Abstract

Tanaman sirih diminati masyarakat karena perawatannya yang mudah dan daunnya dapat dimanfaatkan sebagai bahan antiseptik dan antibakteri. Demikian  juga halnya dengan warga masyarakat Desa Kedaton I, Batanghari Nuban, Lampung Timur, khususnya ibu-ibu Anggota PKK (Pemberdayaan Kesejahteraan Keluarga) Desa Kedaton I, Batanghari Nuban, Lampung Timur.  Namun, terhadap masyarakat khalayak sasaran terdapat persoalan mendasar, yaitu rendahnya tingkat pendidikan, pengetahuan dan pengalaman anggota kelompok mitra, sehingga mereka perlu diberikan kegiatan pengabdian kepada masyarakat. Untuk menguatkan mereka, perlu diberikan kegiatan pengabdian kepada masyarakat berkaitan dengan pendampingan dan pelatihan ekonomi kreatif masyarakat berbasis home industry. Tujuan kegiatan pengabdian kepada masyarakat ini adalah, selain pendampingan dalam pembuatan handsoap, juga pendampingan kepada kelompok mitra dalam bentuk pelatihan dan praktik, serta sosialisasi Covid 19. Berdasarkan atas hasil pengabdian, diperoleh data bahwa pemahaman peserta tentang kewirausahaan handsoap sebesar 63,00%. Selain itu, kelompok mitra juga sudah bisa membuat produk handsoap antiseptik.

Abstract

Omnibus law is a law in which it discusses and contains more than one discussion theme or topic. The omnibus law became the attention of the Indonesian people after the enactment of Law no. 11 of 2020 concerning Job Creation. Even before the law was passed, it had been rejected by the community. This is because people think the law will harm the small people, one of which is PKWT employees and will actually benefit the elite. Then what is the actual status of the omnibus law in Indonesia, considering that the technique has not been regulated in Law no. 12 of 2011 concerning the Establishment of Legislation which was changed to Law no. 15 of 2019. And what is the status of PKWT after the omnibus law regarding the work copyright law. In this study, the author uses a normative juridical research method. The results obtained in this study can be concluded that the application of omnibus law in Indonesia may be applied, but it would be better if before the enactment of the omnibus law, the legal basis was first made, considering that our country is a state of law. The omnibus law is also not the only way out in solving regulatory problems in Indonesia. This is because Indonesia's problems are not only about overlapping regulations, but there are many things that are not sufficiently resolved through the omnibus law. Then regarding PKWT there are five important points that must be considered with the existence of the Job Creation Act, namely the employee's tenure, contract extension, probationary period, compensation money and the form of a written agreement.

Abstract

The existence of the Corruption Eradication Commission or Komisi Pemberantasan Korupsi (KPK)’s Supervisory Board to oversee KPK's work is the result of the KPK Law Number 19 of 2019. This new legislation mandates the KPK Supervisory Board to perform four primary duties. One of the duties of the Board's authority, permitting or not permitting KPK to conduct wiretapping, search, and/or seizure corruption crimes, sparked public outrage due to the fear of attempts to weaken KPK. This research is served for determining whether the role of the KPK Supervisory Board as a licensee for wiretapping, search, and seizure of criminal acts of corruption is functional and will run effectively and efficiently in tackling the eradication of corruption. The research method used is qualitative research with descriptive presentation and a normative juridical approach. According to the findings, the pro-justice authority delegated by law to the KPK Supervisory Board, namely granting permits for wiretapping, search, and confiscation of criminal acts of corruption, has proven to be effective and efficient in combating corruption. It is concluded because, in principle, it is assumed that balancing all the powers of state institutions through supervision is a natural thing to do.

Abstract

Traffic crimes committed by children generally occur because of negligence. The problem of this research is how the implementation of police discretion in traffic criminal cases committed by children and why there are obstacles in the implementation of police discretion in traffic criminal cases carried out by children. The problem approach in this study uses a normative juridical approach. Data collection is done by library research. Data were analyzed qualitatively to obtain research conclusions. The results showed that the implementation of police discretion in traffic criminal cases by children is a form of settlement of cases outside the court carried out with a peace process based on good faith between the parties involved in traffic accidents to pursue settlement in a family way. The settlement of a traffic accident case does not have to be a criminal punishment or the imposition of a criminal sanction, in this case based on the occurrence of an act, if it occurs due to negligence and error not on the suspect. Factors that impede the implementation of police discretion in traffic criminal cases committed by children are the limited number of members of the Metro Police Traffic Satlantas in handling traffic cases, incomplete data and information submitted by the perpetrators and victims involved in traffic criminal cases, so that the perpetrators and victims only provide data deemed not potentially detrimental to their party. Cultural Factors, namely the personal character of the offender, victim and his family who do not support the settlement of cases outside the court.

Abstract

Criminal acts related to hate speech are one of the crimes that occur as a result of the misuse of information technology carried out by a person or group by conveying forms of provocation, seditious actions, or in the form of insults to someone or certain other groups in terms of various indicators, namely race, skin, gender, religion and others. Research problems: how are the efforts to deal with the criminal act of distributing electronic information containing hate speech at POLDA Lampung and why there are obstacles to efforts to overcome the criminal act of distributing electronic information containing hate speech at the Regional Police located in Lampung Province. This type of research is a normative juridical research. The data analysis was done qualitatively. The approach to the problem used is the statute approach. The results of this study indicate that the law enforcement of hate speech using social media is carried out by the Sub-Directorate for Cyber Crime of POLDA Lampung through non-penal and penal means. Non-penal efforts are carried out by carrying out cyber patrols and socializing the prohibition on hate speech using social media. Penal efforts carried out by investigation and investigation. The factors that hinder efforts to overcome criminal acts of hate speech by using social media are in the aspects of legislation, aspects of law enforcement officials, facilities and infrastructure, community conditions and cultural aspects of these factors, there are dominant factors being weaknesses, namely in the aspect of law enforcers who are not yet competent and have mastered the development of types of crimes related to information technology, precisely at the Cyber Police Unit in Lampung Province.

Abstract

Memberikan edukasi kepada masyarakat tentang pentingnya meningkatkan pengetahuan dan kesadaran hukum terhadap Undang-Undang Cipta Kerja dan peraturan pelaksanaanya di bidang kelautan dan perikanan sebagai upaya penanggulangan Illegal Fishing sangat dibutuhkan, dalam hal ini Kantor Syahbandar Perikanan Pelabuhan Perikanan Lempasing (PP Lempasing). Adapun target khusus kegiatan ini yakni mewujudkan pengawasan terhadap praktik Illegal Fishing di Pelabuhan Perikanan Lempasing. Metode yang dipakai dalam pencapaian tujuan tersebut yakni penyampaian materi melalui sosialisasi dan Focus Group Discussuin (FGD). Sasaran kegiatan ini ialah Kantor Syahbandar Perikanan Pelabuhan Perikanan Lempasing dan masyarakat nelayan sekitar Pelabuhan Perikanan Lempasing. Kegiatan ini berlokasi di gedung Kantor Syahbandar Perikanan Pelabuhan Perikanan Lempasing. Setelah pelaksanaan kegiatan, diketahui bahwa 85% dari 25 peserta yang hadir belum memiliki pengetahuan yang cukup tentang illegal fishing berdasarkan hasil rekapitulasi penilaian tes tertulis pertama, karena masing-masing tes peserta dengan jawaban benar tidak ada yang mencapai 50% dari 10 soal yang diberikan. Namun setelah mengikuti pengabdian terjadi perubahan yang signifikan terhadap tingkat pengetahuan peserta, yakni sebanyak 75% dari 25 peserta dengan jawaban benar mencapai 50% dari 10 soal tes tertulis yang telah diisi pada akhir kegiatan.

Abstract

Policies for resolving religious blasphemy in Indonesia are regulated in Law Number 1/PNPS/1965 concerning the Prevention of Blasphemy of Religion and Article 156a of the Criminal Code. Sentences are often repressive and do not fulfill the value of justice. The formulation of the problem in this article is: what is the criminal law policy in the settlement of blasphemy and what kind of settlement model is chosen to handle the case. This research method is normative legal research with a statutory approach based on primary legal materials. The research results show that the imposition of punishment is the main solution. Meanwhile, the model chosen in the resolution of defamation of freedom of expression according to the concept of restorative justice uses an integrated approach that tries to implement penal and non-penal efforts simultaneously to fulfill justice for the perpetrators of defamation, including involving the role of the community through the Religious Communication Forum (FKUB). Suggestions that need to be conveyed are that criminal law policies are still being implemented, but harsh criminal sanctions are softened by using the concept of restorative justice, bearing in mind that not every case of blasphemy deserves a harsh sentence.

Abstract

Abstrak:Penjatuhan sanksi pidana sudah seharusnya diberikan apabila terdakwa pantas mendapatkan sanksi pidana, namun pada kasus ini seorang penyalah guna narkotika bagi diri sendiri dijatuhi sanksi pidana penjara yang dimana sudah seharusnya diberikan rehabilitasi medis ataupun rehabilitasi sosial. Penelitian ini menggunakan metode penelitian yuridis empiris yaitu melakukan pendekatan secara langsung ke Pengadilan Negeri Tanjung Karang dalam memperoleh data-data penerapan sanksi pidana pada perkara penyalahgunaan narkotika. Penulis juga menggunakan teori yuridis normatif yaitu metode dengan menggunakan literatur hukum yang mendasari dengan mengkaji teori, konsep, asas hukum, undang-undang, serta peraturan yang relevan. Penelitian ini diharapkan dapat memberikan penyelesaian mengenai persoalan penjatuhan sanksi pidana pada perkara penyalahgunaan narkotika serta meningkatkan penerapan asas ultimum remedium sebagai jalan keluar pada perkara penyalahgunaan narkotika di masa yang akan datang.Kata Kunci: Ultimum Remedium, Sanksi Pidana, Penyalahgunaan NarkotikaAbstract:The imposition of criminal sanctions should have been given if the defendant deserved it, but in this case a drug user for themselves was sentenced to prison, where medical rehabilitation or social rehablitation should have been given instead. This study uses an empirical juridical research method, namely approaching directly to the Tanjung Karang District Court in obtaining data on the application of criminal sanctions in narcotics abuse cases. The author also uses normative juridical theory, which is a method by using the underlying legal literature by examining relevant theories, concepts, legal principles, laws, and regulations. It is hoped that this research can provide a solution regarding criminal sanctions in drug abuse cases and improve the application of the ultimum remedium principle as a way out for future drug abuse cases.Keywords: Ultimum Remedium, Criminal Sanctions, Narcotics Abuse

Abstract

Pidana pelatihan kerja merupakan amanat dari Pasal 71 Ayat (3) Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak yaitu pidana pelatihan kerja dijatuhkan untuk menggantikan pidana denda. Berdasarkan data dari Bapas Kelas II Bandar Lampung tahun 2020 sampai dengan tahun 2023 setidaknya terdapat 85 anak yang dihukum pidana pelatihan kerja. Hingga saat ini, Bapas Kelas II Bandar Lampung telah menggandeng sebanyak 21 (enam belas) Pokmas Lipas yang membantu pelaksanaan pembimbingan terhadap terpidana dan menjadi tempat pelaksanaan pidana pelatihan kerja, untuk itu perlu diketahui lebih lanjut peran Pokmas Lipas ini sebagai tempat dalam menajalankan pidana pelatihan kerja. Penelitian ini masuk dalam pendekatan yuridis normatif dan yuridis empiris, analisis data yang digunakan dalam penelitian ini adalah analisis kualitatif. Hasil penelitian menunjukan bahwa peran Pokmas secara normatif telah diatur dalam Sk Ditjenpas No. PAS-06.OT.02.02 tentang Pedoman Pembentukan Kelompok Masyarakat Peduli Pemasyarakatan. Secara faktual pokmas lipas telah menjalankan peran sebagaimana diatur dalam Sk Ditjenpas No.PAS-06.OT.02.02. Secara ideal seahrusnya pokmas lipas memberikan arahan moral dan spiritual. Adapun faktor yang menjadi penghambat pelaksaanaan pidana pelatihan kerja yaitu faktor hukum, faktor aparat penegak hukum, faktor sarana dan prasarana, faktor masyarakat dan faktor kebudayaan. Saran yang dihasilkan dari penelitian ini yaitu seharusnya pemerintah membuat aturan hukum tersendiri dalam hal mekanisme pelaksanaan pidana kerja sosial, serta aparat penegak hukum khususnya jaksa sebagai eksekutor putusan harus berperan aktif dalam pelaksanaan pidana pelatihan kerja

Abstract

A visa is a permit (approval) to enter, in the form of a stamp and initials affixed by the relevant representative official to the applicant's passport. Foreigners who enter Indonesia take advantage of the visa-free visit facility by committing immigration violations such as misusing the time limit of the stay permit (overstay) to carry out activities that are not in accordance with immigration law. This study aims to examine the enforcement of criminal law by immigration against foreigners who misuse their visit visas beyond the time limit. The results of this study examine how immigration law enforcement acts in accordance with Law Number 6 of 2011 concerning Immigration by supervising the completeness of administrative procedures for foreigners' visit stay permits, and taking administrative action against those who violate the stay permit by imposing on foreigners to pay a fee, and repatriation to their country of origin.
