Abstract

Social Security Administration Agency of Health has a National National Health Insurance formulary, but in reality patients do not get drugs according to the National Health Insurance National Formulary. Therefore, the aims of this study are to determine the legal protection of patients of the Social Security Administration Agency of Health for the elderly in curative therapy in hospitals according to the national formulary of National Health Insurance at Sanglah Hospital and Balimed Hospital, and to know the responsibilities undertaken by the Social Security Administration Agency of Health in fulfilling its obligations for patients the Agency for the Implementation of the Social Health Insurance of the elderly in curative therapy in accordance with the national formulary of the National Health Insurance. This study uses a participatory observational (empirical-observational) empirical legal research method. Sampling with purposive sampling and data collection techniques using triangulation techniques. In principle, legal protection must refer to legal certainty, fairness and benefits for the population participating in the Social Security Administration Agency of Health for the elderly so that it is not impressed that Balimed Hospital and Sanglah General Hospital and the Social Security Administration Agency of Health make a service to consumers who are not good. The legal responsibility that should be obtained by the participants of the Social Security Administration Agency of Health for the elderly in Balimed Hospital and Sanglah Hospital Denpasar which is currently not maximally received by patients participating in the Social Security Administration Agency of Health for the elderly at Balimed Hospital and Sanglah Hospital.

Abstract

Many foreigners have come and lived in Indonesia. This results in the increasing need for land and buildings for foreigners to be used as a residence. Foreigners are not allowed to have ownership rights over land in Indonesia, however, in this case, the law provides rights for foreigners to own land in Indonesia, but limited to Right of Use and Leaseholds for Buildings. This absence of UUPA has the potential to lead to smuggling of laws, because the lease period granted to foreign citizens is not limited so that foreign citizens can stay in Indonesia for a very long. If the land is fully controlled by foreign citizens or for a long period of time, it is feared that the people's welfare will decrease in the management of the land. Therefore, this study aims to analyze the legal of land right for foreign citizens in Indonesia and the regulation of the period of land lease right for foreign citizens in Indonesia. The type of research used is a normative juridical research through a statutory approach, a case approach, and a conceptual approach. A foreign legal entity wishing to have Building Use Rights (HGB) must fulfill two elements, namely that it is established according to Indonesian law and domiciled in Indonesia, must exist. Besides that, regulation for the period of land lease rights for foreigners have not been regulated in land-related regulations in Indonesia so that there is a vacuum of norms.

Abstract

The transformation of local leadership in Bali has implications for the emergence of various phenomena of the relationship of desa dinas (the official administrative village) and desa adat (the customary village) which both have autonomous rights. The authority of desa adat and desa dinas coincides with each other. With these conditions, various potential conflicts, poor communication patterns, and overlapping authority are very likely to occur at the local level. In this study, several issues will be discussed, namely: What is the model and process of transformation in local leadership especially in desa adat in Bali? What is the process and form of negaranisasi in local leadership especially in desa adat in Bali? What are the competencies and roles of local leaders in the local leadership process in Bali? What are the roots, the causes and solutions in handling horizontal conflicts in local leadership in Bali? Data were collected by interview, documentation and focus group discussion method to obtain sufficient data variance and validity. Furthermore, the data were analyzed qualitatively using interactive models from Miles and Huberman. The results of the study can be described, that the synergy of two (2) types of local leadership is needed. The capacity and competence of village officials and prajuru adat (customary officials) are obliged to be enhanced, strengthened and empowered, so that they are able to adapt in handling various problems that arise in rural communities in the era of modernization and globalization. For this reason, it is needed to build a synergic relationship model and leadership coordination system between desa dinas and desa adat, a model for developing the capacity and competency of village officials and prajuru adat, and developing a model for handling conflicts that have increasingly intense.

Abstract

The purpose of this study is to understand the basis of the government action to nationalize foreign investment companies and legal protection of investors as a result of these nationalization actions. The research method used is normative juridical or library research related to normative substance of law, to find truth based on logic of science regarded from normative side by way of researching bibliography or secondary data consisting of primary law material, secondary law material and tertiary law material.The result of the research shows that the basic of nationalization action by the government underlying are due to economic inequality, where foreign capital companies start to dominate the main sectors in the national economy, and the other thing is the politics of nationalization law. Legal protection of investors is focused on preventive law protection, in which investors are given the opportunity to file an objection (inspraak) before a government decision in the definitive form of nationalization action.

Abstract

Along with the development of law and the community needs that developed rapidly, especially in the globalization era besides the enhancement of public demand for business development in accordance with good corporate governance principles, therefore on August 16, 2007 the Law No. 40 of 2007 was issued, which replace the Law Number 1 of 1995 concerning Limited Liability Companies. Then the enactment of Government Regulation No. 29 of 2016 concerning Changes in Authorized Capital of Limited Liability Company, specifically for beginner entrepreneurs to establish a Limited Liability Company. The provisions of Article 1 paragraph (3) of Government Regulation Number 29 of 2016 regulate: the amount of authorized capital for Limited Liability Company as referred to in paragraph (1) which based on the agreement of the Limited Liability Company founders. Furthermore, in Article 32 paragraph (1) of Law Number 40 Year 2007 concerning Limited Liability Company, regulate that the authorized capital of the Company is at least Rp. 50,000,000.00 (fifty million rupiah). From the above provisions it can be said, there is a norms conflict that cause multiple interpretations and does not provide legal certainty for the parties. Furthermore, the norms regulated in the Government Regulation should be in line with the norms regulated by the law above it, In this case Law Number 40 Year 2007.Keywords : Authorized Capital, Limited Liability Company, Parties

Abstract

Pembangunan kesehatan merupakan bagian integral dari pembangunan nasional, yang bertujuan untuk meningkatan derajat kesehatan masyarakat yang optimal. Undang-Undang Dasar 1945 1945 menyebutkan bahwa: “Setiap orang hidup sejahtera lahir dan batin, bertempat tinggal dan mendapatkan lingkungan hidup yang baik dan sehat serta berhak memperoleh pelayanan kesehatan. Perhatian pemerintah terhadap pembangunan kesehatan semakin menguat dengan menempatkan jaminan kesehatan perlindungan sosial pada perubahan UUD 1945 Pasal 34 menyebutkan bahwa “Negara mengembangkan sistem jaminan sosial bagi seluruh rakyat Indonesia”, juga menyebutkan bahwa “Negara bertanggung jawab atas penyediaan fasilitas pelayanan kesehatan dan fasilitas pelayanan umum yang layak”. Wujud keseriusan Pemerintah Indonesia untuk membangun jaminan kesehatan dan perlindungan sosial lahirnya  Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Pelaksanaan pelayanan kesehatan kepada peserta  BPJS banyak mendapatkan keluhan dari masyarakat. Penelitian ini bertujuan untuk mengkaji dan menganalisis bentuk perlindungan hukum terhadap peserta BPJS dalam pelayanan kesehatan, mengkaji dan menganalisis bentuk pelayanan kesehatan peserta BPJS, mengkaji dan menganalisis kendala yuridis yang dihadapi peserta BPJS untuk mendapatkan pelayanan kesehatan. Jenis penelitian ini adalah sosiolegal research, dilakukan di RSUP Sanglah Denpasar pada bulan Maret-April 2019. Informan dalam penelitan ini adalah keluarga/pasien BPJS, dokter, perawat, petugas rumah sakit di RSUP Sanglah Denpasar. Hasil penelitan didapatkan bahwa Perlindungan Hukum Preventif terhadap peserta BPJS dilakukan melalui pemberian informasi mengenai hak hak peserta BPJS, namun dalam implementasinya masih terdapat beberapa kekurangan yang masih harus segera diperbaiki. Perlindungan Hukum Represif terhadap peserta BPJS sebagai konsumen didapatkan apabila terjadi sengketa. Penyelesaian sengketa dilakukan melalui penyelesaian diluar pengadilan dan penyelesaian didalam pengadilam. Penyelesaian diluar pengadilan dilakukan melalui mediasi, konsiliasi dan arbitrase. Penyelesaian didalam pengadian dilakukan apabila pengyelesaian diluar pengadilan tidak tercapai atau salah satu pihak tidak puas. Pelaksanaan aturan BPJS kesehatan terkesan mengutamakan kepastian hukum atau kepastian pelaksanaan aturan saja sehingga terkesan mengabaikan keadilan serta kemanfaatan bagi masyarakat. Disarankan kepada steakholder dalam pelayanan kesehatan agar mengintensifkan pemberian informasi mengenai hak dan kewajiban peserta BPJS untuk memberikan perlindungan hukum baik secara preventif dan represif sehingga tujuan hukum  yakni keadilan, kepastian hukum dan kemanfaatan dapat tercapai.Kata Kunci: Perlindungan Konsumen, BPJS, Pelayanan Kesehatan

Abstract

Kain Tenun Cepuk merupakan salah satu warisan budaya Desa Tanglad yang bersifat komunal, memiliki nilai-nilai kebudayaan dan berkembang pada masyarakat pengemban. Dengan demikian pemerintah wajib melindungi sebagai objek EBT sesuai ketentuan UUHC. Tujuan dari penelitian ini adalah untuk memahami dan mengkaji pelaksanaan ketentuan Pasal 38 ayat (2) UUHC terkait inventarisasi EBT dan perlindungan hukum terhadap Kain Tenun Cepuk di Desa Tanglad. Metode penilitian yang digunakan yakni yuridis empiris dengan menganalisis fenomena yang terjadi saat ini. Penelitian ini dilakukan di Kantor Kemenkumham Bali, Dinas Kebudayaan Kabupaten Klungkung dan Ngurah Galerry. Hasil penelitian ini menunjukan bahwa belum terlaksananya penginventarisasian berdasarkan ketentuan UUHC dengan maksimal. Ini terlihat dari tindakan Dinas kebudayaan yang sebatas pendokumentasian berupa foto Kain Tenun Cepuk saja dikarenakan adanya beberapa faktor, yakni faktor kaidah hukumnya, sarana fasilitasnya, masyarakatnya serta budaya hkumnya. Adapun upaya perlindungan hukum terhadap Kain Tenun Cepuk sebagai EBT yang dapat dilakukan, yakni perlindungan preventif dengan sosialisasi yang dilakukan oleh Kemenkumham Bali kepada Dinas Kebudayaan selaku penyelenggaraan otonomi daerah dan masyarakat tradisional pengemban EBT terkait pentingnya menginventarisasi objek EBT. Serta perlindungan represifnya dengan menyelesaikan sengketa hak cipta dengan cara arbitrase maupun pengadilan yang sebelumnya terdapat pengaduan yang diajukan oleh sipemegang hak komunal.

Abstract

Bank BPD Bali merupakan bank pemerintah provinsi bali yang menghimpun dana dari masyarakat dan menyalurkan kembali dalam bentuk kredit. Bank BPD Bali memiliki produk kredit yaitu kredit produktif yang diperuntukkan bagi debitur yang memiliki usaha dagang dan produk kredit konsumtif diperuntukkan bagi debitur perorangan yang berpenghasilan tetap dan berpenghasilan tidak tetap, yang sumber pengembalian kreditnya berasal dari gaji atau penghasilan usahanya. Pinjaman kredit perlu adanya suatu jaminan kredit yang berfungsi untuk menjamin kepastian akan pelunasan utang nasabah terhadap bank. Jaminan dapat berupa benda bergerak seperti kendaraan bermotor yang dilengkapi dengan STNK (surat Tanda Nomor Kendaraan), BPKB (Buku Pemilik Kendaraan Bermotor) dan jaminan benda tidak bergerak seperti Tanah atau bangunan yang dilengkapi dengan Surat Hak Milik serta surat-surat sah lainnya. Surat Keputusan (SK) Perangkat Desa merupakam jaminan benda tidak bergerak yang memiliki nilai ekonomis sehingga dapat dipergunakan sebagai jaminan kredit di Bank BPD Bali serta sebagai dasar hukum dalam penerimaan upah atau gaji setiap bulannya. Kendala yang dialami dalam penggunaan jaminan Surat Keputusan (SK) dikarenakan tidak bisa diperjual belikan seperti jaminan lain pada umumnya ketika terjadi kredit bermaslaah. Tujuan dari penelitian ini adalah untuk menganalisis prosedur pemberian kredit dengan jaminan Surat Keputusan (SK) Perangkat Desa dan untuk menganalisis faktor-faktor penyebab kredi bermasalah dan penyelesaian kredit bermasalah di Bank BPD Bali. Metode penelitian yang digunakan yaitu menggunakan pendekatan yuridis empiris yang menganalisis berdasarkan fenomena terjadinya kredit bermasalah dalam penggunaan jaminan Surat Keputusan (SK) dan berpedoman pada teori keadilan dan teori penyelesaian sengketa yang berkaitan dengan fenomena tersebut. Penelitian ini dilakukan di Cabang Pembantu (Capem) Bank BPD Bali di Kabupaten Badung dan Kantor Desa di Kabupaten Badung. Hasil penelitian yang didapatkan yaitu penyelesaian kredit bermasalah dengan penggunaan jaminan Surat Keputusan (SK) di Bank Pembangunan Daerah Bali serta dalam pemberian kredit perlu adanya monitoring langsung kepada perangkat desa yang mengalami kendala dalam pembayaran dikarenakan adanya faktor internal dan eksternal seperti force mejure wabah covid-19 yang mempengaruhi pendapatan Perangkat Desa dan adanya keterlambatan pembayaran upah yang menyebakan Perangkat Desa megalami kendala dalam pemenuhan prestasinya.

Abstract

The notion of democracy is used by most of the countries in the world as a foundation in managing the country, it is also the choice of Indonesia after the reformation period in 1998 as stated in the amendment of the 1945 Constitution. Through democracy, people can control the government administration so that the government does not act arbitrarily. With democracy, people are also given the opportunity to participate in all aspects of development, guaranteed the freedom of association / assembly to express opinions on various matters in the government administration in accordance with the constitutional corridor. In practice, after 2 (two) decades of reformation, freedom in democracy has become an act that exceeds the limit. In the national life order in Indonesia today, there have been various hoaxes (false information), utterances of hatred on social media, anarchic behavior occurring in various places, even radicalism movements which allegedly want to destroy the ideology of Pancasila and replace it with other ideologies. In this study, there are two problems that will be discussed, namely legal policy in the prohibition of hoaxes and hate speech and the ideology of Pancasila in the prevention of hoaxes and hate speeches. Legal policies in the prohibition of hoax and hate speech are regulated in Article 28 paragraph (1) of Law Number 11 Year 2008 concerning Information and Electronic Transactions. Prohibition of hoaxes and hate speeches is also carried out in various laws and regulations in other countries. Hoaxes and hate speeches threaten the integrity of Indonesia. Therefore, to guard and care for the Republic of Indonesia to remain based on the ideology of Pancasila, the nation's commitment to defend Pancasila as a state ideology must be able to actualize the noble values contained in the principles of Pancasila in life as well as possible and committed to fight hoax, utterances of hatred, anarchic actions and radicalism by strengthening the spirit of Pancasila for every Indonesian person and encouraging various government agencies to uphold the concept of the rule of law in preventing the disintegration of the nation.

Abstract

This article wants to understand and analyze the phenomenon of Balinese customary life arrangements related to changes in marital procedures. To be able to produce accurate findings, social phenomena are examined in detail and in-depth through qualitative research, with a phenomenological paradigm. With this paradigm the results are obtained in the form of empirical data and in-depth understanding relating to variations in categories, properties, and attributes related to the changing phenomena of cultural traditions and adat ngerorod marriage. In detail the findings generated that in social reality, the indigenous Balinese have constructed changes in the pattern of marriage from the way of ngerorod or selarian (running together) to switch to the memadik or propose, because the pattern of memadik or ask is seen to better reflect equality and justice in society. The rationale that drives is the existence of a reaction to discriminatory customary norms; innovative faith-based constructive thinking; increasing the level of education and parental-bilateral kinship thinking. Memadik marriage by means of marriage or marriage, implies a marriage as a result of the construction of modern society.
