Abstract

Patent commercialization in Indonesia currently faces challenges due to the lack of clear regulation in the existing Patent Law. Addressing this gap presents a valuable opportunity for enhancing the growth of domestic patents and increasing Indonesia’s economic value. There is an urgent need to establish regulations governing patent commercialization, especially in light of South Korea's Invention Promotion Act No. 19495 of 2023, which enhances the protection of inventors' economic rights and promotes economic growth through effective intellectual property development. This study utilizes a normative juridical approach and comparative law to evaluate existing regulatory frameworks and the potential impacts of new patent commercialization regulations on industrial development and innovation. Currently, Indonesia ranks among the countries with the lowest intellectual property indicators in the world. Therefore, it is crucial to implement specific regulations through Government Regulations and Ministerial Regulations that align with the Patent Law to govern patent commercialization. This research highlights the significance of effective law enforcement in promoting patent commercialization as a vital component of national economic development. By applying incentive theory and economic growth stimulus theory, and utilizing economic analysis of law to evaluate policies that promote certainty, equity, and socio-economic benefits for society and the country.

Abstract

Seiring dengan perkembangan zaman yang didukung dengan perkembanganteknologi informasi, benda tidak hanya ada sebatas di dunia nyata namun juga di duniavirtual, atau dikenal juga dengan virtual property. Virtual property sangat marakditemukan dalam permainan daring, di mana dalam permainan ini virtual propertydalam bentuk item tersebut diciptakan selayaknya benda pada dunia nyata. Namun,para pemain kerap salah memahami bahwa virtual property yang pada akunnya adalahsepenuhnya miliknya, sehingga para pemain bebas untuk melakukan transaksi atasvirtual property tersebut. Hal ini tentu berdampak pada pihak developer permainandaring selaku Pencipta maupun Pemegang Hak Cipta atas permainan daring termasuksegala virtual property di dalamnya. Hingga saat ini Virtual property belum memilikiaturan yang jelas dan hanya berpatokan pada End User License Agreement (EULA)yang dibuat oleh pengembang permainan. Oleh karena itu, penelitian ini ditujukanuntuk memahami mengenai kedudukan hukum dan legalitas transaksi atas virtualproperty dalam permainan daring di Indonesia. Metode yang digunakan padapenelitian ini adalah yuridis normatif yang dititikberatkan pada data sekunder berupabahan hukum primer, sekunder, dan tersier yang erat kaitannya dengan permasalahanyang dikaji, yakni KUH Perdata, Undang-Undang Republik Indonesia Nomor 28 Tahun2014 tentang Hak Cipta, dan Undang-Undang Republik Indonesia Nomor 19 Tahun2016 tentang Informasi dan Transaksi ElektronikBerdasarkan hasil penelitian ini dapatdiperoleh bahwa apabila tidak diatur lain dalam EULA maka pemegang hak milik atasvirtual property dalam permainan dari hanyalah Pencipta dan Pemegang Hak Cipta,sementara pemain hanya memilik hak untuk menguasai virtual property tersebut.Selaras dengan hal tersebut, maka dalam hal transaksi atas virtual property antarpemain dalam permainan daring tidak dapat dibenarkan karena bertentangan denganPasal 1320 KUH Perdata, Undang-Undang Hak Cipta, dan Undang-Undang ITE.

Abstract

Capital invested in a company can be in the form of money or other forms, as regulated in Article 34 paragraph (1) of the Limited Liability Company Law No. 40 of 2007. Other forms (inbreng) include tangible and intangible assets that can be valued in money. Song Copyright is Intellectual Property and an intangible asset. This article describes the potential cancellation of copyright inbreng by a third party. The main issues are the status of shareholders whose copyright inbreng is revoked by the Directorate General of Intellectual Property (DJKI) and legal protection for the company as the recipient of the revoked copyright inbreng, reviewed under the Copyright Law and the Limited Liability Company Law. The research method used is a normative juridical approach, referring to Indonesian laws and regulations and societal norms. The research results are presented descriptively-analytically and analyzed qualitatively to provide a detailed and systematic overview. The conclusion shows that the inbreng agreement is null and void because the song copyright was proven unoriginal and copied from Jimmy Carter's work, the original singer of "Secarik Kertas Pelangi," as evidenced by the originality requirements. With the cancellation of copyright registration, the inbreng becomes void. According to Article 1341 paragraph (2) of the Civil Code, the company as a third party must be respected for acting in good faith in accepting the song copyright inbreng. Therefore, legal protection allows the company to maintain its rights to the asset.

Abstract

Confidential information or trade secrets of a company is very important for business actors, since the development of information-based business. Information has economic values and concerns the quality of the goods and services produced. If the transfer of trade secrets does not explicitly mention the existence of a connection with a Notary Deed, the interests of the parties in an agreement for the transfer of rights and trade secret licenses will lack of legal protection and ultimately create legal uncertainty. The notary deed serves as a means of proof in the event of a trade secret dispute for the parties involved. The power of proof of a notary deed as evidence is a perfect power of proof which then the notary deed must be recorded at the Directorate General of IPR. Abstract

There is a disharmony between PBI PKBI and PADG PKBI with the PDP Law, P2SK Law, SPK Law and PBSSN Common Criteria in terms of regulating the obligation to use privacy reliability certificates by financial sector business actors under BI, so that there are many cases of customer personal data breaches. By using normative and empirical juridical methods, this study analyzes efforts to harmonize the regulations related to privacy certification obligations in the financial sector under BI. The results of the study show that with grammatical, systematic, and teleological legal interpretation, PBI PKBI and PADG PKBI can be harmonized regarding the privacy reliability certificate as the legal object in question and the nature of the regulatory norms, but it is not harmonized regarding the status of the privacy reliability certificate as a mandatory SNI, because both PBI PKBI and PADG PKBI as technical regulations in the perspective of the SPK Law have not stipulated SNI ISO 15408-2, 15408-3, or 15408-5 as the referenced standard.
