Abstract

Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil sudah dinilai baik, namun dalam pelaksanaanya masih ditemukan beberapa permasalahan di lapangan. Bahwa di Lapas Kelas IIA Pamekasan terdapat pegawai tertentu yang melakukan pelanggaran disiplin terkait ketentuan jam dinas. Selain itu masih terdapat beberapa pelanggaran lainnya yang dilakukan dan telah dijatuhi hukuman disiplin. Tujuan penelitian ini adalah untuk mengkaji Efektivitas Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil di Lapas Kelas IIA Pamekasan dalam menjamin kedisiplinan pegawai saat bertugas. Metode penelitian empiris ini dilakukan dengan pendekatan sosiologi hukum. Hasil penelitian menunjukkan bahwa terdapat 5 faktor yang mempengaruhi penegakan hukum disiplin pegawai, meliputi faktor peraturan perundang-undangan, faktor penegak hukum, faktor sarana prasarana, faktor masyarakat dan faktor budaya. Dari penjelasan tersebut dapat disimpulkan bahwa penerapan Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil di Lapas Kelas IIA Pamekasan sudah efektif. Namun pada kenyataannya masih terdapat pegawai yang melakukan pelanggaran disiplin di Lapas Kelas IIA Pamekasan dikarenakan kurangnya kesadaran hukum dan kurangnya pemahaman pegawai terhadap peraturan disiplin PNS. Oleh karena itu, sosialisasi peraturan disiplin kepada seluruh pegawai perlu dilakukan secara rutin sebagai salah satu upaya pencegahan terjadinya pelanggaran disiplin pegawai di Lapas Kelas IIA Pamekasan.

Abstract

The validity of a marriage is the fulfillment of the pillars and conditions of marriage as stipulated in Islamic law. One of the pillars currently being discussed is the online Ijab and Qabul (marriage contract), considering the COVID-19 pandemic, there has been much news about online marriage ceremonies due to various constraints. Moreover, technology is becoming increasingly advanced and evolving, making human tasks easier. The aim of this study is to examine the legality of online marriage contracts that occurred during the COVID-19 pandemic. This research uses a qualitative research method with a library research type, referencing journals, articles, and books related to the main theme of online marriage contracts. All references, including legal and non-legal sources, are presented and then analyzed carefully. Scholars and fiqh experts have provided arguments about the validity of marriage through online contracts. According to the scholars, an online marriage contract is valid if what is meant by one assembly is one time, not one place. Thus, after the Ijab is stated, the Qabul must also be stated immediately. The research results show that marriage contracts conducted online during the COVID-19 pandemic are legally valid, thereby contributing to resolving the difficulties faced by prospective brides and grooms in gathering to conduct the marriage contract due to social restrictions. The validity of online marriage contracts represents a legal renewal that previously considered that marriage contracts must be conducted in one place.

Abstract

This study aims to analyze the impact of the digitalization of the Core Tax Administration System (CTAS) on tax law enforcement, with a particular focus on the application of the ultimum remedium principle. The research method employed is normative legal research, involving an in-depth analysis of tax law literature, relevant regulations, and case studies of CTAS implementation. The urgency of this research lies in addressing inefficiencies, inequities, and the lack of transparency in traditional tax law enforcement through the utilization of digital technology. The findings reveal that CTAS digitalization enhances efficiency, transparency, and data management in tax administration while strengthening law enforce ment processes through improved oversight and compliance. However, this digitalization also presents challenges, including data security risks, privacy concerns, and compliance with applicable regulations. The novelty of this research lies in integrating the ultimum remedium principle within the digital framework, advocating for a proportional approach to tax violations by prioritizing voluntary compliance and corrective measures before escalating to more severe enforcement actions. This study provides strategic contributions to legal policy development, offering essential insights for policymakers, legal practitioners, and system developers in designing a tax law enforcement system that is fair, transparent, and responsive to the demands of the digital era.

Abstract

Disputes in the construction services sector are inevitable due to the complexity of contracts, project delays, cost overruns, and quality issues. Law No. 2 of 2017 on Construction Services seeks to reform dispute resolution mechanisms by emphasizing alternative dispute resolution (ADR), mediation, and arbitration while ensuring legal certainty and fairness. This study analyzes these reforms using a quantitative survey approach to assess their effectiveness and identify existing gaps. The Construction Services Acts of 1999 and 2017 marked significant philosophical and procedural shifts, with the latter focusing on non-litigious settlements through a win-win approach. However, challenges remain, particularly regarding the interpretation of the term "court" and the enforcement of decisions. Findings indicate that while Law No. 2 of 2017 promotes ADR mechanisms, enforcement issues, contractual inconsistencies, and power imbalances between large developers and smaller contractors hinder its effectiveness. The Act also establishes a team formed by mutual agreement to oversee construction services and mediate disputes, yet concerns persist over defects, nonconformities, weaknesses, and perceived biases in its implementation. Despite these challenges, Indonesia is progressing toward more effective construction dispute resolution. To enhance future regulatory frameworks, this study recommends stricter sanctions for violations of construction agreements and improved procedural clarity. Comparative insights from international legal frameworks suggest that Indonesia could benefit from integrating global best practices, such as adjudication boards and expedited arbitration. These findings are crucial for legal practitioners and policymakers in refining dispute resolution mechanisms and raising public awareness of regulatory gaps that hinder sustainable development.

Abstract

The sea and its resources, especially fishery resources, are a gift from God Almighty for the welfare of all Indonesian people. Based on the state's right to control the earth and the natural resources contained therein, which originates from Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia, the government must regulate fishery resources for the greatest prosperity of all people. The use of fishery resources is carried out with various legal products ranging from laws, government regulations, and presidential decrees to ministerial rules. Regulations on using fishery resources include prohibiting using trawl nets to catch fish in certain waters. This prohibition aims to prevent damage to the marine environment, ensure the sustainability of fishery resources, and protect small fishermen. However, in its implementation, it is still hampered by the problem of law enforcement, which is hindered by disharmony of regulations, the availability of professional law enforcement officers, and the lack of support for facilities and infrastructure considering the vast area of law enforcement. One thing that is no less important in enforcing the law on the prohibition of the use of trawl nets is the low legal awareness of fishing communities, especially industrial fishermen who only care about themselves without paying attention to the preservation of marine ecosystems, the sustainability of fishery resources, and the protection of small fishermen or traditional fishermen.

Abstract

The seller offers goods with online media by relying on the description of the goods in the form of videos or photos so that consumers cannot directly check the goods to be purchased. This article analyzes the seller's liability due to hidden defects in online buying and selling transactions. This study uses a normative juridical approach. Results of the study show that hidden defective products sold by sellers in online transactions are the absolute responsibility of the seller as regulated in Article 19 of the UUPK, as well as the provisions of Articles 1365 and 1865 of the Civil Code, namely the seller is responsible for the goods sold. However, this responsibility must be proven that the seller did make a mistake, and the result of the mistake has been detrimental to the consumer. Besides the obligation of consumers to be careful, consumers also need to get protection.

Abstract

Law Number 23, 2009 concerning Environmental and Management Protection has been running for eleven years. This law still needs a lot of evaluation, especially at the level of implementation or implementation. One of them is related to the sanction for corporations that do environmental damage. There are three types of sanctions that can be given to corporations, namely: civil, criminal and administrative. However, all this time the three did not provide a deterrent effect. As a result, the rights of affected citizens to get a healthy environment are also ignored. For this reason, this paper focused on how is the Analysis of corporate sanctions of perpetrators of waste dumping without permission viewed from a Human Rights perspective? This study uses a juridical normative research method, by analyzing secondary data in the form of laws and regulations related to sanctions for corporations that carry out waste dumping without permission. The results of the study found that the analysis of corporate sanctions for the perpetrators of waste dumping without permission did not represent the protection of human rights for the community. Legal fissures make the corporation can continue its activities and make it possible to do environmental damage again. It is necessary to maximize the application of the highest alternative sanctions by paying attention to human and community rights around the location of waste dumping where the quality of water, air, and soil has deteriorated.

Abstract

Penelitian ini bertujuan untuk menganalisis dasar dan alasan pemberian kewenangan pemeriksaan keuangan kepada akuntan publik terhadap Badan Usaha Milik Negara (BUMN) serta menelaah implikasinya terhadap prinsip akuntabilitas pengelolaan keuangan negara. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil kajian menunjukkan bahwa pelibatan akuntan publik dalam audit BUMN didorong oleh kebutuhan efisiensi, profesionalitas, dan percepatan pelaporan keuangan dalam konteks penerapan good corporate governance. Dari sisi yuridis, kewenangan ini berlandaskan pada Undang-Undang Nomor 5 Tahun 2011 tentang Akuntan Publik dan Undang-Undang Nomor 16 Tahun 2025 tentang Badan Usaha Milik Negara yang memberikan ruang bagi audit eksternal. Namun, dari sisi konstitusional, muncul potensi disharmoni dengan Pasal 23E UUD 1945 yang menegaskan Badan Pemeriksa Keuangan (BPK) sebagai satu-satunya lembaga pemeriksa keuangan negara. Kondisi ini menimbulkan persoalan legitimasi dan akuntabilitas hasil audit, terutama ketika terjadi dualisme pemeriksaan antara BPK dan akuntan publik. Penelitian ini merekomendasikan harmonisasi hukum melalui revisi peraturan perundang-undangan, penegasan batas kewenangan audit antara BPK dan akuntan publik, serta penerapan mekanisme joint audit yang terintegrasi secara digital untuk memperkuat transparansi dan koordinasi. Dengan demikian, keuangan negara yang dikelola oleh BUMN dapat diaudit secara profesional tanpa menghilangkan sifat publiknya dan tetap menjamin akuntabilitas negara kepada rakyat.

Abstract

Geographically, it is located in a strategic urban area with quite rapid development, both in terms of infrastructure development and population growth. The heterogeneous composition of its population, both in terms of education level, livelihood, and cultural background, provides both potential and challenges in efforts to create an empowered community and actively participate in sustainable environmental management. In general, most residents of Nginden Jangkungan Village work in the informal sector, such as street vendors, rental services, grocery stores, and transportation services. This is exacerbated by the community's limited technical knowledge regarding waste management based on the principles of reduce, reuse, recycle (3R), as well as the absence of an integrated and sustainable empowerment model. The implementation method of this Community Service activity is designed with a participatory and collaborative approach, prioritizing synergy between academics, the village government, community groups, and beneficiary residents. Nginden Jangkungan Village has adequate social and institutional potential to implement a civil society empowerment program in sustainable environmental management. However, this area still faces serious challenges related to the management of household liquid waste, which has not been handled optimally, so it has the potential to pollute groundwater and waterways and cause environmental health impacts.

Abstract

Reformasi hukum pidana melalui Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana menandai upaya modernisasi hukum nasional dari warisan kolonial menuju sistem yang lebih selaras dengan nilai-nilai demokrasi dan hak asasi manusia. Namun, keberadaan Pasal 240 KUHP yang mengatur tindak pidana “penghinaan terhadap pemerintah yang sah” kembali memunculkan perdebatan mengenai batas-batas kriminalisasi ekspresi serta potensi pembatasan terhadap kebebasan berpendapat. Ketentuan ini dianggap memiliki rumusan yang longgar dan berpotensi menimbulkan penafsiran yang sewenang-wenang, terutama dalam konteks politik dan kritik terhadap pejabat negara. Hampir pada waktu yang bersamaan, Putusan Mahkamah Konstitusi Nomor 105/PUU-XXII/2024 menegaskan bahwa tindak pidana pencemaran nama baik dalam UU ITE hanya melindungi individu, bukan lembaga negara, korporasi, maupun jabatan publik. Putusan ini memperkuat prinsip bahwa institusi publik harus lebih terbuka terhadap kritik sebagai bagian dari mekanisme pengawasan dalam negara demokratis. Penelitian ini menggunakan metode yuridis normatif dengan menelaah peraturan perundang-undangan, doktrin, dan putusan pengadilan. Hasil penelitian menunjukkan bahwa ratio decidendi Putusan Mahkamah Konstitusi Nomor 105/PUU-XXII/2024 memiliki implikasi langsung terhadap interpretasi dan penerapan Pasal 240 KUHP. Pasal tersebut harus ditafsirkan secara restriktif agar tidak melanggar asas legalitas (lex certa) dan tidak mengkriminalisasi kritik yang sah. Karena itu, hanya ekspresi yang benar-benar menimbulkan ancaman nyata terhadap ketertiban umum yang dapat dikenai sanksi pidana. Penelitian ini memberikan kontribusi dalam merumuskan parameter penafsiran Pasal 240 KUHP yang selaras dengan prinsip negara demokratis yang berdasarkan atas hukum.
