Abstract

The purpose of this research study aims to dissect the concept of Breach of contract in the civil law of two countries between Indonesia and Malaysia. As a country that has a different legal system but also recognizes Breach of contract or breaking promises in civil relations. In this research method, the type of research that the author uses is normative research. The nature of the research in this paper is the nature of comparative descriptive research. The approach used in this legal research is the statute approach, and the conceptual approach. The results of the study found that the Breach of contract in Indonesian civil law. This is a deviant act committed by one of the parties to the agreement from what was previously agreed without coercion which can result in losses for the opposing party and default in civil law in Malaysia as regulated in the 1950 Contract Law which is called Contract impossibility, a contract may be terminated. If the contracting parties fail to carry out the responsibilities contained in the contract.

Abstract

Bakakarun is a profit-sharing agricultural partnership between landowners and cultivators commonly practiced by the Banjar community. However, this practice raises two key issues under Islamic law: first, the prohibition of mukhābarah contracts in the Shafi’i school, which is predominantly followed by the Banjar; second, improper zakat payment methods, particularly regarding the calculation of nisab from shared harvests. This study employs an empirical legal approach with a descriptive qualitative method, conducted across three villages in Barito Kuala Regency, South Kalimantan. The findings reveal that the bakakarun practice aligns with the principles of mukhābarah as permitted by Imam Nawawi. Nonetheless, errors in zakat calculation persist due to the absence of khulṭah (asset pooling) in determining nisab. It is therefore recommended that zakat be deducted prior to harvest distribution to prevent avoidance of zakat obligations.

Abstract

This study conducts a structured and narrative literature review on istisna’ to map its contemporary applications and identify research gaps within modern Islamic finance. By systematically screening articles across journal quality tiers (Q1–Q4), the review finds that dedicated, high‑quality studies focusing centrally on istisna’ are extremely limited, with only seven papers meeting strict inclusion criteria. The broader body of work tends to treat istisna’ merely as a sub‑topic within more general discussions on Islamic contracts, banking products, or project financing. The review highlights conceptual ambiguities, under‑explored micro and macro applications, and the near absence of research linking istisna’ with digitalisation, fintech, and smart‑contract infrastructures. These gaps underline the need for future empirical and conceptual studies that reposition istisna’ as a dynamic contract capable of supporting innovation in Islamic financial intermediation and real‑sector development.Penelitian ini melakukan narrative literature review yang terstruktur terhadap akad istisna’ untuk memetakan penerapan kontemporernya serta mengidentifikasi celah penelitian dalam konteks keuangan Islam modern. Melalui proses penyaringan artikel secara sistematis berdasarkan tingkatan kualitas jurnal (Q1–Q4), hasil review menunjukkan bahwa penelitian berkualitas tinggi yang secara khusus dan berfokus utama pada akad istisna’ masih sangat terbatas, dengan hanya tujuh artikel yang memenuhi kriteria inklusi yang ketat. Sebagian besar literatur yang ada cenderung membahas istisna’ hanya sebagai subtopik dalam diskusi yang lebih umum mengenai akad-akad syariah, produk perbankan Islam, atau pembiayaan proyek. Review ini menunjukkan adanya ambiguitas konseptual, minimnya eksplorasi penerapan istisna’ pada level mikro dan makro, serta hampir tidak adanya penelitian yang mengaitkan akad istisna’ dengan digitalisasi, teknologi finansial (fintech), dan infrastruktur smart contract. Kesenjangan-kesenjangan tersebut mengindikasikan perlunya penelitian empiris dan konseptual di masa mendatang yang mampu memposisikan kembali akad istisna’ sebagai kontrak yang dinamis, dan berpotensi mendukung inovasi dalam intermediasi keuangan syariah serta pengembangan sektor riil.

Abstract

This study aims to analyze the practice of Islamic stock trading in the perspective of Islamic economic law, the case study of the Indonesia Stock Exchange (IDX) in South Kalimantan. Using a qualitative research method with a field research approach, the author goes directly to the field to conduct observations and interviews related to the Islamic stock trading system at Indonesia Stock Exchange (IDX) South Kalimantan. The object of this research is Sharia Stock Trading Practice. The results of this study are that the mechanism for trading in Indonesian sharia shares uses Sharia Online Trading System (SOTS), namely the omission of the Margin Trading and Short Selling features and the shares traded may only be shares included in the Sharia Securities flat. Even though using the Sharia Online Trading System (SOTS) system, it turns out that several transaction activities that are prohibited by Fatwa of the National Sharia Council of the Indonesian Ulema Council include fake demand/supply, pump and dump, cornering, heading behavior and fear of missing out. In the perspective of sharia economic law, the practice of trading sharia shares in a trading mechanism has been declared to be in accordance with the findings of several prohibited practices, which can make the practice of trading sharia shares inconsistent with the principles of sharia economic law.

Abstract

Program pengabdiaan ini bertujuan untuk meningkatkan kemandirian ekonomi lansia melalui pemberdayaan kewirausahaan berbasis budidaya selada hidroponik.  Kegiatan dilaksanakan menggunakan pendekatan Participatory Rural Appraisal (PRA) yangh diikuti oleh 10 orang lansia  melalui tahapan 1 persiapan, 2 pelatihan, dan 3 evaluasi partisipatif bersama mitra. Tahap persiapan tercapai 100%. Hasil evaluasi menunjukkan 100% peserta menilai narasumber, materi, dan sarana dalam kategori baik. Kemampuan peserta meningkat, ditunjukkan oleh kenaikan kategori “baik” dari 50% menjadi 80% dan tidak ada berkategori “kurang” (0%).  Program efektif meningkatkan pengetahuan dan keterampilan lansia, serta berpotensi mendukung kemandirian ekonomi berbasis usaha hidroponik.

Abstract

The development of financial technology has given rise to various digital payment instruments, one of which is stablecoin. Stablecoins exist as digital assets designed to maintain stable value through support from certain assets such as fiat currency, gold, or algorithms. The presence of stablecoins has sparked legal debate, particularly from the perspective of Islamic Economic Law, as on one hand they offer digital transaction efficiency, yet on the other hand they may contain elements of gharar, riba, and speculation. This study aims to analyse the legality of stablecoins as digital payment instruments from the perspective of Islamic Economic Law, focusing on the elements of gharar, riba, and value stability. The study uses a normative juridical method with a conceptual approach, a legislative approach, and a maqashid sharia approach. The data sources were obtained from the Qur’an, Hadith, DSN-MUI fatwas, Bank Indonesia and OJK regulations, as well as scientific literature related to digital assets and Islamic finance. The research findings indicate that stablecoins have the potential to be accepted within the Islamic economic system if they meet the principles of transparency, possess clear underlying assets, avoid excessive speculation, and maintain transaction value stability. However, algorithmic stablecoins may carry high gharar due to unclear asset backing and system volatility. From the perspective of maqashid syariah, stablecoins can support the benefits of the digital economy if strictly regulated through Sharia regulations and state supervision. This research emphasises the importance of formulating specific Sharia regulations regarding stablecoins within Indonesia's digital financial system.
