Abstract

Tujuan penelitian menganalisis Penegakan Hukum Tahapan Pencalonan Dalam Pemilihan Kepala Daerah Serentak Tahun 2020 (Tinjauan Kasus Pada Pemilihan Kepala Daerah Kabupaten Majene) yang berkaitan dengan pelaksanaan Pemilihan Kepala Daerah Serentak Tahun 2020, di Provinsi Sulawesi Barat. Metode yang digunakan peneliti adalah Metode Penelitian Hukum Normatif Empiris. Hasil penelitian menunjukan bahwa keterbatasan ruang gerak penyelenggara pemilihan, akibat kepatuhan terhadap protokol kesehatan Covid-19 dalam mensosialisasikan aturan pemilihan dan memastikan keterpenuhan syarat administrasi pencalonan pasangan calon. Disisi lain Integritas penyelenggara Pemilihan sangat dipertaruhkan dalam menjaga sikap dan menjalankan prinsip kerja. Kewenangan yang diberikan dalam penegakan hukum pemilihan menjadi bagian penting terlaksananya pemilihan kepala daerah serentak 2020 secara Luber dan Jurdil. The research objective to analyze the the Law Enforcement of Nomination Stages in the 2020 Simultaneous Regional Head Elections (Case Overview of the Majene Regency Regional Head Election) relating to the implementation of the 2020 Simultaneous Regional Head Election, in West Sulawesi Province. The method used by the researcher is the Empirical Normative Legal Research Method. The results showed that the limited space for election organizers was due to compliance with the Covid-19 health protocol in disseminating election rules and ensuring the fulfillment of administrative requirements for the nomination of pairs of candidates. On the other hand, the integrity of the election organizers is at stake in maintaining attitudes and implementing work principles. The authority given in the enforcement of election law is an important part of the implementation of the 2020 simultaneous regional head elections in Luber and Jurdil.

Abstract

Tujuan penelitian menganalisis efektivitas penegakan hukum tindak pidana pemilihan umum oleh sentra penegakan hukum terpadu di Kota Makassar, dan faktor yang mempengaruhi. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian penulis mendapatkan bahwa: Efektivitas penegakan hukum tindak pidana pemilihan umum oleh sentra penegakan hukum terpadu di Kota Makassar, kurang berjalan secara efektif. Kurang efektifnya penegakan hukum tersebut diakibatkan oleh sistem penanganan tindak pidana pemilu jauh lebih rumit dibandingkan tindak pidana biasa, sementara itu pada penanganan tindak pidana pemilu juga melibatkan Pengawas Pemilu. Sehingga dinilai sebagai salah satu alasan kenapa penanganan tindak pidana pemilu menjadi tidak efektif. Faktor yang mempengaruhi penegakan hukum tindak pidana pemilihan umum oleh sentra penegakan hukum terpadu di Kota Makassar yaitu; substansi, struktur, dan budaya hukum. Ketiga faktor tersebut saling berhubungan terhadap penegakan hukum tindak pidana pemilihan umum oleh Sentra Penegakan Hukum Terpadu di Kota Makassar. The research objective to analyze the effectiveness of law enforcement on general election crimes by an integrated law enforcement center in Makassar City, and the influencing factors. This type of research is empirical juridical. The results of the study the authors found that: The effectiveness of law enforcement for general election crimes by an integrated law enforcement center in Makassar City, is not running effectively. The ineffectiveness of law enforcement is caused by the system for handling election crimes which is much more complicated than ordinary crimes, meanwhile the handling of election crimes also involves Election Supervisors. So it is considered as one of the reasons why the handling of election crimes is not effective. The factors that influence law enforcement for criminal acts of general election by an integrated law enforcement center in Makassar City are; substance, structure, and legal culture. These three factors are interrelated to the law enforcement of general election crimes by the Integrated Law Enforcement Center in Makassar City.

Abstract

Tujuan penelitian menganalisis kedudukan hukum data evaluasi penyedia pengadaan barang/jasa pemerintah ditinjau dari Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik. Metode penelitian dengan pendekatan pada norma atau subtansi hukum, asas hukum, teori hukum, dalil-dalil hukum dan perbandingan hukum. Hasil penelitian ini menunjukkan bahwa Kedudukan hukum data evaluasi pada pemilihan penyedia pengadaan barang/jasa ditinjau dari Undang-Undang 14/2008 belum menegaskan secara jelas keterbukaan informasi proses pengadaan barang/jasa pemerintah. Sementara Peraturan Pemerintah 61/2010 menjelaskan bahwa informasi yang dapat dibuka dalam proses Pengadaan Barang/Jasa dilakukan dengan uji konsekuensi sebagai dasar jangka waktu pengecualian berdasarkan peraturan perundang-undangan. Sehingga peraturan perundang-undangan yang dimaksud adalah Peraturan Presiden. The research objective to analyze the legal position of the evaluation data of government goods/services procurement providers in terms of Law Number 14 of 2008 concerning Public Information Disclosure. The research method with an approach to legal norms or substance, legal principles, legal theory, legal arguments and legal comparisons. The results of this study indicate that the legal position of evaluation data on the selection of goods/services procurement providers in terms of Law 14/2008 has not clearly confirmed the disclosure of information on the government's procurement of goods/services. Meanwhile, Government Regulation 61/2010 explains that information that can be disclosed in the process of Procurement of Goods/Services is carried out with a consequence test as the basis for the period of exception based on statutory regulations. So the legislation in question is the Presidential Regulation.

Abstract

Tujuan penelitian menganalisis efektivitas penahanan yang dilakukan jaksa penuntut umum terhadap pelaku tindak pidana di Kejaksaan Tinggi Sulawesi Barat. Tipe penelitian ini adalah yuridis empiris, data yang diperoleh penulis dari studi dokumen maupun wawancara dengan pihak yang berkepentingan dalam hal ini pihak Kejaksaan Tinggi Sulawesi Barat, kemudian dilakukan analisis kuantitatif. Hasil Penelitian penulis mendapatkan bahwa: Efektivitas penahanan yang dilakukan jaksa penuntut umum terhadap pelaku tindak pidana di Kejaksaan Tinggi Sulawesi Barat kurang berjalan secara efektif dikarenakan banyaknya ditemukan penangguhan penahanan yang dilakukan oleh Penyidik. Faktor yang mempengaruhi efektivitas penahanan yang dilakukan jaksa penuntut umum terhadap pelaku tindak pidana di Kejaksaan Tinggi Sulawesi Barat yaitu; struktur hukum, substansi hukum, budaya hukum. The research objective to analyze the effectiveness of detention by the public prosecutor against perpetrators of criminal acts at the West Sulawesi High Court. This type of research is empirical juridical, the data obtained by the author from document studies and interviews with interested parties in this case the West Sulawesi High Court, then quantitative analysis is carried out. The results of the study the authors found that: The effectiveness of detention by public prosecutors against perpetrators of criminal acts at the West Sulawesi High Prosecutor's Office was not running effectively because many investigators found suspensions of detention by investigators. The factors that influence the effectiveness of detention by the public prosecutor against perpetrators of criminal acts at the West Sulawesi High Prosecutor's Office are; legal structure, legal substance, legal culture.

Abstract

Tujuan penelitian menganalisis pelayanan administrasi kependudukan di kecamatan, dan untuk mengetahui factor-faktor penghambat dalam pelayanan administrasi di kabupaten takalar penelitian ini adalah penelitian deskriptif dengan pendekatan yuridis empiris. Hasil penelitian menunjukkan bahwa setiap peristiwa kependudukan dan peristiwa penting lainnya memerlukan bukti yang sah untuk dilakukan pengadministrasian dan pencatatan sesuai dengan ketentuan undang-undang. Faktor-faktor yang menjadi penghambat dalam pelayanan administrasi sarana dan prasarana, kurangnya kesadaran masyarakat, arsip, dan terjadinya kekosongan jabatan pada seksi. Rekomendasikan Dari Penelitian Ini Adalah Dengan Melengkapi Sarana Dan Prasarana Di Kecamatan, Seperti Komputer Di Tiap Seksi Yang Ada, Dan Sesering Mungkin Melakukan Sosialisai Ke Masyarakat Mengenai System Pelayanan Administrasi Yang Ada Di Kecamtan Sanrobone, Dan Sebaiknya Dibuatkan 1 Ruangan Arsip Agar Data Dapat Dengan Mudah Di Temukan, Dan Sesegera Mungkin Mengisi Jabatan Yang Kosong, Agar Pelayanan Dapat Terselesaikan Dengan Tepat Waktu. The research objective to analyze population administration services in the sub-district, and to find out the inhibiting factors in administrative services in the Takalar district. This research is a descriptive study with an empirical juridical approach. The results of the study indicate that every population event and other important events require valid evidence for administration and recording in accordance with the provisions of the law. Factors that become obstacles in the administration of facilities and infrastructure services, lack of public awareness, archives, and the occurrence of vacancies in the section. Recommendations from this research are to complete the facilities and infrastructure in the sub-district, such as computers in each existing section, and as often as possible to conduct outreach to the community regarding the administrative service system in the Sanrobone sub-district, and it is advisable to make 1 archive room so that data can be easily retrieved. Find, and as soon as possible fill the vacant positions, so that services can be completed on time.

Abstract

Tujuan penelitian menganalisis efektivitas penyidikan dalam tindak pidana penipuan melalui media sosial di kepolisian daerah sulawesi selatan dan faktor-faktor yang mempengaruhi. Penelitian ini menggunakan data primer dan data sekunder, data primer diperoleh dari wawancara maupun melalui pertanyaan tanya jawab yang dibuat menjadi kuesioner atau angket sedangkan data sekunder diperoleh melalui dokumen-dokumen, jurnal-jurnal ilmiah maupun artikel ilmiah. Hasil penelitian ini menunjukkan bahwa: (1) efektivitas penyedikian terhadap tindak pidana penipuan melalui media sosial di kepolisian daerah Sulawesi selatan kurang efektif, Dengan demikian kurang efektifnya penyidikan tersebut mengakibatkan adanya tunggakan perkara setiap tahun.(2)faktor-faktor yang mempengaruhi efektivitas penyidikan terhadap tindak pidana penipuan melalui media sosial yang dilaporkan di kepolisian daerah Sulawesi selatan adalah faktor substansi hukum, faktor aparat penegak hukum, faktor kesadaran hukum masyarakat. The purpose of the study was to analyze the effectiveness of investigations in criminal acts of fraud through social media in the South Sulawesi regional police and the factors that influence it. This study uses primary data and secondary data, primary data obtained from interviews and through question and answer questions that were made into a questionnaire or questionnaire, while secondary data was obtained through documents, scientific journals and scientific articles. The results of this study indicate that: (1) the effectiveness of investigations against criminal acts of fraud through social media in the South Sulawesi regional police is less effective, thus the ineffectiveness of the investigation results in the existence of arrears in cases every year. (2) factors that affect the effectiveness of investigations against criminal acts of fraud through social media reported in the South Sulawesi regional police are factors of legal substance, factors of law enforcement officers, factors of public legal awareness.

Abstract

This study aims to analyze the effectiveness of safeguard of the Police Intelligence against court decisions regarding the object of the dispute in South Sulawesi Province. This research uses an empirical study method which is also called sociological legal research because it sees the application of law as a factual condition in the social environment and its relationship with legal norms. This research was conducted in South Sulawesi Province, with 92 respondents. Data analysis in this study uses a qualitative approach, which processes the output of the questionnaire, and is presented in the form of frequency tabulation (F) and percentage distribution (%). The results of this study show that the safeguard of South Sulawesi Regional Police Ditintelkam in the execution process regarding the object of the dispute in South Sulawesi Province based on Perkap BIN No. 2 of 2013, can be assessed from four aspects, as follows: Safeguarding Targets; Safeguarding Implementation; Coordination and Administration; and Supervision and Controlling. Data acquisition of all indicators based on safeguard aspects of the South Sulawesi Regional Police Ditintelkam still shows less effective results. Seriousness is needed in increasing the safeguard effectiveness at the South Sulawesi Regional Police Ditintelkam to ensure the process of executing court decisions regarding the object of the dispute can be more effective in the future.

Abstract

Coalitions of political parties built within the presidential system, especially in Indonesia, are non-binding and permanent. If government policies or programs are not famous or inline, political parties tend to engage in opposition. This study aims to determine the implementation of the presidential system with a multiparty system and efforts to realize a stable and dynamic government based on the Indonesian constitutional system. This research uses a normative approach. Types and sources of legal materials consist of primary legal materials, secondary legal materials, and tertiary legal materials. The analysis technique used in this research is the hermeneutic analysis method. The study results concluded that with the implementation of the presidential system with a multiparty system, it is rare for a President to be elected and from the majority party. Furthermore, with the election of a minority President and a majority in Parliament, the President will strengthen his position by forming a coalition. However, building a stable coalition is difficult in a multiparty presidential democracy. In this regard, the institutional engineering agenda that needs to be designed includes simplifying the number of factions in Parliament by tightening the threshold requirements for fraction formation; parliamentary coalition regulations aimed at both political blocs (coalition and opposition); strengthening the institution and authority of the Regional Representative Council to balance the House of Representatives so that checks and balances not only occur between the President and the House of Representatives but also between the House of Representatives and the Regional Representative Council.

Tujuan penelitian menganalisis efektivitas penuntutan anak yang melakukan tindak pidana oleh jaksa penuntut umum di Kejaksaan Negeri Ternate. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian penulis mendapatkan bahwa: 1). Efektivitas penuntutan anak yang melakukan tindak pidana oleh Jaksa Penuntut Umum di Kejaksaan Negeri Ternate kurang berjalan secara efektif, dikarenakan pada proses penuntutan kepada anak yang berkonfil dengan hukum masih ditemukan beberapa masalah baik dari profesionalsime yaitu; kurangnya Jaksa Penuntut Umum yang memiliki pengalaman dalam menangani perkara anak, sehingga Jaksa Penuntut Umum kesulitan dalam mempertimbangan hak anak sebagai pelaku tindak pidana, serta atas tindakan dari anak yang berkonflik dengan hukum diancam dengan hukuman yang melebihi dari persyaratan upaya diversi. 2). Faktor yang mempengaruhi efektivitas penuntutan anak yang melakukan tindak pidana oleh jaksa penuntut umum di Kejaksaan Negeri Ternate, yaitu; substansi, struktur, dan budaya hukum. Ketiga faktor tersebut saling berhubungan terhadap penuntutan anak yang melakukan tindak pidana. The research objective is to analyze the effectiveness of prosecuting children who commit crimes by public prosecutors at the Ternate District Attorney. This type of research is juridical empirical. In the results of the study, the authors found that: 1). The effectiveness of prosecuting children who commit criminal acts by the Public Prosecutor at the Ternate District Attorney is not running effectively, because in the process of prosecuting children who are in conflict with the law there are still several problems, both from professionalism, namely; the lack of public prosecutors who have experience in handling children's cases, so that public prosecutors find it difficult to consider the rights of children as perpetrators of criminal acts, and the actions of children in conflict with the law are threatened with punishments that exceed the requirements for diversion. 2). Factors that affect the effectiveness of prosecuting children who commit crimes by public prosecutors at the Ternate District Attorney, namely; substance, structure, and legal culture. These three factors are interconnected with the prosecution of children who commit crimes.

Abstract

Tujuan penelitian menganalisis urgensi Pembentukan Peraturan Daerah dalam Penyelenggaraan Pemerintahan Daerah di Kota Makassar. Penelitian ini bersifat orisinil, menggunakan data primer yaitu pengumpulan data yang diperoleh secara langsung dari sumbernya dilapangan yang merupakan data mentah (raw data) melalui wawancara atau interview yang berkaitan dengan masalah yang dibahas, dan metode penelitian menggunakan data primer maupun data sekunder yakni data yang berhasil dikumpulkan dalam penelitian ini. Hasil penelitian menunjukkan bahwa, Urgensi pembentukan peraturan daerah dalam penyelenggaraan pemerintahan daerah adalah merupakan wujud kewenangan yang diberikan kepada pemerintahan daerah dalam rangka penyelenggaraan otonomi daerah dan tugas pembantuan, serta menampung kondisi khusus daerah atau penjabaran lebih lanjut peraturan perundang-undangan yang lebih tinggi. Faktor-faktor yang mempengaruhi pembentukan peraturan daerah dalam penyelenggaraan pemerintahan daerah di Kota Makassar yakni, faktor tanggung jawab Pemerintah Daerah dan DPRD, faktor Sumber Daya Manusia, faktor budaya hukum, dan faktor peran serta masyarakat. The research objective is to analyze the urgency of the establishment of regional regulations in the implementation of regional government in Makassar City. This research is original in nature, using primary data, namely the collection of data obtained directly from the source in the field which is raw data through interviews or interviews related to the problems discussed, and research methods using primary and secondary data, namely data that are successful. collected in this study. The results of the study indicate that the urgency of the formation of regional regulations in the administration of regional government is a form of authority given to regional governments in the context of implementing regional autonomy and assistance tasks, as well as accommodating regional special conditions or further elaboration of higher laws and regulations. The factors that influence the formation of regional regulations in the administration of regional government in Makassar City are the responsibility of the Regional Government and DPRD, the Human Resources factor, the legal culture factor, and the community participation factor.
