Abstract

This study examines the characteristics of digital transaction disputes in online buying and selling and evaluates the mechanisms for resolving these disputes based on Islamic law principles. The rapid development of digital technology has significantly transformed commercial activities in Indonesia, yet it has also contributed to a sharp increase in consumer complaints, particularly in e-commerce transactions. Secondary data from Bank Indonesia and the Ministry of Trade indicate that more than 90% of consumer complaints from 2022 to 2025 originated from online transactions, demonstrating the vulnerability of digital consumers to misinformation, delivery issues, unilateral cancellations, fraud, and product mismatch. Using a qualitative method with a normative legal approach complemented by conceptual, statutory, and empirical analysis, this study investigates the legal framework governing digital transactions and compares it with the principles of fiqh muamalah. Findings reveal that most disputes arise from violations of fundamental Islamic contractual principles, including uncertainty (gharar), unclear object of contract (ma’qud ‘alaih), imbalance of information, and failure to uphold honesty and good faith. While positive law provides consumer protection through the Consumer Protection Law and the Electronic Information and Transactions Law, its implementation remains limited, particularly in resolving digital disputes. Islamic law, through principles of justice (‘adl), transparency, prevention of harm, and amicable settlement (shulh), offers a comprehensive foundation for fair and efficient dispute resolution. The study concludes that integrating these Islamic legal principles within modern Online Dispute Resolution (ODR) mechanisms can enhance legal certainty, consumer protection, and ethical standards in digital commerce.

Abstract

This study examines the reform of Islamic constitutional law through the Maqasid alShariah approach from the perspective of Jasser Auda. Reform of Islamic constitutional law in the contemporary era faces complex challenges related to the adaptation of sharia principles to the dynamics of modernity, democracy, and respect for human rights. The method used is a qualitative literature study to analyze classical and contemporary literature. The results of the study indicate that the existence of Islamic constitutional law is adaptive and normative, emphasizing the principles of justice, public welfare, and public participation. The mechanism for implementing constitutional law requires the application of good governance principles based on accountability, transparency, and trustworthiness. Jasser Auda's assessment of maqasid emphasizes the need for a multidimensional systemic approach, where the success of law implementation is measured by the achievement of public welfare and social justice, not merely the textual aspects of the law. This framework is expected to become a reference in the renewal of the Islamic constitutional system that is relevant to the needs of the modern state.

Abstract

The development of information technology has transformed political participation, particularly among Generation Z in Indonesia. Social media platforms such as TikTok function not only as entertainment spaces but also as mediums for political participation, allowing users to express opinions, influence public discourse, and engage with political content creatively. This study aims to analyze the essence of political participation in the digital space of TikTok, the mechanisms of digital political participation through the platform, and provide solutions based on the perspective of Maqasid Shariah. The research employs a qualitative descriptive approach, utilizing literature review and content analysis. The findings indicate that TikTok serves as an interactive and visual tool for political participation, yet it also carries potential negative impacts such as the spread of misinformation and social polarization. From the perspective of Maqasid Shariah, it is crucial to uphold public welfare, prevent harm (mafsadah), and prioritize ethical values in digital political engagement. This study recommends enhancing digital literacy and political ethics grounded in Maqasid Shariah principles to optimize Generation Z’s political participation on TikTok.

Abstract

Gender equality in Islamic education in Indonesia is increasingly relevant amid growing awareness of women's roles. Normatively, Islamic law emphasizes al-musāwah (equality) and al-‘adl (justice), but its implementation faces structural and cultural barriers, creating a gap between syariah ideals and practices in educational institutions. This research analyzes the concept of gender equality in Islamic law, identifies legal-social obstacles, and formulates syariah-based solutions for inclusive Islamic education. Employing qualitative library research and descriptive-analytic analysis, the study explores maqāṣid al-syarī‘ah, contextual ijtihād, and khalīfah fī al-arḍ.Findings: Equality is theologically recognized but remains formal; barriers stem from patriarchal fiqh interpretations and cultures that subordinate women. Solutions: Contextual reinterpretation and gender-just policies for equitable Islamic education. The research findings show that although gender equality is recognized in Islamic theological principles, in practice, significant obstacles stem from patriarchal and cultural interpretations of Islamic jurisprudence that place women in a subordinate position. Therefore, contextual reinterpretation and the implementation of more gender-just policies in Islamic education are needed to create a just and equitable learning environment.

Abstract

The gender-equitable distribution of gono-gini property in Indonesia still faces challenges even though the principle of equality has been regulated in the Compilation of Islamic Law (KHI) and the Marriage Law. The principle of gender justice in Islamic law is rooted in sharia values that emphasize balance, benefits, and equality between men and women in acquiring and managing family property. However, practice in the field shows that there is a wrong understanding of society, patriarchal culture, and differences in judges' interpretations that often harm women. This research aims to analyze the form of distribution of gono-gini property according to Islamic law and national law, understand its implementation in the practice of religious justice, and formulate Islamic legal solutions that can realize a gender-fair distribution. The research method used is a literature review with a normative-qualitative approach through the study of primary, secondary, and tertiary legal materials. The results of the study show that the equitable distribution of gender is not only understood as a 50:50 division according to Article 97 of the KHI, but also includes recognition of economic and non-economic contributions, including the domestic role of the wife. Implementation in the religious courts still faces inconsistencies in judges' interpretations, low legal literacy, and socio-cultural barriers. The solutions offered by Islamic law include the application of the principles of shirkah, benefit, deliberation, and ijtihad of judges based on substantive justice.

Abstract

With the largest Muslim population in the world, Indonesia's legal system is based on the 1945 Constitution of the Republic of Indonesia, which does not explicitly define Indonesia as an Islamic state. However, Islamic values such as justice, humanity, deliberation, and public interest are reflected in the constitution and state practices. The purpose of this study is to examine how Islamic values are applied in the Indonesian constitution and in the practice of state governance. The research method used is a qualitative approach. The objective of the study is to understand the relationship and differences between Islamic law and state law through an examination of documents related to legislation, Islamic legal literature, and relevant public policies. The results of the study show that Islamic values serve as a moral and ethical foundation in the formation of national law, although their application faces challenges such as the plurality of legal systems, diversity of society, and social inequality. However, integrating Islamic values substantively, rather than symbolically, can strengthen the nature of national law to be just, humanistic, and responsive to the social dynamics of Indonesian society.

Abstract

This study examines the existence of Sharia-inspired Regional Regulations (Perda Syariah) as a manifestation of Islamic law within Indonesia’s national legal system. The emergence of these regulations has increased significantly since the reform era and the implementation of regional autonomy, which granted local governments broader authority to formulate regulations based on local needs and sociocultural values. This research employs a normative-juridical approach combined with descriptive, critical, and transformative analyses to evaluate the legality, legitimacy, and relevance of Perda Syariah within the framework of the Pancasila rule of law. The findings indicate that Perda Syariah is rooted in strong historical and sociological foundations, yet poses normative concerns, including potential discrimination, regulatory disharmony, and the risk of religious politicization at the local level. This study proposes a transformative framework that enables Perda Syariah to reflect religious moral values while remaining aligned with constitutional principles, non-discrimination, and respect for pluralism. Such reform is essential to ensure that Perda Syariah contributes constructively to Indonesia’s legal development without generating social tension or normative conflict.

Abstract

The main issue highlighted in this study stems from the weak implementation of participatory democracy in Indonesia, despite the existence of various regulations that formally provide space for public involvement in policy-making. The gap between normative guarantees and actual practices is evident in the low level of political literacy, limited access to public information, and the strong dominance of political elites in decision-making processes. This research aims to comprehensively analyze the role of society in the public policy process and to assess the extent to which the principles of participatory democracy are realized in governmental practice. Using a qualitative approach through literature studies on legislation, scientific journals, and relevant academic documents, this study examines both formal and non-formal forms of participation, along with the supporting and inhibiting factors that influence them. The findings reveal that although public participation is legally guaranteed, its implementation remains far from ideal. Various participation mechanisms tend to be procedural and do not substantially influence policy outcomes. These findings underscore the need for strengthening community capacity, improving political literacy, and ensuring the government’s commitment to providing more inclusive, responsive, and transparent participatory spaces

Abstract

Solid waste management in Makassar City constitutes a strategic issue that extends beyond technical and administrative concerns to encompass legal, ethical, and socioreligious dimensions. Although the local government has established regulatory frameworks and policy instruments for waste management, empirical conditions reveal a persistent gap between legal norms and their implementation, as reflected in high waste generation rates, weak source segregation, limited public participation, and increasing pressure on landfill capacity. This study aims to analyze the effectiveness of waste management in Makassar City from the perspective of Islamic law and to examine the potential integration of Sharia principles in strengthening sustainable environmental governance. The research employs a qualitative approach with a descriptive-analytical design based on policy analysis, literature review, and theoretical synthesis of Islamic legal doctrines, particularly maqāṣid al-sharīʿah and fiqh al-bī’ah. The findings indicate that, despite the existence of adequate local legal instruments, waste management practices remain ineffective due to insufficient internalization of ethical values, weak law enforcement, and limited behavioral change within society. From the perspective of Islamic law, these conditions demonstrate the incomplete realization of the principles of amanah (trust and responsibility), maslahah (public interest), and the prevention of harm (lā ḍarar wa lā ḍirār) in both governmental practice and public conduct, thereby undermining the objectives of protecting human life and the environment. The implications of this research highlight the importance of synergizing positive law and Islamic legal principles to promote environmentally sustainable governance oriented toward long-term public welfare.

Abstract

Freedom of religion is a fundamental right guaranteed in Islamic teachings as well as within the Indonesian constitutional framework. However, the practical implementation of this freedom has not fully aligned with the constitutional provisions that regulate it. Various events, including the restriction of worship facilities, discriminatory policies toward religious minorities, and the enforcement of blasphemy regulations, indicate a significant gap between constitutional norms and societal practices. This issue is relevant considering that religion in Indonesia is not only a sociological9 identity but also plays a normative role in the state system. This research aims to examine religious freedom from Islamic legal perspectives and analyze constitutional protection within the 1945 Constitution, while identifying points of harmonization between the two frameworks. A normative legal methodology using comparative analysis between Islamic jurisprudence and constitutional law was applied. Findings reveal that both Islam and the Indonesian Constitution recognize religious freedom while placing limits for public order, equality, and communal well-being. The Qur’anic principle la ikraha fid-din aligns with Article 28E and Article 29 of the 1945 Constitution, although implementation varies based on political and social context. This research recommends strengthening moderate Islamic interpretation and constitutional practice to ensure equal protection for all religious groups.
