Abstract

This article examines the understanding and awareness of gender equality in divorce cases in Lampung Province and its contribution to the reform of Islamic family law in Indonesia. The study aims to analyze the dominant factors in filing for divorce in Lampung Province, as well as the understanding and awareness of gender equality among divorce litigants from a mubādalah perspective. The research employs a qualitative method with field research. Data sources are obtained from a series of activities including interviews and observations conducted directly with judges handling divorce cases and litigants involved in divorce proceedings, complemented by secondary data from relevant scholarly works. Data analysis is performed qualitatively with a focus on the mentioned theories. The results indicate that in Lampung Province, economic factors are dominant in divorce cases, with husbands’ inability to provide for the family or wives feeling dissatisfied with the husband's provisions. The understanding and awareness of gender equality among divorce litigants are reflected in their attitudes towards women's rights, gender roles, and household division of labor, which often lead to injustice and divorce disputes. To achieve gender equality, it is recommended that changes be made to laws defining the roles of husbands and wives as mutually responsible partners in the household. This research contributes to the development of law in Indonesia by providing an in-depth analysis of the understanding and awareness of gender equality in divorce cases, particularly in Lampung Province

Abstract

This study addresses a critical issue exacerbated by the pandemic: the increasing number of street children in Lampung Province. This demographic represents a vulnerable group necessitating focused attention from both governmental and societal entities to prevent exploitation and enhance access to education and social services for women with disabilities. Despite the implementation of various social policies, challenges persist, particularly in developing regions such as Lampung, Indonesia. This study aims to delineate a policy model for managing street children during the pandemic by identifying existing implementation obstacles. The theoretical framework is grounded in the concepts of social empowerment and social welfare policies, as outlined in Law No. 11 of 2009. Employing a qualitative descriptive methodology, data were gathered through interviews, observations, and documentation from 14 relevant informants and analyzed using the Miles and Huberman model alongside triangulation techniques for validation. The findings reveal that Lampung Province’s policy model encompasses orphanages, families, communities, and semi-social homes. However, significant challenges, such as limited budgetary and human resources, impede their effectiveness. This study provides a comprehensive overview of social welfare policy implementation during the pandemic and underscores the necessity of enhancing intersectoral collaboration to improve the welfare of street children in Lampung Province.   Studi ini membahas masalah kritis yang diperburuk oleh pandemi: meningkatnya jumlah anak jalanan di Provinsi Lampung. Kelompok demografi ini merupakan kelompok rentan yang memerlukan perhatian khusus dari entitas pemerintah dan masyarakat untuk mencegah eksploitasi dan meningkatkan akses pendidikan dan layanan sosial bagi perempuan penyandang disabilitas. Meskipun berbagai kebijakan sosial telah diterapkan, tantangan tetap ada, terutama di daerah berkembang seperti Lampung, Indonesia. Studi ini bertujuan untuk menggambarkan model kebijakan untuk mengelola anak jalanan selama pandemi dengan mengidentifikasi hambatan implementasi yang ada. Kerangka teoritis didasarkan pada konsep pemberdayaan sosial dan kebijakan kesejahteraan sosial, sebagaimana diuraikan dalam Undang-Undang No. 11 Tahun 2009. Dengan menggunakan metodologi deskriptif kualitatif, data dikumpulkan melalui wawancara, observasi, dan dokumentasi dari 14 informan terkait dan dianalisis menggunakan model Miles dan Huberman beserta teknik triangulasi untuk validasi. Temuan penelitian mengungkapkan bahwa model kebijakan Provinsi Lampung mencakup panti asuhan, keluarga, masyarakat, dan rumah semi-sosial. Namun, tantangan signifikan, seperti keterbatasan anggaran dan sumber daya manusia, menghambat efektivitasnya. Studi ini memberikan gambaran komprehensif tentang implementasi kebijakan kesejahteraan sosial selama pandemi dan menggarisbawahi perlunya peningkatan kolaborasi lintas sektoral untuk meningkatkan kesejahteraan anak jalanan di Provinsi Lampung.

Abstract

Permasalahan HIV/AIDS masih menjadi tantangan kesehatan masyarakat di Provinsi Lampung, termasuk di RT 13 LK I Kelurahan Sukabumi, Kota Bandar Lampung. Meskipun telah diterbitkan Peraturan Daerah Provinsi Lampung Nomor 1 Tahun 2013 tentang Penanggulangan HIV dan AIDS, khususnya Pasal 5 mengenai pelaksanaan program pencegahan dan penanggulangan, implementasinya di tingkat kelurahan belum sepenuhnya optimal. Penelitian ini menggunakan pendekatan kualitatif dengan teknik pengumpulan data melalui wawancara dan studi dokumentasi. Hasil penelitian menunjukkan bahwa pemerintah telah melaksanakan berbagai program, seperti komunikasi, informasi, dan edukasi (KIE), pelayanan tes HIV di fasilitas kesehatan, serta surveilans pada kelompok berisiko. Namun, pelaksanaannya belum menjangkau sektor dunia usaha dan organisasi masyarakat secara merata. Selain itu, rendahnya pemahaman dan masih kuatnya stigma terhadap HIV/AIDS menyebabkan partisipasi masyarakat dalam program pencegahan masih terbatas. Hambatan lain meliputi lemahnya koordinasi lintas sektor dan belum optimalnya peran Komisi Penanggulangan AIDS (KPA). Dalam perspektif Ibn Taymiyyah, kebijakan yang belum efektif menghilangkan kemudaratan belum sepenuhnya merealisasikan keadilan dan kemaslahatan. Oleh karena itu, diperlukan penguatan implementasi kebijakan agar tujuan perlindungan jiwa dalam kerangka maqashid al-syari’ah dapat tercapai secara optimal.

Abstract

This study examines the legal status of children resulting from an annulled marriage from the perspective of human rights and child protection. This study aims to analyze the legal status of children resulting from an annulled marriage from the perspective of human rights and child protection. In judicial practice, annulment decisions often omit the status of children born from the marriage. Judges generally focus solely on the validity of the marriage, rather than on fulfilling the rights of children born from the relationship. This situation creates a legal gap because, even though the child is not at fault for the annulment of their parents' marriage, their legal status is often unclear, impacting the protection of their rights. The purpose of this study is to examine the extent to which human rights and child protection principles are integrated into judges' legal considerations when deciding annulment cases. This research uses a normative legal method with a statutory approach and case studies of several relevant court decisions. The research results show that the omission of the child's status in the verdict has the potential to conflict with the principles of non-discrimination and the best interests of the child as stipulated in the Convention on the Rights of the Child (CRC), which Indonesia has ratified through Presidential Decree No. 36 of 1990, and Law No. 35 of 2014 concerning Child Protection. From a human rights perspective, children born from an annulled marriage still have a civil relationship with their mother and their mother's family as stipulated in Article 43 paragraph (1) of the Marriage Law and the Constitutional Court Decision, No. 46/PUU-VII/2010.

Abstract

The employment remuneration practices observed in the majek tradition in Semaka District, Tanggamus Regency reveal significant differences between customary law, the formal regulatory framework, and Sharia principles. The main issues identified in this examination include manifestations of legal ambiguity (gharar) and a lack of protection for workers' rights, stemming from unilateral decisions regarding remuneration and post-harvest wage determination. Data was obtained through comprehensive interviews with landowners and agricultural workers, then analysed through the lens of the principles of Fikih Muamalah and Maqashid Sharia. The findings indicate that the majek tradition fails to meet the legal criteria associated with ijarah contracts due to the prevalence of gharar fahish (excessive uncertainty) regarding wage amounts. Juridically and philosophically, this practice contradicts the principles of justice ('is) and property protection (hifz al-mal) as articulated in Shariah Maqashid. This study advocates the formalisation of direct employment contracts in written form to ensure legal certainty and the protection of agricultural workers, who are positioned as vulnerable parties (mustadh'afin).
