Abstract

Indonesia is a country that until now has not have a single law laws specifically regulating the protection of personal data. Lately there have been many cases in the community regarding the misuse of personal data. Especially with the increasingly easy public access to the internet so that the misuse of personal data through electronic media will spread quickly. In the field of health services, the patient's personal data cannot be separated from the possibility of abuse. It would be even more dangerous if the personal data is a trace of the patient's medical record which is indeed highly confidential. The use of Information and Communication Technology (ICT) in health services aims to improve access, efficiency, effectiveness, and quality of medical processes that involve medical service organizations in hospitals, clinics, health centers, medical practitioners both doctors and therapists, laboratories, pharmacies, insurance also involving patients as consumers. However, in the process of service using the E-health program, it will collect a number of consumer personal data which is sensitive personal data and lead to new legal issues, namely the extent to which the health service provider can protect patient personal data can be accessed, disseminated more easily through the progress of ICT. So far, the existing regulations have not provided maximum protection for patient personal data because the arrangements are still sectoral and are scattered in several laws and regulations.

Abstract

The majority of Indonesians make their living from farming, which requires a lot of area to grow crops. To produce fresh land for farmers, a small amount of forest must be cleared. The cost of land cannot be increased by cutting down and burning trees and forests, according to the legislation. However, there are several exceptions to local rules, such as burning up to 2 hectares of land per family head, growing local kinds, and encircling themselves with fire traps to prevent disease transmission, but not to the environment. The study's goal was to examine into the involvement of local sages in land clearance, forest burning, and land burning, as well as the establishment of land clearing operations against police officers who broke local laws. This research method combines a legal (sculpture) and a conceptual approach. The findings demonstrate the importance of local wisdom in large-scale forest fire prevention through constitutional acknowledgment of local wisdom.

Abstract

Indonesian inheritance law is still pluralistic, meaning that it is governed by several legal systems, namely customary inheritance law, Islamic inheritance law and civil inheritance law. The formulation of various types of inheritance laws was due to the needs of the people at that time to respond to the various types of interests they faced, so that their legality was officially justified by the country's constitution for its application until now, without unification of laws. related to inheritance law, to fulfill the legal needs of the Indonesian people now and in the future in order to build a just and prosperous society based on Pancasila and the 1945 Constitution. This legal research uses empirical legal research, which gets references from primary legal materials, namely: Legislation, Judge's Decision. Secondary legal materials, namely: law books, and legal dictionaries. Tertiary legal materials, namely: Big Indonesian Dictionary. The plaintiff stated in the argument for his lawsuit that is posita (pundamentatum petendi) number 3, arguing that under the Plaintiff's rights were obtained from the late Nurhabibah who was married to Anuar with 6 sons and 1 daughter, the plaintiff should argue the plaintiff's civil ties with Sahbudin, Ilham, Herman, Syafaruddin , Muhammad Suheru, Lilinah (Defendant II) and withdrew as a Party in this case with the intention of clarifying the problem and distribution of inheritance (legacy), because the plaintiff could not dissolve the plaintiff's civil ties with 7 heirs and only revoked 1 part in this case and has not involving 5 disputing parties so that the lawsuit has a plurium litis consortium divide defect factor. The law of succession in the concept of civil law is one of the provisions that controls humans and humans in terms of inheritance (heritage). Not only that, the law of inheritance affects property if it is not finalized so that it will lead to disputes between the heirs.
