Abstract

This article examined the controversy of women's testimony and leadership between normative and substantive meanings based on Islamic legal agreements. Hadith about women's testimony of half men's testimony in the terms of law must be reviewed through socio-history. In hermeniotic perspective, the verse about testimony must be seen as a response to the historical facts at the time this verse came down. Thus, compiling historical facts has changed, it can be done to reinterpret the verses and hadith. The hadith about women's leadership in politics in terms of sanad is valid but the understanding of hadith must be approached based on sosio history because the matan of hadith is not always factual. This hadith was conveyed in response to the news of the appointment of Kisra's daughter, a woman who did not receive social approval from the community so that the hadith was acceptable only locally and temporally, not universally applicable. Therefore, leadership in politics can be carried out by anyone, male and female, as long as he/she gain legitimacy from the community.

Abstract

This study examines the perspective of judges in applying their ex officio rights to the protection of the rights of children and wives on divorce cases at Religious Court Pinrang. This research assessed with descriptive qualitative approach using observation and depth-interview to the judges. The result shows that the judges absolutely apply their ex officio to the issue of Mut’ah. There are cross-opinion for the issue of iddah alimony for women in post-divorce, some apply and some do not. While for the issue of hadanah or child rearing, madhiyah property, and common property, the judges agreed that those issues are not include in the judges’ ex officio rights. However, it still must be prosecuted to find out the clear real case.

Abstract

The Likka Soro’ marriage practice, which takes place among the Mandar indigenous community in West Sulawesi, is a form of customary marriage conducted without official state registration, yet it remains socially and religiously recognized. However, the existence of children born from such unions raises serious legal issues, particularly concerning lineage status, inheritance rights, and legal identity. This study aims to analyze the legal implications for children born from Likka Soro’ marriages and to examine the practice through the lens of maqashid syariah, particularly the principles of hifz al-nasl (protection of lineage) and hifz al-nafs (protection of life). The research employs a descriptive qualitative method, using a normative-theological approach and field study. The findings indicate that although Likka Soro’ is culturally accepted, the absence of formal registration results in a lack of legal protection for the children involved. From the perspective of maqashid syariah, such a practice contradicts the core objectives of Islamic law if it causes harm to children. Therefore, marriage registration should be promoted as a means of protecting children's rights within the framework of social justice, national law, and maqashid syariah. Abstract

Praktik nikah muhallil (perkawinan yang bertujuan menghalalkan bekas suami setelah talak tiga) masih menjadi persoalan kontroversial dalam hukum keluarga Islam di Indonesia. Kompilasi Hukum Islam (KHI) sebagai hukum positif yang mengatur perkawinan umat Islam di Indonesia tidak mengatur praktik ini secara tegas, sehingga menimbulkan ketidakpastian hukum dan kesenjangan normatif dengan tujuan luhur syariat (maqashid al-syariah). Artikel ini bertujuan untuk menganalisis status hukum nikah muhallil dalam hukum positif Indonesia, khususnya KHI, serta mengkaji kesenjangan normatif antara KHI dan prinsip maqashid al-syariah. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan filosofis. Bahan hukum primer meliputi Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, Kompilasi Hukum Islam (KHI), literatur fikih klasik empat mazhab, serta Fatwa MUI Nomor 3 Tahun 2021. Bahan hukum sekunder berupa jurnal nasional terakreditasi dan jurnal internasional bereputasi dari sepuluh tahun terakhir. Hasil penelitian menunjukkan bahwa KHI tidak secara tegas melarang nikah muhallil. Pasal 39 KHI hanya mendeskripsikan syarat formil perkawinan setelah talak tiga tanpa mengatur niat di baliknya. Kekosongan hukum ini menyebabkan disparitas putusan hakim dan membuka peluang manipulasi hukum. Lebih lanjut, nikah muhallil bertentangan dengan maqashid al-syariah, terutama perlindungan keturunan (hifzh al-nasl) dan pencegahan kerusakan (dar'u al-mafasid). Kesenjangan antara KHI dan maqashid mengindikasikan bahwa hukum positif Indonesia belum sepenuhnya menginternalisasi nilai-nilai substantif hukum Islam. Kesimpulan menekankan urgensi reformasi hukum untuk secara eksplisit melarang nikah muhallil dan menyelaraskan Kompilasi Hukum Islam dengan prinsip maqashid al-syariah.

Abstract

This study aims to analyze the phenomenon of toxic relationship narratives on social media and their influence on the emergence of fear of marriage syndrome among Generation Z from the perspective of Islamic family law. The widespread exposure to negative relationship content on digital platforms has shaped collective perceptions that marriage is a source of emotional harm rather than a sacred institution. This research employs a normative legal approach with conceptual and statutory methods, focusing on Islamic legal principles and maqashid sharia. The findings indicate that social media plays a significant role in constructing negative perceptions of marriage, which contradicts Islamic teachings that emphasize sakinah, mawaddah, and rahmah. This study contributes to the discourse by integrating digital media analysis with Islamic family law perspectives, offering a new framework to address contemporary challenges faced by Generation Z.
