Abstract

The absence of provisions regulating Judicial Pardon (Rechterlijk Pardon) in the current Indonesian Penal Code and Criminal Procedure Code has created a legal vacuum. Judges are normatively bound to issue one of three verdicts: conviction, acquittal, or dismissal. This limitation excludes the possibility for judges to apply discretionary forgiveness in cases involving minor offenses or mitigating circumstances. Although Article 54 paragraph (2) of Law No. 1 of 2023 concerning the Penal Code introduces the concept of Rechterlijk Pardon, it fails to provide clear parameters regarding what constitutes “minor severity of the act,” as well as the personal background of the offender or contextual factors surrounding the offense. This vagueness raises concerns over legal uncertainty and inconsistency in judicial interpretation. The purpose of this study is to examine the normative foundation and interpretive scope of the Judicial Pardon doctrine under Article 54 paragraph (2) and to formulate a legal construction that harmonizes substantive and procedural criminal law. This research is normative in nature, using a combination of statutory, conceptual, philosophical, case, and comparative approaches. The findings demonstrate that Judicial Pardon must be explicitly regulated through clear interpretive guidelines to ensure its implementation does not conflict with the principles of justice and legal certainty. Moreover, the integration of Judicial Pardon into the Draft Criminal Procedure Code is necessary to provide formal procedural legitimacy for judges to refrain from sentencing in specific circumstances, thus ensuring the penal system accommodates fairness, humanity, and proportionality in the enforcement of criminal justice.

Abstract

Provisions regarding living together as husband and wife outside of marriage, known as cohabitation, were introduced in Law Number 1 of 2023 concerning the Criminal Code (National Criminal Code). However, the regulation has many problems, including philosophical, sociological and juridical problems, as well as inappropriate norms, not reflecting justice and ignoring religious and customary norms. This research aims to analyze and find a reconstruction of the formulation of cohabitation norms in the National Criminal Code based on principle of legal certainty. The formulation of the problem proposed is How to reconstruct the formulation of cohabitation norms in the National Criminal Code, based on the principle of legal certainty. The research method uses normative legal research, namely a process of finding legal rules, legal principles and legal doctrines to answer the legal issues faced. The approaches used are the statutory approach, the comparative approach and the conceptual approach. Sources of legal materials are primary legal materials, secondary legal materials and tertiary legal materials. The results obtained from this research, Article 412 of the National Criminal Code needs to be reconstructed regarding cohabitation norms, namely living together not as husband and wife because it is not based on a legal marriage, the cohabitation offense is also not a complaint offense but is an ordinary offense, and because cohabitation behavior is not in accordance with The spirit of Pancasila is contrary to religious customs and norms, so we must receive heavier sanctions so that between criminal penalties and fines are accumulative punishments.

Abstract

Introduction: A person who carries out a financial transaction or other financial transaction that is suspected of hiding or disguising the origin of wealth from illegal acquisitions as if it were legitimate wealth and not the result of a crime, its truth must first be proven. Purposes of the Research: Research aims to find the urgency of regulating the crime of money laundering originating from prostitution in the National Criminal Code based on the principle of justice and the concept of reformulating the regulation of the crime of money laundering originating from prostitution in the National Criminal Code. Methods of the Research: A study uses normative legal research, namely legal research that focuses on the study, review, and analysis of positive law. This research is a review or analysis that focuses on the rules or provisions stipulated in applicable laws and regulations. A study was conducted on the primary legal materials and secondary legal materials used to answer the legal issues raised, namely related to the regulation of money laundering crimes originating from prostitution crimes. Results Main Findings of the Research: The results of the study show the urgency of reformulating the regulation of prostitution as a predicate crime in money laundering as a crime of follow does not reflect the value of justice for the community involved in both crimes. The community understands that prostitution is not just a symptom of social pathology but is a criminal act. The community should be involved in social control efforts so that there are no further criminal acts, namely money laundering.

Abstract

The ownership of Percaton Asta Tinggi land is governed similarly to other types of land ownership. If individual ownership is not recognized, the land is considered state property under the state's full control. This situation reflects a legal vacuum, creating ongoing issues due to the lack of a clear legal framework for ownership and authority over the land. This study examines the management, ownership, status, and authority concerning Percaton Asta Tinggi land. Findings reveal that the land is managed by the Somala Addition Foundation, with control entrusted to the guardians of Asta Tinggi as managers and custodians, as specified by a specific decree. The land is registered under a use-rights certificate, granting the foundation authority to manage the land based on the Regent's Decree. The decree restricts the land's purpose solely for management and benefit utilization, prohibiting personal ownership or sale. While land transfer registrations follow standard procedures, the registration of Percaton Asta Tinggi land is deemed invalid and nullified when intended for sale. This study underscores the need for a legal framework to address the specificities of managing and transferring rights over Percaton Asta Tinggi land.

Abstract

Notary is a public official needed by the community who needs a deed as evidence for civil transactions. A notarial deed is perfect evidence that does not require other evidence in court proceedings. The authenticity of the Notarial Deed is required to be made by an Official whose authority is granted by law. In addition, one of the requirements for the authenticity of a Notarial deed must be read out in front of the person appearing before it is signed. If the Notary does not read out the deed, the result is that its evidentiary power is degraded to a deed under hand, while the Notary is not subject to any sanctions. Such regulation is unfair to the person appearing, so for justice for the person appearing, the regulation of sanctions in the UUJN must be reconstructed by deleting and changing several provisions of the articles containing sanctions. This research is normative legal research that focuses on the study of legal norms of UUJN, especially those related to the obligation of Notaries to read the deed in front of the person appearing before the deed is signed. The reconstruction is carried out by adding one letter m in the articles containing sanctions for Notaries who do not carry out their obligations, including not carrying out the obligation to read the deed before the deed is signed.

Abstract

The aim of writing this article is to find out and explain the responsibility of corporations in committing criminal acts of burning forests and land as well as the judge's considerations in imposing criminal penalties on corporations that run the palm oil business sector as stated in decision Number: 71/Pid.B/LH/2021/ PN Snt. In the criminal act of burning forests and land, the perpetrators of forest burning, both humans and legal entities (corporations), must be held accountable. Nevertheless, the majority of people still view crime as murder, rape, theft and other similar things, thus reducing the understanding that the real crime with large victims is corporate crime. The provision of criminal sanctions against corporations in the palm oil plantation industry is an effort to provide a deterrent effect so that they do not commit acts of pollution and destruction of the environment in accordance with the legal provisions in force in Indonesia. The problem in this research is how corporate responsibility is in committing criminal acts of burning forests and land and how judges consider in handing down decisions against PT. Mega Anugrah Sawit (PT.MAS). The research method used in this research is normative juridical. The results of the research show that sanctions given to perpetrators of criminal acts of burning forests and land must be strictly enforced by law. So that criminal law becomes the leading law in expressing these legal problems

Abstract

In a democratic system, power is divided between the executive, legislative, and judiciary, each with its own functions and authority. Regarding judicial authority, the Supreme Court has the power to conduct judicial review, which involves testing lower regulations against the law itself. This judicial review process is important to assess whether lower regulations comply with higher laws. An interesting case of judicial review was submitted by the Garuda Party against Article 4 paragraph (1) letter d of PKPU No. 9 of 2020 concerning the Nomination for the Election of Regional Heads. In its decision, the Supreme Court ruled that Article 4 of PKPU No. 9 of 2020 lacked binding legal force and ordered the General Election Commission (KPU) to revoke it. This decision, Supreme Court No. 23 P/HUM/2024, raises questions about the authority and legality of the Supreme Court's power to revoke a regulation that should fall under the legislative authority. This contradicts the concept of open legal policy, which grants the power to form laws and regulations to the legislative body. Furthermore, the legal force of the Supreme Court's decision is also questioned, especially after the Constitutional Court issued a different ruling, No. 70/PUU-XXII/2024. The differing interpretations between the two institutions highlight a conflict in the interpretation of the same regulation.

Abstract

General elections are a form of manifestation of the democratic system adopted by every country that applies democratic values. The implementation of elections is not only used as a form of necessity for government power in carrying out the leadership period but also to be used as a means of infrastructure for the people to articulate aspirations and interests in everyday life. The people can also elect their representatives who will later occupy seats in parliament as members of the legislature. The legal basis for organizing legislative elections in Indonesia has continued to change since the reform era began. Changes to election laws are always made before an election is held, based on an assessment of the results of previous elections for other reasons. This change, of course, coincided with the revision of the law on election administration and the law on political parties. This legal reform package is also known as the main legal reform package. Gaps in statutory regulations can also lead to different interpretations of the implementation of certain rules. The decision of the Constitutional Court which abolished the electoral system which limited the counting of votes demonstrated the inadequacy of the election regulations.

Abstract

This article examines black campaigning on social media during the general election and its legal liability. Using legislative and conceptual approaches, normative legal research is done. Primary, secondary, and tertiary legal materials are used. Legal materials are analysed descriptive-qualitatively. Black political campaigns routinely abuse social media to attain their goals. The Law on General Elections and the General Election Commission Regulation on General Election Campaigns in Indonesia govern social media use in campaigns to combat this. The Law on General Elections and the Law on Information and Electronic Transactions penalise social media black campaigning with fines and jail time. Such actions are election crimes and cybercrimes since they involve technology

Abstract

Kewenangan pemerintah daerah dalam pengelolaan pertambangan mineral dan batubara setelah penetapan Undang-Undang Nomor 3 Tahun 2020 Tentang Pengelolaan Pertambangan Mineral dan Batubara, utamanya dalam pasal 6 ayat (1) yang menjadi fokus utama penelitian ini, dinilai telah tersentralisasi, sebab pada peraturan sebelumnya yakni dalam Undang-Undang Nomor 4 Tahun 2009 Tentang Pertambangan Mineral dan Batubara, pemerintah daerah memiliki kewenangan dalam pengelolaan pertambangan mineral dan batubara, namun dalam undang-undang terkini kewenangan pemerintah daerah dihapus, hanya ada pemerintah pusat yang memiliki mayoritas kewenangan krusial dalam pengelolaan pertambangan mineral dan batubara. Penelitian ini bertujuan untuk mengkaji kesesuaian Pasal 6 ayat (1) Undang-Undang Nomor 3 Tahun 2020 Tentang Pertambangan Mineral dan Batubara terhadap prinsip otonomi daerah, prinsip negara kesatuan dan keadilan pembagian urusan pemerintahan yang sesuai dengan Pasal 18A ayat (2) Undang-Undang Dasar 1945. Penelitian hukum (legal research) adalah penelitian hukum yuridis normatif yang menggunakan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach) dan pendekatan perbandingan (comparative approach). Bahan hukum yang digunakan adalah bahan hukum primer, sekunder dan tersier. Hasil penelitian yang didapat setelah menganalisa kesesuaian Pasal 6 ayat (1) Undang-Undang Nomor 3 Tahun 2020 Tentang Pertambangan Mineral dan Batubara terhadap konsep otonomi, konsep negara kesatuan dan keadilan pembagian urusan yang sesuai dengan Pasal 18A ayat (2) Undang-Undang Dasar 1945, serta membandingkan undang-undang yang lama dengan yang terkini, dinilai tidak sesuai dengan konsep dan peraturan perundang-undangan tersebut, sebab telah ditemukan adanya sentralisasi kewenangan pengelolaan pertambangan mineral dan batubara.
