Abstract

Pengaturan tindak pidana kekerasan seksual nonfisik di Indonesia diatur berdasarkan Pasal 5 UU Tindak Pidana Kekerasan Seksual (TPKS). Meskipun demikian, ada beberapa permasalahan yang perlu diperhatikan yaitu dalam menentukan kebenaran terhadap kekerasan nonfisik yang dilakukan pelaku agar dapat dibuktikan melalui alat bukti yang sah. jika tidak ada saksi yang melihat secara langsung tindakan kekerasan nonfisik, tujuan dari penelitian ini adalah membahas secara mendetail mengenai pembuktian kekerasan seksual non fisik penelitian ini menggunakan penelitian yuridis normatif dengan beberapa pendekatan yaitu pendekatan perundang-undangan, pendekatan konseptual dan pendekatan perbandingan, adapun hasil penelitian ini menunjukkan bahwa keterangan seorang saksi korban mempunyai nilai didalam pembuktian terhadap tindak pidana kekerasan seksual nonfisik berdasarkan UU TPKS tidak bisa berdiri sendiri untuk membuktikan kebenaran atas perbuatan yang dilakukan oleh pelaku tersebut, sehingga diperlukan alat bukti pendukung yang lain untuk memiliki nilai pembuktian yang dibenarkan dalam UU TPKS yaitu berupa alat bukti dalam KUHAP, alat bukti yang diatur dalam UU ITE berupa Informasi Elektronik dan/ atau Dokumen Elektronik dan/ atau hasil cetaknya dan barang bukti yang digunakan dan/atau berhubungan dalam Tindak Pidana Kekerasan Seksual. Kata kunci: Kekerasan seksual, Pembuktian, Non Fisik. Abstract The regulation of criminal acts of non-physical sexual violence in Indonesia is regulated based on Article 5 of the Sexual Violence Crime Law (TPKS). However, there are several problems that need to be considered, namely in determining the truth of the non-physical violence committed by the perpetrator so that it can be proven through valid evidence. if there are no witnesses who directly see acts of non-physical violence, the aim of this research is to discuss in detail the evidence of non-physical sexual violence. This research uses normative juridical research with several approaches, namely the statutory approach, the conceptual approach and the comparative approach, as for the research results This shows that the testimony of a victim witness has value in proving the crime of non-physical sexual violence based on the TPKS Law and cannot stand alone to prove the truth of the actions committed by the perpetrator, so other supporting evidence is needed to have the evidentiary value justified in the Law. TPKS is in the form of evidence in the Criminal Procedure Code, evidence regulated in the ITE Law in the form of Electronic Information and/or Electronic Documents and/or printouts thereof and evidence used and/or related to the Crime of Sexual Violence. Abstract

Ethnicity, religion, race and intergroup (SARA) are social elements that have an important role in human life, therefore, the freedom of each party must be respected and guaranteed. Religion is an important element of human existence and perhaps the most impressive element that can exert an important influence on the behavior of individuals. Indonesian positive law regulates punishment for perpetrators of religious blasphemy regulated in Article 156a of the Criminal Code. The initial purpose of enacting this article was against the backdrop of the many sects of belief and mysticism teachings that were considered heretical and not in accordance with the religious teachings of the Indonesian people. Article 156a of the Criminal Code is intended to prevent religious teachings from being distorted which are considered as the main teachings by the leaders or religious leaders concerned; and this rule protects religious peace in society and maintains the values of religious teachings that are maintained by the community from insults/humiliations and from teachings not to embrace a religion based on Belief in the One Supreme God.

Abstract

Restorative justice or better known as restorative justice in the development of schools of law and punishment in human civilization, where the state returns the ius ponale and ius poniendi mandates to the community within the framework of healing, recovery and recovery. Restorative justice is a concept of thinking that responds to the development of the criminal justice system by focusing on the need to involve actors, communities and victims as a social recovery step in social relations. The principle of restorative justice is one of the principles of law enforcement in resolving cases which can be used as an instrument of recovery and has been implemented by the supreme court in the form of policy implementation (Supreme Court Regulations and Supreme Court Circulars). Restorative justice is considered a model of modern punishment that is more humane than the retributive justice used in the current justice system. One of the applications of this is the termination of the prosecution process by the prosecutor.

Abstract

The purpose of this article is to analyse the revocation of the political right of former convicts to candidacy as public officials in the Indonesian context based on positive law and decisions of the Indonesian Constitutional Court. In addition, this article aims to conduct a comparative study analysis of the issue, namely, between the arrangements in Indonesia and those in the United States and Australia. In Indonesia, everyone has the right to stand as a candidate for public office, including former prisoners, with certain conditions in accordance with positive law. However, the matter of revoking the political rights of former convicts remains a matter of debate, especially before the General Election. The Constitutional Court affirmed that the political right of former convicts to hold elected public office must fulfil several requirements. The political rights of former convicts are still guaranteed, but there are certain limitations. In Australia and the United States, the political rights of former convicts are also maintained, but with exceptions for some instances, such as corruption or treason against the state. Looking at the existing debate, it is necessary to safeguard civil and political rights universally, while paying attention to the specific cases that underlie the prohibition on former convicts from running for public office.KEYWORDS: Elections, Political Rights, Former Convicts.

Abstract

Restorative justice, which is based on POLRI Regulation Number 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice, was formed to realize efforts to resolve criminal acts by prioritizing aspects of restorative justice. Through this regulation, criminal law enforcement by the police is oriented to re-emphasize the restoration of the original situation as before the crime occurred. The research method used uses a normative juridical research type with a statutory and regulatory approach. This research uses literature study techniques by inventorying suitability based on primary and secondary legal materials to answer the problems in this research. ratio legis implementation of the Republic of Indonesia State Police Regulation Number 8 of 2021 reflects a restorative justice approach in the investigation stage of handling criminal acts. It emphasizes the importance of healing and reconciliation as part of the investigative process, reflecting a paradigm shift in criminal law towards a more holistic and recovery-oriented approach. The dynamics of handling narcotics crimes based on the principles of restorative justice, there are special requirements that must be complied with. Republic of Indonesia State Police Regulation Number 8 of 2021 pays special attention to the condition of individuals involved in narcotics abuse. This consideration involves evaluating the status of drug users, the condition of the victim of drug abuse, the level of drug dependence of the perpetrator, the type of narcotics used, and the amount.

Abstract

Perkembangan ekonomi dan teknologi yang pesat pada era Industri 5.0 menuntut adanya lulusan hukum yang tidak hanya memahami hukum secara teknis tetapi juga memiliki keterampilan kewirausahaan dan teknologi. Program LawPreneur merupakan suatu langkah strategis untuk mencetak lulusan hukum yang memiliki keahlian tambahan dalam bidang bisnis berbasis hukum dan teknologi. Program ini bertujuan untuk menjembatani kesenjangan antara kemampuan lulusan hukum dan kebutuhan pasar akan profesional hukum yang siap bersaing, dan berinovasi di sektor legal-tech. Dalam beberapa tahun terakhir, lulusan hukum dihadapkan pada tantangan baru di pasar kerja. Selain peran tradisional seperti advokat, jaksa, atau hakim, muncul kebutuhan terhadap peran inovatif seperti konsultan hukum bagi bisnis teknologi, pengelola startup hukum, dan profesional hukum di perusahaan digital. Sebagai respons, Program LawPreneur menawarkan pendidikan yang mengintegrasikan hukum, kewirausahaan, dan teknologi, didukung oleh mitra-mitra bisnis, salah satunya HeyLaw. Melalui pelatihan dan magang, mahasiswa mendapatkan pengalaman praktis dalam mengelola bisnis hukum berbasis teknologi. Penelitian ini bertujuan untuk menganalisis konsep dan implementasi Program LawPreneur di fakultas hukum dalam membentuk profil lulusan yang kompeten dalam kewirausahaan hukum berbasis teknologi, serta mengidentifikasi arah pengembangan LawPreneur untuk meningkatkan daya saing lulusan di dunia kerja dan memenuhi kebutuhan industri 5.0.  Metode yang digunakan adalah penelitian kualitatif untuk memperoleh pemahaman menyeluruh tentang pelaksanaan program. Teknik pengumpulan data meliputi wawancara mendalam, observasi partisipatif, dan studi dokumentasi. Analisis dilakukan secara kualitatif interaktif, dengan memvalidasi data melalui triangulasi sumber. Luaran yang diharapkan dari penelitian ini mencakup rekomendasi strategis bagi pengembangan Program LawPreneur, peningkatan keterampilan lulusan, dan pemetaan kompetensi yang sesuai dengan kebutuhan industri 5.0. Penelitian ini selaras dengan roadmap Riset Unggulan UNEJ yang berfokus pada daya saing lulusan dan kesiapan menghadapi era digital.

Abstract

During the 2015 PERADI National Conference (Munas) in Makassar, PERADI was divided into three management sections, namely Fauzie Yusuf Hasibuan's PerADI, Luhut MP Pangaribuan's PerADI, and PADI's Peradi. PERADI version Juniver Girsang and later could not give birth to the management received by all circles. Chief Justice of the Supreme Court R.I. Number 073/KMA/HK.01/XI/2015\. This has an impact on advocates establishing organizations in accordance with their respective philosophies and ideals. The type of research in this study is a juridical review that regulates the use of regulations or standards in specific regulations. Studies show that Law No. 18 of 2003 on Advocates provides protection for clients, including by ensuring confidentiality of advocate and client relationships, granting immunity rights to advocates, ensuring protection of attorney files and documents. ensuring protection against wiretapping of advocate electronic communications, ensuring protection of advocate's right to obtain information, data, and documents necessary for defense of client interests, Advocates who do not exercise their obligations to fulfill the rights of their clients or are found to have committed unlawful acts will be sanctioned by the advocate organization or the Advocate Honorary Council, and the concept of single bar with Peradi as the only advocate organization is an ideal form of the advocate organization model in Indonesia.

Abstract

This study investigates the regulation of action sanctions through a restorative approach for children in conflict with the law (ABH) within the juvenile criminal justice system in Indonesia. The objective is to analyze the alignment of these regulations with the principles of child protection and restorative justice. Utilizing a normative juridical method that incorporates statutory and conceptual approaches, the findings indicate that Article 82 of the Juvenile Criminal Justice System Law (SPPA Law) embodies a restorative justice approach, striving to balance community protection with the rehabilitation of ABH. However, the implementation is suboptimal, and many ABH continue to receive prison sentences. This suggests that the principles of the best interests of the child, the right to development, and respect for children’s views have not been adequately upheld. There is a need for further refinement of action sanctions to better align with restorative justice and address the needs of ABH.

Abstract

The increasing number of ‘terrorist prisoners’ in Indonesia has resulted in the establishment of a separate penal institution. This development is novel to Indonesian secure settings, and the perceptions of prison officers’ who work in these specialist prisons offer distinct practical insights into the efficacy of these correctional facilities. The present study provides innovative findings by exploring, for the first time, the perspectives of Indonesian prison officers working in specialist prisons for terrorist prisoners in Indonesia. This study conducted focus groups with Indonesian prison officers in Cipinang, Pasir Putih Nusakambangan, and Surabaya prisons. A qualitative content analysis was deployed that identified several themes for future policy decisions. These included, the establishment and ongoing administration of a special prison;, the need to improve data collection of terrorist inmates; the importance of partnerships with key stakeholders, and the centrality of review mechanisms to ensure that processes for prisoner selection, management, and release are optimised and enhanced to ensure future community safety and security.

Abstract

One of the sources of Non-Tax State Revenue increasing comes from the Administrative Sanctions of Immigration. The enforcement of the sanction is followed up by the deportation of the foreigners who violate the law in Indonesian territory. The juridical basis for this authority is the attribution regulated in Law Number 6 of 2011 concerning Immigration and its derivatives. In practice, the implementation of Article 75 of Immigration Regulation is disrupted which has resulted the human rights protection is not accommodated as stipulated in Article 9 of Declaration of Human Rights and also Article 34 Law Number 39 of 1999. This cannot be allowed in the name of the Principle of Legal Certainty, Transitional Justice, and Global Justice. The result must refer to the declaration agreed upon at United Nations, in which Article 34 stipulates that “every person shall not be exiled or disposed arbitrarily”. This article is an arrangement in Article 9 of the Universal Declaration of Human Rights. Thus, this article must be added to the legal substance regarding the obligation to have a judge’s verdict with permanent legal force from the court in Indonesia against the foreigners who violate the Law. This commitment must also be applied in all legislative products stipulated by the government as the legislator. This includes all legal regulations in Immigration.
