terhadap penguatan demokrasi regional dan global. Simpulan dari studi ini menegaskan bahwa posisi Bawaslu sebagai Presiden GNEJ tidak hanya meningkatkan citra kelembagaan di tingkat internasional, tetapi juga membuka ruang diplomasi antarnegara dalam membangun sistem pengawasan dan peradilan pemilu yang lebih efektif. Kolaborasi dan semangat gotong royong menjadi fondasi utama dalam menghadapi kompleksitas kepemiluan dan tantangan peningkatan kapasitas SDM. Bawaslu RI menunjukkan bahwa lembaga negara dapat berperan aktif sebagai instrumen diplomasi demokrasi yang konstruktif di tingkat global.

Abstract

Hukum Humaniter Internasional memiliki fokus penting pada perlindungan anak dalam situasi konflik. Meskipun demikian, implementasi perlindungan ini di daerah konflik, seperti di Palestina, sering terabaikan. Kajian ini menyoroti hambatan konkret yang menghambat perlindungan anak sesuai norma hukum internasional, terutama dalam konflik yang berlarut-larut. Pelanggaran hak anak, seperti penggunaan anak dalam pertempuran, serangan terhadap lembaga pendidikan dan sarana medis, serta dampak psikologis traumatis, menunjukkan kesenjangan antara prinsip-prinsip HHI dan realitas lapangan yang tak memberikan perlindungan memadai bagi anak-anak. Konflik di Palestina telah mengakibatkan bencana kemanusiaan, dengan ribuan anak tewas atau terluka. Anak-anak yang selamat juga menghadapi dampak serius pada kesehatan mental dan kesulitan akses ke layanan dasar. Konflik ini menunjukkan perlunya perlindungan yang lebih besar bagi anak-anak di tengah kekerasan perang dan ketidakpastian hukum.

Abstract

The European Union (EU) issued a regulation on deforestation, known as the European Union Deforestation-Free Regulation (EUDR), which has caused upheaval in the global commodity industry. Starting December 31, 2020, the EUDR regulation enforces due diligence on companies placing goods linked to deforestation and forest degradation on the EU market. These goods include beef, chocolate, coffee, palm oil, rubber, soy, and timber. Under the EUDR, these seven commodities and their related products must meet requirements related to deforestation and forest degradation to be sold or exported to the EU market.According to Roscoe Pound, a legal expert from the Sociological Jurisprudence school of thought, law should be viewed as a social institution that functions to meet societal needs. He argued that the task of legal science is to develop a framework that maximizes the fulfillment of social needs so that the law can serve as a means of social change. Therefore, a legal study on the application of the EUDR to Indonesia's trade with the EU should assess whether it aligns with the principles of law formation according to Roscoe Pound's Sociological Jurisprudence perspective.

Abstract

The European Union Deforestation Regulation (EUDR), implemented in 2023, requires transparent supply chains to prevent imported products from contributing to illegal deforestation, presenting both challenges and opportunities for Indonesia as a leading exporter of palm oil and timber. This study explores how natural law principles, emphasizing ecological justice and the moral balance between humans and nature, can serve as an ethical foundation to meet EUDR requirements. By integrating these principles into policy reforms such as enhancing the Indonesia Sustainable Palm Oil (ISPO) certification, investing in green technologies, and fostering international collaboration, Indonesia can overcome economic barriers and lead in sustainable trade.

Abstract

Penelitian ini membahas penerapan hukum internasional dalam sistem hukum nasional Indonesia serta tantangan teoritis dan praktis yang menyertainya. Fokus utama kajian ini adalah posisi hukum internasional dalam hierarki norma hukum Indonesia dan kendala dalam proses integrasi ke dalam peraturan perundang-undangan nasional. Menggunakan metode yuridis normatif dengan pendekatan konseptual dan analisis kritis, penelitian ini mengkaji dokumen hukum primer seperti UUD NRI 1945, UU No. 24 Tahun 2000, dan perjanjian internasional yang diratifikasi Indonesia. Hasil penelitian menunjukkan bahwa Indonesia cenderung menganut pendekatan dualisme, dengan kewajiban ratifikasi formal oleh DPR untuk mengadopsi hukum internasional ke dalam hukum nasional. Namun demikian, terdapat berbagai hambatan seperti tumpang tindih norma hukum, resistensi ideologis, rendahnya pemahaman hukum internasional di kalangan aparatur negara, serta lemahnya implementasi di tingkat daerah. Selain itu, ketiadaan norma konstitusional yang eksplisit mengenai status hukum internasional menimbulkan ambiguitas dalam penerapannya. Penelitian ini merekomendasikan reformasi normatif, peningkatan literasi hukum, serta kolaborasi antara pemerintah pusat dan daerah guna menjamin harmonisasi antara hukum nasional dan komitmen internasional Indonesia.
