Abstract

The Constitutional Court is a new State institution resulting from the third amendment of the 1945 Constitution. The Constitutional Court is an independent institution in the judicial sector. The authority of Judicial Review is given to the Constitutional Court. The Constitutional Court is authorized to review the Act against the Constitution. From this it can be seen that one of the legal politics behind the birth of the idea of the establishment of the Constitutional Court is as an effort to anticipate the products of the authorities that can harm the interests of society. Therefore, the Constitutional Court is expected to exercise control with various authorities against various policies and products of governmental law in the form of legislation issued by the government so as not to conflict with the principles contained in the 1945 Constitution.

Abstract

As a student, ideally prioritize consumptive behavior that prioritizes academic affairs. In fact, students often focus on lifestyle dimensions and aspects outside academia. This raises questions about students' motivations and the extent of their awareness of basic needs. This study examines the consumption patterns of State Islamic University (UIN) Raden Intan Lampung students who adhere to a modern lifestyle. This study explores the impact of Sharia economic law on the consumption behavior of the class of 2020 student groups who took the Sharia Economic Law program at the Sharia Faculty. This research includes field research with a quantitative approach. The methodology used is a descriptive analysis study. The primary data of this study consisted of Sharia Economic Law students class of 2020 from the Sharia Faculty of UIN Raden Intan Lampung. Data collection was carried out through interviews, observations, and questionnaires. The results of the study found that. Students majoring in Sharia Economic Law at UIN Raden Intan Lampung do not follow the Islamic Economic Law, especially the theory of Al Ghazali Consumption. Their emphasis on complementary and aesthetic needs, rather than basic needs, shows a lack of awareness of basic needs and a tendency towards extravagance and luxury.

Abstract

The Islamic Financial Institutions play a crucial role in the economy of a country, including Indonesia, but they face challenges such as bankruptcy, insecurity, and inadequate supervision. This research examines the principle of transparency in Wadi'ah savings contracts at BTM An-Nur Mandiri Jaya from the perspectives of Shariah Economic Law and Positive Law. In this study, the researcher analyzes the application of transparency principles in Wadi'ah contracts at BTM An-Nur Mandiri Jaya, focusing on Shariah Economic Law and relevant Positive Law. A qualitative field research method is employed, supported by relevant literature. The research findings indicate that BTM An-Nur Mandiri Jaya has successfully implemented transparency principles in Wadi'ah contracts, including account opening, deposits, withdrawals, and closures, based on Shariah Economic Law. However, compliance with Positive Law, particularly POJK Number 19 of 2021 Article 32 Paragraph 1 and Law Number 1 of 2013 Article 2 Letter e, remains incomplete, as evidenced by the lack of online media access to obtain information. In conclusion, BTM An-Nur Mandiri Jaya needs to enhance transparency practices in accordance with legal provisions, especially by providing online access to information.

Abstract

MUI Fatwa No. 1 of 2004 concerning Interest states that mu'amalah is not permitted using Conventional Banks because there is an Interest system in Conventional Financial Institutions and the practice of interest is haram. Fundraising zakat by BAZNAS Bandar Lampung City in practice is known to use Conventional Banks which are used in collecting zakat. This is contradictory and gives rise to speculation among the public because there is a discrepancy between the fundraising mechanism at BAZNAS Bandar Lampung City and the MUI fatwa No.1 of 2004. This research is field research with a descriptive qualitative approach. Data sources come from primary data and secondary data. The results obtained in this research are: First, the fundraising mechanism for zakat funds is carried out directly, namely muzaki go directly to the BAZNAS / UPZ office and indirectly, namely through transfers to bank accounts, including using conventional banks. This was done because of the existence of an MoU with the Bandar Lampung City Government in optimizing the collection of ASN zakat, the regulations of which are carried out by Regional Banks, and Commercial Banks are used to facilitate and target Muzakki who are not familiar with Sharia Banks, Commercial Banks are used only as a channel for zakat/UPZ (zakat collection unit), deposited and managed by Sharia Bank account. Second, the use of conventional banks in collecting zakat carried out by BAZNAS Bandar Lampung City from the perspective of sharia economic law based on findings and facts that occur in the field and based on maslahah murlah may be done because there are benefits and maslahah for many people (not problems for the interests of one group or certain individuals) and reject harm in order to maintain the goals of shara' (maqashid shari'ah)

Abstract

Kemajuan tekonologi perlu disikapi oleh institusi hukum seperti Mahkamah Konstitusi. Salah satu solusi yang muncul adalah mengadopsi persidangan jarak jauh yang mengubah cara tradisional mereka dalam memutuskan kasus-kasus yang kompleks. Penelitian ini untuk menganalisa Peraturan Mahkamah Konstitusi Nomor 1 Tahun 2021 Tentang Penyelenggaraan Persidangan Jarak Jauh. Penelitian ini termasuk penelitian kepustakaan yang sumber datanya dari buku dan artikel ilmiah. Penelitian ini menemukan bahwa persidangan jarak jauh telah membawa berbagai manfaat signifikan bagi Mahkamah Konstitusi dalam menjalankan fungsi mereka sebagai penjaga keadilan konstitusional seperti aksesibilitas yang lebih luas, efisiensi operasional, fleksibilitas waktu, keamanan, dan pengurangan dampak lingkungan. Namun, persidangan jarak jauh juga menghadapi kendala yakni masalah infrastruktur teknologi, keamanan dan privasi data serta kendala teknis seperti gangguan koneksi internet, masalah perangkat lunak, atau kegagalan sistem dapat mengganggu kelancaran persidangan. Masalah tersebut dapat mempengaruhi efisiensi. Sedangkan dalam fikih siyasah, kehadiran di hadapan hakim tidak hanya merupakan kewajiban prosedural, tetapi juga mencerminkan adab dan sikap hormat terhadap keadilan. Meskipun demikian, fikih siyasah juga mengakomodasi prinsip keberlakuan (istihsan) yang memungkinkan interpretasi dan penyesuaian terhadap kondisi-kondisi kontemporer, termasuk penggunaan teknologi dalam proses hukum. Asalkan prinsip-prinsip keadilan dan keadaban dipatuhi. Penggunaan teknologi harus dikelola dengan bijaksana untuk memastikan bahwa tujuan dari sistem peradilan untuk menyediakan keadilan yang adil dan merata dapat tercapai dengan baik.

Abstract

Dalam praktek transaksi digital metode pembayaran dengan menggunakan QR kode perlu adanya kehati-hatian terhadap tindakan pemalsuan QR kode oleh pihak yang melanggar hukum atau tidak bertanggung jawab. Penelitian ini bertujuan untuk menjelaskan dan menganalisis perlindungan hukum bagi konsumen pada transaksi pembayaran nontunai berbasis QRIS (Quick Response Code Indonesian Standard) Perspektif Hukum Positif dan Perspektif Hukum Ekonomi Syariah dengan pendekatan yuridis normatif. Hasil penelitian Analisis Perlindungan Hukum Bagi Konsumen Pada Transaksi Pembayaran Nontunai Berbasis QRIS (Quick Response Code Indonesian Standard) Perspektif Hukum Positif berkaitan dengan perlindungan hukum preventif, selain dari pengaturan umum mengenai perlindungan konsumen yang terdapat dalam Undang-Undang Perlindungan Konsumen No. 8 Tahun 1999, bagi Konsumen QRIS terdapat regulasi signifikan yang mengatur. Bank Indonesia telah menerbitkan Pengaturan Anggota Dewan Gubernur Nomor 21/18/PADG/2019 tentang Implementasi Standar Nasional Quick Response Code, Peraturan Bank Indonesia Nomor 22/20/PBI/2020 tentang Perlindungan Konsumen Bank Indonesia, Peraturan Bank Indonesia Nomor 18/40/PBI/2016 tentang Penyelenggaraan Pemrosesan Transaksi Pembayaran, Peraturan Bank Indonesia Nomor 20/6/PBI/2018 tentang Uang Elektronik. Kemudian berdasarkan Perspektif Hukum Ekonomi Syariah di tinjau dari teori sadd dzari’ah terkait pengumpulan data pribadi yang semula diperbolehkan karena mengandung kemanfaatan, tetapi dalam tujuan yang akan dicapainya berpotensi dapat berakhir dengan kerugian dan kemafsadatan bila tanpa adanya perlindungan dari Pemerintah. Abstract

This research was made to analyze the urgency of the marriage agreement in marriage. To analyze the urgency of the marriage agreement in forming a sakinah family in the perspective of Islamic Family Law. This type of research is library research. This research is descriptive in nature, namely by using qualitative methods. The results of this study show that the urgency of the marriage agreement is that the marriage agreement has good benefits as a preventive measure in the event of a divorce because the marriage agreement will facilitate the distribution of assets. The urgency of the marriage agreement in forming a sakinah family in the perspective of Islamic family law, namely. First, to form a sakinah family, it is best if the prospective husband and wife make a marriage agreement which includes communication problems, personal and shared assets, biological needs (sex), economic problems, and appearance. Second, the marriage agreement includes a form of maslahah for married couples to achieve maqashid asy-syari'ah. Through a marriage agreement, what is the goal of the Shari'a, namely to achieve benefit can be realized or achieved.

Abstract

Mediation in Islam is known as Islâh and hakam. When a dispute or dispute occurs, the disputing parties make peace efforts by appointing a judge. In the case of divorce, the function and efforts to reconcile are the obligations of the judge as a mediator which must be carried out based on Supreme Court Regulation no. 01 of 2016 concerning Mediation Procedures in Courts. Therefore, peace efforts are sought through mediation in the Religious Courts so that couples who want to divorce cancel their intentions and reconcile. However, the reality is that the success rate of mediation in divorce cases is still relatively low. This is evidenced by the number of cases that end in the trial process, compared to the success of the Mediation process. The purpose of this study was to analyze the implementation of divorce case mediation based on Perma No. 1 of 2016. As well as analyzing Islamic law on the implementation of mediation in divorce cases at the Gedong Tataan Religious Court and the Pringsewu Religious Court. The method used in this research is descriptive qualitative with theological, juridical normative and sociological approaches, with the object of research being the Gedong Tataan Religious Court and the Pringsewu Religious Court in Lampung. The primary data in this study were obtained from interviews with the Mediator Judge. The secondary data used is the report on the success and failure of the mediation implementation recorded in the final report and the Case Investigation Information System (SIPP). The results obtained from the research that the implementation of mediation at the Gedong Tataan and Pringsewu Religious Courts, based on PERMA No. 1 of 2016, but the implementation of mediation cannot be said to be optimal or not effective, because the success of mediating divorce cases is still relatively low. Mediation or Islah in resolving domestic conflicts actually contains benefits, namely maintaining the objectives of Islamic law (maqasid al-syariah), namely maintaining religion, soul, mind, lineage, and property. Maqashid sharia in mediation is hifd al-nasl (keeping offspring)

Abstract

The purpose of this study was to analyze the reasons why female civil servants were prohibited from becoming second, third and fourth wives based on Government Regulation Number 45 of 1990; and to analyze based on Islamic family law against the prohibition of female civil servants to become second, third and fourth wives based on Government Regulation Number 45 of 1990. The results of this study are the Prohibition of Women Civil Servants from becoming the third and fourth second wife is a preventive measure to prevent women who are civil servants from disputes in the family, prevent women from psychological pressure caused by polygamy has an impact on changing attitudes so that can interfere with their performance as a civil servant, to prevent children from psychological pressure that results in children's future growth, and protect the rights of wives and children regarding civilization in the event of a divorce in a polygamous marriage which can harm a woman with a civil servant status and result in imperfect rights support the child. Abstract

Law No. 7 of 2017 highlights that general elections enable citizens to express their sovereignty; however, the phenomenon of abstention (golput) indicates a decline in voter participation. This trend often results from a lack of trust in elected representatives, who are seen as failing to effect significant change. Rising abstention rates require urgent attention from organizers, especially the General Election Commission (KPU) of Bandar Lampung. From an Islamic legal perspective, abstention is deemed haram according to the Indonesian Ulema Council. This study employs qualitative methods through field research, including observation, interviews, and document collection. The KPU of Bandar Lampung has implemented various strategies to reduce abstention in the upcoming 2024 elections, guided by goal-setting, policy formulation, and plan development theories. This research aims to provide insights for enhancing voter participation.
