Abstract

The examination of witnesses is very important in the examination of criminal cases, because these witnesses can shed light on a case. A witness is an individual who has direct information about a criminal event. A person is brought forward as a witness because he immediately "hears, sees and experiences" the criminal case. Witnesses are expected to provide information for the purposes of investigation, prosecution, and justice about a criminal case. So important is the position of the witness, so the existence of the witness should be regulated in laws and regulations, including the assistance of advocates when giving information in front of police investigators. This study examines the legal politics of witness regulation in criminal cases, with reference to the Criminal Code. The Indonesian people are waiting for the renewal of the Criminal Code to replace Law Number 8 of 1981 concerning the Criminal Procedure Law. This research concludes that legal politics as shown by the Draft Criminal Procedure Law provides more opportunities for advocates to provide legal services for suspects and witnesses in the examination of criminal cases ranging from the level of investigation in the police to the examination in court

Abstract

This article critically examines the urgency of reformulating the governance framework of Carbon Economic Value (CEV) in Indonesia by integrating the ethical principles of Pancasila as Indonesia’s national ideology and climate justice. The increasing risks of inequality, greenwashing, and transnational environmental crimes in voluntary and compliance carbon markets demand a just, adaptive, and integrity-based legal approach. By highlighting the current regulatory gaps and institutional weaknesses, this paper proposes a hybrid legal framework for carbon trading, anchored in Indonesia’s national ideology, environmental law, and behavioral economic approaches. The article concludes with specific policy recommendations and outlines a roadmap for legislative reform to ensure Indonesia's carbon governance is both globally competitive and locally just.

Abstract

As stated in Article 1(8) of the Judicial Power Act, tax courts are special courts under the Supreme Court and part of the judicial branch. According to Article 1(5) of the Tax Court Law, tax disputes are those arising in the field of taxation between taxpayers and authorized officials as a result of a decision that can be appealed or challenged in the Tax Court, in accordance with tax laws and regulations. This includes lawsuits regarding the enforcement of tax collection based on the Tax Collection Act with a Summons. Law No. 17 of 1997 on Tax Collection by Means of a Forced Execution Letter regulates tax disputes arising from tax collection actions by officials that do not comply with legal procedures, causing taxpayers to feel aggrieved. Constitutional Court Decision No. 26/PUU-XXI/2023 is based on Article 24(1) of the 1945 Constitution of the Republic of Indonesia, which states that the Supreme Court and the courts under its authority exercise judicial power. The decision reaffirms that the Tax Court is part of the judicial power and that the Supreme Court must supervise it. Constitutional Court Decision No. 26/PUU-XXI/2023 aims to enhance the Tax Court's independence. Transferring the authority for the organization, administration, and finance of the Tax Court from the Ministry of Finance to the Supreme Court is expected to achieve this goal. Prior to the decision, the Tax Court was under the Supreme Court within the Administrative Court System. The Tax Court was also under the Ministry of Finance in terms of organizational, administrative, and financial supervision in accordance with Article 5(2) of Law No. 14 of 2002 on the Tax Court. However, the arrangement of the status of tax courts following the issuance of Constitutional Court Decision No. 26/PUU-XXI/2023 has raised the issue that the decision does not automatically amend the provisions of Law No. 14 of 2002 on Tax Courts, particularly Article 5(2). According to Constitutional Court Decision No. 26/PUU-XXI/2023, the Supreme Court is responsible for supervising the organization, administration, and finances of the Tax Courts. However, Article 5(2) of Law No. 14 of 2002 of the Republic of Indonesia on Tax Courts grants the Ministry of Finance the authority to supervise the organization, administration, and finances of the Tax Courts. These conflicting provisions result in the loss of the Tax Court's status as an independent judicial institution.

Abstract

Purpose: Understanding the application of OSH Management System in the informal sector, especially the occupational fatigue management system for the porters working in Legi traditional market, Surakarta. Methods: The type of research was qualitative based research to describe the implementation of OHS Management System in the informal sector, especially the occupational fatigue management system for porters working in Legi traditional market, Surakarta. Results: OHS Management System’s promotive and preventive efforts, in this case, have not yet reached and involved the porters and have not focused on minimizing the risk of occupational fatigue. The weight of the load carried by porters exceeds the recommended weight threshold and their work posture had a risk of injury and occupational diseases. The occupational fatigue commonly experienced by the porters was such as muscle pain in the knees, lower back pain, and some even getting whole body pain. The problems in implementing OHS Management System at Legi traditional market were due to there was no lifting and transportation equipment available, Station of Occupational Health Effort (Pos UKK) administrators not been trained of implementing OHS in the workplace, and the lack of enthusiasm from the market management and the porters themselves in OHS. Conclusions: The implementation of the OHS Management System did not include efforts for minimizing occupational fatigue for the porters. The Pos UKK needs to involve the porter organization (SPTI) in the implementation of promotive and minimize efforts to manage occupational fatigue. It is necessary to form an OSH policy and committee with support and cooperation from all related parties such as the Trade Department (“Dinas Perdagangan”) which has the workplace area and the Health Department (“Dinas Kesehatan”) which supervise for OHS efforts in term of implementation of OHS Management System in the informal sector is highly expected.

Abstract

Purpose: This study analyzes the implementation of the Occupational Health and Safety Management System in serving COVID-19 patients at the Tanjungpura University Hospital, Pontianak. Methods: This type of research is a qualitative descriptive study using a case study approach. The research location is Tanjungpura University Hospital, Pontianak. There were 10 informants in the study. Data was collected using in-depth interviews and field observations. Results: Implementation of the occupational safety and health management system program in protecting health workers who serve COVID-19 patients at the Tanjungpura University Hospital such as disinfecting, making cubical rooms, preparing special doffing and donning rooms, distributing PPE according to standards, providing vitamins and drinks or nutritious food and conducting special PCR examinations on health workers has been carried out well. Conclusion: Implementing occupational health and safety management at the Tanjungpura University Hospital's plan to protect health workers when serving COVID-19 patients refers to the K3RS guidelines. However, this has not been fully realized, and other fields mostly carry out the implementation.

Abstract

Purpose: To assess the relationship between work stress and burnout in Atma Husada Samarinda Regional Mental Hospital nurses during the COVID-19 Pandemic. Methods: The research employed an analytical observational method with a cross-sectional study design, utilizing a stratified random sampling technique for data collection. The data obtained will be analyzed using univariate analysis, bivariate analysis with the Chi-Square test and Fisher's exact test, and multivariate analysis with ordinal logistic regression test. The results obtained can be strengthened by the results of observations made during the research. Results: Bivariate analysis revealed no relationship between workload (p = 0.223) and work stress (p = 1.000) and burnout. Tenure (p = 0.018) was a confounding variable related to burnout. Multivariate analysis reveals that heavy work stress is associated with a 97 times greater risk of burnout. Heavy workloads risk 360 times burnout. Conclusion: Nurses with >15 years of service have a higher burnout risk compared to those with ≤15 years. Heavy workload and heavy work stress are at risk of causing burnout in Atma Husada Hospital nurses during the COVID-19 pandemic.

Abstract

Purpose: This research aims to analyze the implementation of the occupational safety and health management system at community health centers to determine the achievements of the implementation of occupational safety and health by looking at the indicator system from K3 policy, K3 planning, K3 implementation as well as K3 monitoring and evaluation at the Sentani Community Health Center, Jayapura Regency. Methods: This type of research uses qualitative case study methods. The subjects of this research were health workers at the Sentani Community Health Center, Jayapura Regency, with a sample size of 10 respondents. The data collection technique is a triangulation technique involving observations, in-depth interviews, and documentation studies. The tool used is a questionnaire. Results: The research shows that community health centers must fully implement an occupational safety and health management system. Based on the results of observations and interviews, it was found that the health center still needs to have a written K3 commitment and policy based on the SK—head of Pukesmas. There has been no significant risk research in determining K3 planning. The implementation of K3 at health centers has been implemented through health services, fire control and prevention, and the provision of K3 facilities and infrastructure. Monitoring and evaluation in implementing K3 still need to record and report on planning, implementation, or recording cases of work-related accidents (KAK) and work-related diseases (PAK) at health centers. Conclusion: The safety and health management system must still be fully implemented. The need to review and analyze work risks for workers and the environment and become a benchmark in making K3 policy commitments at health centers in implementing occupational safety and health management systems.

Abstract

Purpose: This study aims to determine the relationship between individual characteristic factors, psychosocial factors, and sleep quality on work fatigue among Yantek employees at National Electricity Company (PLN), Unit (ULP) Bantul. Methods: The method used in this study is a quantitative method with a cross-sectional design. The population in this study used a total sample of 55. The research instruments used the IFRC, COPSOQ III, and PSQI. Data analysis uses univariate tests, chi-square tests, and field observations. Results: Work fatigue among Yantek employees was categorized as mild in 47.27%, moderate in 40%, and severe in 12.73%. There was a significant relationship between individual characteristics such as age (<0.001), water consumption (0.004), smoking status (0.008), exercise habits (0.005), shift work (0.003), and work duration (<0.001). There was a significant relationship between psychosocial factors and work fatigue in the demand domain in the workplace (0.003), content and job organization (0.003), interpersonal relationships and leadership (0.007), and individual and job interactions (0.003). There was a significant relationship between sleep quality (p = 0.001) and work fatigue. Conclusion: Individual characteristics were associated with work fatigue. Psychosocial factors were associated with work fatigue. Sleep quality also had a significant relationship with work fatigue.

Abstract

Purpose: Stress is a global epidemic. In the decade, more than 50% of the population in many countries reported experiencing work-related stress. The percentage of female workers working in the formal sector in Indonesia has increased every year, and female workers tend to be more vulnerable to work stress. Some of the causes of work stress in the industrial world are workload, interpersonal conflict, and work-family conflict. Methods: This study employed a quantitative cross-sectional design. The research sample was 70 respondents. This research utilized the National Institute of Occupational Safety and Health's Generic Job Stress Questionnaire as a measurement tool. Results: Results of chi-square and Fisher's exact test showed a positive correlation between workload (p = 0.00), interpersonal conflict (p = 0.00), and work-family conflict (p = 0.00) with work stress. The results of the logistic regression test showed that conflicts between interpersonal and work-family conflict correlated significantly with work stress, with a Pseudo R² value of 0.3285, indicating that the variables of interpersonal conflict and work-family conflict correlate equally to 32.85% of work stress. While 0.6715, or 67.15%, of work stress on women workers sewing parts may be caused by other factors. Conclusions: Workload, interpersonal conflict, and work-family conflict have a positive relationship with events and work stress on women workers sewing part.

Abstract

Kajian ini membahas mengenai konsep dan prinsip-prinsip tata kelola yang baik di bidang keolahragaan (Good Sport Governance) yang dihubungkan dengan lembaga arbitrase keolahragaan di Indonesia. Metode kajian yang digunakan untuk membahas hal tersebut adalah metode kajian doktrinal. Untuk itu, kajian akan fokus mencermati data sekunder, baik yang berupa bahan hukum primer maupun sekunder. Kajian ini menyimpulkan bahwa prinsip-prinsip Good Sport Governance sudah diadopsi ke dalam sistem hukum keolahragaan di Indonesia yang diatur dalam Undang-Undang Nomor 11 Tahun 2022 tentang Keolahragaan, yang mana di dalamnya juga memuat mekanisme penyelesaian sengketa keolahragaan melalui arbitrase. Arbitrase keolahragaan itu mengandung nilai-nilai profesionalisme, mengutamakan win-win solution serta prosedur yang sederhana dalam penyelesaian sengketa, dan nilai-nilai tersebut secara substansial sesuai dengan prinsip-prinsip Good Sport Governance.
