Abstract

This study discusses the priority development projects of the Government to improve Infrastructure, which is expected to benefit the community. In the process there are problems that arise, including delays in payment of compensation for land acquisition for public interest for development. This research method uses an empirical legal approach, data obtained from field research and library research will be analyzed qualitatively to answer the problems in the payment research, there are 3 factors, namely the absence of an accurate budget estimate, incomplete payment files, and there is land in a forest area. Delays in payment of compensation will have economic and social impacts on the community and of course hinder project development for the community. Therefore, to fulfill a sense of justice, legal certainty is needed in the form of clarity regarding compensation for the community.

Abstract

Beberapa undang-undang memberikan kerangka kerja untuk pengaturan tindakan medis dan pendelegasian kekuasaan untuk melaksanakannya. Undang-undang tersebut antara lain Undang-Undang Kesehatan No. 36 tahun 2009, Undang-Undang Praktek Kedokteran No. 29 tahun 2004, dan Undang-Undang Keperawatan No. 38 tahun 2014. Selanjutnya, pelaksanaan praktek perawat diatur dengan peraturan No. 17 tahun 2013 dan pelaksanaan dan pelaksanaan praktek medis diatur dengan peraturan Menteri Kesehatan No. 2052. Peraturan ini memungkinkan perawat untuk melakukan tindakan medis di fasilitas darurat dengan pendelegasian wewenang tertulis dari dokter. Meskipun demikian, transmisi kekuasaan secara verbal adalah hal yang biasa.Penelitian ini menggunakan pendekatan analisis kualitatif dengan spesifikasi deskriptif untuk mengkaji faktor-faktor yang menghambat pendelegasian kewenangan dalam pelayanan kesehatan. Faktor-faktor ini termasuk, tetapi tidak terbatas pada, hal-hal berikut: kurangnya kejelasan dalam ketentuan hukum; kurangnya pemahaman tentang peraturan saat ini oleh dokter dan perawat; rasio perawat terhadap dokter yang lebih tinggi; dan kurangnya kesadaran hukum secara umum di kalangan profesional perawatan kesehatan. Karena pengalihan kekuasaan bersifat verbal untuk menyederhanakan praktik dan dipengaruhi oleh situasi yang tidak terduga, hal itu tidak melarang evaluasi pasien di unit gawat darurat

Abstract

Introduction: A problem that often occurs in connection with the implementation of the duties of a Notary is if there is a Notarial deed that is faulted by the parties, especially if the parties come to the Notary with false information or fake evidence.Purposes of the Research: This research aims to analyze the validity of a notary's statement which is based on evidence that is declared to be fake and legal protection for notaries for fake statements.Methods of the Research: This research uses normative legal research methods by looking for solutions and legal issues that arise, which will be achieved and then provide predictions. Legal approach and conceptual approach, with primary and secondary legal materials.Results of the Research: Based on Supreme Court Decision Number 702/J/Sip/1973 dated September 5 1973, the Notary who recorded what was shown and conveyed by the person facing, there is no obligation for the notary to investigate materially. In this way, the Notary is not asked to be held responsible for losses incurred because the parties provided false information.

Abstract

Dispute is an inseparable part of conflict, which can occur in various aspects of daily life. Studying disputes is crucial to understand their nature and resolution methods. This research uses a normative research method with prescriptive research specifications and a comparative, conceptual, and historical approach. Data is collected through a bibliographic study from primary, secondary, and tertiary legal sources. Land conflicts are often caused by issues such as boundary disputes, inheritance, state land control, and legal uncertainty in land tenure, which fundamentally stem from the imbalance of land rights ownership and uncontrolled land conversion. Land dispute resolution can be carried out through litigation and non-litigation pathways. The litigation pathway offers legal certainty, execution power, and transparency but has weaknesses in terms of cost, time, and its confrontational nature. Conversely, the non-litigation pathway is more efficient in terms of cost, time, and its collaborative nature, but is limited in terms of execution and legal certainty. Therefore, the choice of dispute resolution method must consider the characteristics of the dispute and the needs of the parties involved.

Abstract

Conversion of agricultural land to dry land is a crucial issue in the context of sustainable development and food security in Indonesia. This change is triggered by various factors, including urbanization, industrialization, and economic pressure on agricultural land. This study aims to analyze the impact of land conversion on environmental, social, and economic aspects. The method used is secondary data analysis from various relevant sources. The results of the study indicate that this change causes land degradation, characterized by decreased soil fertility, increased risk of erosion, and reduced biodiversity. From a social perspective, land conversion contributes to a decrease in farmers' welfare due to decreased agricultural productivity and their income. In addition, the reduction in agricultural land also has a negative impact on local food security and encourages migration to urban areas in search of better sources of livelihood. Economically, land conversion can increase land value and open up new investment opportunities, but it is often not profitable for small farmers who lose their sources of livelihood. Therefore, a sustainable land management strategy is needed through policies that are oriented towards a balance between development needs and natural resource conservation. Collaboration between the government, local communities, and the private sector is key to overcoming the negative impacts of land conversion and maintaining food security and community welfare in the future.

Abstract

This study aims to determine the legal factors of judges at the Salatiga District Court in adjudicating applications for recognition of illegitimate children. The research approach used in this study is normative juridical. The data used in this study are secondary data which include primary legal materials, secondary legal materials, and tertiary legal materials. The data obtained are then analyzed qualitatively. The results of this study indicate that the ambiguous provisions regarding the recognition of illegitimate children in Law Number 1 of 1974 concerning Marriage require the resolution of the case through the application of the Civil Code (KUHPerdata) which has not been formally abolished in the Indonesian legal framework as substantive civil law used in the District Court. The legal considerations of the judges at the Salatiga District Court in adjudicating applications for recognition of illegitimate children born before their parents were officially married indicate that the child, Farra Abigail Sherina, is the biological child of the couple Nugroho Fajar Aji and Anissa Alif Putrianti. Furthermore, the applicant's application for recognition of the illegitimate child has met the requirements set out in the Civil Code.

Abstract

Right of Management (HPL) is part of the state right to control the land and part of the rights delegates to the HPL holders. In order to carry out the construction HPL holders may grant land rights on HPL with a land use agreement (SPT). In practice, however, there are often legal issues related to the granting of land rights over HPL, especially HPL requested on land that already belongs to state owned company (BUMN / BUMD), or also Local Government to be converted into commercial activities. This paper will examine the legal problems arising from land use on HPL. The method used in this paper is a doctrinal / legal approach, where the law is conceived as a legislation. The result of HPL analysis is not the right to land as stipulated in the LoGA, in the application of land above the HPL the extension of their rights to rights holders on HPL may be given priority after obtaining approval from HPL holders. Keywords:  Right of Management, Land Use Agreement, Local Government Asset

Abstract

Perjanjian Pengikatan Jual Beli (PPJB) merupakan perjanjian pendahuluan sebelum dilaksanakannya perjanjian jual beli yang bersifat definitif. PPJB sering digunakan ketika terdapat kondisi tertentu yang menghambat transaksi langsung, seperti belum terpenuhinya persyaratan administratif atau pelunasan pembayaran. Dalam praktiknya, PPJB sering dibuat dalam bentuk akta autentik di hadapan notaris guna memberikan kepastian hukum. Penelitian ini bertujuan untuk mengkaji persyaratan hukum pembuatan PPJB sebagai akta autentik serta tanggung jawab notaris dalam menjamin keabsahannya. Dengan metode yuridis normatif, penelitian ini menganalisis peraturan hukum dan putusan pengadilan terkait. Hasil penelitian menunjukkan bahwa PPJB yang dibuat sebagai akta autentik harus memenuhi persyaratan formil dan materiil, jika tidak, maka dapat dianggap sebagai akta di bawah tangan yang memiliki kekuatan hukum lebih lemah. Peningkatan kualitas serta kepastian hukum dalam pembuatan akta PPJB sebagai akta autentik, diperlukan langkah perbaikan baik dari segi regulasi maupun praktik notaris di lapangan, dengan penguatan pengawasan terhadap notaris.

Abstract

A notary is a public official appointed by the state to carry out part of the public authority, especially in making authentic deeds that have legal force. The role of a notary must comply with various legal provisions stipulated in Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary (Notary Position Law). One of the main obligations that must be carried out by a notary is to act in a trustworthy manner, as stipulated in Article 16 Paragraph (1) Letter a of the Notary Position Law. In Islam, the principle of trustworthiness has a position as one of the basic values that must be applied in community and state life. Trustworthiness is a commendable trait recommended by the Qur'an and Hadith. The obligation of a notary to act in a trustworthy manner as stipulated in the Notary Position Law has strong relevance to the teachings of Islamic law. A study of the obligation of a notary to act in a trustworthy manner according to Article 16 Paragraph (1) Letter a of the Notary Position Law, when viewed from the perspective of Islamic law, is important to provide a more comprehensive understanding of the relationship between positive law and Islamic values. This study aims to analyze the obligation of notaries to act in a trustworthy manner, identify its relevance to the principle of trustworthiness in Islamic law, and examine the law of violations of this obligation.

Abstract

The land acquisition process requires the involvement of various parties, one of which is the Land Deed Making Officer (PPAT). PPAT has an important role in ensuring the validity of land administration through the creation of authentic deeds, such as deeds of sale and purchase, deeds of gift, and deeds of release of rights. In the context of land acquisition for public interest, the authority and responsibility of PPAT are very crucial in ensuring legal certainty for all parties involved. This study aims to find out and understand the authority of PPAT in the process of land acquisition for public interest and to analyze the legal responsibility of PPAT in making words related to land acquisition. The type of research used in this thesis is normative legal research, namely research that focuses on the study of laws and regulations, legal doctrine, legal principles, and relevant literature. This study is used to analyze the authority and responsibility of PPAT as regulated in the positive legal system in Indonesia, especially in the context of land acquisition for public interest. The results show that the PPAT's authority in land acquisition for public interest is to make authentic deeds related to the transfer of land rights, such as deeds of sale and purchase, deeds of release of rights, and deeds of gift. This authority is administrative in nature and does not include the assessment of compensation or determination of land acquisition policies and the legal responsibilities of the PPAT include ensuring the validity of documents and the identities of the parties, as well as ensuring that the transferred land is not in dispute. PPAT's negligence can have legal consequences, both administrative, civil, and criminal.
