Abstract

Keberhasilan dalam pengembalian aset hasil tindak pidana korupsi menjadi salah satu indikator keberhasilan dalam upaya pemberantasan korupsi di Indonesia. Tren korupsi yang lintas negara dan melibatkan banyak aktor, menyebabkan upaya pengembalian aset (asset recovery) menjadi tidak mudah. Paper ini bertujuan untuk mengkaji tiga hal penting, yakni: (1) upaya pengembalian aset hasil korupsi yang berada di luar negeri, (2) peran lembaga negara dan aparat penegak hukum, dan (3) faktor hambatannya. Penelitian paper ini menggunakan pendekatan yuridis sosiologis, penelitian kualitatif dengan spesifikasi penelitiannya deskriptif analitis, teknik pengumpulan data dengan cara wawancara dan dokumentasi. Paper ini menggarisbawahi bahwa p pengembalian aset dapat dilakukan melalui jalur formal dengan MLA dan informal melalui hubungan diplomatik. Tahap pengembalian aset terdiri atas: (1) identifikasi dan penelusuran, (2) proses hukum, dan (3) perampasan aset. Hambatan dalam pengembalian aset meliputi sistem hukum yang berbeda, lemahnya putusan hakim, kemauan politik pemerintah, dan berlakunya asas kerahasiaan bank di beberapa negara. Permasalahan yang muncul dalam pengembalian aset bisa diatasi dengan perjanjian bilateral, meningkatkan kompetensi aparat penegak hukum, dan memantapkan aturan dan sarana prasarana pendukung. Peran pemerintah baik Kejaksaan Agung, NCB Interpol Indonesia, KPK, Kemenkumham, dan Kemenlu, semuanya saling mendukung satu sama lain dalam upaya pengembalian aset sesuai dengan aturan hukum yang berlaku. Paper ini menyimpulkan bahwa dalam pengembalian aset membutuhkan kerjasama antar lembaga dan aparat penegak hukum baik yang berada di dalam maupun di luar negeri.One of aimed indicators on corruption eradication in Indonesia is the successful of assets recovery. Trend of corruption that cross border nations and involved many actors caused the assets recovery process was not easy to be done. This paper would examine three main points: (1) the effort of corrupted asset which save abroad; (2) roles of state institutions and law enforcement officers on assets recovery; and (3) the obstacles on assets recovery. The paper used a socio-legal approach, qualitative research with descriptive analytical research specifications, and techniques of data collection through interviews and documentation methods. This paper was underlined that assets recovery can be optimized by two ways, one of formal track through MLA and other is informal track with diplomatic relations. The process of assets recovery started from (1) identify and trace, (2) legal proceedings, and until (3) repatriate. The obstacles on asset recovery was concerning to a different legal system, a weakness of judicial verdict, good and political will of government, and the implementation of bank secrecy principle in some countries. Some problems faced in assets recovery process resolved by conducting bilateral agreements, improving the competence of law enforcement officers, and establishing the rules and supporting infrastructure. The roles of government, whether it’s Attorney General, National Central Bureau Interpol Indonesia, KPK, Kemenkumham, or Kemenlu, all of which mutually support one another in an effort to return the assets in accordance with the rules of the applicable law. This paper concluded that the asset recovery requires cooperation between institutions and law enforcement agencies both within and outside the country.

Abstract

Dari perspektif sejarah, kekerasan merupakan salah satu masalah sosial yang paling lama bertahan, mungkin bahkan lebih tua daripada peradaban manusia. Ini mengherankan karena manusia pada dasarnya adalah makhluk homo homini lupus, yang merujuk pada pemikiran filsuf kenamaan Aristoteles, bahwa manusia bisa menjadi serigala bagi orang lain dan bisa menjadi "kanibal" dalam arti bahwa mereka dapat melakukan kekerasan terhadap sesamanya dalam situasi tertentu, baik dalam bentuk fisik atau verbal. Kekerasan berbasis gender adalah salah satu jenis kekerasan yang telah menjadi masalah besar selama bertahun-tahun. Fenomena ini merupakan masalah global yang masih menjadi subjek diskusi di berbagai forum di dalam negeri, regional, dan internasional. Kekerasan berbasis gender tidak hanya terjadi pada kaum perempuan; itu juga dapat terjadi pada laki-laki atau kelompok lain seperti laki-laki, atau kaum Lesbian, Gay, Biseksual, dan Transgender (LGBT). Namun, data menunjukkan bahwa lebih sering terjadi pada kaum perempuan. Tujuan dari tulisan ini adalah untuk memahami dan mempelajari konsekuensi serta penerapan hukum atas kasus kekerasan berbasis gender dari perspektif teori hukum feminis, juga dikenal sebagai teori hukum feminis. Teori ini menyatakan bahwa karena perspektif laki-laki adalah dasar hukum, aturan saat ini masih dianggap sebagai hasil dari patriarki. Dalam bahasan artikel ini, metode hukum normatif digunakan, yaitu ulasan literatur. Oleh karena itu, diharapkan adanya konsekuensi hukum yang mendukung gagasan hukum feminis yang tidak terbatas pada negara tertentu.

Abstract

In a state governed by the rule of law that upholds the principles of equality before the law and access to justice , the provision of fair and equitable legal aid is a fundamental human right that must be guaranteed by the state. However, in practice, legal access disparities persist, particularly among the poor, vulnerable groups, and communities in remote areas. In response to the limited availability of lawyers and legal aid services, paralegals emerge as non-professional actors who perform non-litigation legal assistance roles. This study aims to analyze the legal legitimacy and existence of paralegals within Indonesia’s legal system. Using a normative juridical approach, supported by historical and conceptual analysis, the study finds that paralegals gain legal standing through Law No. 16 of 2011 and its derivative regulations. Nevertheless, their formal recognition remains limited, especially following Supreme Court Decision No. 22 P/HUM/2018, which restricts paralegals from participating in litigation processes. This limitation overlooks the significant role paralegals play in legal education, community advocacy, and grassroots legal empowerment. Therefore, policy reform and stronger legal recognition are urgently needed to enable paralegals to contribute more effectively to the realization of substantive justice and broader access to legal remedies.

Abstract

The development of technology and information has created new spaces that offer convenience in life. However, behind this ease lies a loophole exploited by individuals with malicious intent. This space is used as a means to commit criminal acts. Crime in the digital era represents a modern type of offense that requires a different legal approach compared to conventional crimes. The shifting characteristics and modus operandi of criminal acts in the digital era must be met with a reconstruction of positive law in Indonesia. This is crucial to ensure that these crimes can still be effectively handled, thereby maintaining state order.

Abstract

Artikel ini mengkaji tentang isu penting terkait kebebasan pers dan perlindungan identitas anak korban asusila. Dalam konteks hukum pidana, pertanyaan mengenai tanggung jawab pidana bagi jurnalis atas pelanggaran privasi identitas anak korban asusila menjadi sangat relevan dalam era media modern. Penelitian ini bertujuan untuk melakukan perbandingan regulasi hukum di Indonesia dan Malaysia terkait pertanggungjawaban pidana jurnalis dalam kasus pemberitaan identitas anak korban asusila. Hasil dari penelitian ini menunjukkan bahwa meskipun Indonesia dan Malaysia memiliki peraturan hukum yang berbeda terkait pertanggungjawaban pidana bagi jurnalis, keduanya memiliki prinsip-prinsip yang serupa dalam perlindungan identitas anak korban asusila. Evaluasi mendalam terhadap kasus-kasus yang telah terjadi menunjukkan bahwa implementasi hukum terkait pelanggaran tersebut masih memiliki celah yang perlu diperbaiki. Diperlukan pendekatan yang lebih holistik dan komprehensif dalam menangani kasus-kasus sensasionalisme media yang merugikan anak korban asusila. Berdasarkan analisis ini, implementasi regulasi yang lebih ketat dan sanksi yang tegas terhadap pelanggaran hukum terkait pemberitaan identitas anak korban asusila akan menjadi langkah efektif dalam mencegah penyalahgunaan kebebasan pers demi kepentingan publik. Melalui pemahaman mendalam terkait perbandingan hukum antara Indonesia dan Malaysia dalam kasus pertanggungjawaban pidana bagi jurnalis atas pemberitaan identitas anak korban asusila, diharapkan dapat lebih meningkatkan kesadaran akan pentingnya perlindungan anak korban asusila dan mendorong perbaikan perundang-undangan guna mencapai keadilan yang lebih baik dalam konteks ini.

Abstract

This study delves into the persistent challenges of corruption in Indonesia despite extensive anti-corruption initiatives. By examining the multifaceted modus operandi across various institutions, we uncover the menacing threat corruption poses to the stability of the nation. The analysis explores structural, cultural, instrumental, and management barriers hindering anti-corruption measures, emphasizing the urgent need for comprehensive reforms. Drawing insights from Law Number 31 of 1999, which classifies corruption actions, including bribery and conflicts of interest, this research underscores the gravity of corruption's impact on state finances, politics, and the economy. To effectively combat this menace, we propose a strategic approach, including the redesign of public services, enhanced transparency, oversight, and sanctions, and the empowerment of mechanisms supporting corruption prevention. In light of these findings, the study advocates for an integrated law enforcement strategy, international cooperation, and harmonized regulations to strengthen Indonesia's resolve in anti-corruption efforts. The proposed reforms aim not only to curb corruption but also to fortify the stability of the nation, reflecting a crucial step towards a more transparent and accountable governance system.

Abstract

The internet has profoundly transformed interfaith relations, offering an unprecedented global arena for dialogue and community building. Yet this transformative power is shadowed by a growing threat: the digital space is increasingly weaponized as a battleground for religious tensions, fueled by hate speech, misinformation, and targeted harassment. The absence of robust legal and ethical frameworks tailored to the complexities of online interaction leaves interfaith communities vulnerable and undermines genuine cooperation. This article introduces the conceptual model of a “digital sanctuary”—a deliberately designed and protected online space where diverse faiths can coexist and flourish. Achieving this ideal is not an organic outcome of technology but requires intentional, multi-faceted efforts from all stakeholders. The paper critically examines regulatory gaps and ethical dilemmas obstructing interfaith harmony online, highlighting the limitations of fragmented national laws in a borderless environment and analyzing the responsibilities of technology platforms. We advocate moving beyond simple content moderation toward a proactive, rights-based approach that prioritizes the safety and dignity of religious minorities. By proposing a model of “digital jurisprudence,” the article calls for holistic guidelines that extend beyond traditional statutes. These include policy recommendations for algorithmic transparency, community-led dialogue, and greater international cooperation to establish standards that balance freedom of expression with protection from religious incitement. Ultimately, the paper contends that the future of peaceful interfaith coexistence depends on transforming the digital realm from a passive, ungoverned space into a resilient ecosystem where principles of mutual respect are systematically protected and nurtured

Abstract

Sexual violence against persons with disabilities is a crime that requires full attention. Persons with disabilities, as victims of crime, must receive justice. This study aims to identify the obstacles experienced by persons with disabilities in the evidentiary process of law enforcement and to provide information about a disability-friendly evidentiary system. This research is normative in nature, with data sources derived from secondary data. The data were collected, classified, and processed according to the discussion to provide answers to the issues raised, then presented descriptively. The results show that obstacles may arise from persons with disabilities themselves, law enforcement officers, and the still-developing understanding of sexual violence. Regarding the evidentiary system, there is a need to update regulations to facilitate the evidentiary process. The evidentiary system based on Law No. 12 of 2022 offers a disability-friendly approach to achieving justice. In implementing the evidentiary process, disability-friendly measures must also be considered, as stipulated in Government Regulation No. 39 of 2020 concerning Reasonable Accommodation for Persons with Disabilities in Judicial Processes.

Abstract

Persons with disabilities facing the law need special legal protections to ensure equal and non-discriminatory justice. However, in law enforcement practice in Indonesia, the implementation of proper accommodation and legal assistance is still not optimal. This research aims to analyze legal protection for persons with disabilities and the application  of restorative justice in the perspective of educational criminalization. The research method used is normative research with a legislative and conceptual approach. The results of the study show that even though legal regulations are available, they still face obstacles in their implementation, so that the application  of restorative justice based on educational criminalization is seen as more humane and just because it focuses on recovery and rehabilitation.

Abstract

Economic exploitation of children is still a serious problem that occurs in various regions, including in Pati Regency, and has a direct impact on the violation of children's rights. This problem is generally triggered by the socio-economic conditions of vulnerable families and low legal awareness of the community, so that children are often used as a means to gain economic benefits. This study aims to analyze law enforcement against the crime of economic exploitation of children in Pati Regency and formulate an integrated handling model in the context of protecting children's constitutional rights. The research method used is sociological juridical with a qualitative approach, through the collection of primary data obtained from the public and law enforcement officials, as well as secondary data sourced from laws and regulations and literature studies. The results of the study show that normatively the legal apparatus for child protection has been adequate, but its implementation at the regional level has not been running optimally. Law enforcement is still dominated by preventive efforts, while repressive actions against exploiters have not been carried out firmly and consistently. The low legal culture of the community is also a factor that inhibits the effectiveness of child protection. This study concludes that it is necessary to strengthen fair law enforcement, increase cross-sector coordination, and build community legal awareness as part of an integrated handling model to suppress the practice of economic exploitation of children and ensure the protection of children's constitutional rights in a sustainable manner.
