Abstract

The purpose of writing is to analyze the legal protection of the tenants of the building that stands on the land to be executed. This research uses normative legal research. Legal Effects The principle of horizontal separation of land is a principle that divides, limits, and separates ownership of a plot of land and everything related to the land horizontally, which means that the principle of horizontal separation has legal consequences in terms of building ownership. building owner. Legal Protection for Tenants of Buildings Standing on Land To be Executed, namely if someone builds a building on vacant land on the basis of a lease agreement with a certain period of time made between the owner of land rights and the owner of the building, then based on the principle of horizontal separation of land and buildings, the difference is ownership rights. In relation to rent, it’s an agreement with one party to bind himself to provide enjoyment of an item to another party for a certain period of time, with the payment of a price agreed by that party. One of the obligations of the owner of land rights is to give the building owner the right to enjoy the leased goods during the lease period. After the lease runs, the leased land is used as collateral for mortgage rights by the owner of the land rights. those on it get legal certainty and no party is harmed, the owner of the building and the owner of land rights. juan penulisan yaitu untuk menganalisa tentang perlindungan hukum terhadap penyewa bangunan yang berdiri diatas tanah yang hendak di eksekusi. Penelitian ini menggunakan penelitian hukum normatif. Akibat Hukum Asas Pemisahan Tanah Horizontal merupakan asas yang membagi, membatasi, dan memisahkan pemilikan atas sebidang tanah berikut segala sesuatu yang berkenaan dengan tanah tersebut secara horizontal yang artinya asas pemisahan horizontal memiliki akibat hukum segi kepemilikan bangunan adalah bahwa asas pemisahan horizontal memisahkan antara pemilik tanah dengan pemilik bangunan. Perlindungan Hukum Terhadap Penyewa Bangunan Yang Berdiri Diatas Tanah Yang Hendak Di Eksekusi yaitu apabila seseorang mendirikan bangunan di atas tanah kosong atas dasar perjanjian sewa dengan jangka waktu tertentu yang dibuat antara pemilik hak atas tanah dengan pemilik bangunan maka berdasarkan asas pemisahan horizontal tanah dan bangunan tersebut berbeda hak kepemilikannya. Terkait dengan sewa, merupakan suatu persetujuan dengan pihak yang satu mengikatkan diri untuk memberikan kenikmatan suatu barang kepada pihak yang lain selama waktu tertentu, dengan pembayaran suatu harga yang disanggupi oleh pihak tersebut. Adapun salah satu kewajiban dari pemilik hak atas tanah adalah memberikan hak kepada pemilik bangunan untuk menikmati barang yang disewakan itu dengan tentram selama masa sewa. Setelah berjalannya sewa, tanah yang disewakan tersebut dijadikan jaminan hak tanggungan oleh pemilik hak atas tanah. yang ada diatasnya mendapatkan kepastian hukum dan tidak ada pihak yang dirugikan baik pemilik atas bangunan dan pemilik hak atas tanah.

Abstract

This study aims to explore legal views on the implementation of wages below the minimum wage for Micro, Small Enterprises (MSEs) in Indonesia. The research method applied is a literature study that includes an analysis of Law Number 6 of 2023 on the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation into Law, Government Regulation Number 36 of 2021 on Wages, as well as related case studies in the field. The results show that wage arrangements for MSEs aim to protect workers' welfare and improve decent living standards. Nevertheless, its implementation faces various challenges, especially in terms of law enforcement against employers who do not comply with the stipulated minimum wage provisions. This shows that there is an expansion of the reach of legal protection for workers/laborers in the MSEs sector.

Abstract

The aim of this study is to examine the extent of authority that can be exercised by a notary in reporting suspicious financial transactions and what the notary's responsibilities are in implementing the principle of recognizing users of his services in accordance with the provisions of the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 9 of 2017 concerning the Application of Principles. Recognizing Service Users for Notaries. This study uses normative legal research methods with a legislative approach and analysis of legal concepts. Abstract

This study aims to discuss the law and investment business between China-Indonesian companies and the European Union lawsuit. China companies that build nickel refining and processing plants or smelters in Indonesia with large investment values, the Indonesian government obtains significant profits from exports through domestic processed nickel exports. The research method used in this study is the normative legal research method. The results of the study indicate that the benefits between Indonesia and China include China investment in Indonesia, job creation in Indonesia, and increased export results, which have an impact on concerns in the European Union, especially since Indonesia recently banned the export of nickel ore. On the contrary, Indonesia has encouraged domestic nickel ore processing to add value to nickel products. Indonesia as one of the largest nickel producers in the world has regulations regarding nickel exports. This is stated in the Regulation of the Minister of Energy and Mineral Resources Number 11 of 2019 concerning the Second Amendment to the Regulation of the Minister of Energy and Mineral Resources Number 25 of 2018 concerning Mineral and Coal Mining Business Activities. In the regulation, Indonesia imposed a ban on nickel ore exports. Regarding this ban, the European Union reacted by filing a lawsuit with the World Trade Organization (WTO). Based on the State sovereignty & Theory of Welfare State, the state must actively strive for welfare, and act fairly that can be felt by all people evenly and in balance. Therefore, the implementation of a ban or restriction on nickel ore exports is a way for the Indonesian government to improve people’s welfare. The narrative of national sovereignty and welfare state can be used as an argument in front of the WTO international forum but accompanied by a strong legal basis argument by using Article XIX of GATT 1994 regarding the exception in economic circumstances, a safeguard measure against domestic industry when there is a surge in imports that causes or threatens to cause serious losses.

Abstract

The COVID-19 pandemic had a significant impact on various countries, including Indonesia, in particular on the securing of the state budget and state financial stability in anticipation of the systemic and comprehensive impact of the pandemic. This deviation is not in line with the Indonesian constitution, welfare state principles, and even regulations based on the principles of good legislation. This article will examine three aspects of the problem: firstly, the formation of Government Regulation Number 1 of 2020 (Perppu) concerning State Financial Policy and Stability under COVID-19 countermeasures by the formation mechanism; secondly, the constitutionality issue in the drafting of Perppu; and thirdly, the legal issue of Article 27 on the immunity of officials who carry out financial policies. This paper employs a combination of normative legal research methods, including a statutory approach, a legal conceptual approach, a legal fact approach, and a relevant case law approach. The result of the research is  that Perppu is a policy in an emergency period that contains a policy of relaxation of the implementation of the APBN is constitutional. The form of deviation that appears from Perppu is that this Perppu implements financial relaxation or sets state financial policies without involving the DPR. This has been constitutionally confirmed by Article 12 of the 1945 Constitution that the government and the DPR must determine state financial policies together. Although the constitutionality of Perppu in terms of fiscal policy is not in question, the provisions of Article 27 of Perppu that are unconstitutional can be cancelled by the Constitutional Court. The legality of Perppu relating to immunity must be implemented by prioritising the principle of good faith in carrying out the duties and functions of each state financial stakeholder during the emergency period.

Abstract

This article aims to examine the legal regulations regarding the responsibilities of directors as liquidators in the dissolution of limited liability companies. This journal article employs a normative legal research method that utilizes legislative and conceptual approaches by reviewing the Limited Liability Company Law. The regulations for the dissolution of limited liability companies are outlined in the Company Law Article. The dissolution of a company must be followed by liquidation carried out by a liquidator. In terms of appointing a liquidator, the Company Law only provides for the appointment of a liquidator similar to the general appointment of directors. This provision of the Company Law does not necessarily provide legal certainty for creditors or interested parties. Based on this, the issues can be raised regarding how the legal certainty of the regulation of Directors as Liquidators in the dissolution of Limited Liability Companies is established, as well as what the Responsibilities of Directors as Liquidators are in the presence of conflicts of interest within Limited Liability Companies.

Abstract

This paper aimed to find out more deeply and understand the validity of debt and receivable agreements made by debtors and creditors with collateral for joint assets and to be able to find out and analyze the ratio of decisions of the Panel of Judges in handing down decisions. The method used is the normative research method, which uses several types of approaches, namely the case approach and the statute approach, the context of which is carried out by examining laws relating to legal issues. The results obtained from this research are that the debt and receivable agreement made by the parties in case Number 202/Pdt.G/2023/PN.Gin is not in accordance with the provisions of Article 36 paragraph (1) of Law No. 1 of 1974 concerning Marriage and ratio decidendi The Panel of Judges in this decision did not contain a legal basis explaining that the debt and receivable agreement made by the parties was legally valid.

Abstract

Justice, non-discrimination, equality before the law are important values of the constitution. This study seeks to examine the constitutional rights of the younger generation that were cut by the framers of the law through the age requirement in the electoral law for presidential and vice presidential candidates. The research method used is a normative legal research method with qualitative methods. The age requirement no longer needs to be regulated in the Election Law because it is not in line and is not expressly regulated by the 1945 Constitution. If it is still regulated, the age requirement used must be 18 years, in accordance with the adult size applicable in Indonesia, as a consequence providing opportunities for the younger generation to participate in politics and government, and realize a more inclusive democracy. Factors influencing the setting of age requirements for presidential and vice presidential candidates are the history of national leadership, maintaining the status quo, and senior-junior practices. Therefore, Article 169 letter Q of the Election Law must be revised/deleted.

Abstract

This article analyzes the impact of changes to spatial planning arrangements after the promulgation of the Job Creation Act Number 6 Year 2023. This article aims to find out whether the enactment of the Job Creation Act properly accommodates the need for spatial planning arrangements. This article uses a type of juridical-normative legal research with secondary research data in the form of primary legal materials and secondary legal materials. The results of the study found that changes to spatial planning arrangements in the Job Creation Act had the following impacts: the implementation of spatial use can be carried out without a spatial plan for the implementation of strategic national policies, there is a reduction in the authority of the regional government in carrying out spatial planning so that some tasks are carried out by the central government, and there is a reduction in the function of community control, especially regarding the cancellation of environmental permits through the courts. ___ Referensi Buku dengan penulis: Kodoatie, Robert J., & Sjarief, Roestam. Abstract

Implikasi perubahan Undang-undang Dasar Tahun 1945 menciptakan perubahan yang mendasar terkait dengan lembaga kepresidenan, yakni terjadinya pergeseran konsep kekuasaan eksekutif dari executive heavy menjadi legislative heavy. Lembaga kepresidenan diharapkan akan dapat membawa bangsa dan negara ke arah tujuan yang lebih baik dalam kerangka gagasan rancangan undang-undang lembaga kepresidenan di Indonesia pada masa mendatang, demi terselenggaranya pemerintahan menuju visi Negara seperti dirumuskan dalam Pembukaan UUD 1945. Tulisan ini bertujuan untuk menganalisis gagasan rancangan undang-undang lembaga kepresidenan. Adapun tulisan ini dibuat dengan menggunakan metode penulisan normatif dengan pendekatan studi konseptual dan pendekatan undang-undang. Melalui tulisan ini diharapkan dapat kembali menggagas kembali rancangan undang-undang lembaga kepresidenan di Indonesia yang berbasis pada pertama, mewujudkan kepemimpinan yang kuat dan beretika politik. Kedua, penyederhanaan sistem kepartaian. Ketiga, mendorong partisipasi budaya politik, Keempat, membangun parlemen modern dalam mewujudkan pemerintahan yang baik. Kelima, reformasi birokrasi, yang tertuang dalam gagasan rancangan undang-undang lembaga kepresidenan.
