Abstract

This study examined a traditional mediation of mahurui hatulang kabalim which is a local wisdom of indigenous Dayak society in Central Katingan, Central Kalimantan who has a traditional mentality and belief in resolving household disputes. Mahurui hatulang kabalim is rooted on conciliation and deliberation culture as society values transforming into the character which is manifested into mechanical solidarity. This study was an empirical legal study or so-called non-doctrinal sociological legal study. The approaches applied in this study were explanatoris approach, conceptual approach and philosophical approach. In the mediation practice of Mahurui hatulang kabalim, the mantir adat as a mediator to resolve disputes was by mangatawan masalah (knowing the problem), nyundau ije-ije (visiting respectively), ngahau ije-ije (calling respectively), Manggau jalan damai (seeking a peaceful way), manukep atei (approaching the heart). Some were successfully reconciled (sarukui haluli) and some were failed to reconcile (separate pinja). The essence of Mahurui hatulang kabalim was a traditional mediation as a repressive effort in restoring family relations as society’s traditional mentality.

Abstract

This article aims to understand the scope of zakat regarding its role as a source of state wealth. The writing of the paper is carried out using a literature study method sourced from library books, research journals, laws, and relevant article websites. Zakat as a source of state wealth is a method of managing assets belonging to Muslims which will be used for the benefit of the people in order to build a just and prosperous country's economy. Zakat is one of the instruments in macroeconomics that allows the economy to continue running at a minimum level. Zakat is property that must be issued by a Muslim or business entity to be given to those who are entitled to receive it in accordance with Islamic law. Basically zakat is shown to eliminate the gap between the rich and the poor, because the wealth in the world is solely a deposit from God to humans to be managed properly. For this reason, the potential of zakat as a support for the economy in Indonesia is one of the efforts to manage assets as well as possible by prioritizing the benefit of the people.

Abstract

This study intends to identify the epistemology of the Fatwa of the Indonesian Ulema Council on the monasticism of money politic. Qualitative research in the form of literature studies uses a normative-philosophical approach. The primary data of this study is in the form of a document of the Ijtima' Ulama Decree of the Indonesian Fatwa Commission in 2018. Secondary data uses a variety of correlative scientific literature with a focus on discussion. The theory of idealism and the realism of Islamic law became the theory of analysis of this research. Data collection through documentation. Meanwhile, data analysis goes through the stages of data reduction, data presentation, and data verification. This research shows the epistemological construction of the fatwa of the Indonesian Ulema Council on the political monastery of money not only based on the idealistic-normative-deductive epistemology of Islamic law, but also emphasizes the aspects of Islamic legal realism in the form of considerations about the effectiveness of the fatwa in the midst of community life. The theoretical implications of this study show that the provisions of Islamic law (fatwa) related to the prohibition of money politics require considerations of legal formulations that do not only refer to normative idealism of law, but also legal realism. The limitations of this study have not identified the method of interpretation of the Indonesian Ulema Council on various theological foundations of monasticism of money politics.

Abstract

Kegiatan pelatihan pengolahan kerupuk ikan gabus di Desa Lembeng bertujuan untuk meningkatkan nilai jual ekonomi dan menyediakan pangan alternatif bagi masyarakat. Ikan gabus dipilih sebagai bahan masakan karena tinggi nutrisi, mudah didapat dan terjangkau. Memilih kerupuk karena popularitasnya jajanan ini, pelatihan ini memberikan teori dan praktik langsung proses pembuatan kerupuk ikan gabus kepada masyarakat Desa Lembeng. masyarakat sekitar agar dapat membudidayakan berbagai jenis ikan olahan. Para peserta pelatihan sangat puas dengan pelaksanaan pelatihan ini dan berharap kedepannya kegiatan serupa dapat dilakukan pada produk olahan lainnya.

Abstract

The research on family law reform in Morocco aims to analyze the changes in family law in Morocco after the reform in 2004. The study discusses child marriage and the impact of the reforms on society, particularly in relation to gender equality and legal protection for women and children. This research is normative-explanatory and explains family law reform in Morocco by using a literature review to analyze policies. The results show that family law reform in Morocco has improved gender equality and provided better legal protection for women and children. However, there are still some challenges in the application of the law, such as changing attitudes towards tradition and culture and difficulties in applying the law in remote areas. This research can contribute to an understanding of the changes in family law in Morocco and can be used as a reference in efforts to improve legal protection for women and children in other countries that have similar legal systems.

Abstract

This study discusses legal arguments related to Indonesia's regulatory framework for managing Sharia funding and loan risk. This study uses a legal analysis approach concerning the principles of the state constitution, Islamic banking laws, the fatwa of the Indonesian Ulema Council (MUI), and regulations from the Financial Services Authority (OJK). This arrangement aims to protect consumer interests, ensure compliance with Sharia principles, and maintain the sustainability of the Sharia financial industry in Indonesia. This study uses qualitative research with data search methods, namely through library research sources and literature studies through library research in scientific journals, books, papers, and articles directly related to the research problem under study. It has the purpose of doing a description of the problem under study. In conclusion, this regulatory framework is essential to protect consumer interests, ensure compliance with Sharia principles, and maintain sustainability in Indonesia's Islamic finance industry. These regulations are based on solid legal principles, such as the country's constitution, laws, MUI fatwas, and OJK regulations. This research contributes to understanding the legal arguments regarding Indonesia's regulatory framework for managing Sharia funding and loan risk. It can be a reference for further research and development in this field..

Abstract

Tujuan artikel ini merupakan buat menyebutkan bagaimana aturan perbankan menaruh proteksi aturan bagi nasabah bank dan kewajiban bank bagi nasabah yang bermasalah waktu berbelanja online. Hukum Perbankan adalah semua yang berkaitan dengan perbankan, yang mempengaruhi sifat dan keberadaan lembaga keuangan dan semua aspek aturan tertulis dan tidak tertulis yang mengaturnya, yang mengatur kegiatan bisnis mereka, cara mereka menjalankan bisnis, dan mencakup prosesnya. Dasar hukum pengaturan ini adalah Undang-Undang Perbankan No. 10 Tahun 1998. Isi Undang-undang No. 10 Tahun 1998 menyebutkan bahwa asas hukum perbankan adalah bahwa sistem perbankan di Indonesia harus diselenggarakan atas dasar demokrasi ekonomi kehati-hatian. Proses perdagangan online dicirikan oleh kurangnya kontak tatap muka antara bisnis dan konsumen, karena media yang digunakan adalah Internet. Ketentuan ini sangat bermanfaat bagi konsumen karena memudahkan dalam menyelesaikan transaksi tanpa perlu bertatap muka yang membutuhkan perlindungan hukum.

Abstract

This study discusses the construction of residential houses in accordance with sharia principles, both in the art and science of designing and constructing buildings and residential houses, which is then called architectural fiqh. Residential construction in addition to paying attention to architecture must also pay attention to aspects of Islamic law. Attention of classical and contemporary scholars very few specifically talk about architecture from the point of view of jurisprudence. So far, studies on architecture have mostly studied Islamic architecture, but no one has studied architecture in a fiqh approach. So, through the fiqh approach, a new study was initiated, namely architectural fiqh. This research is a literature study with a focus on fiqh studies in building sharia residential houses using a conceptual approach and an architectural fiqh approach which is analyzed through qualitative content analysis. The findings of this study indicate that the construction of residential houses so far only pays attention to architectural aspects, so there is a need for a fiqh and architectural approach (architectural fiqh), namely building houses according to sharia signs such as aspects of worship, muamalah, neighborly etiquette and ‘urf or adat. That occurs in society. Through the architectural fiqh approach, it directs to build and maintain sharia residential homes in accordance with sharia maqashid, namely maintaining religion, soul, mind, lineage, and property.

Abstract

Penelitian ini merupakan penelitian mengenai praktik jual beli masyarakat Dayak dalam menjual ramuan tradisional di pasar Kahayan kota Palangka Raya dilakukan para pedagang yang berumur di atas 55 tahun di karenakan kematangan pengetahuan yang dimiliki para pedagang, selain itu tidak semua masyarakat asli suku Dayak memiliki pengetahuan tentang ramuan tradisional ini, karena tidak ada sumber tertulis yang dapat dijadikan pedoman mereka. Hanya mengandalkan bakat turun-temurun dari para leluhur mereka. Etika jual beli masyarakat Dayak dalam berdagang ramuan tradisional adalah  terdapat penerapan falsafah Belom Bahadat pada praktik jual beli mereka. Peneliti menyimpulkan terdapat prinsip tolong-menolong yang amat kuat dan dijunjung tinggi oleh pedagang yang merupakan masyarakat adat Dayak, dengan slogan mereka yaitu Handep tuntung haduhup yang artinya menanggulangi masalah bersama dan saling tolong-menolong. Jual beli ramuan tradisional masyarakat dayak di Pasar Kahayan Kota Palangka Raya perspektif belom bahadat dan etika bisnis syariah terdapat adanya kesamaan antara filosofi Belom Bahadat, yaitu hidup bertata krama dan beradab dan hidup dalam kedamaian, kebersamaan, kesetaraan, keharmonisan, toleransi, menjunjung tinggi hukum dan kerja sama untuk meraih kesejahteraan bersama yang diaplikasikan dalam etika jual beli masyarakat Dayak dalam berdagang ramuan tradisional dengan etika bisnis syariah antara lain adanya prinsip Ketuhanan, rahmatan lil alamin (rahmat bagi seluruh alam), tahqiq ‘adl (me­wujudkan keadilan), nubuwwah (kenabian). As-siddiq (transparansi), freedom to act (kebebasan dalam bertindak dan berusaha) dan socio-profit oriented.
