Abstract

2016 was highlighted as the year of the biggest and scandalous tax havens report in all over the world: the Panama Papers. This report contributes into country initiation in tax contribution and tax evasion criminalization. It highlights and offers new concept of tax havens by providing the new definition in offshore utilization as a part of tax havens scheme. Hence this thesis focuses on UK and BVI (British Virgin Islands) relations on how they form mutual relations in tax havens network and give a detrimental effect toward tax contribution. United Kingdom and British Virgin Islands form an umbilical relations as overseas territory and part of their financial services, hence their presence as part of United Kingdom tax havens assesses as part of United Kingdom contrary and ambivalance. Therefore this research focuses on how hegemonic country preserved their relations with their former colony into one affiliation, and aims on how harmful London curbs their former colony as a part of their offshore nexus in tax havens.

Abstract

Forest fires in Sumatera which occurs almost every year has become a major problem for Indonesia that need to be resolved. The forest fires is purposely caused by the corporates’ activities which use fires in their land clearing method. On one hand, Indonesia has tried to overcome the problem by creating legal base as the policy to restrict fire utilization for land clearing method done by the corporates. On the other hand, as the primary purpose of corporates is under economic reason for gaining profit, the idea of extracting nature sustainably without interfering ecological balance has not been completely understood. This situation has become a concern regional by ASEAN as it has created serious effect towards other member of states’ territory. In 2002 ASEAN established ASEAN Agreement on Transboundary Haze Pollution (AATHP) as a environmental regime which its purposes is to prevent and monitor transboundary haze pollution as a result of land and/or forest fires through concerted national efforts also intensified regional and international co-operation. Using environmentalism perspective and negotiated environmental agreement, this research shall analyze the problem faced by Indonesia’s government and give its recommendation in the form of creating an environmental protection agreement among the corporates and the civilians.

Abstract

Despite all of the conflicts involving the two countries, in reality, the United States of America has an anti-drug trafficking cooperation with Cuba. Abstract

International Seabed Authority came as an international organization that provided aregime to minimize the territory conflict that feared would be happened among states andminimizing environmental crime that would be occurred in international seabed area whichare beyond any national jurisdiction. As a part of UNCLOS and 1994 Agreement Part XI,the Authority was an international organization which duty is to manage seabed area thatlocated in international territory. But, in its development, United States as an activeparticipant of law of sea treaty development decided to decline the concept of InternationalSeabed Authority and reject the Authority as an international seabed regime until date.United States decided to not join International Seabed Authority and decline mining codeof the Authority as international seabed regime because of politic, economic, social andenvironmental factors which is less profitable if US joined the Authority. Meanwhile, international seabed regime that was built by the Authority is also not in line with USnational interest in international seabed management. Therefore, US established DSHMRA(Deep Seabed Hard Mineral Resource Act) as an alternative legal act to carry out theactivities in the Area. By DSHMRA, US interest in building the hegemony of seabedmanagement could be more facilitated.

Abstract

Japan's participation in World War II against allies encouraged Japan to carry out aggression in East Asian and Southeast Asian countries, including Indonesia. After the Japanese landing in Indonesia on 1942, the Japanese military carried out various policies, one of it was sexual slavery or jugun ianfu. Thousands of Indonesian women were made into Japanese military sex slaves. Women's International War Crimes Tribunal (WIWCT) on Japan's Military Sex Slavery was held in 2000, which judge 10 Japanese war crimes defendants. Jugun ianfu is a systemic crime organized by the Japanese military. This study aims to explain the driving factors of the Japanese Military in committing war crimes against Indonesia in the form of sexual slavery during World War II 1942-1945. This study using historical research method and the library search for data collection. Organizational Culture theory of Constructivism will be used to explain the driving factors of Japanese military commit sexual slavery. This study found that what prompted the Japanese military to commit sexual slavery in Indonesia was influenced by two factors. First, the Japanese military doctrine that is the Imperial Rescript Armed Forces which demanded military compliance with all orders from the Japanese Emperor. Secondly, the doctrine of the Japanese Emperor who ordered the establishment of the jugun ianfu system itself, so that the Japanese military carried out the establishment of a jugun ianfu system in its occupying countries, including Indonesia.
