Abstract

The purpose of the advocacy process in resolving Islamic family law disputes is to bring about justice, so that it requires treatment and advocacy in accordance with Islamic teachings that originate from the Koran and hadith by promoting commendable morals. This condition is a legal ideal (rechtsidee) and an ethical value system for advocates in resolving Muslim family law disputes. This research is a normative legal research with a statue approach, a conceptual approach and a philosophical/ushul fiqh approach (philosophy of Islamic law approach) then analyzed qualitatively. The ideals of the law and the ethical value system of advocates in the resolution of Islamic family law disputes are not limited to justice in positive law but also explore broader values and principles beyond positive law. These values and principles can be found through legal foundations and principles, namely the foundation of the Koran and Hadith, the basis of laws and regulations consisting of Pancasila and the 1945 Constitution, Law Number 18 of 2003 Concerning Advocates, and the Indonesian Advocate Code of Ethics for the Year 2002, philosophical foundation, theoretical foundation, juridical foundation, and sociological foundation which become advocate ethical values system through values, norms, and morals that have concepts and are interrelated and complement each other in the advocate ethics system through basic values then are translated into instrumental and concrete values be a praxis value in resolving Islamic family law disputes.

Abstract

In line with the rapid development of technology, patterns and payment systems in economic transactions continue to change. Technological advances in the payment system are shifting the role of cash (currency) as a means of payment in the form of digital payments that are more efficient and economical. In its development, several countries have discovered and used electronic payment products known as Electronic Money (e-money). The presence of non-cash payment instruments mentioned above, is not only caused by innovations in the banking sector but also driven by the public's need for practical payment instruments that can provide convenience in conducting transactions. This paper aims to analyze the impact of the development of digital payment systems on the existence of cash in the era of the digital economy. In addition, this also minimizes the risks that can be caused by the use of digital payment systems and prevents inflation due to the large amount of cash in circulation. The method used in this paper is qualitative and is supported by a phenomenological approach. The results of this study indicate that technological advancements in the era of the digital economy (Industrial Revolution 4.0) are indeed unavoidable, especially in the rapid development of digital payment systems. Digital payment systems have advantages and disadvantages. But in general, the advantages of digital payment systems outweigh the disadvantages. The presence of this digital payment system does not mean eliminating the existence of cash. However, the existence of a digital payment system can also minimize the occurrence of inflation due to the large amount of money circulating in the community.

Abstract

Penyelesaian sengketa melalui lembaga arbitrase banyak diminati oleh para pelaku bisnis, sebab penyelesaian sengketa melalui lembaga arbitrase memiliki kelebihan dibanding lembaga pengadilan yang bersifat formal. Kelebihan lain lembaga arbitrase diantaranya yaitu proses cepat dan sederhana, biaya murah, kerahasiaan sengketa terjaga, putusan bersifat merangkul dan menguntungkan para pihak (win-win solution), serta menjaga hubungan bisnis para pihak, sehingga dijadikan pilihan oleh pelaku bisnis. Penelitian ini merupakan penelitian yuridis normatif. Metode pendekatan yang digunakan adalah metode yuridis normatif yaitu penelitian yang menekankanpada data sekunder yakni dengan mempelajari dan mengkaji azas-azas hukum khususnya kaidah-kaidah hukum dalam peraturan perundang-undangan serta ketentuan-ketentuan yang berkaitan dengan penyelesaian sengketa bisnis melalui lembaga arbitrase dan eksekusi putusan lembaga arbitrase dalam penyelesaian sengketa bisnis.Hasil dari penelitian ini dapat disimpulkan seperti berikut. (1) Penyelesaian sengketa bisnis melalui lembaga arbitrase dilakukan dengan dua cara yaitu melalui factum de compromittendo, sebelum terjadi sengketa klausula arbitrase telah dicantumkan dalam perjanjian pokok, atau melalui akta kompromis setelah terjadi sengketa klausula arbitrase dibuat dalam bentuk tertulis terpisah dari perjanjian pokok. Sedangkan proses penyelesaian sengketa melalui lembaga arbitrase menurut Pasal 27 sampai dengan 60 Undang-Undang Nomor 30 Tahun 1999 dan memiliki keputusan lembaga arbitrase bersifat final dan mempunyai kekuatan hukum tetap dan mengikat para pihak, para pihak harus terikat dalam putusan arbitrase tersebut, walaupun pada tahap eksekusinya masih memerlukan keterlibatan Pengadilan Negeri. (2) Eksekusi putusan lembaga arbitrase dalam penyelesaian sengketa bisnis sebagaimana diatur dalam Pasal 59 sampai dengan 64 dari UU No. 30 Tahun 1999 dalam waktu paling lama 30 (tiga puluh) hari terhitung sejak tanggal putusan diucapkan, lembar asli atau salinan otentik putusan arbitrase diserahkan dan didaftarkan oleh arbiter kepada Panitera Pengadilan Negeri untuk dilakukan pengujian syarat formil dan syarat materil oleh Ketua Pengadilan Negeri yang menjadikan putusan lembaga arbitrase memiliki kekuatan hukum mengikat yang bersifat final and binding.

Abstract

Sharia compliance is currently an important issue for sharia bank stakeholders in Indonesia. There have been many sharp criticisms from the public regarding the compliance of Islamic banks to Islamic principles, that Islamic banks in Indonesia are currently not compatible with sharia. This condition may be a positive impact of the increasingly massive socialization of Islamic banking to the public so that people are starting to become aware and have sufficient knowledge of Islamic banking, both from a juridical perspective as a regulatory framework and a solution to the legal vacuum of sharia banking regulations to ensure legal certainty, as well as a perspective. philosophical on the regulatory system that aims to create justice and benefit in Islamic banking practices.

Abstract

Penelitian ini merupakan penelitian mengenai praktik jual beli masyarakat Dayak dalam menjual ramuan tradisional di pasar Kahayan kota Palangka Raya dilakukan para pedagang yang berumur di atas 55 tahun di karenakan kematangan pengetahuan yang dimiliki para pedagang, selain itu tidak semua masyarakat asli suku Dayak memiliki pengetahuan tentang ramuan tradisional ini, karena tidak ada sumber tertulis yang dapat dijadikan pedoman mereka. Hanya mengandalkan bakat turun-temurun dari para leluhur mereka. Etika jual beli masyarakat Dayak dalam berdagang ramuan tradisional adalah  terdapat penerapan falsafah Belom Bahadat pada praktik jual beli mereka. Peneliti menyimpulkan terdapat prinsip tolong-menolong yang amat kuat dan dijunjung tinggi oleh pedagang yang merupakan masyarakat adat Dayak, dengan slogan mereka yaitu Handep tuntung haduhup yang artinya menanggulangi masalah bersama dan saling tolong-menolong. Jual beli ramuan tradisional masyarakat dayak di Pasar Kahayan Kota Palangka Raya perspektif belom bahadat dan etika bisnis syariah terdapat adanya kesamaan antara filosofi Belom Bahadat, yaitu hidup bertata krama dan beradab dan hidup dalam kedamaian, kebersamaan, kesetaraan, keharmonisan, toleransi, menjunjung tinggi hukum dan kerja sama untuk meraih kesejahteraan bersama yang diaplikasikan dalam etika jual beli masyarakat Dayak dalam berdagang ramuan tradisional dengan etika bisnis syariah antara lain adanya prinsip Ketuhanan, rahmatan lil alamin (rahmat bagi seluruh alam), tahqiq ‘adl (me­wujudkan keadilan), nubuwwah (kenabian). As-siddiq (transparansi), freedom to act (kebebasan dalam bertindak dan berusaha) dan socio-profit oriented.

AbstractThe renewal of Islamic law has always coincided with the development and renewal of thought in the Muslim world with respect to the sacred text and discussing topics more closely related to philosophy or thought. Of the many prominent figures of Islamic law thinking are contemporary Islamic legal thought, such as Fazlur Rahman which offers specific moral and legal ideal terms in the meaning of texts and the early division of Islamic tradition, Muhammad Shahrur offers theoretical limits in the provisions of Islamic law, and Abdullah Ahmad An-Na'im who offers an alternative answer based on the theory of nasakh in melalukan reformulation of Islamic law that arises because the theories or results of traditional Islamic legal thinking is no longer relevant to the circumstances of the times. So the offer of renewal of contemporary Islamic legal methods such as Fazlur Rahman, Muhammad Shahrur, and Abdullah Ahmad An-Na'im. Contemporary thinking is applied in the Islamic law reformation method which can be used as a renewal in Islamic family law such as Rahman's double motion theory, Shahrur's boundary theory, and nasakh theory as an alternative answer by Na'im in the context of renewal of family law in accordance with the objectives of Islamic law applies in every place and time (shalih likulli zaman wal makan).Keywords: theory and application, contemporary, renewal, Islamic family law

Abstract

This research is a study of sharia reasoning regarding fidyah or relief from not carrying out Ramadan fasting in the study of maqashid al-syariah al-iqtishadiyah, by knowing the objectives, secrets and virtues, as well as their context in the development and economic development of the people. This research is library research with a multi-approach study of the concept of fidyah according to Islam, then looks at the implementation of fasting fidyah through maqashid al-sharia and in an economic context. This research uses a conceptual, historical, and contextual approach. The results of this study Allah wants ease of worship, especially in fasting by not forcing servants to fast for the elderly, such as the elderly or the elderly, pregnant and nursing mothers, people who experience illness with very little hope of recovery, and people who work hard. The obligation of fidyah be paid by feeding the poor and needy in a dose of one mudd or equal to 15 tahil or 567 grams or it can also be converted into staple food. Fidyah payments can be made at any time, if it is delayed then the payment will be doubled. According to the maqashid sharia, fidyah is a form of benefit and goodness given by God to his servants with regard to three elements of care, namely religion, soul and wealth. The release of wealth to elderly Muslims, fidyah also gave birth to an indication as an instrument and potential as well as economic development for the people, especially the poor. the implementation of fidyah has value, wisdom, and benefit to the giver and recipient of fidyah

Abstract

Artikel ini bertujuan untuk membahas kaidah jaminan pada perbankan syariah. Jaminan atau anggunan adalah sebuah harta yang diserahkan kepada seseorang untuk pembayaran atau bukti kesanggupan terhadap kewajiban. Jaminan merupakan salah satu bagian dari penerapan prinsip kehati-hatian pada perbankan syariah, dengan adanya jaminan maka pihak bank percaya bahwa nasabah akan bersungguh-sungguh dalam menjalankan kewajibannya dalam sebuah transaksi. Dalam perbankan terdapat penilaian terhadap jaminan atau yang dikenal dengan istilah appraisal. Penilaian barang jaminan meliputi nilai pasar, nilai baru, nilai wajar, nilai asuransi, nilai likuiditas, dan nilai buku.
