Abstract

The implementation of narcotics client guidance by Community Guidance to prevent criminal acts of narcotics abuse is regulated in the Law of the Republic of Indonesia Number 35 of 2009 concerning Narcotics and Law of the Republic of Indonesia Number 12 of 1995 concerning Correctional Clients Guidance in practice is still a lot of dependence on narcotics. Based on the results of the study, it can be concluded that: First, the role of Bapas Class I Padang Community Supervisor in guiding clients of narcotics abuse has been carried out well, because the guidance provided by Bapas Class I Padang Community Supervisor is in the form of Post-Rehabilitation Program which is a follow-up stage given to narcotics addicts after undergoing rehabilitation which aims to guide the narcotics client to develop attitudes to society and not repeat it again. Secondly, the effectiveness of narcotics clients in preventing narcotics criminal acts at Padang Class I Correctional Facilities in principle can be said to be quite effective because every client who follows the Post-Rehabilitation Program does not have a client who repeats narcotics abuse. Third, Constraints faced in Narcotics Client Guidance at Padang Class I Correctional Institution are limited conditions and functions and lack of Human Resources (HR), as well as clients who have undergone rehabilitation to undergo post-rehabilitation services, many who have not been serious about recovering, because of the lack of family and community support in realizing the recovery of former addicts, and the lack of a place to channel their interests and potential to return to the social environment of the community. In addition, the demands of the client's economic needs become an element of strengthening the absence of clients because they cannot leave their jobs which are mostly from the private sector. Besides that, budget problems are an important factor in post-rehabilitation implementation in order to run optimally.

Abstract

The existence of IPR, especially Geographical Indications and Brands, is the basis of policy making in the world of Trade. Indonesia is a country that is rich in potential Geographical Indication products and then Law No. 20 of 2016 concerning Geographical Indications and brands for National Regulations and in TRIPS as International Arrangements. but there are still violations of cases regarding Geographical Indications and Trademarks and occur in Toraja coffee and Gayo coffee. The formulation of the problem in this research is how is the trademark legal law for Geographical Indications in the case of Toraja coffee and Gayo coffee registered by other countries? How is the legal settlement of the Violation of Brand Geographical Indications carried out by other Countries against Toraja coffee and Gayo coffee?The specification of this study is Descriptive Analysis. The approach is a normative juridical approach using secondary data obtained through library studies. The data is then analyzed qualitatively and presented in a qualitative descriptive form. Based on the results of research and analysis, answers can be obtained: 1) Legal protection against Toraja coffee and Gayo coffee registered by other countries, namely by registering the trademark to the Director General of Intellectual Property Rights and after obtaining a Geographical Indication certificate from the Director General of Intellectual Property Rights, the geographical indication of a product's brand it gets strong protection. 2) Legal settlement of brand violations and geographical indications of the brand of Toraja coffee and Gayo coffee are litigation methods carried out through the Commercial Court institution, for Toraja Coffee to be carried out at the Ujung Pandang Commercial Court and Gayo Coffee at the Medan Commercial Court.

Abstract

Efforts to deal with the occurrence of crimes at Minangkabau International Airport by the Minangkabau International Airport Regional Police is to carry out investigations and investigations. Criminal acts that occur are still general crimes so that the handling is still carried out by the Police as is the handling of criminal acts in general. In the event of a special crime in the Minangkabau International Airport area, special handling will also be carried out. Criminal acts that specifically occur in airport areas such as aviation crime, narcotics crime, customs crime, smuggling and so on. Collaboration with various related institutions is carried out against these special crimes in terms of their handling. Obstacles in the Effort to Handling Criminal Actions at Minangkabau International Airport By the Regional Police of the Minangkabau International Airport Area is to socialize what the community should do in order to avoid criminal acts. Another obstacle is the lack of responsiveness of law enforcement officers to reports provided by victims, so that the process of handling crimes that occur at airports is slow. There are still many visitors who do not understand the environmental safety standards of the Minangkabau international airport.

Abstract

With the increase and spread of the number of cases of Corona Virus Disease 2019 (Covid-19), the impact of increasing the percentage of non-performing loans at PT. Adira Dinamika Multi Finance, Tbk Padang Branch, from the data obtained from bad loans before the Covid-19 Pandemic there were around 500 (five hundred). Restructuring of Motor Vehicle Loans for Financing Companies Due to the Covid-19 Pendemic Situation at PT. Adira Dinamika Multi Finance, Tbk Padang Branch is implemented in the form of rescheduled installment payments and there are consumers (creditors) who have been given restructuring with terms and conditions agreed by both parties, provided that the debtor or customer who submitted it is affected by Covid 19, the collateral or product being credited is still with the debtor, it is not transferred or over credited to another party, the financing value (principal debt) is below Rp10 billion. Preventive supervision of the Financial Services Authority (OJK) in the West Sumatra Region OJK will send a letter of warning to Financing Companies that do not carry out restructuring programs during the current COVID-19 pandemic, and repressively to Financing Companies that do not implement Restructuring programs as per government policy. OJK will impose administrative sanctions in the form of fines to financing companies.

Abstract

The Religious Courts based on Article 49 of the Law on Religious Courts have expanded their authority to settle sharia economic cases. Based on Article 10 of PERMA Number 14 of 2016 concerning Procedures for Settlement of Sharia Economic Disputes, it is emphasized that judges in ordinary examination procedures must seek reconciliation through mediation. In practice, mediation efforts are often unsuccessful, as happened in the Padang Religious Court, of the 4 sharia economic cases that were entered, only one case was successfully mediated. Based on the results of the research, discussion and analysis, it can be concluded: first, mediation efforts in resolving Sharia economic disputes at the Padang Religious Court are mediators using informative, educative and persuasive methods. In the Padang Religious Court, there are internal factors: (1) mediators from judges who do not have certificates, (2) mediation seems only a formality, External factors: (1) litigants who are reluctant to be mediated, (2) The place to hold mediation is not yet conducive so it is not comfortable to negotiate

Abstract

Kejaksaan sebagai salah satu penegak hukum pada dasarnya melaksanakan tugas dibidang penuntutan, melaksanakan penetapan dan putusan pengadilan. Kejaksaan juga mempunyai tugas dan wewenang pada Bidang Perdata/ Tun untuk dapat bertindak atas nama negara pemerintah untuk melaksanakan pemberian bantuan hukum, penegakan hukum, pertimbangan hukum, pelayanan hukum, serta tindakan hukum lainnya kepada pemerintah atau instansi pemerintah, BUMN/BUMD. Berdasarkan penelitian dapat dijelaskan bahwa: Pertama, pelaksanaan pendampingan pada proyek strategis telah dilaksanakan sebanyak 4 (empat) kali sepanjang tahun 2020, 2021, pendampingan hukum dimulai dengan adanya kerja sama bidang hukum (Moi) antara pemerintah Kota Pariaman dengan Kejaksaan Negeri Pariaman yang diikuti dengan kerja sama bidang hukum antara Dinas PUPR, Dinas Kesehatan dan Dinas Perumahan Rakyat, Kawasan Pemukiman dan Lingkungan Hidup Kota Pariaman dengan Kejaksaan Negeri Pariaman. Kedua, kendala-kendala yang dihadapi dalam pelaksanaan pendampingan pada proyek strategis tersebut adalah kendala internal: berupa kurangnya sosialisasi dan pemahaman fungsi tugas dan wewenang Kejaksaan kepada seluruh instansi terkait khususnya dalam bidang pendampingan hukum, kendala eksternal: permohonan pendampingan baru diajukan oleh pemerintah Kota Pariaman pada saat pelaksanaan pembangunan proyek tersebut akan dilaksanakan sehingga tim pendamping tidak dapat secara maksimal mengantisipasi segala potensi, kendala hambatan baik teknis, yuridis maupun administrasif atas proyek yang didampingi, serta rapat secara berkala untuk memberi masukan, saran, pendapat hukum terkait kemajuan / progres proyek hanya dilakukan diawal kegiatan, sehingga berbagai kendala permasalahan yuridis terlambat di antisipasi oleh tim pendamping.

Abstract

Conventional crimes, namely: conventional/national crimes are crimes against life, property and honor that cause both physical and psychological harm, whether committed in ordinary ways or in a new dimension, which occur within the country. The effect of the Covid-19 Pandemic Period on Increasing Conventional Crime in the Legal Area of ​​the West Sumatra Regional Police is the reduction in their moral values ​​and social and economic conditions due to the pandemic. So it is not wrong to say that a person's actions for a reason are interrelated, either directly or indirectly. From a criminological point of view, the increase in crime rates during the pandemic was an action driven by the weakening economy. Criminal cases in West Sumatra that experienced an increase during the Covid-19 Pandemic were cases of Curat, Curas and Curanmor and Begal. Based on sociological theory, the existence of crime during a pandemic occurred due to an imbalance in the structure of society. There are people who are still well off and not a few people who are experiencing difficulties during the Covid-19 pandemic. Conventional Crime Control Efforts During the Covid 19 Pandemic in the Legal Area of ​​the West Sumatra Regional Police are Preemptive Efforts, namely increasing the functions of Bimas (Community Guidance and Counseling), Shabara, as well as precincts related to robbery crimes; The service and service program, namely the KAMTIBMAS (Community Order Security) safari to community leaders and village officials; Community development through Polmas (activating Polmas); and Collaborate with the mass media to convey to the public to always be vigilant against the crime of robbery.

Abstract

Penerapan Pidana Oleh Hakim Terhadap Terdakwa Tindak Pidana Pencabulan Secara Berlanjut Pada Putusan Nomor 55/Pid.Sus/2020/Pn.Pdp dan Nomor 61/Pid.Sus/2020/Pn.Pdp Majelis Hakim menyatakan bahwa unsur-unsur perbuatan terdakwa memenuhi unsur dalam Pasal 82 ayat (1) Undang-Undang RI Nomor 17 Tahun 2016 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2016 tentang Perubahan Kedua atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Hakim menerapkan unsur memberatkan pidana yaitu Pasal 64 Ayat (1) KUHP tersebut dikarenakan para korban pencabulan ini masih di bawah umur serta perbuatan ini telah memenuhi kualifikasi serangkaian perbuatan yang harus dipandang sebagai perbuatan berlanjut. Pertimbangan Hakim Dalam Penerapan Pidana Terhadap Terdakwa Tindak Pidana Pencabulan Secara Berlanjut Pada Putusan Nomor 55/Pid.Sus/2020/Pn.Pdp adalah pertimbangan yuridis perbuatan terdakwa yang unsur-unsurnya yaitu unsur setiap orang dan unsur Dilarang melakukan kekerasan atau ancaman kekerasan, memaksa, melakukan tipu muslihat, melakukan serangkaian kebohongan, atau membujuk anak untuk melakukan atau membiarkan dilakukan perbuatan cabul. Pada putusan Nomor 61/Pid.Sus/ 2020/Pn.Pdp dengan pertimbangan yuridis yang sama namun dikaitkan dengan Pasal 64 Ayat (1) KUHPidana yaitu unsur melakukan beberapa perbuatan yang ada hubungannya sedemikian rupa sehingga harus dipandang sebagai perbuatan berlanjut.

Abstract

Land is the main source of people's prosperity and well-being. In an effort to control and own limited areas of land, sometimes people try to control and own emerging land. There is no definite data on the extent of state land originating from emerging land, so the process of controlling emerging land is outside the state's control. The BAL does not specifically regulate the issue of emerging land, but in a general formulation, that emerging land is under state control. Judicial regulation regarding emerging land, starting with the Minister of State for Agrarian Affairs Decree Number 410-1293 of 1996 concerning Controlling the Status of Rising Land and Reclamation Land and ATR/KBPN Ministerial Regulation No. 17 of 2016 concerning Land Management in Coastal Areas and Small Islands and PP no. 16 of 2004 concerning Land Use Management. Until now there has not been found a law that strictly regulates the existence of land arising. This research is a legal research with descriptive analytical research specifications. Abstract

Pasal 267 Undang-undang Nomor 22 Tahun 2009 telah mengatur tentang Tata Cara Penindakan Pelanggaran Lalu Lintas dan Angkutan Jalan. Ketentuan ini bertujuan untuk meningkatkan kepatuhan pengendara kendaraan bermotor roda dua dalam mematuhi peraturan berlalulintas sehingga terciptanya ketertiban dan kenyamanan di jalan raya. Namun walaupun aturan hukumnya sudah ada, dalam prakteknya masih banyak masyarakat yang melakukan pelanggaran lalu lintas seperti yang terjadi di Kota Bukittinggi. Spesifikasi penelitian ini bersifat deskriptif analitis, yaitu menggambarkan tentang penerapan Jumlah denda kepada pengendara kendaraan bermotor roda dua diwilayah hukum polres Bukittinggi. Sedangkan metode pendekatan yang digunakan adalah yuridis Normatif sebagai pendekatan utama dan yuridis empiris sebagai pendukung pendekatan utama dengan menggunakan data sekunder dan data primer. Teknik pengumpulan data adalah studi lapangan melalui wawancara untuk data primer dan studi kepustakaan untuk memperoleh data sekunder. Data yang diperoleh kemudian dianalisis secara kualitatif dan disajikan secara deskriptif kualitatif
