Abstract

Penelitian ini bertujuan untuk mengevaluasi efektivitas penerapan Undang-Undang Nomor 16 Tahun 2019 sebagai revisi dari Undang-Undang Nomor 1 Tahun 1974 mengenai batas usia pernikahan dalam upaya mengurangi pernikahan dini di Desa Soligir, Kabupaten Bolmut. Selain itu, penelitian ini juga berupaya merumuskan langkah-langkah yang dapat diambil oleh pemerintah desa untuk meningkatkan pencegahan pernikahan di bawah umur. Metode yang digunakan dalam penelitian ini adalah pendekatan hukum empiris dengan teknik kualitatif, yang melibatkan observasi langsung serta wawancara dengan pihak terkait. Hasil penelitian tersebut menunjukkan bahwa Undang-Undang Nomor 16 Tahun 2019 tentang ketentuan terkait pernikahan yang berkaitan dengan batasan usia pernikahan belum diterapkan secara efektif. Minimnya upaya penyadaran pemerintah desa Soligir telah menghalangi masyarakat untuk memahami peraturan-peraturan yang berkaitan dengan perubahan hukum, padahal penerapan kebijakan ini berdampak pada menurunnya angka pernikahan dini di desa tersebut. Selain itu, upaya yang dilakukan aparat Desa Soligir dalam mencegah dan mengurangi pernikahan dini adalah dengan meningkatkan kesadaran akan perubahan Undang-Undang Perkawinan, memberikan pendidikan kesehatan reproduksi bagi remaja, dan menerapkan peraturan yang lebih tegas mengenai pernikahan dini di Desa Soligir. Oleh karena itu, dalam rangka meningkatkan kesadaran masyarakat dan kepatuhan terhadap peraturan perundang-undangan yang relevan, Pemerintah Desa Soligir diharapkan dapat meningkatkan sosialisasi mengenai pengaturan batas usia pernikahan sesuai dengan Undang-Undang Perkawinan dan memberikan pemahaman yang lebih mendalam tentang akibat dari pernikahan dini. Abstract

Penelitian ini bertujuan untuk mengkaji pertanggungjawaban hukum notaris dalam penyusunan Surat Keterangan Waris (SKW), khususnya apabila terjadi kelalaian dalam mencantumkan seluruh ahli waris yang secara hukum berhak. Fokus permasalahan terletak pada sejauh mana notaris dapat dimintai pertanggungjawaban atas tindakan kelalaian tersebut serta konsekuensi hukum terhadap keabsahan akta-akta yang menjadikan SKW sebagai dasar pembentukannya. Metodologi yang diterapkan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan analisis doktrinal terhadap bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa notaris yang melakukan kelalaian dalam menyusun SKW berpotensi dimintai pertanggungjawaban secara perdata, administratif, maupun pidana. SKW yang tidak mencantumkan seluruh ahli waris secara utuh dapat menimbulkan implikasi yuridis berupa pembatalan keabsahan akta turunan oleh pengadilan, yang berdampak pada ketidakpastian hukum dan potensi konflik antar pihak. Temuan ini menggarisbawahi pentingnya prinsip kehati-hatian, integritas profesi, serta jaminan kepastian hukum dalam setiap tindakan dan produk hukum yang dihasilkan oleh notaris

Abstract

Abstrak Permasalahan yang berhubungan dengan sampah kini semakin memburuk, disebabkan oleh rendahnya kesadaran masyarakat dalam memilah serta mengelola sampah khususnya sampah rumah tangga. Program pengabdian ini dirancang untuk meningkatkan pengetahuan dan keterlibatan masyarakat dalam pengelolaan sampah rumah tangga melalui pendekatan yang edukatif, seperti memberikan penyuluhan hukum. Sasaran dari kegiatan ini adalah kelompok ibu-ibu rumah tangga di Kelurahan Tomulobutao dengan jumlah peserta 25 orang. Metode yang diterapkan dalam kegiatan ini mencakup kegiatan observasi dan penyuluhan hukum sebagai salah satu upaya untuk memberikan pemahaman kepada kelompok ibu-ibu. Dari pelaksanaan kegiatan ini, diperoleh hasil bahwa kelompok ibu-ibu tidak hanya diberikan pemahaman terkait cara mengelola sampah dengan baik, tetapi juga diberikan pemahaman mengenai sanksi hukum bagi mereka yang tidak mengindahkan aturan. Oleh karena itu, diharapkan kegiatan yang dilakukan dapat memotivasi kelompok ibu-ibu untuk menangani sampah secara bijak dan berkelanjutan. Kata kunci: kesadaran; masyarakat; pengelolaan; sampah. Abstract Waste-related problems are worsening due to low public awareness regarding waste sorting and management, particularly household waste. This community service program is designed to increase public knowledge and involvement in household waste management through an educational approach, including legal counselling. The target group of 25 housewives in Tomulobutao Village was a group of housewives. The methods used in this activity included observation and legal counselling as an effort to provide understanding to the group. The results showed that the group of mothers was not only provided with an understanding of how to manage waste properly but also about the legal sanctions for those who disregard regulations. Therefore, it is hoped that this activity will motivate the group of mothers to manage waste wisely and sustainably. Keywords: : awareness; community; management; waste.

Abstract

The increasingly rampant conversion of agricultural land in Gorontalo City poses a threat to the sustainability of Sustainable Food Agricultural Land (LP2B), so a legal study is needed from a land use perspective. This study aims to analyze the protection of Sustainable Food Agricultural Land (LP2B) in Gorontalo City from a land use perspective. This study uses an empirical legal approach with qualitative methods, through interviews with technical agencies and farmers and analysis of policy documents. The results show that LP2B protection in Gorontalo City has not been optimally implemented due to the absence of specific regional regulations that regulate LP2B protection in detail. This regulatory weakness is exacerbated by the vulnerable socioeconomic conditions of farmers, high urban development pressures, and weak inter-agency coordination in monitoring and controlling land use conversion. Although there are land replacement policies and outreach to farmers, these steps have not been able to address the structural challenges of LP2B protection. Therefore, it is necessary to formulate regional regulations on LP2B protection, integrate spatial data into the RTRW (Regional Spatial Plan), strengthen land use monitoring, and provide incentives to agricultural actors to maintain food security and agrarian sustainability in Gorontalo City.

Abstract

The rapid development of digital technology has led to the emergence of crypto assets as a new financial instrument that is starting to be considered as collateral for banking transactions in Indonesia. Although crypto has been recognized as a digital commodity that can be traded on futures exchanges, there are currently no specific regulations explicitly governing its use as collateral for bank loans. This study aims to analyze the legal aspects, practical challenges, and risk management faced by banks in accepting crypto as collateral. The research method used is a normative legal method with a statutory and conceptual approach, supported by a literature review and comparative analysis of international practices. The results show that although crypto meets the criteria for collateral from a civil law perspective, banks still face several significant challenges, such as high price volatility, digital security risks, and the lack of standard operating procedures related to the assessment and execution of crypto collateral. Therefore, banks tend to position crypto as additional collateral, rather than primary collateral, to minimize the risk of loss. This study recommends the need to establish a more comprehensive and adaptive legal framework, strengthen technological infrastructure, and improve digital financial literacy to support the safe and effective implementation of crypto as collateral. Thus, synergy between regulators, industry players, and the public is essential to create an inclusive and sustainable digital financial ecosystem in Indonesia.

Abstract

This research aims to examine the binding force of coastal border land regulations and the mechanism for issuing land certificates by the National Land Agency (BPN) in Botutonuo Village, Bone Bolango Regency. The background of this research is based on the increasing land ownership conflicts in coastal areas, particularly regarding the coastal boundary limits, which are regulated to be at least 100 meters from the highest tide line as stated in Presidential Regulation Number 51 of 2016. The research method used is empirical law with a qualitative approach, thru interviews with the community, village officials, and the National Land Agency (BPN), direct observation in the field, and literature studies. The research results show that the coastal community of Botutonuo has inherited land ownership, but when the certification process was carried out thru the PTSL, PRONA, or sporadic registration programs, problems arose because some of the land parcels for which certificates were issued were located in coastal buffer zones. This creates conflict between customary rights, the economic interests of the community, and the country's legal rules. On the one hand, land certificates provide legal certainty, access to capital, and improved well-being; however, on the other hand, their issuance has the potential to violate ecological aspects and cause disputes between residents. The findings of this research confirm the importance of harmonization between land regulations, environmental conservation, and the economic needs of coastal communities to achieve social justice and sustainable coastal space management.

Abstract

Penyelesaian sengketa lingkungan hidup melalui mediasi merupakan hal yang penting dalam upaya penegakan hukum lingkungan hidup, terutama setelah diberlakukannya Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja (UUCK) yang lebih memperhatikan perlindungan keperdataan masyarakat (Pasal 91 ayat (2) huruf d Undang-Undang Nomor 11 Tahun 2020). Tujuan dari penelitian ini adalah untuk mengevaluasi eksistensi mediasi sebagai bentuk penyelesaian sengketa lingkungan hidup dan kendala yang dihadapi dalam penggunaannya setelah diberlakukannya UUCK. Penelitian ini menggunakan pendekatan yuridis normatif, dengan fokus pada analisis perundang-undangan dan konsep hukum. Dalam penelitian ini, ditemukan bahwa eksistensi mediasi dalam penyelesaian sengketa lingkungan pada prinsipnya telah menjadi budaya masyarakat Indonesia sejak dulu dan eksistensi berkembang dengan hadirnya berbagai peraturan perundang undangan misalnya SEMA Nomor 1 Tahun 2002 tentang Pemberdayaan Lembaga Perdamaian dan Peraturan Mahkamah Agung (PERMA) Nomor 2 Tahun 2003 tentang Prosedur Mediasi di Pengadilan, Peraturan Mahkamah Agung Nomor 1 Tahun 2008 tentang Prosedur Mediasi di pengadilan dan Peraturan Mahkamah Agung (PERMA) RI Nomor 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan serta yang terbaru dalam UUCK. Meskipun mediasi seringkali tidak memuaskan, tetapi masih merupakan salah satu upaya yang penting. Namun, kendala yang dihadapi dalam penggunaan mediasi dalam penyelesaian sengketa lingkungan hidup semakin kompleks setelah putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 menyatakan bahwa UUCK inkonstitusional bersyarat, sehingga tidak mungkin untuk membuat aturan teknis tentang penyelesaian sengketa lingkungan hidup melalui mediasi. Meskipun UUCK sudah dinyatakan tidak berlaku dengan hadirnya Peraturan Pemerintah Pengganti Undang-Undang (PERPU) Nomor 2 Tahun 2022 tentang Cipta Kerja, namun Perpu masih menyisakan perdebatan dan belum menjadi Undang-Undang hingga tulisan ini diterbitkan.

Abstract

Early marriage is a marriage carried out by someone who is a teenager or under the age determined by the Marriage Law No. 1 of 1974 which explains the age at which a person can enter into marriage, namely 19 year old men and 16 year old women. The purpose of this study is to find out about early marriage, the factors that cause early marriage, the impact of early marriage, and the community's view of early marriage. To find out the overall and more in-depth problems, in this study a qualitative approach was used which is useful for providing data and facts about early marriage and its problems in the City of Gorontalo. Then the data is analyzed systematically so as to obtain in-depth answers about early marriage and its problems in the City of Gorontalo. From the results of this study it was found that the factors that cause early marriage are different from the past. The main factors behind early marriage in Gorontalo City are promiscuity among adolescents which causes adultery, economic factors, education, arranged marriages, and social factors. Early marriage has an impact on psychology, social, economy, health and education. Community views differ on early marriage, namely positive and negative depending on the impact and factors behind early marriage.

Abstract

This paper aims to examine the regulation of land use by the Limboto Lake community. This study uses an empirical juridical approach. The study results show that the regulation of land rights, especially land along the banks, has been regulated by the government and local governments, starting from laws and regulations, regional regulations, and other decisions. The existence of laws and regulations has given legitimacy to the state, in this case, the government, regarding the control and utilization of the land on the banks of the lake because the state legally owns the land on Lake Limboto. However, the fact is that the land on the banks of the lake has changed its function to become a community settlement. , making it difficult to carry out an inventory of the surrounding population. In order to prevent mismanagement or management that is not based on the rule of law, it is necessary to have clear and accurate boundaries regarding the allotment of areas/zones for various interests so that there is no overlap between the government and the land agency, considering that some community lands already have land rights (land certificate). Thus, an alternative solution to save the lake is establishing a zoning system.

Abstract

The court as a law enforcement instrument has been implementing mediation since 2008. However, the success of mediation is still far from what was expected. This indicates that the integration of mediation in the court system has not been effective, especially related to divorce cases. The integration of mediation into court practice, on the one hand, aims to avoid the accumulation of cases and maximize the function of court institutions in resolving adjudicative disputes, but on the other hand, it increases the judges' workload. Therefore, integrating mediation into court proceedings can be an instrument in reducing the divorce rate. This research uses an empirical normative approach in terms of Supreme Court Regulation Number 1 of 2016. The obtained data will be analyzed qualitatively. The research results indicate that the integration of mediation in divorce cases at the Gorontalo City and Regency Religious Courts has prioritized societal values, particularly deliberation to reach the best solution for the parties involved. However, this approach does not seem to align well with the social dynamics in Gorontalo City.  This is because there are still several key factors that hinder achieving the best results through mediation. The failure to reach critical points in these deliberations results in a minimal success rate for mediation in resolving divorce cases, as evidenced by the relatively high number of divorce decisions. This is often due to the parties involved blaming each other and being unwilling to negotiate for a mutual agreement.
