Abstract

Kesadaran hukum merupakan kesadaran yang lahir dari diri sendiri tanpa adanya unsur paksaan untuk menaati hukum. Penerapan hukum di masyarakat akan sangat efektif bahkan tidak diperlukan adanya sanksi manakala kesadaran hukum ini telah terbentuk. Melalui kesadaran hukum ini akan mendorong terciptanya budaya hukum yang baik serta mendukung dalam proses penegakan hukum sebagaimana yang telah diungkapkan oleh Lawrence M. Friedmann didalam bukunya yang berjudul, “Sistem Hukum”. Menurutnya, ada tiga aspek yang mendukung terciptanya penegakan hukum yang efektif yakni materi hukum (substance), budaya hukum (culture) dan struktur hukum (structure). Paralegal memiliki peran penting dan strategis dalam memberikan bantuan hukum masyarakat miskin. Membentuk kesadaran hukum bukanlah sebuah pekerjaan yang mudah. Dibutuhkan sosialisasi, transformasi pemahaman yang secara berkelanjutan agar pemahaman dapat tersampaikan dan perilaku hukum dapat terbentuk. Hal ini merupakan suatu tantangan tidak hanya bagi pemerintah atau perangkat daerah, akan tetapi juga bagi akademisi hukum. Faktor pendidikan dan ekonomi merupakan tantangan utama dalam mentransformasi pemahaman akan pentingnya hukum bagi masyarakat. Pendidikan yang tidak merata dan beragam menjadikan proses sosialisasi diperlukan. Hal ini yang menjadi tantangan khususnya bagi Kabupaten Tegal Posisi paralegal dalam suatu tatanan masyarakat adalah hal yang sangat menarik untuk dikaji. Paralegal banatuan hukum memebutuhkan kebijakn yang mampu meningkatkan kemahiran dalam melakukan pendampinagna hukum masyarakat miskin dalam realitas sosial atau cerminan sebuah peradaban. Melalui proses pemberian pemahaman Pembentukan Kebijakan Kemahiran Paralega Berbasi Kearifan Nilai Lokal pada Pusbakum Kabupaten Tegal diharapkan mampu meningkatkan kesadaran hukum bagi masyarakat. Para lelegal mampu meningkatkan kemahiran dalam mendampingi dan pendampingan hukum masyarakat miskin Kabupaten Tegal. Posbakum semakin memiliki kemampuan dalam meningkatkan peran, melaluiakses partisipasi dan manajemen pelayanan yang akuntabel berbasis pada keraifan nilai lokal kabupeten Tegal yang memuliakan manusia. Produkknya adalah artikel ilmiah terpublikasi di jurnal nasional terakreditasi dan atau disajikan di forum ilmiah nasional dan dimuat di media massa lokal. Luaran dari program ini Pembentukan Kebijakan Kemahiran Paralegal Berbasis Kearifan Nilai Lokal pada Pusbakum Kabupaten Tegal.

Abstract

Most countries in the world choose the form of Federal state or Unity within organizing a government. The selection of this form of state based on political, s­ocial will include the culture and history of a country. Each form of this country has advantages and disadvantages. The Unitary State emphasizes the administration of government in the government centers and regions in the province do not have extensive autonomy in managing their regions. Unlike the Federal State, where the position of the Federal State and the State are equal. The concept of federalism has been applied in many countries. The state is given the widest possible autonomy to take care of their area. Regional autonomy aims to improve community service, develop democratic life, and encourage the community empowerment to foster creativity. Regional autonomy also has a positive impact and a negative impact on the region. This paper intends to analyze the concept of federalism and regional autonomy with practical analysis in Indonesia.

Abstract

Penerapan model pendampingan keaksaraan fungsional yang berbasis gender mempunyai peran penting dan strategis dalam meningkatkan kualitas hidup masyarakat. Masyarakat termarginal khususnya perempuan seringkali menjadi kelompok yang paling tidak mampu meningkatkan kualitas hidup dalam memperoleh HAM-nya. Hal ini terjadi karena Mereka mempunyai keterbatasan pokok yaitu ketidak mampuan membaca. Kondisi ini menjadikan Mereka tak berdaya dalam menghadapi hidup yang membutuhkan kemampuan membaca dalam menjalankan kesehariannya. Mereka hidup hanya sebagai buruh, di lokasi pengabdian Mereka adalah buruh petik lombok dan plonco melati tidak mampu membaca. Ada lima puluh persen dari jumlah buruh yang tidak mampu membaca yaitu 30 buruh dari sejumlah 60 buruh. Kondisi ini memperburuk Mereka tidak mengatahui posisi sebagai perempuan yang mempunyai kedudukan setara dengan laki-laki, sehingga Mereka tetap saja pasrah mendapatkan ketidakadilan dari lingkungan. Oleh karena itu kemampuan membaca melalui pendampingan keaksaraan fungsional berbasis gender harus Mereka lakukan. Hasil pendampingan Mereka menyadari ketidak adilan gender dalam pemeliharaan lingkungan hidup dan hak perolehan makan empat sehat lima sempurna bagi laki-laki dan perempuan. Selanjutnya menunjukan hasil yang positif Mereka menjadi motivasi untuk mampu membaca, sehingga dalam kegiatan selanjutnya tetap ada pendampingan berjenjang untuk terus membaca, terutama Mereka bisa membaca dasar untuk mampu melihat dunia yang sangat indah penuh rahmat. Tugas Tridarma Perguruan Tinggi bidang pengabdian harus dilanjutkan oleh Tim yang sinergis antara lain TIM Pengabdian pelatihan mengelola makanan menjadi makanan siap saji untuk diperjual belikan sehingga mampu menambah pendapatan keluarga.

Abstract

This paper compares the cases of Indonesia, Malaysia, and Australia to examine how these countries incorporate principles of justice in the establishment of laws and regulations. It explores the significance of mainstreaming justice in lawmaking, emphasizing equitable representation, fair access to justice, and human rights considerations. The analysis highlights the legal frameworks and institutional structures in each country. In Indonesia, the role of the Constitutional Court and stakeholder involvement in the legislative process are examined. Malaysia's constitutional framework and efforts to address ethnic and religious diversity, as well as the role of judicial review, are discussed. Australia's common law system emphasizes parliamentary scrutiny, public consultations, and protection of individual rights through the High Court and parliamentary committees. This study provides insights into the diverse approaches and challenges faced by these countries in mainstreaming justice in their lawmaking processes. It contributes to understanding how justice can be effectively integrated into laws and regulations, offering valuable insights for policymakers and legal practitioners seeking to promote justice in legislative contexts.

Abstract

The COVID-19 pandemic changed the education system in Indonesia from Early Childhood to Higher Education through the application of distance learning (DL). It has an impact on the intensity of Early Childhood Education, particularly, to recognize and access technology and interactive media. Young children need to be educated to surf the internet healthily and protect themselves. Cyber wellness refers to the health/well-being of internet users and involves an understanding of online behavior and awareness of how to protect themselves in cyberspace. This study aims to describe the use of technology and interactive media that supports cyber wellness education for kindergarten. The method used in this research was qualitative through interviews and documentation. The results of this study were to create proactive cultures with technology and interactive media in schools to help students become digital learners by 1) paying attention to safety, cultural suitability, needs, interests, and children development, 2) learning to use technology in kindergarten is active, direct, engaging, and empowering children; 3) controlling over children when accessing technology, 4) using technology in class when discussing themes/materials, and when completing assignments or projects given by the teacher, and 5) communicating how to use the internet safely for children with parents.

Abstract

The development of business and information technology has a significant impact on economic development on the one hand, but also raises various legal issues on the other. One of the problems that often occur in relation to the business world is trademark disputes. Various cases of trademark disputes occur in various regions in Indonesia, ranging from trademark plagiarism, trademark abuse, to trademark counterfeiting both on a small and large scale. Kenteng Village, as one of the areas in Semarang Regency, has high tourism potential. In addition, Kenteng Village is also known as a village producing various handicrafts and small businesses typical of the region, so many brands in the village have not been registered. Whereas with a registered trademark, it has clear legal legality. This service program aims to provide strengthening of village community empowerment in the mechanism for resolving trademark disputes. This program is a community service program with partners Kenteng Village and Kenteng Village MSME Forum, Bandungan District. The outputs of this program are scientific articles, video highlights and mass media publications. In addition, this program is expected to provide a clear scheme in village institutions related to the settlement of trademark disputes.

Abstract

The empowerment and fulfillment of senior rights model based on Law Number 13 of 1998 in Tegal District and Central Java Province have begun to fulfill the rights of senior citizens through schools, with support from the community, village government, provincial government, and central government, including support from families with senior members, even though it has not yet been fully synchronized and quickly implemented in each region. Socialization continues to be conveyed to the public about the need for attention and respect for senior citizens by all segments of society, even though there are still societal stigmas that consider senior citizens as having many limitations and being unproductive, and therefore not needing special attention from the government.

Abstract

Latar Belakang: Kecacingan merupakan penyakit yang disebabkan oleh cacing parasit usus dengan prevalensi yang cukup tinggi dan menyebar di seluruh wilayah Indonesia. Kecacingan dilaporkan jarang menyebabkan kematian namun mampu mempengaruhi kesehatan dan produktivitas penderita melalui penurunan status gizi. Tujuan: Diketahuinya hubungan status gizi dan sanitasi lingkungan terhadap kecacingan pada anak Madrasah Ibtidaiyah Darul Taklim  Metode: Desain penelitian yang digunakan adalah deskriptif kuantitatif dengan pendekatan Cross Sectional. Populasi dalam penelitian ini adalah semua anak di sekolah Madrasah Ibtidaiyah Darul Taklim. Pengambilan sampel secara total sampling berjumlah 28 anak. Pengambilan data ini dilakukan pada bulan Februari-Juni 2023. Analisa data menggunakan analisa univariat dan analisa bivariat dengan uji statistik Chi square. Hasil: Ada Hubungan Status Gizi Terhadap Kecacingan Pada Anak dengan p value 0,020. Ada Hubungan Sanitasi Lingkungan Terhadap Kecacingan Pada Anak p value 0,011. Saran: Agar adanya program pemberantasan kecacingan pada anak dan penyuluhan sanitasi lingkungan, serta pola hidup bersih kepada masyarakat merupakan salah satu program terdepan untuk meningkatkan derajat kesehatan masyarakat. Kata Kunci: Status Gizi,Sanitasi Lingkungan, Kecacingan Pada Anak

Abstract

In the face of escalating global terrorism threats, nations worldwide have grappled with the imperative to enact and amend legislation aimed at preventing, detecting, and prosecuting acts of terrorism. This paper conducts a comprehensive and critical examination of legislative responses to terrorism, with a focus on their efficacy, implications for civil liberties, and broader societal impacts. The research begins by analysing the evolution of counterterrorism laws across diverse jurisdictions, emphasizing the shifting landscape of security concerns and the subsequent legal adjustments. It scrutinizes the core features of these legislative measures, including preventive detention, surveillance, intelligence gathering, and the definition of terrorism offenses. A critical analysis is employed to assess the balance between security imperatives and the protection of individual liberties, scrutinizing the potential for abuse, discrimination, and erosion of due process. Case studies from various countries illuminate the real-world consequences of counterterrorism legislation, shedding light on the impact on marginalized communities, legal frameworks, and international human rights standards. The paper also explores the effectiveness of oversight mechanisms, judicial review, and safeguards incorporated within these legislative frameworks to curb potential abuses and protect against overreach. Furthermore, the study considers the role of technology, intelligence-sharing agreements, and international cooperation in shaping legislative responses to terrorism. It aims to provide a nuanced understanding of the challenges and successes in addressing the complex interplay between security concerns and the preservation of fundamental rights. This critical review seeks to contribute to the ongoing dialogue on counterterrorism policy by offering insights into the multifaceted implications of legislative responses. The paper concludes with recommendations for fostering a balanced approach that upholds both security imperatives and the foundational principles of democracy.

Abstract

Clinical Legal Education (CLE) in Indonesia embodies a transformative approach to legal education, with distinct objectives and advantages. CLE's primary goals include enhancing practical skills, bridging the gap between theory and practice, and fostering a sense of social responsibility. Through real-world engagement, students develop crucial skills like legal research, client counseling, and courtroom advocacy. The objective of promoting community engagement aligns with Indonesia's commitment to social justice, encouraging legal practitioners to address the needs of marginalized communities. Additionally, CLE contributes to ethical and professional development, guiding students through real ethical dilemmas to establish a robust ethical foundation. The interdisciplinary nature of CLE promotes collaboration with professionals from various fields, providing students with a holistic understanding of legal issues and their broader societal implications. The advantages of CLE in Indonesia are manifold. Graduates with CLE experience exhibit enhanced legal competence, making them highly sought after by employers. This practical skill set not only increases employability but also positions graduates to excel in a rapidly evolving legal landscape. The networking opportunities facilitated by CLE contribute to the building of professional relationships crucial for career advancement and mentorship. Moreover, CLE students become agents of legal reform, actively contributing to improvements in the legal system and its responsiveness to societal needs. In essence, CLE in Indonesia stands as a catalyst for producing socially conscious, skilled legal professionals equipped to address the challenges of the legal profession.
