Abstract

Regional autonomy refers to the authority that regulates the community's interests or acts as a regulator in areas where the federal government empowers local governments to manage their own government. This research technique utilizes five book sources in order to learn about regional autonomy, its various forms, and legal foundations. Community engagement in governance, particularly at the village level, is one of the foundations of regional autonomy that requires attention in this regard. Concerning the village government system's role in development implementation, many village development initiatives have been conceived and determined primarily on considerations and techniques from above, without involving the community being developed.

Abstract

The violence in the family is frequently difficult to detect, and the public paradigm continues to assume that something happens in the family is private. The presence of Laws number 23 of 2004 on the elimination of domestic violence is expected to protect state citizens from unsettling senses and forms of violence, but the number of incidents of domestic violence in everyday life instantly increases. As the Writer will examine the function of Laws number 23 of 2004 prohibiting domestic violence in providing protections for state citizens, particularly those who are victims of domestic abuse. By focusing on the following questions: Is it sufficient to safeguard state citizens who are victims of domestic violence? and What should be done to reduce the number of domestic violence cases in Indonesia? The conclusion drawn by the author is that Laws number 23 of 2004 prohibiting domestic violence have been sufficient to protect victims and offer an elementary level of protection to law enforcement. However, its implementation must be coherent and systematic, not only with the country according to its instruments of power, but also with the population that supports the eradication of domestic violence.

Abstract

Corruption is a product of the attitude of life of a group of people who use money as a standard of truth and as absolute power. Corruption has been going on for a long time, since the times of Ancient Egypt, Babylonia, Rome until the Middle Ages and until now. The purpose of this study is to determine the eradication of corruption and law enforcement in terms of the perspective of legal philosophy as a philosophy of implementing positive law in Indonesia. This study is normative legal research with descriptive method which explains that this legal research is carried out using primary legal materials, secondary legal materials and tertiary legal materials. Philosophy of Law which is the basic foundation of thinking in the application of any applicable legal rules and is considered in many branches of science gets special attention on the enforcement of corruption which should be done in eradicating corruption so that enforcement is not only based on written rules alone in eradicating but the eradication of corruption animates law enforcement in enforcement of corruption, written laws can be regulated, but these rules can be implemented by the implementers so that when the rules apply at the time of a criminal act of corruption, they can be in line with what has been written in the laws and regulations.

Abstract

Social stratification is a system in the social order that divides individuals into social classes. Finally, the social class will differentiate both the level and the rights and obligations of each individual in the class. The basis and core of a social stratification system is that there is an imbalance in the acquisition of rights and obligations, as well as responsibilities, between each individual and group in a series of social systems. The purpose of this research is to examine how law is applied at every level of society in Indonesia. This article was written using a qualitative technique, and it is designed to provide theoretical and practical usefulness to the community. According to the discussion, a social stratification system is one in which there is a distinction between one class or groups in standardized classes. Furthermore, there is evidence that there is a disparity between class stratification and law enforcement in Indonesia. As a result, law enforcement should be carried out in line with the applicable laws that have been jointly agreed upon in order to avoid creating a new long-term problems.

Abstract

This study aims to find out the relationship between two different field, namely law and information technology, which both aim to improve human welfare. This study employs normative research, which entails evaluating or analyzing secondary data derived from primary, secondary, and tertiary legal materials, which is then assessed descriptively, comparatively, and qualitatively before being encouraged to provide answers to the issues under consideration. Law along with the growth of social life, while information technology exists when the human need for a better life is so important. Thus, the law is needed to control the use of information technology in every side of human life. On the other hand, information technology is needed to help implement the law properly, because of human limitations in collecting and processing so much information. Information technology continues to grow rapidly, expanding into other fields, but this growth is not accompanied by control rules in its application. Generally, in Indonesia laws and regulations regarding the application and use of information technology are slow, and when a law is launched the challenges of legal backwardness are already evident. The legal technology perspective tries to look at things that might be taken into consideration in understanding the possibilities of resolving the lagging laws and regulations compared to the growth of information technology.

Abstract

Tax collection is a series of actions so that the tax insurer pays off tax debts and tax collection costs by admonishing or warning, carrying out instant and simultaneous collections, notifying forced letters, proposing prevention, carrying out confiscations, carrying out hostages, selling confiscated goods. In accordance with the tax system adopted by Indonesia, the Directorate General of Taxes functions as a supervisory agency or implementation of tax obligations. In carrying out this guidance and supervision function, it is carried out through research, examination of tax assessments and collections. To conduct this research, it is carried out by using a normative approach, namely by examining the data on legal materials in the form of Law Number 19 of 2000 concerning Tax Collection by Forced Letters. In Indonesia, the implementation of tax collection with a forced letter based on law number 19 of 2000 which is carried out at the tax service office is not an arbitrary act but is based on a strong legal basis. The implementation of tax collection by force letter is a form of execution without a judge's regulation (which is the authority of the tax authorities) which is usually called direct execution. In the case of tax collection, the forced letter is notified by the tax bailiff with a statement and submission of a copy of the tax letter to the tax guarantor.

Abstract

 The research objectives to be achieved in this study are to find out, analyze and find solutions in overcoming legal fraud. Interfaith couples prefer to marry in Indonesia. Considering that it is more cost-effective and their desire to get married can be carried out and implemented in Indonesia. On the other hand, there is no legal protection to provide guarantees for the implementation of interfaith marriages in Indonesia. So some couples commit a fraudulent marriage law by ignoring the requirements in the national marriage law. The research method in this research is a normative research method by examining every applicable marriage law rule and legal theories that will answer and provide a solution in providing a discourse on understanding law and marriage and its relationship with the concept of divinity. Based on the data above, the results of the analysis find that interfaith married couples abroad have cheated Indonesian marriage law on interfaith marriages that occur abroad. After holding an interfaith marriage abroad, the artist couple returns to Indonesia and registers the interfaith marriage at the Population and Civil Registry Office. However, considering that their marriages are of different religions, the Population and Civil Registry Service does not immediately register interfaith marriages. According to the population administration, a valid marriage according to the legislation must be reported by the resident to the implementing agency at the place where the marriage took place no later than 60 (sixty) days from the date of the marriage.Tujuan penelitian yang akan dicapai pada penelitian ini yaitu untuk mengetahui, menganalisis dan mencari solusi dalam mengatasi pengelabuan hukum perkawinan pasangan beda agama lebih memilih melangsungkan perkawinan di Indonesia. Mengingat lebih irit biaya dan keinginan mereka untuk menikah dapat terlaksana dan terimplementasikan di Indonesia. Di sisi lain bahwa tidak ada perlindungan hukum untuk memberikan jaminan untuk terlaksananya perkawinan beda agama di Indonesia. Beberapa pasangan melakukan suatu pengelabuan hukum perkawinan dengan mengabaikan bagian syarat dalam hukum perkawinan nasional. Metode penelitian dalam suatu suatu penelitian ini digunakan suatu metode penelitian normatif dengan mengkaji setiap aturan hukum perkawinan yang berlaku serta teori-teori hukum yang akan menjawab serta memberikan suatu solusi dalam memberikan wacana pemahaman hukum serta perkawinan dan hubungannya dengan konsep ketuhanan. Berdasarkan data diatas maka hasil analisis menemukan bahwa pasangan menikah beda agama di luar negeri telah melakukan pengelabuan hukum perkawinan Indonesia atas perkawinan beda agama yang terjadi diluar negeri. Setelah melangsungkan perkawinan beda agama diluar negeri pasangan artis kembali ke Indonesia dan mencatatkan perkawinan beda agama tersebut pada kantor Dinas Kependudukan dan Catatan Sipil. Namun mengingat perkawinan mereka berbeda agama, Dinas Kependudukan dan Catatan Sipil tidak langsung serta merta mencatatkan perkawinan beda agama. Menurut administrasi kependudukan perkawinan yang sah menurut peraturan perundangundangan wajib dilaporkan oleh penduduk kepada instansi pelaksana di tempat terjadinya perkawinan paling lambat 60 (enam puluh) hari sejak tanggal perkawinan.
