Abstract

This study examines the implementation of public transportation policies in Bandar Lampung City based on Regional Regulation Number 10 of 2017 through the perspective of Fiqh Siyasah Tanfidziyyah. The main problem studied is the lack of adequate provision of public transportation even though it has been regulated in Regional regulations, especially regarding the obligation of the Regional government to guarantee the availability of public transportation as stipulated in Article 89 Paragraph (1). This study uses a juridical-normative and juridical-empirical approach with data collection techniques through in-depth interviews, field observations, and documentation studies at the Bandar Lampung City Transportation Agency. The results of the study indicate that the implementation of public transportation policies has not been running optimally due to budget limitations, minimal coordination between stakeholders, and low commitment to implementing regulations. The analysis of Fiqh Siyasah Tanfidziyyah reveals that the government as ulil amri has constitutional and sharia responsibilities in realizing public welfare through the provision of safe, comfortable, and affordable transportation facilities. This study recommends the need to revitalize the public transportation system through strengthening regulations, increasing budget allocations, and implementing good governance principles in line with Islamic values.

Abstract

This study examines the legal status of children resulting from an annulled marriage from the perspective of human rights and child protection. This study aims to analyze the legal status of children resulting from an annulled marriage from the perspective of human rights and child protection. In judicial practice, annulment decisions often omit the status of children born from the marriage. Judges generally focus solely on the validity of the marriage, rather than on fulfilling the rights of children born from the relationship. This situation creates a legal gap because, even though the child is not at fault for the annulment of their parents' marriage, their legal status is often unclear, impacting the protection of their rights. The purpose of this study is to examine the extent to which human rights and child protection principles are integrated into judges' legal considerations when deciding annulment cases. This research uses a normative legal method with a statutory approach and case studies of several relevant court decisions. The research results show that the omission of the child's status in the verdict has the potential to conflict with the principles of non-discrimination and the best interests of the child as stipulated in the Convention on the Rights of the Child (CRC), which Indonesia has ratified through Presidential Decree No. 36 of 1990, and Law No. 35 of 2014 concerning Child Protection. From a human rights perspective, children born from an annulled marriage still have a civil relationship with their mother and their mother's family as stipulated in Article 43 paragraph (1) of the Marriage Law and the Constitutional Court Decision, No. 46/PUU-VII/2010.

Abstract

This research aims to strengthen the institution of the House of National Representatives (DPD) in the national legislation programme, to be more representative in accommodating national aspirations. Through a normative juridical approach and analysis of Siyasah duturiyah, this research examines the principles of justice, deliberation, and participation under the values of Sharia in public policy making. This research is normative juridical research by collecting primary and secondary legal materials relevant to the research utilizing a statutory approach and conceptual approach in both positive law and siyasah duturiyah. The results found that to strengthen the control and development of DPD in the national legislation, it is necessary to amend the 1945 Fundamental law of the Republic of Indonesia, revise the Law No. 17/2014, revise the Law No. 27/2009, separate arrangements regarding the assignment and functions of DPD, adopt a strong bicameral system and likely bicameral. The impact is hoped to enrich the study in the field of Fiqh Siyasah and Fundamental law, especially in the context of developing a more inclusive legislative system under the framework of the Unitary Republic of Indonesia.

Abstract

Kemiskinan masih menjadi persoalan kompleks di Kabupaten Tanggamus yang memerlukan solusi komprehensif melalui regulasi dan kebijakan publik. Peraturan Daerah Kabupaten Tanggamus No. 4 Tahun 2022 Pasal 21 tentang Penanggulangan Kemiskinan hadir sebagai instrumen hukum untuk mengatur mekanisme pemberdayaan masyarakat, bantuan sosial, serta keterlibatan berbagai pihak dalam menurunkan angka kemiskinan. Permasalahan akademik yang muncul adalah sejauh mana implementasi perda ini dapat berjalan efektif dalam perspektif fiqh siyasah tanfidziyah, yang menekankan pentingnya pelaksanaan kebijakan secara konsisten, adil, dan berorientasi pada kemaslahatan. Tujuan penelitian ini adalah menganalisis pelaksanaan Pasal 21 Perda No. 4 Tahun 2022, baik dari aspek praktik birokrasi maupun dari perspektif siyasah tanfidziyah, serta menilai dampaknya terhadap upaya pengentasan kemiskinan di Kabupaten Tanggamus. Penelitian ini menggunakan metode kualitatif dengan analisis dokumen dan wawancara terstruktur dengan informan terkait. Hasil penelitian menunjukkan bahwa implementasi Perda telah berjalan melalui program bantuan sosial, pemberdayaan ekonomi masyarakat, serta kemitraan antara pemerintah, dunia usaha, dan masyarakat. Namun, tantangan masih muncul berupa keterbatasan anggaran, validitas data penerima manfaat, serta lemahnya koordinasi antar instansi. Dari perspektif fiqh siyasah tanfidziyah, Perda ini mencerminkan tanggung jawab Pemerintah Daerah dalam menegakkan keadilan sosial, menjaga kemaslahatan, serta melindungi kelompok rentan. Hasil penelitian menunjukan bahwa, Pasal 21 Perda Kabupaten Tanggamus No. 4 Tahun 2022 memiliki peran penting dalam menurunkan angka kemiskinan, meskipun keberhasilan jangka panjangnya sangat ditentukan oleh konsistensi implementasi, transparansi, dan partisipasi aktif masyarakat.

Abstract

Penelitian ini dilatarbelakangi oleh lambatnya responsibilitas pemerintah dalam pelaksanaan pembangunan desa di Pekon Bandar Sukabumi Kecamatan Bandar Negeri Semuong Kabupaten Tanggamus yang dinilai belum sepenuhnya sesuai dengan ketentuan Pasal 82 Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Pasal tersebut memberikan hak kepada masyarakat untuk memperoleh informasi, melakukan pemantauan, serta menyampaikan aspirasi dan keluhan terhadap pelaksanaan pembangunan desa. Penelitian ini bertujuan untuk mengetahui pelaksanaan pembangunan desa menurut Pasal 82 Undang-Undang Nomor 6 Tahun 2014 tentang Desa dan menganalisisnya dalam perspektif Siyasah Tanfidziyyah. Jenis penelitian yang digunakan adalah penelitian lapangan (field research) dengan pendekatan deskriptif kualitatif. Data diperoleh melalui observasi, wawancara, dan dokumentasi yang melibatkan pemerintah pekon, Badan Permusyawaratan Desa (BPD), kepala dusun, dan masyarakat Pekon Bandar Sukabumi. Analisis data dilakukan secara induktif melalui tahapan reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa pelaksanaan pembangunan desa di Pekon Bandar Sukabumi belum berjalan secara optimal. Hal ini terlihat dari masih adanya infrastruktur jalan yang rusak, minimnya penerangan jalan umum, serta kurangnya keterlibatan masyarakat dalam perencanaan dan pengawasan pembangunan. Selain itu, respons pemerintah terhadap aspirasi dan keluhan masyarakat dinilai masih lambat sehingga menghambat efektivitas pembangunan desa. Dalam perspektif Siyasah Tanfidziyyah, kondisi tersebut belum sepenuhnya mencerminkan prinsip amanah, keadilan, tanggung jawab, dan kemaslahatan yang menjadi dasar pelaksanaan kekuasaan eksekutif dalam Islam. Oleh karena itu, diperlukan peningkatan responsibilitas pemerintah desa, transparansi, serta partisipasi masyarakat agar pelaksanaan pembangunan desa dapat berjalan sesuai dengan ketentuan peraturan perundang-undangan dan prinsip-prinsip Siyasah Tanfidziyyah.

Abstract

The employment remuneration practices observed in the majek tradition in Semaka District, Tanggamus Regency reveal significant differences between customary law, the formal regulatory framework, and Sharia principles. The main issues identified in this examination include manifestations of legal ambiguity (gharar) and a lack of protection for workers' rights, stemming from unilateral decisions regarding remuneration and post-harvest wage determination. Data was obtained through comprehensive interviews with landowners and agricultural workers, then analysed through the lens of the principles of Fikih Muamalah and Maqashid Sharia. The findings indicate that the majek tradition fails to meet the legal criteria associated with ijarah contracts due to the prevalence of gharar fahish (excessive uncertainty) regarding wage amounts. Juridically and philosophically, this practice contradicts the principles of justice ('is) and property protection (hifz al-mal) as articulated in Shariah Maqashid. This study advocates the formalisation of direct employment contracts in written form to ensure legal certainty and the protection of agricultural workers, who are positioned as vulnerable parties (mustadh'afin).

Abstract

Regional Regulation of North Lampung Regency Number 07 of 2016 concerning the Village Consultative Body and Village Community Institutions aims to position community institutions as partners of the village government in community empowerment. In practice, however, the implementation of Regional Regulation Number 07 of 2016 in Tanjung Beringin Village has not been carried out optimally. Karang Taruna, as one of the village community institutions, has not been able to perform its community empowerment function as mandated in Article 25 of the Regulation. This condition is reflected in the low level of youth participation, the lack of sustainable empowerment programs, weak coordination between the village government and Karang Taruna administrators and organizational activities that tend to be incidental and more oriented toward entertainment rather than social empowerment. Consequently, there is a discrepancy between the normative provisions that position Karang Taruna as a strategic partner of the village government in community development and the empirical realities found in the field. This study aims to analyze the implementation of Article 25 of the Regional Regulation concerning the role of Village Community Institutions and to examine its implementation from the perspective of fiqh siyasah. This research employs a qualitative method with an empirical approach through field research conducted in Tanjung Beringin Village, Tanjung Raja District. Data were collected through interviews, observations, and documentation. Interviews were conducted with the Village Head, the Head of Karang Taruna, Karang Taruna members, and members of the village community. The collected data were analyzed descriptively and analytically using the perspective of fiqh siyasah. The findings indicate that Karang Taruna in Tanjung Beringin Village has not optimally carried out its community empowerment function as mandated by Regional Regulation Number 07 of 2016. The activities conducted tend to be unsustainable, incidental and more oriented toward entertainment activities rather than community empowerment efforts. From the perspective of fiqh siyasah, this condition reflects the suboptimal implementation of the principles of trustworthiness (amanah), justice and public welfare (maslahah) in the management of village community institutions.

Abstract

Zakat management must evolve from traditional charity to a contemporary development mechanism to fulfill its potential in poverty alleviation. This study aims to comparatively analyze the implementation of the Contemporary Integrated Zakat Distribution Model utilized by the National Zakat Agency (BAZNAS) across three provinces, Lampung, South Sumatra, and Banten, and to empirically measure its impact on the welfare transformation of pre-prosperous families (mustahik). A multi-location case study approach, employing a Mixed-Method framework, was adopted. Qualitative data were gathered through in-depth interviews with BAZNAS managers and mustahik beneficiaries, supported by the analysis of internal reports and policies. Quantitative data on change the economic status of mustahik post-intervention were analyzed descriptively and comparatively to validate the model's effectiveness. The findings confirm that BAZNAS successfully implements an Integrated Model that systematically combines consumptive support (for immediate needs) with productive empowerment (capital, skills training, and human capital investment). This model demonstrates a significant positive impact on sustainable welfare. The quantitative analysis is highly conclusive: the percentage of households classified as pre-prosperous declined substantially, specifically by 31% in Lampung, 35% in South Sumatra, and 40% in Banten. The highest transformation rate in Banten is linked to its strategic focus on educational investments (One Family One Scholar). The research validates that a contemporary, integrated approach to Zakat distribution is effective in achieving socio-economic transformation, thereby supporting the objectives of maqāsid al-sharīah. The results provide an empirical basis for Zakat institutions to prioritize high-impact human capital programs for sustainable poverty exit

Abstract

Rice-field pawning remains a common form of community-based financing in East Lampung, Indonesia, where agricultural land is pledged as collateral to meet urgent economic needs. However, the utilization of pledged land by the murtahin may create an imbalance in rights, obligations, risks, and economic benefits when the arrangement lacks clear contractual boundaries. This study aimed to analyze the utilization of pawned rice fields from the perspective of Sharia economic law and to formulate a reconstruction of justice governing the relationship between rahin and murtahin. A qualitative field research design was employed in Purbolinggo District, East Lampung Regency. Data were collected through field observation, in-depth interviews, and documentation and analyzed through data reduction, data display, and conclusion drawing, supported by source and technique triangulation. The findings revealed that rice-field pawning was predominantly based on oral agreements and customary practice, with the murtahin controlling and cultivating the land and receiving agricultural yields until the debt was repaid, while contractual duration, benefit allocation, and utilization mechanisms remained unclear. The proposed reconstruction emphasizes restoring rahn to its debt-security function, separating the loan agreement from land-utilization arrangements, establishing a definite contractual period, strengthening written documentation, and regulating agricultural benefits proportionately. The study concludes that these mechanisms provide a more balanced framework for protecting both parties, strengthening contractual certainty, and aligning rice-field pawning with Sharia economic law.

Abstract

Community cadres often work between voluntary participation and paid public service. This study examines the service arrangement of Bina Keluarga Balita (BKB) cadres integrated with Posyandu in Natar Village, South Lampung, and evaluates its conformity with ijarah al-asykhash under Islamic economic law. Using empirical legal research with a descriptive qualitative approach, data were collected through interviews, observation, and document review involving ten purposively selected informants from provincial and subdistrict program institutions, the village government, Posyandu management, and BKB cadres. Data were analyzed inductively using source triangulation and a normative matrix covering the parties, consent, services, service period, ujrah, rights, obligations, and dispute prevention. The findings show that the village head's decree establishes organizational membership rather than a complete service contract. Duties and schedules are mainly communicated orally, activities generally follow the monthly Posyandu agenda, and cadres receive IDR 130,000 per month, but these elements are not brought together in one clear agreement. The absence of a written document does not automatically invalidate ijarah because Islamic law recognizes oral agreements. The main weakness is uncertainty about the authorized service recipient, detailed duties, scheduling, the basis and procedure of payment, and responsibility. The arrangement therefore cannot be consistently classified as either pure tabarru' or fully specified ijarah. A two-layer governance model is proposed: an appointment decree that establishes institutional status and a service agreement that clarifies duties, duration, compensation, accountability, complaints, and termination. This model can strengthen preventive legal protection while preserving the community-based character of BKB cadres.
