Abstract

This paper aims to reveal fiqh's review of Intellectual Property Rights (IPR) and their relationship with monopolies that can harm humankind. There are two opinions in contemporary fiqh regarding IPR; first, Ahmad al-Ḥujjī al-Kurdī, which states that IPR as part of worship, should not be hidden and should not be monopolized and exploited by anyone. Second, Muṣṭafā Zarqā, Muḥammad Fatḥī al-Duraynī, Muḥammad Sa'īd Ramaḍān al-Būṭī who agree with the protection of IPR. Through literature study and descriptive analysis approach, this paper concludes that if intellectual property rights cause harm to society and the state, especially in the exploitation of material rights, then it has created a monopoly that is detrimental and prohibited. Every country has different policies to protect IPR when it does not harm the community and the state.

Abstract

This paper aims to describe the worth noting that the Samanids had prominent civil and political roles. During their reign, writing appeared in the Persian language and the Arabic language. The Samanid era witnessed an industrial renaissance manifested in ceramics, paper, carpets, and textiles. From a political point of view, the Samanids defended the eastern border region and extended Islamic influence to the countries of the Turks. They never departed from the subordination of the Abbasid Caliphate in Baghdad. We conducted a literature study to discuss the development of the Samanid dynasty, starting from its power, administration, and distinction in science and the race that developed in this Sunni dynasty. He also endeavoured to bring scholars to the presence of his kingdom and honoured them, benefited and rewarded them. During the years of his rule, which exceeded thirty years, this prince was just, benevolent, and wise. The cities of his state flourished, namely: Nishapur, Merv, Balkh, Bukhara, Samarkand, and others. But after the death of Prince Ismail al-Samani, a conflict erupted between members of the Samanid house in greed for power. Abstract

Writing this article aims to explain the development of Islamic da'wah in the Maldives Islands, which is unique and rarely found in other Muslim regions. So far, the Maldives is only known as a tourist spot. It is rarely known that all of the Maldives adhere to Islam. The British have also ruled the Maldives for 78 years, influencing the Maldives to some extent. What is the form of da'wah carried out by Abu al-Barakat, whose origins are still debated by historians? But what is clear is that he had a significant influence on the spread of Islam in the Maldives Islands, which is corroborated by classical sources such as the text attributed to Ibn Battuta and several contemporary books. We conducted a literature study on this paper, with a historical approach, by collecting data, verifying and analyzing the data thoroughly, and rewriting the results of the analysis inductively in a qualitative descriptive form. Islam spread in the Maldives peacefully without violence and continues to survive from Christian missionaries and Shiite sects who come to spread their views. Scholars say about the fiqh theory that faith in conscience will not be changed by the sins and heresies it commits.

Abstract

Islam is a moderate religion that is very close to the dignity of women which is very different from the two religions of its predecessors. In both religions women are considered as a burden in life and very detrimental, women's rights are morally and materially ignored. Like ownership of property, the right to issue testimony, identity is assigned to the husband not to his father. Even as far back as 1956 and perhaps up to now in France and Germany full of women's freedom must obtain the husband's permission to conduct transactions, such as buying and selling, grants from his own property. With library studies and comparative approaches and qualitative methods the author reveals whether Jews and Christians have similarities in their treatment of women in theory and is there a difference between the two religions? Do Islam, Judaism and Christianity in theory give equal treatment to women? Let a Muslim know that there is a gap between the teachings of Islam and the behavior of some Muslims today that are no longer in accordance with Islamic norms. Abstract

This article examines and explores the phenomenon of Sufism among Western academics and women, as well as the factors that influence it. The background to this study is the increased attention to Sufism after the events of September 11, 2001, in which Sufism was considered an alternative to overcome psychological anxiety in modern life. The aim of this study was to analyze the factors influencing the distribution of Sufism among Western academics and women, as well as to understand the role of women in the spread of Sufism. The research method used is a literature study with a descriptive analysis approach. The main finding of the study is that Sufism is considered a tolerant school and can accommodate a variety of cultures, including in the context of Western culture. The role of women in the spread of Sufism is also very important, where Sufism becomes a means to prevent moral decay and seek spiritual tranquility in the midst of spiritual pressure.

Abstract

Islam is a religion of tolerance wherever it is embraced, and the tolerant spirit will reside in the souls of the followers of this religion. Turkish people who have long embraced Islam along with the conquest carried out by Umar bin Khattab in 641 AD. The Ottoman society is a multi-ethnic and diverse religious community, Orthodox Christians, Catholics, Jews were living in peace. The question is whether religious tolerance practiced by the Ottoman Turks is in line with Islamic teachings. This qualitative discussion was carried out with a literature study. With the pattern of deduction, the author tries to make the arguments of the Qur'an and the Hadith to measure the tolerance policy implemented by the Ottoman. After the existence of a foreign capitulation agreement, the lives of minority groups are more prosperous than the Muslims. Freedom to apply the law following the teachings of each religion, tax breaks. The Jewish migration in 1877 from Kazan, Bukhara, and central Asia had flooded the Anatolian region. Minority groups such as Jews are only barred from entering the country of Hijaz (present-day Saudi Arabia) and are prohibited from establishing a Palestinian state because of a long-standing agreement since the time of the Prophet and Umar bin Khattab with Christian Palestine. Abstract

The problem of socio-economic phenomena always attracts the attention of various layers of society and individuals because the State's economic stability is the backbone of the material prosperity of the people. It will positively impact development in multiple fields. The Covid-19 Pandemic outbreak that occurred paralyzed not only humans but also paralyzed the Indonesian economy. During Al-Maqriz's life there was starvation and Inflation in the government of the Bani Mamluks in Egypt, Inflation during this period became the main attraction of researchers to make Al-Maqrizi's Economic Thought as a cornerstone of this research theory. This study aims to determine the concepts and work of Al-Maqrizi in his contribution to the Islamic Economy with his relationship with the Covid-19 Pandemic in Indonesia by using the literature study research method and field observations. He was armed with adequate experience as a muhtasib (market watchdog). Al-Maqrizi discussed the problem of Inflation and the role of money in it, a fantastic discussion at that time because it correlated two things that were very rarely done by Muslim and Western thinkers. Inflation occurring in Indonesia is still relatively stable even amid the soaring Rupiah exchange rate when compared with Inflation in the same period before the co-19 epidemic broke out in Indonesia. Abstract

This article aims to explain the importance of the steps that Islamic banks must take to stay away from usury to increase Muslim confidence in Islamic banking, which has been stretched all this time to revive the Muslim economy. Riba can cause prolonged inflation and even make the country's economy collapse slowly. However, there are still many usury practices carried out by Islamic banks due to several factors, such as central bank regulations and managers who do not yet understand the rules of Islamic law. This discussion is carried out through a literature study and a descriptive analysis approach through documents and journals that discuss Islamic banking. We interpret the results obtained: Islamic banking is still involved in Mu'amalah Riba, which is more than an extension of conventional banks that sell their products. However, there is still an event to get away from usury by implementing the rules of Islamic Shari'ah thoroughly by developing the proper investment methods. Islamic banks may perform Mudharabah (profit sharing), Musyarakah, Murabahah, Ijarah, and Muzara'ah by paying attention to the distribution of profits and losses by Islamic law. Let these trading and investment instruments be carried out in real terms with full responsibility.

Abstract

This article intends to describe today's feasibility of using the dinar and dirham currencies in the Islamic economic system. The application of Dinar and Dirham is considered more appropriate because they have a fixed value and guarantee stability. The dinar and Dirham currencies are deemed capable of solving currencies, such as coping with massive inflation in the world currency system. Dinar and Dirham can realize the stability of exchange rates and increase international trade progress, especially in Islamic countries throughout history. The author analyzes books from the library with a descriptive analysis approach. In theory, dinars and dirhams stabilize a country's finances if supported by production factors. This will accelerate the turnaround of money and the economy. However, the Dinar and Dirham also do not escape various problems. For example, the large hoarding of gold and silver, the obstacles between a country, the possibility of a monopoly by a government with more gold reserves, and very high production capabilities.

Abstract

Pre-employment Card is a program that provides training cost assistance to Indonesian people who want to improve or have new skills. However, in the process of the emergence of the phenomenon of jockey services in pre-employment card registration. The purpose of this study is to determine the role of jockey services in pre-employment card registration in Kerinci Regency. This type of research is qualitative with a case study research approach. Primary data sources were obtained through interviews and observation methods. Based on the results of the study, the role of jockey services in pre-employment card registration in Kerinci Regency generally does not violate the principles of Islamic economics. This general thing can be seen where in principle justice, fairness, transparency, and integrity and desires have been fulfilled and the distribution of pre-employment card funds and wages does not contain elements of maisir, gharar and usury.
