Abstract

Penelitian ini membahas mengenai dinamika penyelesaian perkara poligamipengadilan agama Parepare, dengan sub masalah:1) Bagaimana proses permohonan Izin perkawinan poligami. 2) Bagaimana Pertimbangan Hakim dalam Permohonan perkara Izin Poligami. 3) Bagaimana tinjauan hukum Islam terhadap pertimbangan hukum hakim dalam mengabulkan permohonan Izin poligami di Pengadilan Agama Parepare?. Dengan Tujuan untuk mengidentifikasi proses permohonan izin perkawinan poligami , untuk menganalisis pertimbangan hakim dalam permohonan perkara izin poligami serta untuk menganalisis tinjauan hukum Islam terhadap pertimbangan hukum hakim dalam mengabulkan permohonan izin poligami di Pengadilan Agama Parepare. Penelitian ini adalah penelitian Lapangan (field research) dengan menggunakan pendekatan metode normatif-empiris. Penelitian dilakukan di Pengadilan Agama Parepare dengan pengumpulan data melalui wawancara dan studi kepustakaan dengan penelusuran terdahadap literatur, buku, dan Perundang-undangan. Hasil penelitian ini menunjukkan: 1) Proses permohonan izin perkawinan poligami di Pengadilan Agama Parepare umumnya melibatkan langkah-langkah sebagai berikut: a) Pengajuan Permohonan, b) Pemeriksaan Dokumen dan Bukti, c) Pemeriksaan Sidang, d) Pertimbangan Majelis Hakim dan e) Putusan. 2) Pertimbangan Hakim dalam permohonan perkara Izin poligami di Pengadilan Agama Parepare adalah Hakim di Pengadilan Agama Parepare melakukan penilaian cermat dan berimbang dalam memutuskan permohonan izin poligami, mempertimbangkan penerapan hukum yang tepat, keadilan bagi semua pihak yang terlibat, serta mematuhi prosedur hukum yang berlaku. 3) Tinjauan Hukum Islam terhadap pertimbangan hakim adalah bahwa keputusan untuk mengabulkan permohonan Izin poligami telah didasarkan pada prinsip-prinsip hukum Islam yang mengatur poligami sebagai upaya untuk menjaga keadilan dan kemaslahatan umum, serta menghindari mudharat yang lebih besar bagi semua pihak yang terlibat. Abstract

This research focuses on the discussion of misyār marriage as one of the contemporary phenomena that did not exist in the time of the Prophet Muhammad SAW by using a type of literature research with a qualitative approach and analyzing existing data inductively. The results of the study show that misyār marriage was triggered by its emergence due to the massive development of the times. One of the indicators is the emergence of women who no longer live at home and work, so that they are economically independent. In addition, the varied work of men keeps them away from their wives which then causes problems. By analyzing the opinions of several scholars who have detailed the marriage of misyār, such as Yusuf Qardhawi and Abdullah Muhammad Aṭ-Ṭayyar, it can be concluded that this opinion cannot be separated from the concept of legal change of Ibn Qayyim which is also influenced by the changing times. This study proposes to deepen the understanding of the concept of nikah misyār to answer the development of the times and its relevance to Islamic teachings, namely ṣaliḥ likulli az-zamān wa al-makān. In addition, this study also offers constructive approaches in assessing the validity of misyār marriage. This research is expected to enrich the discourse around marriage in Islam and become a medium for the wider community to know this phenomenon.

Abstract

This research discusses career women and fulfilling their family's livelihood in the Bugis community in Ganra District, Soppeng Regency through social fiqhi analysis. This is based on the dynamics of life development, namely the involvement of women in the world of work with the nickname of career women to participate in providing for the family. The main problems are: 1) What are the factors that encourage women in Bugis community families in Ganra District to become career women? 2) What is the social fiqhi analysis of career women in fulfilling their family's livelihood in the Bugis community in Ganra District?. The author conducted research using a descriptive qualitative method approach; the data sources in this research are housewives who work as honorary workers, ulama, the Head of Ganra District, and the community in Ganra District (primary data) and documents on the condition of the population in Ganra District (secondary data); The research instrument is the researcher himself and is assisted through data collection tools, namely observation sheets, interview guides, digital cameras and tape recorders; data collection techniques are observation, interviews, and documentation; and testing the validity of research data, namely credibility, transferability, dependability, and confirmability. The main problem solving process in this research uses grand theory, namely the theory of social jurisprudence and the theory of the role of women. The results of this research show that 1) The involvement of women from Bugis community families in Ganra District in the world of work is influenced by various factors, namely: economic factors, lack of husband's income to meet all household needs. Educational factor, a form of women's self-actualization regarding the education they have received. Technological developments, availability of jobs that suit your skills. Financial independence, reducing dependence on husband. 2) In Bugis families, women who are married and want to work outside the home must first obtain permission from their husbands. This is in line with the principles of social fiqhi, namely legal contextualization, maslahah, dynamic/adaptive, social role in law, and social justice which shows that men and women have the same opportunities to improve their abilities in the world of work. Women who have received permission to work outside the home are obliged to maintain a balance between their rights and obligations as housewives and career women. However, in the position of fulfilling family support, the obligation is the man's duty as a husband. Meanwhile, women's work is seen as a form of financial support for themselves and their families.

Abstract

Marriage in Islam, regulated by law and sharia principles, emphasizes the importance of the consent of the bride and groom. However, in Watang Pulu District, Sidenreng Rappang Regency, forced marriages, still occur as a result of the implementation of the right of ijbar. In the Shafi'i School, although the guardian has the right to marry his child, the marriage must be carried out based on consent, not coercion. This study uses a qualitative descriptive method to analyze the practice of forced marriage and its impact on children's mental and physical health. Observations and interviews reveal that forced marriages often end in divorce and unhappiness, ignore individual rights, and cause severe emotional distress to victims. This shows the need for law enforcement and a better understanding of rights in marriage to prevent this practice in society

Abstract

This research aims to evaluate the responsibility of Sidenreng Rappang Class IB Religious Court in reducing the number of marriage dispensations. The study employs a qualitative approach with a case study method, involving in-depth interviews with judges, court officials, as well as families and couples applying for marriage dispensation. The findings of the study are as follows: 1) From 2019 to 2023, there has been a significant shift in the number of marriage dispensation applications at Sidenreng Rappang Class IB Religious Court. This shift indicates a change in societal perspectives on marriage values and the challenges they face in meeting marriage requirements. 2) Factors such as changes in family structure, increased social mobility, and the evolution of religious and cultural norms may contribute to this trend. Additionally, difficulties in meeting marriage requirements can drive individuals to seek dispensation. 3) The responsibility of Sidenreng Rappang Class IB Religious Court is also critical in preventing child marriages. The court's role includes tightening the examination of administrative requirements, providing explanations, exploring the genuine intentions of the child, and considering the true benefits and harms of child marriage

Abstract

This research discusses women's rights after divorce by comparing Islamic family law in Indonesia and Egypt. The main focus of this research is to answer three questions: 1) how are women's rights post-divorce regulated in Indonesia, 2) how are the same arrangements in Egypt, and 3) comparative analysis between the two countries. The research uses a library method (research library) with a normative juridical approach and data collection techniques through document study. The research results show that in Indonesia, Islamic family law aims to protect women's rights through iddah, mut'ah and madhiyah livelihoods. However, enforcing these rights often faces challenges. In Egypt, Law no. 100 of 1985 provides similar protection, including the right to divorce and maintenance during the iddah period, although its implementation is hampered by social and cultural factors. A comparison between the two countries reveals similarities and differences in the arrangement of these rights. The husband's obligation to provide maintenance during the iddah period in Indonesia is flexible and determined by the court, whereas in Egypt it is more strict. Mut'ah in Indonesia is considered a respect that is not always required, while in Egypt it is the wife's right. In terms of joint assets, Indonesia considers all assets during a marriage to be jointly owned with division based on agreement, while Egypt considers the contribution of each party. This difference is influenced by economic factors, local culture, as well as regulations on interfaith marriages which are prohibited in Indonesia but exist in Egypt.

Abstract

This research examines social facts related to marriage dispensation before and after the enactment of Law No. 16/2019 at the Sidenreng Rappang Religious Court. The focus of the research is on the factors causing the increase in marriage dispensation applications and the response of law enforcers in the religious courts. The method used is field research with a qualitative descriptive approach and case study method. The results showed that after the enactment of Law No. 16/2019, which raised the minimum age of marriage to 19 years, there was a significant increase in marriage dispensation applications at the Sidenreng Rappang Religious Court. The main factors influencing the high number of applications include family economic conditions, low levels of education, strong local social and cultural norms, pregnancy outside marriage, and lack of supervision and education from parents. In addition, fear of violating religious norms and a desire to maintain the family's reputation are also important reasons for marriage dispensation applications. Despite various education and socialization efforts by the Sidenreng Rappang Religious Court, the effective implementation of the minimum age of marriage still faces challenges due to deep-rooted social and cultural factors in the community. This study recommends the need for increased legal education, strengthening the role of parents, and synergy between agencies to reduce marriage dispensation.

Abstract

The Likka Soro’ marriage practice, which takes place among the Mandar indigenous community in West Sulawesi, is a form of customary marriage conducted without official state registration, yet it remains socially and religiously recognized. However, the existence of children born from such unions raises serious legal issues, particularly concerning lineage status, inheritance rights, and legal identity. This study aims to analyze the legal implications for children born from Likka Soro’ marriages and to examine the practice through the lens of maqashid syariah, particularly the principles of hifz al-nasl (protection of lineage) and hifz al-nafs (protection of life). The research employs a descriptive qualitative method, using a normative-theological approach and field study. The findings indicate that although Likka Soro’ is culturally accepted, the absence of formal registration results in a lack of legal protection for the children involved. From the perspective of maqashid syariah, such a practice contradicts the core objectives of Islamic law if it causes harm to children. Therefore, marriage registration should be promoted as a means of protecting children's rights within the framework of social justice, national law, and maqashid syariah. Abstract

Gaya hidup merupakan suatu sekumpulan kebiasaan, pandangan dan pola-pola respon terhadap gaya hidup, terutama perlengkapan untuk hidup. Cara berpakaian, cara kerja, pola konsumsi, bagaimana individu mengisi kesehariannya merupakan unsur-unsur yang membentuk gaya hidup. Gaya hidup dipengaruhi oleh keterlibatan seseorang dalam sekelompok sosial dari seringnya berinteraksi dan menanggapi berbagai stimulasi. Jenis penelitian yang digunakan dalam skripsi ini ialah field research dengan metode kualitatif, dan penelitian ini menggunakan analisis data deskriptif kualitatif.data dalam penelitian ini diperoleh dari data primer dan sekunder. Teknik pengumpulan data yang digunakan ialah observasi, wawancara dan dokumentasi. Hasil penelitian ini menunjukkan bahwa: (1) Life style para istri di Desa Bilalangnge Kecamatan Bacukiki dalam pengunaan produk kecantikan yakni: Hedonisme, boros, mudah terpengaruh dengan penampilan teman, melalaikan tugas dan tanggung jawab di lingkungan keluarga. Dari bentuk-bentuk life style para istri yang diperlihatkan diatas, dalam hukum Islam dianggap bertentangan dengan perintah Allah Swt dimana gaya hidup tersebut kurang baik bagi keluarga yang berpenghasilan rendah. (2) Dalam hukum Islam dampak dari life style semacam itu tidak dibenarkan karena dari gaya hidup diatas dapat menimbulkan sifat tabarruj atau dapat menarik perhatian laki-laki untuk menatapnya dan menimbulkan beberapa mudharat bagi keluarga sakinah, mawaddah dan rahmah karena kedamaian dan ketentraman serta kasih sayang yang ada didalam suatu keluarga bisa berkurang atau bahkan bisa hilang begitu saja karena faktor dari gaya hidup yang berlebihan/tabarruj. Temuan penelitian menunjukkan bahwa gaya hidup istri yang cenderung hedonis dan konsumtif berdampak negatif terhadap keharmonisan keluarga SAMAWA. Istri harus lebih bijak dalam penggunaan produk kecantikan dan memperhatikan tanggung jawab dalam keluarga sesuai dengan ajaran Islam.

Abstract

Harmony is something that is expected by a married couple in their marriage. This article describes the implications of the mappasiewa ada' tradition on household harmonisation in Bugis marriages in Segeri, Pangkajene and Islands Regency using descriptive qualitative research with a philosophical and normative approach and analysed with ’urf  (tradition theory) and maslahah (kindness theory). The results showed that the practice of mappasiewa ada' tradition in Bugis community marriage is still preserved as a tradition in marriage which has philosophical meaning with symbols. This tradition has a kindness (maslahah) impact and a badness (mafsadah) impact for the bride and groom in building household harmony. The mappasiewa ada' tradition is in accordance with Islamic teachings in the form of good tradition (’urf shahih) which can be preserved as long as it does not deviate from the objectives of sharia or maqashid ash-shari'ah (the purpose of Islamic law), namely: preservation of offspring (muhafadzah al-nasl). It can also be understood as optimism (tafa'ul), because every symbol in the tradition contains a hope or prayer symbolised by an object. If the mappasiewa ada' tradition is not understood comprehensively, people may consider it a practice that contains polytheism (syirik). However, if an Islamic and cultural approach is used, then cultural Islamisation can be carried out, so that the mappasiewa ada' tradition can be preserved and become an important part of the Bugis marriage tradition.
