Abstract

Abstract: This study aims to examine the role of the Office of Religious Affairs (Kantor Urusan Agama or KUA) in reducing underage marriage rates and to identify the factors that hinder the execution of its duties. The research employs a qualitative approach with a descriptive method. Primary data were collected through in-depth interviews with KUA officials, community leaders, parents, and underage marriage participants, while secondary data were gathered from official documents, annual reports, and relevant literature. The findings reveal that KUA has implemented various measures to prevent early marriages, such as stringent administrative document verification, community outreach, and premarital counseling. However, KUA faces several challenges, including limited human resources, cultural resistance, and a lack of cross-sectoral collaboration, which hinder its effectiveness in combating underage marriages. This study recommends strengthening institutional capacity, enhancing cross-sectoral collaboration, and leveraging digital technology to support education and prevention efforts. With a holistic strategy and strong support from various stakeholders, underage marriage rates can be significantly reduced.

Abstract

Abstract Divorce is the end point of a marriage that is unable to achieve the noble goal of family happiness as expected by every married couple. The phenomenon of divorce due to increasing economic factors has recently intrigued the author to conduct research on divorce due to economic factors at the Religious Court of Gorontalo City in 2021. The purpose of this study is to explore and find out data about the basic concept of divorce, to find out what factors are happening at the Religious Courts of Gorontalo City in 2021, and to find out the description of divorce due to economic factors and the impact of these factors on divorce in Gorontalo City in 2021 2021. This research uses a normative approach because it highlights the number of divorces due to certain factors. While the method uses a descriptive method because it uses a description to describe the data presented. The results of this study indicate that divorce is the breaking of the marriage bond for certain reasons in accordance with religious rules and marriage laws. There are 13 factors that cause divorce in Indramayu Regency, namely unhealthy polygamy, moral crisis, jealousy, forced marriage, economy, no responsibility, underage marriage, persecution, being punished, biological defects, politics, third party interference. , and there is no harmony. Of the many factors, it turns out that economic factors dominate the divorce rate in Gorontalo City in 2021. In 2021 there were 5550 cases of divorce with 13 factors causing divorce, including divorce due to economic factors as many as 4905 cases or around 88.38%, the remaining 11 .62% ​​for factors other than economics. The percentage of divorces due to economic factors shows the magnitude of the economic influence on household integrity. Therefore, family income (economic) which is a very important matter for husbands and wives to pay attention to, turns out to have a huge impact on the occurrence of divorce in Gorontalo City in 2021.

Abstract

This study aims to ensure that heirs cannot be simply removed or not handed over to heirs who have rights. Because there are two types of heirs, this is regulated by the Civil Code, namely heirs based on marriage and descent, and heirs determined through a will. This study applies a normative approach, which focuses on literature studies in the field of law. Normative legal research examines legal behavioral products, such as laws, through normative case studies.

Abstract

This article discusses the highest factors that hinder the resolution of disputes over mixed assets. The determinant factors that impede the implementation of the religious court's decision on the resolution of disputes over arbitrary assets in the City of Gorontalo to those who apply for the separation of arbitrary assets are internal and external factors. Internal factors include obstacles; the lack of human resources for judges at court, as well as the knowledge of judges in resolving cases where the wife who is more dominantly working earns income while the husband does not work. In this case the judge uses the principle of justice by determining that the ex-wife gets ¾ of the share while the ex-husband gets ¼ of the share. External factors include: Partners between ex-husbands and ex-wives are not willing, do not accept, or do not agree with the results of the decision from the court. The approach used in writing this article is empirical juridical with a case study approach. Based on the data found in this article, the highest factor in the delay in resolving disputes over Gono-Gini assets is disagreement between ex-husbands and ex-wives over the decision of the Class IA Gorontalo Religious Court.

Abstract

This research aims to analyze the impact of Covid-19 in triggering spousal conflict that leads to divorce. This research uses a normative-empirical legal research method (applied law research) which is basically a combination of normative legal approaches with the addition of various empirical elements. The results obtained from this research are that there are several impacts of Covid-19 which are factors in the occurrence of divorce between couples based on data from the Gorontalo City Statistics Agency, not a few divorce rates during the Covid-19 period, one of the biggest factors is economic factors that affect everyone in this world.

Abstract

The purpose of this study is to find out how the arrangement of the joint responsibility system in the lending and borrowing agreement at PNM Mekaar East City Branch 2 Gorontalo City and to find out the legal consequences and efforts to resolve defaults in joint responsibility agreements by debtors in Huangobotu Village. The research method used is Normative legal research. The data obtained are primary and secondary data. The data collection techniques used by the author are observation, interview, and literature. The results of the study show that the arrangement regarding the joint responsibility system in the loan and borrowing agreement at PNM Mekaar Branch Kota Timur 2 Gorontalo City is in accordance with the provisions of the applicable rules as stated in Article 1278 of the Civil Code concerning joint responsibility or joint responsibility where the joint responsibility agreement can occur over the will or agreement of the parties and must be expressly stated in the agreement. And the type of joint responsibility that is applied by business groups in the village of Huangobotu is a type of passive joint responsibility as stated in Article 1280 of the Civil Code. And the legal consequences of default in the lending and borrowing agreement with a joint responsibility system at PNM Mekaar East City 2 Branch City of Gorontalo in Huangobotu Village are payment of achievements by each group member, and requests for fulfillment of achievements by PNM Mekaar East City 2 Branch of Gorontalo City to the person in charge of customers who do not fulfill these obligations. And efforts to resolve defaults by PNM Mekaar Branch Kota Timur 2 Kota Gorontalo are more to the approach of deliberation or mediation with customers to find the right settlement solution.

Abstract

The legal protection of trademarks for Micro, Small, and Medium Enterprises (MSMEs) in Pohuwato is an increasingly urgent issue in light of the sector’s rapid growth and contribution to the local economy. Despite the existence of Law No. 20 of 2016 on Trademarks and Geographical Indications, which provides a clear legal framework for trademark registration and protection, a large number of MSME actors in the region have not registered their trademarks. This is largely due to a lack of legal awareness, the perception that registration costs are too high, and the belief that the process is too complex or unnecessary for small businesses. The objective of this research is to analyze how trademark protection for MSMEs is implemented in Pohuwato, to understand the legal consequences of unregistered trademarks, and to evaluate the role of government institutions in facilitating registration. The research employs an empirical legal method with a qualitative approach, using data gathered through interviews, field observations, and questionnaires distributed to 100 MSME respondents. The findings reveal that although the local government and the Regional Office of the Ministry of Law and Human Rights in Gorontalo have made substantial efforts such as door-to-door socialization campaigns and registration facilitation the overall rate of trademark registration remains low. The legal consequence of not registering a trademark is the absence of exclusive rights and the inability to take legal action against infringement, which may result in financial loss and reputational damage. This research concludes that consistent legal education and expanded outreach programs across all districts in Pohuwato are essential to enhance MSMEs' legal awareness and strengthen their legal protection.

Abstract

Land conflicts, particularly overlapping claims of land ownership and control, represent a structural issue that continues to recur in Indonesia due to population growth, technological advancement, and the increasing complexity of development. This study aims to analyze the role of the National Land Agency (BPN) in resolving overlapping land ownership cases in Tuloa Village, North Bulango District, Bone Bolango Regency. The research employs an empirical legal approach, collecting data through interviews, field observations, and document analysis, including land regulations and BPN archives. The findings reveal that the primary causes of overlapping land claims are the lack of physical boundary maintenance and changes in ownership status due to inheritance. BPN plays a role in document verification, mediation, and handling complaints, although it faces challenges such as staff rotation and a weak documentation system. The resolution of land disputes in Tuloa Village was achieved through a familial approach involving deliberation, facilitated by the village government and BPN, resulting in a mutual agreement on land division. The implications of this study highlight the need to strengthen BPN’s institutional capacity, enhance public legal awareness on land issues, and improve the administrative system to prevent similar conflicts in the future.

Abstract

Dalam Memperkuat Dukungan Terhadap UMKM Di Platform E-commerce. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normative dengan pendakatan perundang-undangan. Hasil dari penelitian ini menunjukan bahwa pengaturan hukum yang ada saat ini belum memadai untuk melindungi UMKM dalam ekosistem pasar digital. Analisis data mengungkapkan bahwa mayoritas UMKM menghadapi tantangan dalam memahami kebijakan platform e-commerce, terutama yang terkait dengan algoritma peringkat dan sistem keamanan data. Lebih dari 70% responden melaporkan kurangnya pengetahuan tentang perlindungan data pelanggan dan menyatakan bahwa proses pengelolaan data yang ada masih rentan terhadap serangan siber. Selain itu, temuan penelitian ini juga menunjukkan adanya praktik persaingan tidak sehat, seperti predatory pricing, yang dilakukan oleh pelaku usaha besar dan berdampak negatif pada keberlangsungan UMKM di platform e-commerce. Meskipun peraturan seperti Undang-Undang Perlindungan Data Pribadi dan Anti Monopoli telah ada, penerapannya di lapangan masih lemah dan memerlukan harmonisasi regulasi yang lebih komprehensif untuk melindungi kepentingan UMKM. Penelitian ini menyimpulkan bahwa dukungan regulasi yang adaptif, peningkatan literasi digital, dan mekanisme penyelesaian sengketa yang efektif adalah kunci untuk menciptakan lingkungan digital yang aman dan berkelanjutan bagi UMKM di Indonesia.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum atas hak kepemilikan tanah di Indonesia, dengan fokus pada pengadaan tanah untuk pembangunan Waduk Bulango Ulu di Kabupaten Bone Bolango. Metode yang digunakan adalah pendekatan kualitatif dengan analisis deskriptif, yang melibatkan pengumpulan data melalui studi dokumen dan wawancara dengan pemangku kepentingan terkait, termasuk masyarakat, pemerintah, dan ahli hukum. Hasil penelitian menunjukkan bahwa meskipun Undang-Undang Pokok Agraria (UUPA) memberikan kerangka hukum untuk perlindungan hak atas tanah, implementasinya sering kali tidak transparan dan menimbulkan konflik antara pemilik tanah dan pemerintah. Isu-isu seperti penilaian ganti rugi yang tidak adil dan kurangnya partisipasi masyarakat dalam proses pengambilan keputusan menjadi sorotan utama. Penelitian ini merekomendasikan perlunya kebijakan yang lebih adil dan transparan dalam pengadaan tanah, serta peningkatan partisipasi masyarakat untuk memastikan keadilan sosial dan perlindungan hak-hak pemilik tanah
