Abstract

Perkembangan industri elektronik yang pesat memberikan kontribusi signifikan terhadap pertumbuhan ekonomi. Namun, seiring dengan itu, muncul permasalahan yang merugikan konsumen, seperti barang cacat atau praktik pemasaran yang menyesatkan. Artikel ini membahas perlindungan hukum terhadap konsumen barang elektronik di Indonesia berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Dengan pendekatan yuridis normatif, artikel ini menganalisis berbagai aspek hukum, pelaksanaan peraturan, dan efektivitas perlindungan konsumen di masa depan. Hasil penelitian menunjukkan bahwa meskipun regulasi telah ada, implementasinya masih menghadapi kendala dalam melindungi hak-hak konsumen secara efektif. Kata Kunci: Perlindungan Konsumen, Barang Elektronik, Hukum Ekonomi.

Abstract

Corporate governance plays a pivotal role in fostering transparency, accountability, and sustainable economic development, particularly in developing countries. This study conducts a bibliometric analysis using data from Scopus and VOSviewer to explore the academic discourse on corporate governance with a focus on regulatory and policy developments. The analysis reveals "corporate governance" as the central theme, with strong connections to "developing countries," "corporate social responsibility," and "firm performance." Key findings highlight the significance of regulatory frameworks, transparency, and board structures in enhancing governance practices, while also emphasizing the growing integration of corporate governance with strategic dimensions such as market performance and corporate strategy. Despite these advancements, gaps in the literature remain, particularly concerning the role of informal institutions, cultural influences, and technological innovations in governance. This study underscores the need for tailored governance frameworks that address the unique challenges of developing countries while aligning with global best practices. These insights provide valuable directions for policymakers, practitioners, and scholars aiming to enhance corporate governance in emerging economies.

Abstract

Tindak Pidana Korupsi yang terjadi di Indonesia bukan lagi tersangkanya di tinggkat bawah pada lingkungan pemerintahan Indonesia, akan tetapi sudah ke level Menteri sebagai pemutus yang tertinggi dalam jabatan publik, hal ini terjadi pada mantan Menteri Pertanian, yaitu Syahru Yasin Limpo bersama-sama dengan Sekjen dan Direktur (Kasdi Subagyono dan Muhammad Hatta). Adapun penyidikan terhadap tindak pidana korupsi dilakukan berdasarkan hukum acara pidana yang berlaku, yakni Undang-Undang Nomor. 8 tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana, dalam Pasal 1 angka 2 menyebutkan penyidikan adalah serangkaian tindakan penyidik dalam hal dan menurut cara yang diatur dalam undang-undang ini untuk mencari serta mengumpulkan bukti yang dengan bukti itu membuat terang tentang tindak pidana yang terjadi guna menemukan tersangkanya. Dalam hal ini Komisi Pemberantasan Korupsi (KPK) telah melakukan penyelidikan yaitu melakukan penggeledahan di kantor Menteri Pertanian telah ditemukan barang bukti temuan uang senilai Rp.30 miliar, dan Rp.400 juta, dan 12 dugaan senpi, dan dokumen-dokumen penting, merupakan bukti permulaan terhadap Syahru Yasin Limpo, bahwa pada tanggal 11 Oktober 2023 KPK melakukan Penangkapan terhadap tersangka Syahru Yasin Limpo, sebagaimana diatur dalam Pasal 1 angka 20 KUHAP, metode dalam penelitian ini adalah mempergunakan metode hukum normatif, akan menganalisa kepustakaan dan perundang-undangan. Dalam proses penangkapan tersebut tidak ada kendala hingga saat ini tersangka telah dilakukan penahan oleh KPKKata kunci : penyelidikan, kpk, tindak pidana korupsi, penangkapan, tersangka.

Abstract

This research examines the implementation of Law Number 44 of 2008 on Pornography in relation to morality crimes, with a case study focus on Decision Number 136/Pid.B/2023/PN.Cbi from the Cibinong District Court. The background of the study arises from the increasing misuse of information technology for distributing pornographic content, which violates moral norms and individual dignity, particularly affecting women. The aim is to analyze Indonesia's legal regulations on morality crimes under the Pornography Law and to review the judge’s legal considerations in the verdict. Using normative legal research methods with statutory and case approaches, data was collected through literature studies and analysis of court documents. The findings indicate that the defendant was proven to have violated Article 35 of the Pornography Law by secretly recording a victim while bathing and sharing the screenshots via WhatsApp status. The court sentenced the defendant to four years in prison and a fine of one billion rupiah. The verdict reflects the application of justice, utility, and legal certainty, although it does not fully embody a progressive legal protection approach for the victim. This study contributes to understanding the effectiveness of Pornography Law enforcement and highlights the need for a more responsive approach to handling technology-based morality crimes.

Abstract

The distribution of hard drugs without a permit is a criminal act that endangers public health and violates applicable legal provisions. This study aims to examine the effectiveness of the application of criminal provisions in Law Number 36 of 2009 concerning Health against perpetrators of the distribution of hard drugs without a permit, as well as to assess the independence of judges in making decisions based on Decision Number 83/Pid.Sus/2023/PN Cbi. The method used is normative juridical with a statutory approach, case approach, and conceptual approach. The analysis was carried out comparatively against Law Number 36 of 2009 and Law Number 17 of 2023 concerning Health. The results of the study indicate that the provisions in Article 197 of the 2009 Health Law are still relevant and effective in reaching perpetrators, even though there have been regulatory updates. In addition, judges are considered to have carried out judicial functions independently by considering legal facts and the principle of justice. This study emphasizes the need for consistency in law enforcement to provide proportional legal protection in the health sector.

Abstract

Military criminal Law plays an important role in maintaining discipline, moralty, and honor within the Indonesia National Armed Forces (TNI). One of the serious Violations of concern is acts of sexual misconduct, including same-sexual misconduct. The handling of such cases involves not only legal aspects but also ethical values and military discipline. This study analyzes how military criminal law, particular within the scope of the Military Penal Code (KUHPM) and Law Number 25 0f 2014 on Military Disciplen law, regulates and prosecutes perprtrators of same-sexsual misconduct within the TNI. The research method used is normative juridical with a qualitative approach to relevant cases. The findings indicate that akthough legal provisions are already in place, law enforcement still faces obstacles, both due to the closed nature of military culture and the lack of protection for victims. Therefore, there is a need to raise awareness among TNI members to create a more professional military environment and to uphold the good name of the Indonesia National Armed Forces

Abstract

According to data from the International Labor Organization (ILO), the construction industry accounts for nearly 20% of all workplace accidents that occur worldwide. This emphasizes the importance of continued efforts to improve work safety in this sector (Artha Safety, 2024). In addition, the application of smart technology can also help improve operational efficiency, enable faster identification of risks, and enable more effective interventions before accidents occur. Therefore, this research aims to take a closer look at the role of smart technology in improving work safety in the construction environment. This research used a combination of quantitative and qualitative methods. Literature study, primary data collection, and data analysis are the three main stages of this research. From the available data, it can be seen that the adoption of smart technologies, including AI, IoT, and wearable devices, has a significant impact on reducing accidents in the construction sector. Not only a decrease in fatal accidents, but also an increase in workers' awareness of physical conditions and potential hazards on the job site. However, some challenges such as worker resistance and implementation costs still need to be overcome through education and management support. Implementing these technologies requires a comprehensive approach, including intensive training and education for workers, as well as management support to overcome resistance and implementation cost challenges. This investment in smart technology will ultimately lead to a safer, more efficient and productive work environment in the future.

Abstract

The enactment of Law Number 17 of 2023 concerning Health through the omnibus law method marks a fundamental transformation in Indonesia's health legal system. This research aims to analyze the legal politics of the formation of the Health Law, focusing on the dialectic between fulfilling public interests and protecting medical professionalism. This research constitutes normative legal research (yuridis normatif) employing three approaches: the statute approach, conceptual approach, and philosophical approach. The data sources are secondary, encompassing academic manuscripts, parliamentary minutes, Constitutional Court Decision Number 182/PUU-XXII/2024, relevant legislation, and scholarly literature. Data collection techniques were conducted through library research with systematic tracing of legal documents and academic literature. Data analysis was performed descriptively-analytically using deductive methods to draw systematic and comprehensive conclusions. The findings demonstrate that philosophically, the Health Law represents a manifestation of state responsibility within the welfare state framework, shifting the health paradigm from a cost burden to social investment. Sociologically, this legislation responds to the crisis in medical personnel distribution and digital disruption, although facing resistance from professional organizations due to the erosion of professional autonomy. Juridically, the omnibus law method aims to simplify hyper-regulation; however, Constitutional Court Decision Number 182/PUU-XXII/2024 affirms the necessity of institutional independence for the council and collegium to preserve professional dignity. This research concludes that harmonization between state control and professional independence constitutes the key to the effectiveness of the national health system. This research recommends strengthening the operational and financial independence of the Health Council and Collegium, transparent implementation of the Health Sector Master Plan, and optimization of restorative justice mechanisms in medical dispute resolution.
