Abstract

Islamic studies is a broad and multidimensional academic field, covering various aspects from theology, law, history, to social practice. This paper aims to find out and analyze how the social science approach in Islamic studies and how the humanities approach in Islamic studies. The results of this study can be seen that the social science approach in Islamic studies is a perspective or method that uses concepts, theories, and analysis from social science disciplines such as sociology, anthropology, history, and political science to understand religious phenomena, especially Islam. The humanities approach in Islamic studies is a method that uses disciplines such as history, philosophy, literature, and cultural studies to understand Islam from an intellectual and cultural perspective. Each of these approaches contributes to a deeper understanding of how Islam interacts with different aspects of society, culture and history.

Abstract

Abstract: Acts of radicalism and religious extremism are often associated with religious teachings that are considered deviant from what they should be because they lead to acts of terrorism. Radicalism is ideological thinking with the aim of achieving change through more systematic or organized methods. Meanwhile, religious extremism is thinking or behavior that is very radical and often leads to acts of violence and intolerance to differences. This research is a literature study that examines efforts to resolve radicalism and religious extremism through the constitution, civil society and law in Indonesia. The results of the discussion explain: in the Radicalism section, the government emphasizes the importance of Pancasila and the Law as the basis of life so as not to deviate and be radical about the order of the Indonesian state. While in the Religious Extremism section which leads to acts of terrorism, the government issued regulations PP No. 77 of 2019 concerning the Prevention of Criminal Acts of Terrorism and Law No. 5 of 2018 concerning Eradication of Criminal Acts of Terrorism, besides that prevention is carried out through religious-based educational institutions and community efforts through social media and community organizations. The value of legal philosophy shown is through a deep understanding of radicalism and religious extremism in Indonesia which is extracted from religious, social and political values. Abstract

Indonesia is a country with the largest Muslim population in the world, but on the other hand, Indonesia is also a country with a diverse indigenous community. So the existence of these two aspects creates a diversity of laws that apply to society. In Indonesia itself, family law has a very important role, it is an integral part of regulating the family life of Indonesian society with diverse cultures, religions, and traditions. Family law in Indonesia faces major challenges to remain relevant and fair. The writing method used by the author in making this paper is library research through several literatures such as books, articles, journals, library searches, and internet site searches. The results of this discussion include. The development of Islamic family law culture in Indonesia is a debate between conservatives who maintain the old legal discourse and modernists who offer laws that are in accordance with the demands of the times. In the Enforcement of Family Law in Indonesia, there are also challenges. One of them is the rampant practice of underage marriage which is widely practiced in Indonesian society, this is due to the very large influence of customs and religious factors that exist in the requirements. In realizing the values ​​of justice, society plays a role in instilling its values ​​through legal awareness in the family, as well as encouragement that is carried out such as caring about gender equality and justice in the household. The role of the government is also very large in ensuring that the policies that are made can be appropriate and effective.

Abstract

This study examines the ethical boundaries of judicial authority and their impact on law enforcement and public trust. The role of judges extends beyond merely applying legal principles; it also involves ethical considerations that ensure fairness, impartiality, and integrity in judicial decisions. This research employs a qualitative approach using a literature review method, analyzing legal documents, academic writings, and court rulings to explore the intersection of judicial ethics and the limits of authority. The findings reveal that ethical violations, such as conflicts of interest and abuse of power, significantly affect public perception of judicial credibility. Weak ethical supervision, personal interests, and ineffective accountability mechanisms contribute to these issues. To address these concerns, this study recommends stronger ethical training, enhanced oversight mechanisms, and institutional reforms to uphold judicial integrity. Implementing these measures is crucial for strengthening public confidence in the judiciary and ensuring the fair application of the law.

Abstract

This study examines the interaction between the three main sources of law in the context of Islamic family law in Indonesia, namely state law, Islamic law, and customary law. Using a philosophical approach, this paper evaluates the extent to which the interaction between these legal sources fulfills the principles of justice, legal certainty, and utility. The findings indicate that legal pluralism creates complex dynamics, particularly in cases of interfaith marriage, polygamy, and inheritance. The main challenge lies in the inconsistency between state law, Islamic law, and customary law, which often leads to legal uncertainty and injustice, especially for women. Recommendations include revising the Marriage Law and the Compilation of Islamic Law (KHI), harmonizing legal sources, and increasing legal awareness among the public. This paper is expected to contribute to the development of a more just and harmonious family law system in Indonesia.

Abstract

Dalam dinamika bisnis modern, Corporate Social Responsibility (CSR) atau tanggung jawab sosial perusahaan menjadi aspek strategis dalam pengelolaan usaha. CSR mencakup kontribusi positif perusahaan terhadap kesejahteraan sosial, pelestarian lingkungan, dan pembangunan ekonomi berkelanjutan. Ekonomi Islam, dengan prinsip-prinsip syariah yang menekankan keadilan, transparansi, kejujuran, dan larangan merugikan pihak lain, memiliki relevansi yang kuat untuk diintegrasikan ke dalam praktik CSR. Tujuan utama CSR sejalan dengan nilai-nilai etika ekonomi Islam, yaitu menciptakan keseimbangan antara perolehan keuntungan dan kepedulian terhadap masyarakat serta lingkungan. Meskipun penerapan CSR semakin meluas, kajian mendalam terkait implementasi prinsip etika Islam dalam praktik CSR masih terbatas. Penelitian ini bertujuan menganalisis penerapan nilai-nilai etika ekonomi Islam dalam pelaksanaan CSR pada badan usaha. Metode yang digunakan adalah studi kepustakaan (library research) dengan pendekatan analisis kualitatif deskriptif, melalui pengumpulan data dari buku, artikel ilmiah, dan sumber relevan lainnya. Data dianalisis dengan membandingkan konsep dari berbagai literatur untuk menemukan kesamaan, perbedaan, dan implikasinya. Hasil kajian diharapkan memberikan kontribusi terhadap pengembangan model CSR yang selaras dengan prinsip syariah, memperkuat reputasi perusahaan, dan mendukung keberlanjutan usaha.

Abstract

Artikel ini bertujuan menganalisis prinsip kesahajaan dalam etika konsumsi Islami dengan menggunakan pendekatan pendekatan normatif syariah. Metode penelitian yang digunakan adalah studi pustaka, mengumpulkan data dari buku, artikel, catatan, dan sumber daring yang relevan. Teknik analisis dilakukan dengan membandingkan konsep dari berbagai sumber untuk menemukan persamaan, perbedaan, dan dampaknya. Hasil penelitian menunjukkan bahwa prinsip kesahajaan dalam etika konsumsi Islami mendorong umat untuk hidup sederhana, tidak berlebihan, dan fokus pada kebutuhan dasar. Islam mengajarkan pengelolaan sumber daya secara bijak berdasarkan nilai keadilan dan keberlanjutan, menghindari pemborosan (israf), serta mengarahkan konsumsi untuk mendukung keseimbangan duniawi dan ukhrawi. Prinsip ini mencakup konsumsi barang yang halal dan baik, efisiensi penggunaan harta, serta tanggung jawab sosial melalui zakat dan infak. Kesimpulan penelitian menegaskan bahwa etika konsumsi Islami memberikan panduan komprehensif dalam menjalani aktivitas konsumsi yang berlandaskan syariat untuk menciptakan kesejahteraan individu dan masyarakat secara berkelanjutan

Abstract

Sistem ekonomi, yang mencakup cara mengelola dan mendistribusikan sumber daya yang terbatas, memiliki pengaruh besar terhadap kehidupan manusia. Salah satu elemen penting dalam sistem ekonomi adalah etika, yang menjadi pedoman pengambilan keputusan ekonomi dalam konteks nilai moral dan sosial. Artikel ini bertujuan mengkaji etika dalam sistem ekonomi dari tiga perspektif utama: Islam, Liberalisme, dan Sosialisme. Perspektif Islam menekankan keadilan sosial, tanggung jawab moral, dan pemerataan distribusi kekayaan sesuai dengan prinsip-prinsip syariah. Sementara itu, Liberalisme memprioritaskan kebebasan individu, pasar bebas, dan intervensi pemerintah yang minimal dalam aktivitas ekonomi, dengan dasar bahwa etika ekonomi terletak pada kebebasan memilih dan hak-hak individu. Adapun Sosialisme berfokus pada kesetaraan ekonomi, penghapusan ketimpangan, serta peran negara dalam mengatur distribusi kekayaan demi kesejahteraan bersama. Analisis ini membahas bagaimana setiap sistem mengintegrasikan nilai-nilai etika ke dalam struktur ekonominya, serta implikasinya bagi keadilan sosial dan kesejahteraan masyarakat. Perbandingan ini diharapkan memberikan wawasan mengenai peran etika sebagai pedoman dalam pembangunan ekonomi yang adil dan berkelanjutan.

Abstract

This paper examines domestic partners who do not fully understand the obligations and rights of each husband and wife. This lack of understanding can lead to an imbalance in the relationship and the potential for conflict. The main focus is on the concept of Obligations and Rights of husband and wife according to KH. Hasyim Asy'ari in the book ?au' al-Mi?b?h and the relevance of the Obligations and Rights of husband and wife in the present. The research method used in this research is library research with a research approach using literature (library research) using a qualitative approach with a content analysis approach method. The result of the research on the obligations and rights of husbands and wives according to KH. Hasyim Asy'ari in the book ?au' Al-Mi?b?? from a gender perspective is that the Quran is very wise by mentioning that the relationship between husband and wife must be built in a mu'?syarah bi al-ma'rûf manner. A good husband is a husband who can please, take care of and help his wife just as his wife pleases him, takes care of him and helps him, and the husband must be patient with his wife's shortcomings and vice versa. The obligations and rights of husband and wife in Imam Malik's opinion are the suitability of maslahah which is seen as a stand-alone source of evidence with the purpose of shari'ah (al-maqasid al-shari'ah), maslahah must make sense (rationable), the use of this maslahah argument is in order to eliminate the difficulties that must occur. As long as the working wife does not forget the family, because by nature, the wife is still obliged to take care of the household and pay attention to the family.

Abstract

Abstract: The growing use of cryptocurrency has triggered debates about its compatibility with Islamic law, especially in countries with a strong commitment to sharia economics. This study seeks to compare the legal regulations and religious fatwas on cryptocurrency in Indonesia and Malaysia, evaluated through the Maqasid Shariah framework. Using a normative-comparative legal approach, this research relies on statutory analysis, conceptual reviews, and cross-country comparisons. Key sources include DSN-MUI Fatwa No. 140/2021, Bappebti regulations, the Securities Commission Malaysia’s Guidelines on Digital Assets, and resolutions from the Shariah Advisory Council of Bank Negara Malaysia. Findings indicate that Malaysia shows stronger sharia governance through mandatory audits and public literacy initiatives, while Indonesia provides clearer legal certainty by codifying fatwas and regulations. These findings suggest that each country can learn from the other: Indonesia may strengthen governance, and Malaysia may enhance legal certainty. The contribution of this paper lies in its novelty of applying Maqasid Shariah to a comparative legal study of cryptocurrency, offering relevant implications for policymakers and sharia authorities.
