Abstract

State-Owned Enterprises are business entities whose capital is wholly or substantially owned by the state through direct participation originating from separated state assets. The Board of Directors is responsible for the business activities of the company as stipulated in Article 97 paragraph (1) of the Limited Liability Company Law, so that any decisions cannot be taken without taking into account the elements of prudence and applicable regulations. The purpose of establishing BUMN is to pursue profits, while in making decisions BUMN directors are often faced with decisions that are fraught with the risk of loss or bankruptcy so that a legal umbrella is needed for BUMN directors to relieve the responsibility borne by directors or what is known as the Business Judgment Rule. This study aims to determine the urgency of setting the Business Judgment Rule as a reason for eliminating criminal acts of corruption and this research uses juridical research methods. The research method uses normative juridical research with two approaches, namely the statute approach and case approach. Business decisions that are protected by the principles of the Business Judgment Rule are business decisions taken based on good faith and the principle of prudence. The existence of this principle will make the directors have no doubts in making business decisions because the principle of the Business Judgment Rule is an excuse if in the future there are things that must be accounted for by the directors.

Abstract

 AbstrakSetiap anak yang menjadi korban atau pelaku tidak pidana berhak mendapatkan bantuan hukum. Anak.Untuk mewujudkan perlindungan hukum terhadap anak dalam sistem peradilan pidana anak, telah dibentuk UU11/2012 tentang Sistem Peradilan Pidana Anak sebagai pengganti dari UU3/1997 tentang Pengadilan Anak. Dalam UU tersebut, pemberian bantuan hukum didasarkan pada UU 16/2011 tentang Bantuan Hukum. Namun demikian hak atas bantuan hukum tersebut diperuntukkan bagi orang miskin dan bukan hanya untuk Anak (Pasal 1 angka 2 UU Bantuan Hukum). Penga- turan ini perlu dicermati dan ditata ulang demi terwujudnya perlindungan hukum yang mencerminkan prinsip the best interest of the child dan prinsip non diskriminasi sesuai amanah pembentukan UU Perlindungan Anak. Kata kunci : anak, bantuan hukum, perlindungan anak.

Abstract

Tulisan  ini bertujuan untuk menggali, menganalisis dan menemukan urgensi dan pola bentuk kegiatan diversi anak pada tingkat pennyidikan yang mencerminkan politik hukum UU SPPA. Tulisan ini dibuat berdasarkan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan perbadingan (comparative approach). Hasil penelitian menunjukkan bahwa bentuk pelaksanaan diversi di Indonesia dapat dipertimbangkan melalui pengembangan pendidikan dan pelatihan bagi anak misalnya   fasilitas bagi anak untuk 4 (empat) jenis aktifitas  yaitu olahraga, rekreasi, assistance programs dan kesenian. Di Indonesia, kegiatan tersebut dapat dilakukan dengan menjalin kerjasama dengan dinas sosial dan LSM. Selanjutnya kegiatan yang diberikan pada anak disesuakan dengan karakteristik daerah dan menyesuaikan bakat dan minat anak.

Abstract

Tulisan merupakan hasil penelitian yang  bertujuan  untuk :  (1) menggali dan menganalisis ratio legis pembentuk undang-undang menetapkan pidana pelatihan kerja sebagai pengganti denda bagi ana, dan : (2) menawarkan konsep pidana pelatihan kerja sebagai pengganti denda yangberkemanfaatan dalam perspektif perlindungan anak. Untuk menjawab tujuan tyersebut, digunakan metode penelitian normatf, dengan pendekatan peraturan perundang-undangan.Hasil penelitian menunjukkan bahwa  ratio legis penetapan pidana pelatihan kerja sebagai pengganti denda dalam Undang-Undang No. 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak adalah sebagai berikut: (1)( pidana denda tidak dikenakan pada anak-anak di bawah umum, karena asumsinya mereka belum bekerja. Bila denda  dijatuhkan pasti yang akan membayar adalah orangtuanya. Oleh sebab itu, tidak ada pidana denda di dalam Undang-Undang ini. (2) diharapkan agar lebih baik anak sendiri bertanggung jawab terjhadap perbuatan yang dilakukannya. Oleh karena itu, mungkin karena anak tidak bisa bekerja atau tidak punya uang, harus dicari alternatif lain supaya anak merasa dia bertanggung jawab terhadap perbuatannya yaitu pelatihan kerja. Selanjutnya, konsep pidana pelatihan kerja sebagai pengganti denda bagi anak yang berkemanfaatan adalah berikut ini. (1) Pidana pelatihan kerja sebagai pengganti denda bagi anak yang diberikan harus meminta pertimbangan dari anak, pertimbangan yang diberikan anak berkaitan dengan bakat dan minat anak;  (2) Pidana pelatihan kerja sebagai pengganti denda bagi anak harus memp[erhatikan prinsip perlindungan anak sebagaimana tertuang dalam UU Perlindungan Anak dan UU SPPA dan juga harus sesuai dengan tujuan peradilan anak. (3) Pidana pelatihan kerja sebagai pengganti denda bagi anak harus dilaksanakan oleh lembaga yang berwenang dan  berkompeten sesuai dengan  bakat dan minat anak sehingga memberikan manfaat bagi anak.

Abstract

This article aims to examine the inmates position as a justice collaborator in the disclosure of organized crime that can assist law enforcement officers. This is againstthe backdrop of crown witnesses who are often used in proving criminal cases but are judged to be in violation of human rights. The difficulty of disclosure of organized crime is that the perpetrators involved in organized crime are bound by the oath of silence (omerta). Information from inmates related to crime networks he has committed, facilitates the disclosure of organized crime by law enforcement officers. This paper is based on the results of legal research with a statutory approach, conceptual approachand comparative approach. The results showed that inmates as justice collaborators have a role that can be utilized by law enforcement officials in uncovering organized crime as well as as a form of correcting the wrongdoing of the inmates themselvesas in the purpose of funding, so that inmates can be accepted back into society.

Abstract

The LGBT (Lesbian, Gay, Bisexual, and Transgender) community represents a sexual orientation and behavior that diverges from religious doctrine and societal norms in Indonesia. Recent revelations have shown instances of LGBT behavior among TNI soldiers, prompting discussions on how the Military Justice system handles such cases. This study delves into the philosophical underpinnings of the Panel of Judges' considerations regarding evidence of criminal acts related to LGBT behavior, particularly focusing on Article 103 of the Indonesian Criminal Code and Military Criminal Law. Utilizing a normative research approach with a comparative perspective on judicial decisions from two military courts, the research aims to provide insights into the resolution of LGBT-related cases within the military context. Ultimately, it concludes that LGBT behavior within Military Courts constitutes immoral conduct and may result in severe sanctions under the provisions of Articles 281 and 103 of the Criminal Code

Abstract

Monopoly is regulated in the regulation of State-Owned Enterprises (SOEs) as the right to regulate (bestuur) all state resources as mandated by the constitution of Article 33 of the 1945 Constitution and also the BUMN Law Number 19 of 2003 where one of them is a company that is an entity a government-owned business in the form of a limited liability company. The capital is divided into wholly or at least 51 percent of the shares owned by the Republic of Indonesia with the main objective of pursuing profit. In the case of SOEs, corporate actions are determined by the direction of state policies in their economy. Problem formulation based on the above background, is monopolistic and de-monopoly practices against SOEs, inconsistency of the government? This research used normative juridical with a quantitative analytical approach and examines literature studies that conclude. The study results showed that corporate action was not doubt or inconsistency in implementing a state monopoly. However, this holding was to increase the capacity and existence of SOEs as agents of development and the state in managing resources related to many people’s lives.

Abstract

This article aimed to discuss the Islamic law notes on child-friendly justice and the importance of protecting children's rights during the juvenile process. The reform of Juvenile Justice in Indonesia was based on the UN convention, where on January 26, 1990, in New York, the Indonesian Government signed the 1989 Convention on the Rights of Children. Thus, to protect children through criminal law, paying attention to the principles in the Convention on the Rights of the Child has been the norm. The Child Protection Law in Indonesia has regulated the age limit for a child who can be held accountable. The existence of provisions regarding the minimum age limit for children in the law is what is required by international documents, especially regarding the minimum age of criminal responsibility, namely at least 12 years. Such provisions are parallel to The Beijing Rules, which recommend an age limit that is not too low. The problem is the provision of the law that children under 12 years (meaning between 8-12 years) can still be processed for trial and can be subject to action. Even at the age of 8 years, it is still possible to process. The problem is whether the eight-year age limit needs to be higher. Even though they were not punished and were only subject to action, the experience during the process of being submitted to trial did not bring stigma and negative impacts for children of young age. Abstract

This paper aims to explore the essence of the excuse defense for child offenders and justice for victims. In uncovering its meaning, doctrinal research is conducted with a legislative and conceptual approach, accompanied by a teleological interpretation of legal materials. The research findings indicate that the excuse defense is granted to children under the age of 12 who commit criminal offenses not because their actions are forgiven but due to their inability to form intent or comprehend the consequences of their actions. On the other hand, victims, as the injured party, must also receive justice. The author believes that the government should reconsider the application of the excuse defense for children. The government must also be more selective in determining appropriate sanctions for children based on the nature of the crime committed. If the child's actions result in significant material or immaterial harm, restorative justice may serve as a viable option to balance the interests of both parties, restore the victim's situation, and divert the child from judicial proceedings, thereby achieving a win-win solution.

Abstract

This research discusses how former terrorism convicts or prisoners can be accepted in society using the company's CSR funding assistance approach. The author finds a vacuum in the legal norms because the Terrorism Law only regulates efforts to prevent and suppress terrorism. Through an empirical research model by inviting sources for interviews, it is hoped that this research can provide an overview of the revision of the Terrorism Law and the social reintegration model for former convicts. This research indicates that it is necessary to amend the Terrorism Law and reconceive BNPT as an institution to prevent acts of terror in Indonesia. Abstrak Penelitian ini membahas tentang bagaimana mantan narapidana terorisme atau napiter bisa diterima di tengah masyarakat dengan pendekatan bantuan dana CSR perusahaan. Penulis menemukan bahwa terdapat kekosongan norma hukum yang mengaturnya, sebab UU Terorisme hanya mengatur upaya pencegahan dan penindakan terorisme saja. Melalui model penelitian empiris dengan manghadirkan narasumber untuk di wawancara, penelitian ini diharapkan bisa memberikan gambaran untuk revisi UU Terorisme dan model reintegrasi sosial mantan napiter. Hasil dari penelitian ini menunjukkan bahwa perlu dilakukan amaendemen UU Terorisme dan rekonsepsi BNPT sebagai lembaga pencegahan aksi teror di Indonesia.
