Abstract

Tindak pidana pencabulan sesama jenis pada anak diatur dalam Undang-Undang Nomor 35 Tahun 2014 Perubahan atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Dalam Putusan Nomor 18/Pid.Sus/2017/PN.Pdg dan Putusan Nomor 243/Pid.Sus/2017/PN Pdg, tercantum beberapa bentuk Pertimbangan Hakim dan Sanksi Pidana Dalam Menjatuhkan Putusan Terhadap Tindak Pidana Pencabulan Sesama Jenis Pada Anak. Penelitian ini bertujuan untuk mengtahui sanksi pidana yang dijatuhkan oleh hakim terhadap tindak pidana pencabulan sesama jenis Pada Putusuan Nomor 18/Pid.Sus/2017/PN.Pdg dan Putusan Nomor 243/Pid.Sus/2017/PN.Pdg?. Penelitian ini merupakan penelitian normatif dengan pendekatan penelitian hukum yang in-concreto. Menggunakan bahan hokum primer, sekunder dan tersier yang diperoleh melalui studi dokumen berupa Putusan Nomor 18/Pid.Sus/2017/PN.Pdg dan Nomor 243/Pid.Sus/2017/ PN.Pdg Sanksi Pidana yang Dijatuhkan Oleh Hakim Terhadap Tindak Pidana Pencabulan Sesama Jenis Pada Anak pada Putusan Nomor 18/Pid.Sus/2017/PN.Pdg dan Putusan Nomor 243/Pid.Sus/2017/PN.Pdg sama-sama berbentuk pidana pokok yang terbagi pada dua bentuk yaitu pidana penjara dan pidana denda. Namun, besar sanksi pidana yang dijatukan oleh Majelis hakim berbeda. Pada Putusuan Nomor 18/Pid.Sus/2017/PN.Pdg, sanksi pidana yang dijatuhkan oleh Hakim terhadap pelaku, M. Kiki Fernanda Pgl. Mami Kiki Als. Amak adalah berupa pidana penjara selama 5 (lima) tahun dan denda sejumlah Rp.500.000.000,00 (lima ratus juta rupiah), dengan ketentuan apabila denda tersebut tidak dibayar diganti dengan pidana kurungan selama 1 (satu) bulan. Pada Putusan Nomor 243/Pid.Sus/2017/PN.Pdg sanksi pidana yang dijatuhkan oleh Hakim terhadap pelaku, Mayferi Mahyudin panggilan Feri adalah berupa pidana penjara selama: 7 (tujuh) tahun dan denda sebesar Rp.400.000.000,- (empat ratus juta rupiah) dengan ketentuan apabila denda tersebut tidak dibayar diganti dengan pidana kurungan selama: 1 (satu) bulan.

Abstract

Undang-undang Nomor 4 Tahun 2009 Pasal 1 tentang mineral dan batubara melarang kegiatan Pertambangan Emas Tanpa Izin (PETI). Namun dalam kenyataannya Pertambangan Emas Tanpa Izin (PETI) banyak terjadi, salah satunya adalah di Kabupaten Sijunjung. Kegiatan dari para penambang yang tidak memiliki izin ini sudah menjadi perkerjaan utama/tetap. Dalam hal tertangkap tangan, maka yang dijerat adalah para pekerja saja tanpa menangkap pemilik modal atau beking yang selalu lepas dari jerat hukum. Komplesitas masalah PETI bukan tanpa jalan keluar. Peneggakan hukum oleh Pihak Kepolisian Kabupaten Sijunjung sangat diperlukan dalam upaya pencegahan kerusakan lingkungan hidup dan memberikan efek jera. Penelitian ini merupakan penelitian hukum dengan spesifikasi penelitian yang bersifat deskriptif analitik. Pendekatan yang digunakan adalah yuridis normative sebagai pendekatan utama didukung pendekatan yuridis empiris. Data yang digunakan adalah data sekunder dan data primer sebagai data pendukung yang dikumpulkan melalui studi kepustakaan dan studi lapangan dengan teknik wawancara. Data tersebut kemudian dianalisis secara kualitatif dan disajikan dalam bentuk deksriptif kualitatif.

Abstract

Pasal 4 ayat (1) huruf e Peraturan Komisi Pemilihan Umum Republik Indonesia Nomor 9 Tahun 2020 Tentang Perubahan Keempat Atas Peraturan Komisi Pemilihan Umum Nomor 3 Tahun 2017 Tentang Pencalonan Pemilihan Gubernur Dan Wakil Gubernur, Bupati Dan Wakil Bupati, Dan/Atau Walikota Dan Wakil Walikota mensyaratkan calon mampu secara jasmani, rohani dan bebas penyalahgunaan narkotika berdasarkan hasil pemeriksaan kesehatan menyeluruh dari tim dokter yang terdiri dari dokter, ahli psikologi dan Badan Narkotika Nasional (BNN). Pendekatan pada penelitian menggunakan pendekatan Yuridis Normatif yang didukung pendekatan Yuridis Empiris. Kepastian Hukum Penetapan Hasil Tes Kesehatan IDI Terhadap Pasangan Calon Pada Pemilihan Kepala Daerah Kabupaten Solok 2020 adalah menentukan standar Minimal dalam melaksanakan tes Kesehatan. Ikatan Dokter Indonesia (IDI) dipastikan bertindak secara independen, IDI merekomendasikan dokter-dokter yang memenuhi persyaratan. Dokter yang tugaskan tidak boleh memiliki hubungan apapun dengan bakal calon. Selain itu harus siap bekerja diluar jam kerja sesuai dengan ketentuan berdasarkan regulasi yang dipaparkan. Guna Kepastian hukum terhadap hasil tes Kesehatan maka bagi pasangan calon yang tidak lolos dapat mengajukan gugatan keberatan ke Bawaslu. Selanjutnya Bawaslu akan merekomendasikan untuk melakukan tes kesehatan ulang dan jika kembali tidak lolos tes kesehatan maka panwaslu akan menerbitkan SK bagi pasangan yang tidak lolos tes Kesehatan. Pasangan calon bisa melakukan upaya hukum ke PTUN terkait penetapan tidak lolos tes kesehatan yang dikeluarkan oleh KPU. Kendala-Kendala Yang Ditemukan Dalam Penetapan Hasil Tes Kesehatan IDI Terhadap Pasangan Calon Pada Pemilihan Kepala Daerah Kabupaten Solok 2020 Dan Solusinya diantaranya Kurang nya sarana dan prasarana kesehatan di daerah. Ketidak percayaan pasangan calon pilkada terhadap pelaksanaan tes kesehatan oleh IDI, Kurangnya sumber daya manusia terutama tenaga kesehatan yang berkualitas di daerah.

Abstract

Pasal 374 KUHP mengatur tentang tindak pidana penggelapan dengan pemberatan yaitu penggelapan yang dilakukan oleh orang yang penguasaannya terhadap barang disebabkan karena ada hubungan kerja atau karena pencarian atau karena mendapat upah untuk itu, perbuatan ini diancam dengan pidana penjara paling lama lima tahun. Di Rumah Sakit Yos Sudarso Padang telah terjadi tindak pidana penggelapan yang dilakukan oleh karyawan selaku kasir dengan cara menggelapkan uang pembayaran pasien pribadi sehingga menyebabkan kerugian bagi pihak Rumah Sakit. Atas kerugian yang dialami, Direktur Rumah Sakit Yos Sudarso Padang melaporkan perbuatan para pelaku ke Polresta Padang sesuai yang tertuang dalam Laporan Polisi Nomor: LP/330/K/VI/2020/SPKT Unit II, tanggal 27 Juni 2020. Penelitian ini merupakan penelitian hukum dengan spesifikasi penelitian yang bersifat deskriptif analitis. Pendekatan yang digunakan adalah pendekatan yuridis normatif sebagai pendekatan utama didukung pendekatan yuridis empiris. Penyidikan tindak pidana penggelapan dalam jabatan yang dilakukan oleh karyawan Rumah Sakit Yos Sudarso Padang pada Satreskrim Polresta Padang diawali dengan dibuatnya Laporan Polisi oleh Direktur Rumah Sakit Yos Sudarso Padang, kemudian penyidik Satreskrim Polresta Padang melaksanakan penyelidikan terhadap dugaan tindak pidana itu. Setelah ditemukan bukti permulaan yang cukup penyidik meningkatkan status perkara ke Penyidikan dan melaksanakan rangkaian tindakan penyidikian berupa pemeriksaan saksi-saksi, penyitaan, penangkapan dan penahanan. Selanjutnya berdasarkan hasil penyidikan, penyidik berkesimpulan bahwa para tersangka telah melanggar Pasal 374 juncto Pasal 372 KUHP. Kendala dalam penyidikan tindak pidana penggelapan dalam jabatan yang dilakukan oleh karyawan Rumah Sakit Yos Sudarso Padang pada Satreskrim Polresta Padang adalah orang yang melakukan pembayaran uang pasien pribadi kepada para tersangka selaku kasir tidak memenuhi panggilan dengan alasan tidak mau terlibat dalam perkara pidana.

Abstract

This research examines disciplinary law enforcement through the Online Civil Service System (KEPO), its obstacles and impact on ASN discipline. This type of research is normative juridical supported by empirical juridical. The data used is secondary and primary data. Secondary data was obtained from document studies and primary data was obtained by interviews. The data obtained was analyzed qualitatively, presented in a qualitative descriptive manner. First research results: In general, enforcement of disciplinary law through the KEPO system for ASN at the Kantor Camat Lubuk Sikarah is less effective. Even though discipline has been enforced by reducing or cutting additional employee income in accordance with Solok Mayor Regulation Number 17 of 2022 concerning Providing Additional Income to Regional ASN Employees. Second, the obstacles in enforcing disciplinary law through the KEPO system are: a) the legal factor is still weak: regulating the presence of a 50 meter radius, b) the law enforcement factor is still reluctant, c) the server facility factor is inadequate, d) the community understanding factor ASN in Kantor Camat Lubuk Sikarah regarding KEPO, e) Cultural Factors in the work environment in Lubuk Sikarah District, ASN's culture is reticent. Another finding from the research: there are ASNs who do not yet have an Android cellphone (camera) and a stable internet network. Meanwhile, the impact of implementing or enforcing ASN disciplinary laws on ASN performance in general has relatively increased, although it is still not effective.

Abstract

Broadly speaking, gather and issue opinions as stipulated in Article 28 (e) Paragraph (3) of the 1945 Constitution, independence expresses opinion as stipulated in Law No. 9 of 1998, then everyone has the right to freedom of association. The practice is in the field, many demonstrations taste or demonstration that ended in riots that led to anarchists. In carrying out the task of handling mass riots during the Police demonstration using 1) Perkap No. 16 of 2006 concerning Mass Control Guidelines, 2) Protap/1/X/2010 concerning Countermeasures for Anarchy, 3) Perkap No. 1 of 2012 concerning Mass Unraveling Platoon, 4 ) Perkap No. 7 of 2012 concerning Procedures for Organizing Services, Safeguards and Handling of Cases of Public Opinion. The problems in this thesis are: First, how is the use of force by the Padang Police Satsabhara in dealing with anarchist demonstrations in Padang City? Second, the obstacles encountered by Padang Satsabhara in handling anarchist demonstrations in Padang City and how to overcome these obstacles? Third, how effective is the use of force by the Padang Police Satsabhara in handling anarchist demonstrations in Padang City?The specification of this research is a descriptive analytical study. The approach used is normative juridical as the main approach and supported by an empirical juridical approach. The data used is secondary data and primary data. The data obtained were analyzed qualitatively and presented descriptively analytically. Based on the research and discussion, it can be seen that: First, the use of force by Satsabhara Polresta Padang in handling anarchist demonstrations in Padang City includes organizing services, organizing security and handling cases, carried out by using force, such as in the preparation stage before the demonstration , in the event of anarchist demonstrations and at the time of anarchist demonstration activities are over. Second, the obstacles encountered by Padang Satsabhara Polresta in handling anarchist demonstrations in Padang City are human rights problems, provocation from certain parties, legal unconsciousness of the community and lack of coordination with the Police and related agencies. Whereas the efforts made in handling the demonstration are; a). pre-emptive effort, b). preventive efforts, c). repressive efforts. Then the Police also made several efforts, namely by increasing the professionalism of members of the Police, coordinating with relevant agencies and conducting legal counseling to the community. Third, the effectiveness of the use of force by the Padang Police Satsabhara in handling anarchist demonstrations in Padang City based on its duties and authorities has shown performance in police actions to deal with anarchic demonstrations in Padang City that are optimal with the number of anarchist rallies in Padang City that have been handled.

Abstract

Law Number 23 of 2014 concerning Regional Government mandates the District Government to provide guidance and empowerment to the Village / Nagari Government through the Regional Apparatus / Camat organization. Article 226 paragraph (1) of Law Number 23 of 2014 concerning Regional Government states that in addition to carrying out the tasks referred to in article 25 paragraph (1) the Camat receives the delegation of part of the Regent / Mayor's authority to carry out part of the government affairs which fall under the authority of the Regency / City. Based on the background of the above thought, the problems discussed are, first, how is the implementation of the Camat's authority in empowering the Nagari government in Suliki District, Lima Puluh Kota Regency? and second, what are the obstacles faced in empowering Nagari government in Suliki District, Lima Puluh Kota district? This research is a descriptive analytical study, with the normative juridical approach as the main approach and the empirical juridical as the support for the main approach. The data collected are secondary data and primary data. Data collection techniques with field studies through interviews for primary data and literature study for secondary data. The data obtained were analyzed qualitatively and presented in descriptive analytical form, which only described how the Camat's authority was exercised, the obstacles faced and the efforts made to overcome obstacles in the implementation of the Camat's authority in empowering the Nagari Government in Suliki District, Lima Puluh Kota Regency. Based on the results of research and discussion, it can be concluded that Law Number 23 of 2014 concerning Regional Government, Government Regulation Number 17 of 2018 concerning Districts and Regulation of the Regent of Fifty Cities Number 72 of 2016 concerning the Position of the Organizational Structure, Duties and Functions and Administration of the sub-districts has arranged in detail the duties and authorities of the Camat in empowering the Nagari government. However, the fact is that the guidance, empowerment and supervision of the nagari are mostly carried out by sectoral institutions / agencies. This, of course, will indirectly result in a reduction in the authority of the Camat in carrying out activities, especially those concerning Nagari governance. As a result, the control range is too far causing ineffective and inefficient implementation of tasks in the sub-district as well as in the nagari. The obstacles faced by the sub-district head in the process of empowering the village government are the limited and unclear authority which results in unallocated budgets to empower the village government and the lack of coordination between the District Government and the Nagari Government. The effort made by the sub-district head is to continue carrying out his duties in accordance with the Regulation of the Regent of Fifty Cities Number 72 of 2016 concerning 2016 concerning the Position of the Organizational Structure, Duties and Functions and Work Procedures of the sub-districts

Abstract

Article 2 of Law Number 51 Prp of 1960 concerning Prohibition of Land Use Without Permission from the Entitled Person or his legal proxy. This research is a legal research with a descriptive analytical specification. The implementation of coordination between the Padang Pariaman Police Criminal Investigation Unit and the Padang Pariaman BPN/ATR in the investigation of the prohibition of land use without a permit or legal proxy is in terms of proving the status of ownership of the land. The National Land Agency was asked for information regarding land grabbing because the authorities and understanding of land grabbing are related to the legality of ownership of the land, even though the reporting party has shown proof of ownership but still requires information from the National Land Agency. Coordination is also carried out in terms of testing the validity of the documentary evidence collected by investigators in land grabbing cases. Obstacles in Coordination Between the Padang Pariaman Police Criminal Investigation Unit and Padang Pariaman BPN/ATR in Criminal Investigations for Prohibition of Land Use Without a Permit or Legal Proxy, among which are often difficult to distinguish the authenticity of proof of land ownership and the existence of overlapping land ownership which this cannot be proven by BPN as the institution that issued the evidence on the pretext of differences in leadership policies at that time. There are different agencies issuing proof of ownership of the same plot of land to different parties. The existence of falsification of land documents so that the Land Agency takes a long time to test the authenticity of these documents and makes the investigation take a long time.

Abstract

The Republic of Indonesia Prosecutor's Office Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice is the legal basis used by the Republic of Indonesia Prosecutor's Office in resolving minor crimes through restorative. Based on this regulation, the Pariaman District Prosecutor's Office for the last 2 (two) years from 2020 to June 2022 succeeded in resolving criminal acts that occurred with the concept of Restorative Justice as part of law enforcement. two) cases, 2 (two) cases of torture. The approach used in this study is a normative juridical approach which is supported by an empirical juridical approach. The data used are secondary data as the main data and primary data as supporting data, which were collected through library research and field studies with interview techniques. All data were then compiled and analyzed qualitatively, and presented in a qualitative descriptive form. Results Based on the research it can be explained that: First, the Juridical Implications of the Republic of Indonesia Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice Against Criminal Suspects, the Pariaman District Prosecutor's Office succeeded in committing 4 (four) criminal acts throughout 2020 until June 2022 with the Restorative Justice Method. However, only 2 (two) criminal acts ended peacefully and did not proceed to the District Court. Second, the obstacles faced by the Prosecutor's Office in implementing the Regulation of the Prosecutor's Office of the Republic of Indonesia Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice against suspects of criminal acts consist of legal and non-legal obstacles. The legal obstacle is that the position of the prosecutor's regulation itself is not strong enough because the process of delaying the regulation is only regulated by a Ministerial-level regulation. Abstract

Ministerial Regulation ATR/BPN Number 5 of 2020 concerning Electronically Integrated KPR Services has changed conventional mortgage services to an electronic system. With the enactment of Ministerial Regulation ATR/BPN Number 5 of 2020, every land office in Indonesia has provided pawning services electronically. The Pesisir Selatan District Land Office has implemented electronically integrated KPR services. The specification of this research is descriptive analysis. The approach used in this study is a normative juridical approach as the main approach which is supported by an empirical juridical approach. Based on the results of the research, discussion, and analysis it can be concluded as follows: First, the application of Ministerial Regulation ATR/BPN Number 5 of 2020 in Electronically Integrated Pawning Activities at the Land Office of Pesisir Selatan Regency is that when registering Mortgage Rights manually the PPAT must come in person to the BPN office representing the bank takes care of everything up to the issuance of the Mortgage certificate, now the PPAT's task is only to submit APHT through the electronic system. The second obstacle encountered in the Implementation of Permen ATR/BPN Number 5 of 2020 in Electronically Integrated Pawn Service Activities at the Pesisir Selatan District Land Office is more likely to be technical problems related to electronic systems, such as server interruptions and power outages.
