Abstract

This article discusses the development of the principle of dominus litis as a foundation for ethics and professionalism in prosecution at the Prosecutor's Office. The principle of dominus litis, which positions prosecutors as controllers of cases, plays an important role in Indonesia's criminal justice system. This research employs a normative legal approach by analyzing existing regulations and prosecutorial practices carried out by the Prosecutor's Office. The findings indicate that strengthening prosecutors' authority within the context of dominus litis not only enhances the effectiveness of law enforcement but also contributes to the formation of ethics and professionalism in prosecution. Thus, the principle of dominus litis becomes a crucial foundation for realizing justice that is oriented towards public interests and fulfilling human rights

Abstract

Indonesia telah mengesahkan Kitab Undang-Undang Hukum Pidana (KUHP) yang baru dalam Undang-Undang Nomor 1 Tahun 2023. Perubahan kebijakan hukum pidana itu menimbulkan perdebatan, khususnya terkait kedudukan pidana mati yang kini diatur sebagai hukuman alternatif. Penelitian ini bertujuan untuk menganalisis kebijakan tersebut dengan menggunakan pendekatan teori sibernetika dari Talcott Parsons. Teori ini memandang masyarakat sebagai sistem sosial yang saling terkait dan bertumpu pada fungsi adaptasi, pencapaian tujuan, integrasi, dan pemeliharaan pola. Penelitian menggunakan metode yuridis normatif dengan pendekatan konseptual dan perundang-undangan. Hasil kajian menunjukkan bahwa pengaturan pidana mati sebagai hukuman alternatif mencerminkan upaya adaptasi sistem hukum terhadap nilai-nilai hak asasi manusia dan perkembangan sosial global. Selain itu juga menjaga stabilitas sosial melalui simbolik hukuman yang tegas terhadap kejahatan berat. Kebijakan ini dinilai sebagai bentuk respon sistem hukum terhadap dinamika masyarakat, dengan fungsi integratif yang tetap memperhatikan struktur norma dan moral kolektif. Kesimpulannya, KUHP baru berusaha menyeimbangkan antara kebutuhan penegakan hukum yang efektif dan perlindungan hak hidup sebagai prinsip universal.

Abstract

Worthy children and women's Village/Sub-district is a village/sub-district development that brings together the commitment and resources of village/village government that involve the community and business world in the sub-district in order to promote, protect, Fulfilling and respecting the rights of children and women, which are planned consciously and sustainably. Some laws have been established to support the protection of children and women such as the Act of the Republic of Indonesia number 35 year 2014 about the amendment to law Number 23 year 2002 about protection Children and Law Number 23 year 2004 concerning the elimination of violence in households. In order to realize the child and women's friendly villages, there are several efforts that can be done as the socialization of legal protection and community empowerment. Socialization programs not only provide information or knowledge but also supported by the empowerment of community that provides training and experience in the community. So that socialization tends to only provide information to be easier to understand by the community through the Community Empowerment program and increase public awareness to continue to actively participate in the realization of child and women's friendly villages.

Abstract

Public legal awareness is an important foundation in creating a fair and effective legal system. The low level of legal understanding is the main trigger for public non-compliance with the law. Therefore, legal literacy is a strategic key in shaping legal awareness. The novelty of this article discusses the urgency of legal literacy and compliance in realizing a law-aware society and highlights the role of JDIH UNNES as an important tool in disseminating legal information. The method used in this study is normative juridical. The results of this study show that legal literacy not only includes the ability to understand the content of the law, but also encourages proactive legal attitudes and behavior. JDIH UNNES has proven to play a strategic role in providing legal information that is easily accessible, accurate, and relevant so as to support information disclosure and public participation in law enforcement and encourage the development of a legal culture in Indonesia. Thus, strengthening legal literacy through means such as JDIH has practical implications in shaping a society that understands, obeys, and is aware of the law in a sustainable manner.

Abstract

The imposition of criminal penalties must be based on careful legal consideration and in accordance with the principle of Negatief Wettelijk, which is enshrined in the Indonesian Criminal Procedure Code (KUHAP). This principle requires that judges may only impose criminal penalties if there are at least two valid pieces of evidence that can fully explain the occurrence of the criminal act and the involvement of the defendant. In the case of the murder of Wayan Mirna Salihin, Jesica Kumala Wongso was designated as a suspect and sentenced by the prosecutor and judge. However, this designation sparked controversy because it did not meet the requirement of two valid pieces of evidence as stipulated in the Criminal Procedure Code. The decision against Jesica was deemed not to be based on complete and objective evidence, and therefore could be considered legally flawed when viewed from the principle of Negatief Wettelijk. Therefore, it is important for the criminal justice system to uphold the principles of legality and caution when rendering decisions.

Abstract

Introduction: Indonesia's juvenile justice system faces significant challenges in implementing diversion mechanisms that marginalize victim existence. The assault case involving seven motorcycle-riding juveniles in Tasikmalaya demonstrates substantial gaps between normative guarantees and restorative justice practices that predominantly focus on offenders rather than victims' needs and participation.Purposes of the Research: This study examines victim existence in diversion efforts within Indonesia's juvenile criminal justice system and analyzes factors influencing restorative justice implementation. The research aims to identify structural barriers preventing meaningful victim participation in juvenile diversion processes.Methods of the Research: The research employs qualitative juridical-empirical methodology through semi-structured interviews with prosecutors and legal document analysis. This approach enables comprehensive examination of diversion practices in concrete cases, revealing implementation gaps in restorative justice frameworks.Results Main Findings of the Research: Findings reveal that diversion processes remain dominated by offender-oriented approaches, systematically marginalizing victim participation and recovery needs. Despite Article 6 of Law Number 31/2014 guaranteeing psychosocial rehabilitation for victims, adult victims receive inadequate support compared to child victims. The Tasikmalaya case, involving collective revenge motives, resulted in Rp75 million compensation from Rp120 million total medical costs. Inhibiting factors include structural-institutional limitations, socio-cultural resistance, and psychological-participatory challenges. Achieving meaningful victim existence requires structural reforms integrating victimological approaches, prioritizing measurable recovery mechanisms, and strengthening institutional capacity for substantive victim participation while maintaining child welfare principles.

Abstract

Bullying in Indonesia is increasingly on the rise, especially among children and teenagers, and most of it occurs in school environments. Bullying that occurs to a student will affect their psychological and social development and raise concerns about their health in the future. The problem faced by the students of SMA Islam Al-Azhar 30 Salatiga is the prevalence of bullying experienced by students, perpetrated by their own peers, both individually and in groups. This is due to the students' lack of knowledge, which stems from insufficient attention and education about bullying provided by parents and the school. The service team help solve the Partner's problem by creating a bullying box as a place for students to report bullying behavior they have experienced, witnessed, or heard, and by forming a bullying prevention and resolution team or violence prevention team. The purpose of this activity is to help prevent and resolve bullying among students at SMA Islam Al-Azhar 30 Salatiga.

Abstract

This study examines the implementation of labor regulations aligned with the Sustainable Development Goals (SDGs) within the context of human resource (HR) management at Universitas Negeri Semarang (UNNES), a leading institution in Indonesia’s higher education sector. As universities are expected to model sustainable and equitable employment practices, this research explores how labor laws—particularly those concerning decent work, gender equality, and inclusive employment—are applied in institutional HR policies and practices. Employing a normative juridical approach supported by empirical data, the study analyzes the legal frameworks governing labor rights in Indonesia and their integration into HR procedures at UNNES. The findings reveal a partial but growing compliance with SDGs-based labor principles, highlighting areas where legal advocacy and institutional commitment are still needed to ensure fair labor standards. The study further discusses the role of legal services and advocacy in advancing labor justice and institutional accountability within higher education settings. By focusing on the intersection of labor law, sustainability, and human resource management, this paper contributes to the broader discourse on legal reform and advocacy for sustainable work environments in Indonesian universities.

Abstract

The formulation of the National Criminal Code through Law Number 1 of 2023 highlights the importance of reforming sentencing theory to anticipate legal and social developments in Indonesia. This study adopts a normative qualitative approach, taking into account the evolution of sentencing paradigms. The findings reveal that the sentencing theory in the new Criminal Code has shifted from a retributive model to an integrative model. It combines restorative justice, absolute, and relative theories. Sentencing today is not solely aimed at punishment, but also at restoring social relations and protecting human rights. The introduction of more diverse types of punishment, the recognition of corporations as legal subjects, and the establishment of sentencing standards as judicial guidelines reflect this reform. In conclusion, a more humanistic and responsive national criminal law policy depends on the development of sentencing theory.

Abstract

This article explores the concept of justifying grounds (alasan pembenar) in the context of victims who commit criminal acts, analyzed through the lens of criminal liability theory. Under Indonesian criminal law, criminal liability requires the existence of an unlawful act; however, certain conditions may negate the unlawful nature of such acts, one of which includes justifying grounds. The focus of this article is to examine situations in which victims engage in criminal behavior as a response to threats or assaults they have experienced, such as in cases of self defense or coercion. The research employs a normative legal approach by analyzing statutory regulations and legal doctrines. The findings indicate that the application of justifying grounds can exempt victims from criminal liability if their actions meet specific criteria outlined in the Indonesian Penal Code (KUHP), particularly Articles 48 and 49. The article underscores the importance of a contextual approach in the application of criminal law and highlights the need for caution among law enforcement authorities when evaluating cases in which victims become perpetrators, in order to uphold justice and ensure balanced legal protection.
