Abstract

Economic exploitation of children is a form of human rights violation that is still rampant, especially in areas with high poverty rates and limited access to education and legal protection. In Central Java, this phenomenon often affects children from marginalized families who are forced to work to help support their families' economy. This study aims to analyze how empowering marginalized communities can be an effective strategy in supporting the implementation of legal protection for children who are victims of economic exploitation. Using a qualitative approach and case study methods in several areas in Central Java, this study explores the role of local communities, civil society organizations, and government institutions in building legal awareness and social capacity of marginalized communities. The results of the study show that community empowerment not only increases understanding of children's rights but also strengthens the community's bargaining position in rejecting exploitative practices. Programs such as skills training, legal counseling, and the formation of local advocacy groups have been shown to create a more protective environment for children. In addition, collaboration between the community, local government, and child protection institutions is key to building a sustainable protection system that is responsive to local needs. This study confirms that a community-based approach is an important element in child protection strategies, especially in areas with limited resources. Therefore, policies are needed that support the active participation of marginalized communities in the process of formulating and implementing child legal protection. Thus, child protection efforts are not only the responsibility of the state, but also become a collective movement from the grassroots that starts from shared awareness and concern.

Abstract

This article comprehensively analyzes the Indonesian Constitution as a crucial foundation and solid bulwark for strengthening Environmental Criminal Law. Given the alarming global ecological crisis, characterized by massive deforestation, uncontrolled pollution, biodiversity loss, and excessive resource exploitation, reforming the criminal law framework to be adaptive, responsive, and progressive is urgent. This research firmly argues that the Constitution isn't just a general, declarative legal umbrella; it intrinsically embodies fundamental constitutional values and principles. These include every citizen's right to a good and healthy environment and the state's obligation to protect it, which must be actively interpreted, internalized, and expanded into all norms and practices of Environmental Criminal Law enforcement. Using a normative-juridical approach focused on analyzing legal texts, doctrines, and court decisions, this article systematically examines how in-depth constitutional interpretation and creative elaboration of principles can catalyze stronger, more comprehensive, and ecologically just environmental criminal regulations. The discussion identifies and critically analyzes structural and substantive weaknesses in current environmental criminal law enforcement, such as evidentiary challenges, weak sanctions, and limited scope of legal subjects. Furthermore, this article explores the Constitution's potential to legitimize overcoming these obstacles. This includes strengthening criminal sanctions for proportional deterrence, expanding the definition of environmental crimes to encompass new and complex ecological offenses, and enhancing more effective corporate accountability mechanisms. Ultimately, this article affirms that reforming and developing Environmental Criminal Law, firmly rooted in constitutional values and principles, is an absolute prerequisite for building a holistic and sustainable environmental protection system. This step is essential in preventing further ecological degradation, restoring the balance of nature, and effectively guaranteeing environmental rights for current and future generations.

Abstract

Digital transformation in public services is a strategic step in enhancing the effectiveness, efficiency, and transparency of bureaucracy. This study employs a qualitative approach with an empirical juridical method to analyze the public service innovations implemented by the Investment and One-Stop Integrated Service Agency (DPMPTSP) of Kendal Regency in supporting good governance. Data were collected through interviews with DPMPTSP staff, direct observations of digital services, and an analysis of policy documents related to public service innovation. The findings indicate that various digital-based innovations, such as public service websites, geospatial information systems, business partnership platforms, and Self-Service Printing Kiosks (ACM), have positively impacted accessibility, streamlined licensing procedures, and strengthened bureaucratic accountability. However, the study also identifies challenges in system integration and human resource readiness in managing the implemented technology. Therefore, strengthening digital infrastructure, enhancing human resource capabilities, and optimizing service evaluation mechanisms are necessary to ensure the sustainability of these innovations and their alignment with good governance principles.

Abstract

The Constitutional Court of Indonesia’s Decision Number 93/PUU-XX/2022 marks a pivotal moment in disability rights by ruling that the terms “imbecile,” “mentally ill,” and “dark-eyed,” along with the word “must” in Article 433 of the Civil Code, are inconsistent with the 1945 Constitution. The Court replaced these derogatory terms with “persons with mental and/or intellectual disabilities” and revised “must” to “can,” signaling a shift toward a more rights-based approach. However, this legal amendment raises critical questions: Does it effectively balance guardianship proceedings with the rights and autonomy of persons with disabilities? And who will advocate for their protection and inclusion in the legal system? This study analyzes the decision’s implications, particularly its impact on the legal mechanisms available to individuals with mental and intellectual disabilities. Using a qualitative approach and a statutory analysis of the Civil Code, Law No. 8 of 2016 on Disability, Law No. 19 of 2011 on the Protection and Rights of Persons with Disabilities, and the Constitutional Court ruling, this research evaluates the extent to which the amendments align with international human rights standards, such as the UN Convention on the Rights of Persons with Disabilities (CRPD). By placing Indonesia’s legal reforms in the broader international debate on disability rights, this study highlights the urgency of stronger advocacy and legal safeguards to prevent continued marginalization. The findings contribute to discussions on legal capacity, guardianship, and human dignity, offering insights for policymakers, legal practitioners, and human rights advocates seeking to advance disability rights worldwide.

Abstract

Artikel ini mengkaji tentang isu penting terkait kebebasan pers dan perlindungan identitas anak korban asusila. Dalam konteks hukum pidana, pertanyaan mengenai tanggung jawab pidana bagi jurnalis atas pelanggaran privasi identitas anak korban asusila menjadi sangat relevan dalam era media modern. Penelitian ini bertujuan untuk melakukan perbandingan regulasi hukum di Indonesia dan Malaysia terkait pertanggungjawaban pidana jurnalis dalam kasus pemberitaan identitas anak korban asusila. Hasil dari penelitian ini menunjukkan bahwa meskipun Indonesia dan Malaysia memiliki peraturan hukum yang berbeda terkait pertanggungjawaban pidana bagi jurnalis, keduanya memiliki prinsip-prinsip yang serupa dalam perlindungan identitas anak korban asusila. Evaluasi mendalam terhadap kasus-kasus yang telah terjadi menunjukkan bahwa implementasi hukum terkait pelanggaran tersebut masih memiliki celah yang perlu diperbaiki. Diperlukan pendekatan yang lebih holistik dan komprehensif dalam menangani kasus-kasus sensasionalisme media yang merugikan anak korban asusila. Berdasarkan analisis ini, implementasi regulasi yang lebih ketat dan sanksi yang tegas terhadap pelanggaran hukum terkait pemberitaan identitas anak korban asusila akan menjadi langkah efektif dalam mencegah penyalahgunaan kebebasan pers demi kepentingan publik. Melalui pemahaman mendalam terkait perbandingan hukum antara Indonesia dan Malaysia dalam kasus pertanggungjawaban pidana bagi jurnalis atas pemberitaan identitas anak korban asusila, diharapkan dapat lebih meningkatkan kesadaran akan pentingnya perlindungan anak korban asusila dan mendorong perbaikan perundang-undangan guna mencapai keadilan yang lebih baik dalam konteks ini.

Abstract

This community service activity aims to increase the awareness and understanding of teachers at Labschool UNNES regarding the importance of excellent education services as an integral part of realizing the Pancasila Student Profile Strengthening Project (P5). The background of this activity is based on the results of initial surveys and observations, which show that some teachers have not fully understood or optimally implemented the principles of excellent education and the values in P5. Therefore, this activity was designed in the form of training and mentoring using a participatory approach. The methods used included interactive lectures, group discussions, and hands-on practice in learning development and implementation. During the activity, there was an increase in teachers' awareness through active involvement in the training process, reflection on their learning practices, and improvements in planning and teaching strategies that are more oriented towards Pancasila values. Nevertheless, challenges in classroom implementation are still encountered, especially regarding consistency and adaptation to students' needs. Therefore, further efforts are needed in the form of continuous mentoring and cooperation between stakeholders so that the expected educational transformation can be realized thoroughly and sustainably. ABSTRAKKegiatan pengabdian kepada masyarakat ini bertujuan untuk meningkatkan kesadaran dan pemahaman para guru di Labschool UNNES mengenai pentingnya layanan pendidikan prima sebagai bagian integral dalam mewujudkan Proyek Penguatan Profil Pelajar Pancasila (P5). Latar belakang kegiatan ini didasarkan pada hasil survei dan observasi awal yang menunjukkan bahwa sebagian guru belum sepenuhnya memahami maupun mengimplementasikan prinsip-prinsip pendidikan prima dan nilai-nilai dalam P5 secara optimal. Oleh karena itu, kegiatan ini dirancang dalam bentuk pelatihan dan pendampingan yang menggunakan pendekatan partisipatif. Metode yang digunakan mencakup ceramah interaktif, diskusi kelompok, serta praktik langsung dalam pengembangan dan pelaksanaan pembelajaran. Selama kegiatan berlangsung, terlihat peningkatan kesadaran guru melalui keterlibatan aktif dalam proses pelatihan, refleksi atas praktik pembelajaran mereka, dan perbaikan dalam perencanaan serta strategi mengajar yang lebih berorientasi pada nilai-nilai Pancasila. Meskipun demikian, tantangan dalam implementasi di kelas masih dijumpai, terutama terkait konsistensi dan adaptasi terhadap kebutuhan siswa. Oleh karena itu, dibutuhkan upaya lanjutan berupa pendampingan berkelanjutan dan kerja sama antar pemangku kepentingan, agar transformasi pendidikan yang diharapkan dapat terwujud secara menyeluruh dan berkelanjutan.

Abstract

This study examines the application of restorative justice by the Semarang City Police Criminal Investigation Unit (Satreskrim) in handling perpetrators of criminal acts during the stages of investigation and inquiry. The study arises from the need for alternative solutions to criminal cases that prioritize not only punishment but also the restoration of conditions for victims, offenders, and the wider community. The research is directed toward two central problems: first, how restorative justice is applied by the Semarang City Police, and second, what factors support or hinder its implementation. Using a juridical-sociological approach with descriptive analytical methods, this study relies on both primary and secondary data. Primary data were collected through interviews with police officers, victims, perpetrators, and community leaders involved in the settlement process. Secondary data were obtained from laws, regulations, literature, and previous studies. Data were analyzed qualitatively through reduction, presentation, and conclusion, guided by Howard Zehr and John Braithwaite’s restorative justice theory as well as Soerjono Soekanto’s theory of legal effectiveness. Findings reveal that restorative justice is implemented primarily through mediation, where perpetrators, victims, families, and community representatives meet to achieve peaceful agreements. These agreements generally consist of apologies, compensation, and case dismissal as regulated in Police Regulation Number 8 of 2021. Supporting factors include a clear legal foundation, institutional support, adequate facilities, and strong traditions of deliberation in society. Nevertheless, challenges remain, such as limited officer comprehension, differing views with prosecutors, weak regulatory enforcement, and public preference for retributive justice. The study concludes that restorative justice has shown positive results but requires stronger regulations, capacity building, and wider public education for consistent application.

Abstract

The prolonged social conflict in Afghanistan has caused its citizens to flee to various countries around the world. Asylum seekers from this country located in Central and South Asia often face challenges in legal protection, especially in asylum-receiving countries such as Indonesia. Although it does not have an official policy regarding refugees, Indonesia is one of the transit destinations for asylum seekers, including those who are refugees from the conflict in Afghanistan. The study aims to analyze the protection, challenges, and mechanisms of legal protection for asylum seekers from Afghanistan in Indonesia. A qualitative approach is used in the study that relies on literature reviews, such as books, scientific articles, institutional reports, and documents related to the protection of asylum seekers. Indonesia is a member of international legal instruments, such as the 1951 Refugee Convention, but does not yet have a clear national legal framework to protect the rights of asylum seekers. In Indonesia, asylum seekers from Afghanistan face legal uncertainty, limited access to basic services, and the potential risk of deportation to an unsafe country of origin

Abstract

The shift from print, television, and radio to online media has made it simpler to obtain a variety of current news sources. Regretfully, despite the ease of access, not all news meets journalistic ethics and legal requirements, including those regarding minors in legal trouble (ABH). This article finds that there are still media offices that do not meet the standards of press regulation, which is governed by Press Council Regulation Number 1/Regulation-DP/II/2019, concerning the Guidelines for Child-Friendly News (PPRA) and Article 5 in the journalistic code of ethics, namely by producing news that is not child-friendly. This research uses 2 (two) theories, namely: Social Responsibility Press Theory and the theory of the relationship between criminal liability and criminal acts, with the research method used being normative juridical with a type of prescriptive research that is a literature study. The type of data used is secondary data. By analyzing the news of several online media that are still disclosing photos or publishing on ABH's identity, ABH's identity should be kept secret, aiming for ABH to be accepted in the community, if ABH's identity is revealed, it is feared that in continuing his life the child will be difficult to accept in society, especially if he is labeled as a "child of a criminal offender".

Abstract

Economic exploitation of children in urban environments is a complex form of social crime that is often hidden behind the dynamics of city life. Children are not only victims of family economic pressures, but also become objects of crime by parties who take advantage of their vulnerability. This article aims to analyze the phenomenon of child exploitation from a criminological perspective, highlighting how social structures, economic inequality, and weak legal protection systems contribute to the rampant practice of exploitation in urban areas. Using a qualitative approach and critical criminology theory, this study examines the patterns of exploitation that occur, including the involvement of children in informal work, forced labor, and other forms of hidden exploitation. The results of the analysis show that child exploitation is not only triggered by economic factors, but also by the cultural normalization of child labor, lack of legal awareness at the community level, and minimal community-based state intervention. This article emphasizes that child exploitation must be understood as a structural crime that requires an interdisciplinary and collaborative approach. Prevention and handling efforts are not enough only through law enforcement, but also through community empowerment, social policy reform, and strengthening child protection systems that are responsive to the urban context. Thus, protecting children from economic exploitation must be a priority agenda in criminal and social policies in urban areas.
