Abstract

Dalam persaingan pasar yang semakin ketat, desain produk susu kambing (etawa) menjadi faktor kunci yang mempengaruhi daya tarik konsumen dan pangsa pasar sebuah produk, penelitian ini bertujuan untuk mengidentifikasi hambatan dan tantangan dalam pelindungan hukum terhadap desain produk susu kambing di bawah hak desain industri. Penelitian ini sangat penting untuk mendukung pertumbuhan dan inovasi  industri susu kambing serta melindungi hak intelektual pemilik model susu kambing. Permasalahan yang diteliti dalam penelitian ini adalah  produk susu sapi tidak dapat ditiru oleh masyarakat lain, dan  produk yang diciptakan berada dalam pelindungan hukum sehingga susu kambing  dapat diproduksi dengan produk baru di seluruh wilayah Indonesia. Jenis penelitian yang digunakan penulis  adalah penelitian deskriptif kualitatif yang menggunakan metode normatif empiris. Dengan memberikan perlindungan hukum terhadap desain produk susu kambing (etawa), pedagang merasa lebih aman dan mendorong pengembangan desain  baru dan unik. Hal ini  mendorong inovasi dan kreativitas pada industri susu kambing (etawa) yang pada akhirnya dapat menghasilkan produk yang lebih menarik dan memperoleh nilai tambah. Kata kunci: Pelindungan hukum, Susu Etawa, Hak desain industri

Abstract

Radikalisme dan fanatisme beragama bukanlah fenomena yang terbatas pada satu kelompok atau agama tertentu, tetapi merupakan tantangan yang melibatkan berbagai elemen masyarakat. Penelitian ini bertujuan untuk mengetahui kurangnya pemahaman dan internalisasi terhadap nilai nilai Pancasila, ketidaksetaraan sosial dan diskriminasi berdasarkan agama, serta mengetahui pengaruh media sosial dalam memperkuat atau menyebarluaskan pandangan ekstrem terkait dengan fanatisme beragama. Penelitian ini menggunakan metode Penelitian kuantitatif dengan terstruktur Melalui instrument pengukuran seperti kuesioner atau observasi sistematis. Metode kuantitatif dengan angket adalah salah satu teknik pengumpulan data penelitian kuantitatif yang dilakukan dengan cara memberikan seperangkat pertanyaan atau pernyataan tertulis kepada responden untuk dijawabnya. Penelitian ini melibatkan 31 siswa-siswi kelas XI di SMA Gajah Mada sebagai responden. Mereka dipilih secara acak dari berbagai latar belakang sosial, ekonomi, budaya, dan agama. Penelitian ini melibatkan 2 kelas yaitu dari jurusan IPA dan IPS. Sebanyak 17 responden laki-laki dan 14 responden perempuan turut serta dalam penelitian ini. Usia responden berkisar antara 16   hingga 18 tahun. Aktualisasi nilai Pancasila dapat menjadi alat yang efektif dalam mengatasi tindakan radikalisme yang berasal dari fanatisme beragama yang berlebihan.

Abstract

The role of the local government of North Sumatra province in the development of Tortor Toba dance and gordang sambilan dance as performing arts that are expressions of traditional culture. EBT (traditional cultural expression) is a form of traditional intellectual property. Tortor is a dance, but the meaning more than the movements states that Tortor is a medium of communication, where through the movements displayed there will be interaction between participation in ceremonies, weddings, and also welcome. On the other hand, the lack of attention of the Indonesian government makes the Tortor dance has no copyright protection, therefore the author is interested in conducting further research on legal protection of the Tortor dance, the important role of the local government of North Sumatra province and the solution that can be provided by the government to the problem of claiming tortor and gordang sambilan dances by neighboring countries. This research uses qualitative descriptive research methods, with normative-empirical legal research types. Data collection techniques are interviews, documentation and data sources from the North Sumatra Provincial Culture and Tourism Office and the owner of the Sihoda dance studio. The finding in this study is that legal protection for Tortor's dance has not provided legal certainty specifically for Tortor's own dance, but the law recognizes the existence of regional arts.

Abstract

Criminal law consists of regulations. which determines what is prohibited and what is permitted in criminal cases, and determines the punishment that can be given to people who commit them. It is easy to measure the success of Indonesia's legal reform. One of the criminal acts of theft that is often considered to occur very often is motorbike theft. Motorbikes are an important means of transportation for most Indonesian people because the price is affordable for most people with middle to lower incomes, where the increase in the number of motorized vehicles is in line with the increase in the number of crimes involving motorbikes which has led to the crime of motorbike theft. The author uses qualitative legal research with secondary data sources in this research. In this article, the research method used is the normative news method. The Police of the Republic of Indonesia have direct authority to carry out all criminal acts, including theft with violence. This is in accordance with the police's duty to maintain security and public order, protection, protection and community service, as well as law enforcement. In the law enforcement process, efforts are made to uphold functions with legal norms as guidelines for behavior in traffic or legal relations in society and the state where there are perpetrators who commit the criminal act in question, in the sense of people who, with some intention or something unintentional, as required by law, have left a consequence of climbing the law whether it is subjective elements or other elements and in article 362 of the Criminal Code it is explained that the act of taking an item which in whole or in part includes a statement by another person with the intention of possessing the item in violation of the rights.

Abstract

The aim of this research is to find out how criminal responsibility is for perpetrators of theft with weights in the Legal Area of ​​the Medan District Court. The research method used is a normative legal method with a type of normative juridical research, where research focuses on studying the application of rules or norms in positive law. The results of this research show that the criminal and his partner were legally proven and promised to be guilty of committing the crime of "aggravated theft", the factor that caused the perpetrator to commit the crime of theft was because the criminal was addicted to drugs. The judge's decision stated that the fraudster did not find anything that could eliminate criminal liability for himself. Criminal liability for the defendant is imprisonment for: 10 (ten) months in prison minus the period of isolation that has been served and with an order that the defendant remain in detention.

Abstract

The development of information technology and social media has significantly impacted the social behavior of adolescents. One concerning issue is the proliferation of hate speech on Facebook. This research focuses on the impact of hate speech on Facebook on students at the Private National Heroes Middle School in Medan. The method used in this research is qualitative descriptive, involving interviews. The research findings present the impact of hate speech on social media, aiding in understanding the influence of social media on adolescents. This is essential for guiding students in the responsible and ethical use of social media. The research can serve as a basis for further studies and contribute to a safer social media environment for adolescents. It addresses the knowledge gap regarding the impact of hate speech on social media on the behavior of students in the digital era.

Abstract

This research discusses religious diversity which is a natural part of the modern school environment. Each school member adheres to a different religion, has different traditions, and celebrates different religious holidays. Therefore, it is very important for schools to create an atmosphere where everyone, regardless of religion or belief, can feel welcome. Islam, Catholicism, Christianity, Hinduism, Buddhism and Confucianism are some of the religions widely practiced in Indonesia. The research aims to find out how students' attitudes respect diversity by using quantitative research methods by collecting data through questionnaires given to grade 8 students at SMP Negeri 14 Medan with a total of 26 respondents. This data will be analyzed statistically to determine students' understanding of religious diversity. As a pluralistic nation, Indonesia will certainly face small conflicts and even major betrayals. The disintegration of the nation will certainly have an impact if this disease is not treated. For this reason, it is necessary to instill an understanding of religious pluralism without conflict in students from childhood.

Abstract

Inheritance law (erfrecht) is a set of norms or rules that regulate the transfer or transfer of rights and obligations (assets) from people who die (heirs) to people who are still alive (heirs) who have the right to receive them. Or in other words, inheritance law is a regulation that regulates the transfer of assets of a person who dies to one or several other people. Customary inheritance law is customary law which contains provisions regarding the system and principles of inheritance law, regarding the transfer of control and ownership of inherited property from the heir to the heirs. Traditional inheritance law is actually the law of passing on assets from one generation to the next. Distribution of inherited assets in the Karo traditional community, which is different from the way inheritance is distributed in law. In the Karo traditional community, the distribution of inherited assets depends on the family, so inherited assets will be passed on to the family and will not be passed on to individuals. Legal plurality. Karo custom places men and women in an unequal position. Boys as clan bearers receive honors in various traditional events, including in the process of dividing inheritance. Karo men are positioned superior to women in various sectors of life. There is a tendency for parents, both men and especially mothers, to give inheritance to their daughters in two ways, namely gift and will.

Abstract

Referring to the Constitutional Court decision Number 46 / PUU-VIII/2010 that recognizes illegitimate children as having a civil relationship with their biological father, so that illegitimate children have inheritance rights. This decision has drawn pros and cons from the public. For those who support it, this decision is seen as legal protection and justice for illegitimate children, whereas for those who reject it, this decision is seen as an opening for crimes of deviation from religious values, such as unregistered marriages, acts of adultery or sexual immorality. This research method is empirical juridical. Types of secondary data sources obtained using library research. The results of the research show that to obtain legal certainty, the heir's statement should include the names of children from unregistered marriages, but this cannot be done, because there are no statutory regulations that determine the names of children resulting from extramarital marriages. is included in the deed, so an inheritance certificate containing the name of a child resulting from an unregistered marriage has legal force, therefore it is recommended that the government immediately do this and make regulations regarding the creation of inheritance certificates for children resulting from an unregistered marriage, so that it has clear legal force and permanent, and binding in general.

Abstract

The Mini Research Assignment for Group 4 from Class B PPKn 2022 is entitled: "Division of inheritance for girls according to the customary laws of the Mandailing community and Islamic civil law (case study of the Tanjung Mompang village community)". This Mini Research examines the position of daughters of the Mandailing Indigenous community in the distribution of inheritance according to the customary law that applies in the Mandailing community as well as according to the distribution of Islamic civil inheritance. The aim of this research is to find out the position of daughters of the Mandailing Indigenous community in the distribution of inheritance according to the customary law that applies in the Mandailing community. This Mini Research uses Qualitative Research Methods with qualitative descriptive research presented descriptively. Data collection techniques Through literature studies by collecting some information related to the research field such as books, journals, scientific works and many other references for collecting relevant data.
